AP: IRS to Issue ‘Scary Letters & Threats,’ Hire Thousands of New Employees to Enforce Health Care Law

WASHINGTON (AP) — Can the Internal Revenue Service police President Barack Obama’s health care mandate while simultaneously collecting all the taxes for running the federal government?

The question is being renewed in the wake of the Supreme Court’s decision upholding most of the 2010 Affordable Care Act as a tax issue rather than one of interstate commerce.

Nearly 2 1/2 years before taxpayers will have to start providing proof on their tax returns that they have health insurance, key Republicans suspect the agency already is diverting resources from collecting taxes to gear up for becoming the government’s health care cop.

“Knowing the complexity of the health law, there’s no question that the IRS is going to struggle with this,” said Rep. Charles Boustany Jr., R-La., chairman of the House Ways and Means oversight subcommittee. “The IRS wants more resources. Well, we need to start digging down into what are they doing with the resources and personnel.”

Ways and Means Committee Republicans have accused the IRS of obscuring its cost of putting in place the health care law by absorbing it into other parts of the agency’s budget. They cite a June report by the Government Accountability Office that said the IRS has not always accurately identified spending related to the new health care law.

“The agency’s repeated lack of transparency to Congress and its failure to provide accountability to the American taxpayers raises fundamental concerns about implementation authorities vested to the IRS,” the top four Republicans on the Ways and Means Committee wrote in a June 27 letter to the IRS commissioner.

The committee chairman, Rep. Dave Camp, R-Mich., has scheduled a hearing on the tax implications of the Supreme Court’s ruling for Tuesday.

Under the law, the IRS will provide tax breaks and incentives to help pay for health insurance and impose penalties on some people who don‘t buy coverage and on some businesses that don’t offer it to employees.

The changes will require new regulations, forms and publications, new computer programs and a big new outreach program to explain it all to taxpayers and tax professionals. Businesses that don’t claim an exemption will have to prove they offer health insurance to employees.

The health care law “includes the largest set of tax law changes in more than 20 years,” according to the Treasury inspector general who oversees the IRS. The agency will have to hire thousands of workers to manage it, requiring significant budget increases that already are being targeted by congressional Republicans determined to dismantle the president’s signature initiative.

Treasury spokeswoman Sabrina Siddiqui said, “The overwhelming majority of funds used by the agency to implement the Affordable Care Act go to administer the premium tax credits, which will be a tax cut averaging about $4,000 for more than 20 million middle-class people and families.”

The Supreme Court, in its 5-4 ruling, upheld the mandate that most Americans get health insurance. The majority said Congress has the power to enforce the mandate under its taxing authority. The decision labeled the penalties a tax, noting that they will be collected by the IRS.

Those who don’t get qualified health insurance will be required to pay the penalty — or tax — starting for the 2014 tax year, unless they are exempt because of low income, religious beliefs, or because they are members of American Indian tribes.

The penalty will be fully phased in by 2016, when it will be $695 for each uninsured adult or 2.5 percent of family income, whichever is greater, up to $12,500. The nonpartisan Congressional Budget Office estimates that 4 million people will pay the penalty that year.

The law, however, severely limits the ability of the IRS to collect the penalties. There are no civil or criminal penalties for refusing to pay it and the IRS cannot seize bank accounts or dock wages to collect it. No interest accumulates for unpaid penalties.

So how can the IRS enforce the mandate? Scary letters and threats to withhold tax refunds.

The law allows the IRS to withhold tax refunds to collect the penalty, and most filers get refunds. This year, 77 percent of the 135 million individual income tax returns processed by the IRS qualified for a refund. The average refund: $2,707.

For those who don’t qualify for a refund, a stern letter from the IRS can be effective, even if it doesn’t come with the threat of civil or criminal penalties, said Elizabeth Maresca, a former IRS trial attorney who supervises the Tax & Consumer Litigation Clinic at the Fordham University law school.

“Most people pay because they’re scared, and I don‘t think that’s going to change,” Maresca said.

The IRS has not yet issued procedures for taxpayers to prove they have insurance. But IRS Commissioner Douglas Shulman, in a 2010 speech, said he envisioned a process similar to the one used by taxpayers to report interest or investment income.

Under this scenario, an insurance company would send the taxpayer and the IRS forms each year verifying that the taxpayer has qualified insurance. Taxpayers would file the forms with the IRS along with their returns, and the IRS would check them to make sure they match the information supplied by the insurance companies.

The IRS says it is well on its way to gearing up for the new law but has offered little information about its long-term budget and staffing needs, generating complaints from Republican lawmakers and concern from government watchdogs.

The IRS is expected to spend $881 million on the law from 2010 through 2013, hiring more than 2,700 new workers and upgrading its computer systems. But the IRS has not made public information about its spending plans in the following years, when the bulk of the health care law takes effect.

The lack of information makes it impossible to determine whether the IRS will have adequate workers to enforce the health care law, the Treasury inspector general for tax administration said in a report three weeks ago. The report, however, concluded that “appropriate plans had been developed to implement tax-related provisions” of the law.

In 2010, House Ways and Means Committee Republicans issued a report saying the IRS may need as many as 16,500 additional auditors, agents and other employees “to investigate and collect billions in new taxes from Americans.”

That assessment has been widely cited by opponents of the law. The IRS disputes the jobs number but hasn’t offered another one.

“That is a made-up number with no basis in fact,” IRS spokesman Dean Patterson said in an email. “The 2012 budget calls for about 1,200 employees for the IRS to implement the (Affordable Care Act), and the vast majority of those employees are needed to build technology infrastructure to support payments like the new tax credits for individuals and small businesses.”

      Don‘t be fooled about the IRS not being able to enforce the tax on those that don’t want to comply. All those lieing thieving crooks have to do is adjust your tax return to assess the tax up front and that leaves you with taxes owed in the rear of your return. Taxes owed is enforceable at that point! Don’t be stupid about this. They can do whatever they want to do. We have to clean out the White House, and clean out the other two houses from democrats and worthless accomplice rhinos.And put people in there that will actually do what we tell them to do. Not more Godless perverted people, but those that have a Godly moral compass.

      Hey MONK, Naturally the administration has a lengthy outlook to eventually becoming a single payer system. Just as 0bama stated in many speeches prior to his becoming the Dem Candidate in ‘08. It’s an obvious power play. They don’t care about the unemployed. From the parts of this law that I have read, they would have the power to heard the homeless into federal prisons for not having insurance unless they could scrape up the fine payment. We know that will not happen…at least not within the next very few years.

      What are they going to do with all the people who don’t pay? Even if it is enforceable at the end of the form are they just going to throw everyone in jail? I’m scared to death of this and what is coming next. I can’t imagine how our patriot forefathers felt in the 1760s and 70s when this sort of thing was going on and the printed hand bills were flying around with comments like we see on the web today. I bet they were scared though. I hope the people today can hold on to what so many died for. Lets stay strong!

      Also listen up folks, inform your friends…This bill does NOT, I repeat DOES NOT cover people with pre-existing conditions like the proponents are touting. It simply says that those with pre-existing conditions cannot be denied insurance based on their condition, it does not reference the COST of that insurance anywhere. So the insurance company has to offer you coverage, but can charge you ANY amount they want and if you can’t afford it tough luck (oh and by the way, pay the fine for not having insurance)! This bill is the biggest bait and switch scam I have ever seen.

      Kinda confused, is the new healthcare law suppose to actually help people or is it just a way to stop people from getting refunds?
      So if this ends up in withholding money from people, that will trickle down into the economy which means less money spent, in return more companies closing/laying off.

      You are right about the tax credits. Not trying to change the subject, but used to work with an associate who only paid $600.00 into taxes and received a return of close to $2000.00. He stated Obummer secured his vote.

      The article says average refund is 2500. Why would anybody loan the govt 2500 for a year without interest. Adjust your withholding so there is a zero $ refund and get your money each paycheck. That way the IRS has no power over your refund.

      I am an accountant and I have been putting the word out. Starting in 2013 everyone needs to adjust their withholding to zero, put their money in a savings account, pay in what they owe at year end. And refuse to “self report” as to weither you have insurance. There simply is not ENOUGH IRS agents in the world to enforce this law if we do not assist them in doing so. They are counting on holding refunds hostage to force self reporting. Don’t get a refund, and they have no leverage.

      I can tell you the majority of the folks getting those large refunds do not “loan” the government money. Most refunds that large are due to tax credits, like the child tax credit and the EIC. It’s money given them from the government not money back from the government.

If you work for the IRS you are a servant of satan himself.       When the very first part of Obamacare kicked in it kicked my insurance premium up $300/month. Fortunately, that increased my deductions to the point where I no longer pay income taxes. I’d still prefer to have the $3600 to ease the severe restrictions on living expenses.

    First of all, never call it a penalty again, Blaze. A penalty was declared unconstitutional, and it is by law a TAX. It’s settled, we’re taxed.

    Second of all, more bad news. Not only will we be taxed, but we will be taxed to death. New taxes will be imposed, because Barack needs lots of money to stimulate his commie economy. Isn’t this way we fought the Revolutionary War?

      Yep, we were originally set up to have a consumption tax. If you wanted to live off the grid and not buy anything, you could live tax free. But if you had to buy anything, you contributed to the tax bin. To tax what you earn, discourages one from earning. Why would anyone work just to give their money over to the government? In this day and age, why not sit back, make babies and pull in the money from the government? The Health care bill provides that anyone making (as a family) $80,000 or less gets about 80% of their premiums paid for them. I can see it now…..when everyone realizes it’s not FREE health care, they will riot. I wonder if even those on Medicaid will now be forced to pay 20% of their medical bills?

    Who in their right mind would vote for a political party that wants to give the IRS more power over our lives? Have you ever dealt with the IRS? People that don’t pay taxes I suppose.

      As one who has had to deal with the IRS, I can tell you all that you have no idea what we are in for when they start collecting medical bills. You have no choice, you have to beg, they will take your money. They can take up to 85% of your paycheck and empty your bank accounts. You have no rights, your only defence or atribute is your ability to kiss IRS ass. Miss one payment and it all starts again, you’ll have to hire an accountant because there is no way you will be able to navigate the maze.

      STELEX, and the left constantly whines about how heartless and cruel mortgage companies are. If you want to experience heartless and cruel go ahead and cross paths with the IRS. They will not only take all of your property, but will take every penny from all of your accounts, they will take from your children’s accounts as well. If they deem it necessary they will leave you penniless.

      I know what they’re like. We “owed” them over $6000 – mostly in penalties and interest – because in one year, they concluded that the numbers between our payroll (from our small business) and our personal tax return simply didn’t add up. It was a proprietorship so the income you earn in the business is reflected in your personal tax return. Anyways, after a couple of years, and several menancing and threatening letters from the IRS, we were finally able to resolve this problem with the IRS, and we were fortunate enough that they “forgave the penalties and interest and allowed” to just pay the principal, that they had originally come after us for. This was a very stressful time in our lives, for my wife and I. We just didn’t have the money. We had to close the business down because we could no longer compete against the Head Start program and their govt bailout money. Even, after we had closed the business, the IRS was still coming after us with full force. Yes, we had to resort to begging, and my wife resorted to crying, when speaking to the IRS agent(s). As I mentioned, they forgave us the penalties and interest, but that’s the scary part, ironicly. It’s scary to know that a govt agency can wield that kind of power over you – the power to forgive or to punish. On another note, I already thought the govt was pretty anti-business back then, I can only imagine what they are going to be like now. WATCH OUT BUSINESS OWNERS, because you’re about

    The expansion of the federal government and more power for the IRS? This won’t end well because once a new government program starts it only gets bigger and more costly.If this law isn’t killed you can kiss the good ole USA goodbye and the transformation will be complete.

    It’s really pretty simple,when the takers outnumber the makers we’re finished.

      Getting rid of the law won’t work. You’d have to get an amendment to the constitution to undo the damage the SCOTUS did to it. That is unlikely. Get used to being a slave.
