‘It Is Not, Per Se, a Tax’: Sebelius Contradicts Administration’s Legal Defense of Obamacare

In a stunning video from a hearing before the House Ways and Means Committee this week, Kathleen Sebelius contradicted the Obama administration Department of Justice’s official stance on the individual mandate by denying that the mandate was a tax. You can watch the Secretary’s comments below:

Sebelius is the latest administration official to contradict the Justice Department’s official stance. Almost two weeks ago, White House Budget Director Jeffrey Zients said the same thing:

By the way, it‘s not like Sebelius’ dodge is apparently motivated by fear of talking about raising taxes. Here she is defending a tax on medical devices from a similar hearing about two weeks ago:

The Obama Justice Department’s case that Obamacare is constitutional hinges on the idea that the mandate is no different from any other tax in that it effectively “raises taxes” on everyone who disobeys it by expropriating money from them. This particular defense was explored by the Heritage Foundation when it was first introduced:

The New York Times confirmed Friday that in preparation for defending constitutionality of the Obamacare individual mandate in court, an Obama Justice Department legal brief argues that the penalty used to enforce the mandate is “a valid exercise” of Congress’s power to impose taxes. Mr. Obama’s own Justice Department further repudiates the President’s earlier statement by noting that the penalty is imposed and collected under the Internal Revenue Code, people must report it on their tax returns, and that the Congressional Budget Office estimates that it will cost Americans $4 billion a year. Yale Law School professor Jack Balkin told a meeting of progressive activists last month that President Obama “has not been honest with the American people about the nature of this bill. This bill is a tax.”

The fact that the Obama administration and their allies are now admitting the individual mandate is a tax betrays their very real fear that the Supreme Court could find Obamacare’s individual mandate unconstitutional. In the bill itself, Congress identified the Commerce Clause as the source of their authority to force all Americans to buy health insurance. But as our legal team has made eminently clear, the mandate does not purport to regulate or prohibit commerce of any kind. To the contrary, it purports to “regulate”—and penalize—inactivity. If the Supreme Court allows the Obamacare individual mandate to stand, then Congress could do anything it wanted. They could: require us to buy a new Chevy Impala each year to support the government-supported auto industry; require us to buy war bonds to pay for the Iraq and Afghan wars; or force us to eat our vegetables.

But even if the Obama administration is now admitting the individual mandate is a tax, that still does not make the law constitutional. Rather than operating as a tax on income, the mandate is a tax on the person and is, therefore, a capitation tax. Therefore the 16th Amendment’s grant of power to Congress to assess an income tax does not apply. The Constitution does allow Congress to assess a capitation tax, but that requires the tax be assessed evenly based op population. That is not how the Obamacare mandate works. It exempts and carves out far too many exceptions to past muster as a capitation tax. The Obamacare mandate is still unprecedented and unconstitutional.

If this is the administration’s defense, then Sebelius’ reply raises serious questions. If the law were found Constitutional, she would be the Executive Branch official in charge of enforcing it through regulation. As such, her confusion about how a key part of the law operates may strike some readers as dangerously uninformed, and is arguably only a further symptom of the Obama administration’s confusion on the issue.

      If a tax then its an illegal law. The bill originated in the Senate and tax bills can only originate in the House. If the US Constitution is null and void then why are we obey IRS laws and laws passed by Congress. Congress is now null and void.

      It’s a tax, it’s a fine, it’s a fee, it’s a penalty for not obeying (i.e. – purchasing a product [insurnace]). It’s not constitutional. It‘s a scam that our Supreme Court didn’t do it’s job and denounce it. You see, enough of the wrong people in the right positions does all the damage necessary.

      The Federal lawyers arguing in the lower courts avoided the issue of calling Social Security taxation, until the Supreme Court heard the case.
      Then the Federal lawyers dropped the bomb and argued that Social Security IS in fact, a tax, and can be imposed on the public under the provisions of the 16th Amendment

      Now, all payroll is subject to Social Secuity taxation and there is no other option

      When you see someone constantly rearranging the papers in front of them while talking means they are lying and can’t look at their questioner “see I‘m not looking at you because I’m busy rearranging my paperwork”. Also why will there be more customers in the healthcare system, which she supposively insinuates meaning more money coming in to offset the taxes. Question, I thought the problem with the healthcare system was that there were too many uninsured people using the system now. So now she wants more people using the system, so now what, I will be mandated to use the healthcare system even if I don’t need it so that I have to pay at least the $750.00 penalty, tax, penalty, tax, tax, penalty whatever?

      I have been posting about this practice trying to call attention to the fact that Harry R. seems to be the arbitrator of all bills that get a vote in the Senate and he is keeping all bills that pass in the house off the agenda! Why are we not talking about that in the MSM?
      In case some of you do not know? The constitution mandates that all bills emanate from the house not the Senate. If a bill is from the Senate it is not legal PERIOD!
      I do not care what you lib’s say you are wrong.
      This is not right and they know it and you should know it.
      All the bills that have been passed by this congress that originated from the Senate are illegal and the backers are guilty of treason plane and simple!
      This is not rocket science and the people who are part of this activity are on both sides of the isle.
      I for one would refuse to vote and would try to disrupt any voting in the congress as much as I could if I were an elected official! They would half to arrest me to get me off the floor.

      LOL…you can see Obamacare sinking fast. Not only a few weeks ago Sebelius’ deputy said it was indeed a tax before congress. Now Sebelius is spinning very hard and saying “it’s not per se a tax”. Obama promised he wouldn’t raise taxes on anyone under 250K and this is why Sebelius is trying very hard to contain the out of control spiral this is taking. It’s a tax before the SCOTUS, this is how Obama’s lawyers are selling it. For the American people though, Sebelius says “it’s not a tax per se”. A more vulger, duplicitious and reptillian group of people than the Obama administration you will never find. I’m enjoying watching Obamacare fall apart before our eyes.

    Ladies and gentlemen,

    Even if this were a tax, Obamacare would still be unconstitutional because there s no enumerated power that grants the federal government the power to be involved in health care in any way.

    The power to levy an income tax does not give the federal government carte blanche to do whatever it wants.

    The 16th Amendent like the many clauses of the Constitution can only legitimately be used to support the enumerated powers. In other words, the federal government is only allowed to use the income tax to raise money for legitimate, enumerated purposes. The same for the oft abused Necessary and Proper clause. The government can only do what is necessary and proper in support of the enumerated powers. Congress does not have dictatorial powers in spite of what the Leftists want.

IRoughly 90 years ago a samll fraction of a population managed to subdue a large nation and polunged it into darkness for 70 years…That same nation is now slipping backwards into that same darkness and another is on the verge of joining them.

      You bring up a VERY GOOD POINT! Once all those checks are made out to the US Treasury, will the same thing happen to it as the Social Security “Lock Box”? When we need health care, will the money be there, or will it be in the UN Treasury, or IMF loan funds, or where will it be?
      Who (besides al gore) gets the money from carbon credits, and carbon swap funds, will this money go to pay international taxes, including the u n tax global tax on global citizens?

    Taxation for deathcare- we have seen first hand a socialist hospital in a third world country and the roach droppings gracing the halls while the suffering go unaided…why will America be any different? The State will ration care and unions will only serve themselves. Repeal Obamacare-now!
