Israeli-Americans’ U.S. Passport Case Against Obama Admin Goes to Supreme Court

U.S. Supreme Court to Hear Jerusalem Israel Passport Case Against Obama AdministrationFollowing President Barack Obama’s call for Israel to return to its 1967 borders, there has been much talk about his treatment of America’s greatest ally in the Middle East. Some accuse him of being anti-Israel, while claiming that his stances have irreparably damaged his support among American Jews.

Now, Obama faces additional scrutiny surrounding a battle over Israeli-American passports and the administration’s stance on Jerusalem. To add insult to injury, the fight is headed for the U.S. Supreme Court, where the president could face public defeat on the issue this fall.

The controversy can be summarized as follows: If an American citizen was born in Jerusalem, the United States government will not include “Israel” as the locality of birth on an individual’s passport. Considering the ongoing debate surrounding Jerusalem, this decision has purportedly been made to avoid inciting international anger among those who would dispute Israel’s ownership of the city. Some have called this move discriminatory, while others — mainly those in the executive branch — have defended it.

But, regardless of once’s stance on the issue, the time has come to conclusively settle the debate. The family of Menachem Zivotofsky, an American citizen who was born in Jerusalem in 2002, is taking legal action in an effort to change the U.S. State Department’s policy.

At the heart of this debate is a 2002 instruction to the State Department (within the Foreign Relations Authorization Act) by Congress. By law, the Department is required to record Israel as the place of birth on passports of American children who were born in Jerusalem, should parents request it. The New York Times sheds more light on the issue:

This fall, not long after Menachem turns 9, the Supreme Court will hear arguments in his case, which seeks to force the executive branch to follow the 2002 law. The case weaves together generations of conflict in the Middle East, the dueling roles of Congress and the president in the conduct of foreign affairs and the combustible topic of presidential signing statements.

Nathan Lewin, a lawyer for Menachem and his parents, said the point pressed in the lawsuit was a modest one shared by many people. “This client is representative of a large group of American citizens born in Jerusalem who are proud of the fact that they were born in Israel,” he said, “and they want their passports to reflect that fact.”

The Obama administration failed to convince the High Court not to hear the case. Additionally, the justices will force all sides to face the question of whether the contentious law “impermissibly infringes the president’s power to recognize foreign sovereigns.”

In the past, the courts have said that the president’s authority to “receive ambassadors and other public ministers” also means that he has the power to recognize foreign governments. Robert J. Reinstein, a law professor at Temple University, disagrees with this sentiment and claims that the president does not have the authority to recognize foreign states and governments.

President Obama isn’t alone in his efforts to avoid complying with the law. While it was signed by President George W. Bush back in 2002, Bush expressed his disagreement with its tenets and claimed that he would not necessarily comply with it. Perhaps Thompson Reuters best summarizes the presidents’ stance on the matter:

Presidents George W. Bush and Barack Obama say this unconstitutionally limits their powers, since U.S. policy for six decades has been to leave Jerusalem’s status to Israel and the Palestinians.

Groups like One Nation stand strongly against both presidents’ stances on the issue, but they particularly target Obama in their reaction:

This case is especially important at a time when the US President has effectively endorsed the division of Jerusalem in calling for a return to the 1967 lines while an overwhelming majority of Congress supports defensible borders and a united Jerusalem.

The debate over which branch of government has the authority to decide an issue like this will likely be settled this fall. It will be intriguing to see how both sides rationalize their viewpoints on the matter.

Eastern Countries like China and Japan would be mired down in courts as well. But the Middle East? Not one country in the Middle East was gained through peaceful means. If you look back in History, war has been the one constant in border change.

    This is a blatant anti Semitic act by the Obama administration. The real need for this stamp of birth in Israel is to include within the statistics of Israel those who were born there but reside some where else. By taking it out, it gives a leg up to the Palestinians.

    I hope the case results in a victory for the sons family — even if it just comes down to being a moral and ethical victory as Mr Obama will probably just up and ignore the inconveinece of the matter. He does so with any laws and the Constitution when needed, which is quite a lot anymore.

    At the very least, once again he will be shown to the world and the nation the farce of a POTUS he is and the mess he is still continuing to create.

      BUT…the Jewish population of the US is only 6M. Of that, less than 50% are of voting age. That would be <3m potential votes if all Jews voted for the nimrod. He won by 10M votes and had 69.5M total votes. The Jews contribution was minimal at best. That leaves a whole lot of idiots left over.

    If your citizenship his here than why is this story not American Passport? If he is an Israeli, why isn’t it an Israel Passport? The picture in the story shows and American Passport so if it is a issue of visa’s or something else, this story is BOFFO!

      Something of interest anyone who looks at a map of the Israeli 1967 borders can see clearly is that after the war with their neighbours (and yes they were hit first), the borders encompassed the Siani Peninsula in Egypt…so are the Egyptians going to be forced to give back that portion of the lands to Israel?

      Fair is fair, when demanding a return to the 1967 borders, they were held be Israel at one time after the war so they should, under the arguments of the administration, be returned to Israel governance.

    While they are at it, check President Obama’s Passport records. This President has a very dark and shady past and he needs to be investigated. A lot of dark and rotten activity happened in this President’s past. What SS# did he use to apply for a Passport? What Birth Certificate did he use to apply for a Passport? You should be very interested in where this investigation leads. Here is his SS# (042-68-4425). Report it to the Social Security Fraud department on line or by mail.

      Had there been no peace deal between israel and egypt then yes that too would have to revert to pre 67israel.[fair is fair[.Since they have had a settlement between them AND since it has been UNCONTESTED between them then like say the US and mexican border it is what it is.If americans and mexicans were still fighting over borders then that would be contested and entail a negotiated settlement to resolve it.       ROSE ELLEN Those ‘67 borders were set in 40’s agreement to try for peace in the middle east. It only resulted in an almost 20 year muslim ban of all other faith practice in Jerusalem, Since Israel took back control of Jerusalem, they have had all faith practice- Jewish, Christian. AND Musim. Also, do not omit the fact that these borders shifted in ‘67 when Israel repulsed an Arab backed attack into Israel. This land was acquired when Israel pushed back their attackers.Even if history did not justify Israel’s claim on this land— they are entitled to their spoils of war!!

      I seem to recall the names of many countries changing in the last 20 + yrs. Did that change the original birth records? I’ll bet not, but I’ll still bet all those people put the NEW NAME OF THEIR COUNTRY ON THEIR PASSPORT APPLICATIONS? Could be wrong on that though.

      I think we all expect Kagan to tow whatever line Obama wants her to tow.

      HOWEVER, this should not in any way be related to the president’s power to recognize foreign sovereigns. Recognizing someone born in Jerusalem as from Israel does not force Obama to recognize Israel or keep him from recognizing a palestine state. He’s intentionally trying to muddy the waters in order to control something he really has no authority over.

      Funny, I thought about those Pakistan trips the other week when he was speaking before a gay group. Noone in the media picked up on the fact that he said that while he was in college he experimented. There have been past allegations that he and the person he went with to Pakistan were in a relationship, and that it was on these trips that he worked with the CIA. I don’t think such work was optional, but it also seems that it created a Columbia University cover. All speculation and conspiracy theory I know, but the more incidental info I hear, the more ties/truth there seems to be.
