Israel Approves First-Ever Extraction and Freezing of Dead Teen’s Eggs

For the first time the Israeli court has approved the extraction and freezing of a dead woman’s eggs, a ruling that The Telegram reports is the first time in the world the door has been opened for a mother to give birth after her death.

The case centers around 17-year-old Israeli woman. Chen Aida Ayash. She was hit by a car in a tragic accident a couple weeks ago and died after struggling for 10 days. At the time, her  family donated all of her organs, but they wanted to keep one thing: her eggs. Why? To eventually make children.

The family originally requested the eggs be fertilized and frozen as embryos (frozen embryos have a greater chance of producing a child), a medical source familiar with the case told Ha’aretz, but were denied this request. Even though eggs were extracted and frozen, it was reported the family later abandoned the idea of having them fertilized.

Still, this ruling opens the door for a mother to give birth after her death. But if Ayash’s family had moved forward with a request to fertilize the eggs, according to Israeli law that requires implied consent of the deceased, they would have needed evidence of Ayash’s desire to be a mother. The Guardian reports:

According to Irit Rosenblum, a lawyer who founded New Family, an Israeli organisation that promotes family rights, the key issue is consent. “We don’t know if [Ayash] was concerned about continuation,” she said adding that even though the girl was only 17, she may have expressed a desire to bear children. “If [the family] can prove the fact that she wanted children, I see no reason why not to allow this.”

The Guardian goes on to note other times when parents have Israeli families have been allowed to extract sperm from deceased sons:

In 2007, the Israeli parents of a deceased soldier won a legal battle to be allowed to use his sperm, which was extracted post mortem, to create a child with an identified surrogate mother. Earlier this year, another Israeli family embarked on a legal battle to be allowed to use their dead son’s sperm to produce a grandchild, although they had no surrogate standing by.

Although not many countries have laws  for post-mortem gamete harvesting, according to The Telegraph, it has been more common for men to have sperm extracted after death. The US does not have any specific laws about sperm extraction after death, although disposition laws after death of already extracted sperm, eggs or embryos do exist and vary by state.

The Telegraph goes on to say that a dozen or so cases of sperm retrieval has been conducted from corpses in the US but also references an instance in 2010 where judges and doctors did not allow eggs to be extracted from from a woman killed by a heart attack.

    This may have been an only child. This might be the only way to have a grandchild.

    Your child is dead but you can still keep a piece of them alive.

    Is this any different than today’s egg banks?

    If it gives the parents peace of mind AND the government isn’t paying for it, I’m okay with it.

    We have enough Frankenstein Science going on. Stop trying to play God! Can’t you see this is leading to half human and half animal perversion?? When’s it going to stop? It better soon, or God will make it stop! Amongst other things! But with Jewish backed Abortion killing…it doesn’t surprise anyone that some Jews would accept this unnatural behavior also. Dr. Bernard Nathanson who is reponsible for the deaths of over 60,000 babies from abortion killing has stated that the Jews are behind and support financially most of the Abortion killing movement..Founder of Planned Parenthood’s billion dollar abortion mill industry.. Margaret Sanger, along with Nathanson were Jews. Although Nathanson coverted before his death… and regretted doing just One abortion….as he said, he “knew all along, he was killing little human beings.” May God have mercy on him.

      God will choose whether or not the egg becomes fertilized. He would put every cell together, piece by piece, just as He did with you and me. He is the creator – NO MATTER WHAT YOU OR I DO.

    I don‘t wanna judge these people and I don’t see any reason to outlaw anything like this but, personally, I think it’s just really wired. Extracting sprem and eggs from a dead body? Eww.

      Deadfacebook, there is no need to be anti-Semitic to disagree with using a dead young woman’s eggs. I personally don’t agree with doing something like this but there are many who would from all faiths and perhaps from no faith. Antisemitism is about people who who hate Jews, not about Jews themselves.

    I feel so sorry for the parents of their 17 year old daughter. My heart goes out to them. One should never make huge decisions about life changing events when one is in mourning. I’m glad they changed their minds about having the eggs fertilized. There are too many ethical questions to be answered when you are not thinking straight.

    I can see a wife doing this if she lost her husband unexpectedly and they were intending on having children….but that’s really the only situation where I agree with such unnatural measures

    I don‘t think they’re doing this to be nice. My guess is they want to be able to make up for mistakes or make DNA adjustments once they start depopulating the world. If I were into Eugenics this would make total sense to me.

    I am shocked surprised and saddened. I grieve for their loss, but this si wrong, both spiritually and morally according to Jewish Law. If they need a child- there are tons in state orphanages……to these parents….. contact AMIT- I know they would direct you to children in need………

    In 2006, according to the Alan Guttmacher Institute, an average of 46,000,000 babies annually were murdered in the womb; in the last 25 years, its totaled over 900,000,000 dead babies, or, 3 times the amount due to war. Those people just want to have a part of their loved ones back…leave them alone!! They’re trying to CREATE life instead of destroy it, and you disagree with that? Parents will walk into hell, if need be, to have their child back again; freezing sperm and eggs is the closest they’ll get to holding their child again, and I say, let them do it.

      I agree, that these devastated parents are only trying to create life, and that on the surface that seems like a good thing in comparison to the numbers of abortions. However, they are in the midst of such devastating grief, that they aren’t making rational decisions. They’re grasping at straws trying to replace their own children. It isn’t mentally healthy behavior, for them, or for the potential child.

      They‘re in a position where they can’t see that bringing “Susie’s” baby into the world won’t replace “Susie”. Susie’s baby will be a unique individual, maybe completely different than her mother. More so, because “Susie’s” baby won’t have parents. Her mother died before her birth, and she’ll have no father other than a donor….and she’ll have to live with the fact that her grandparents are constantly comparing her to her mother.

      There are so many babies and children out there who need parents. These grandparents would do well trying to become foster parents or even adopt if they could.

      This was pure selfishness on the (trying to be) grandparents, the mother of the teen. They just wanted grandchildren. I’m glad they changed their minds.
