‘It’s My Gun’: Minn. Man Beaten, Arrested for Reportedly Carrying Handgun… Despite Having Concealed Carry Permit

A Minneapolis man says he suffered a concussion after receiving a beating from five police officers who attacked him after they noticed he was carrying a gun in his waist band, WCCO-TV in Minnesota reports.

The problem is, Zachary King has a concealed carry permit to lawfully carry the firearm. He argues police still attacked him anyway as he was leaving a local nightclub on Father’s Day night even after he told them he was carrying the permit.

“’I have my conceal and carry, and it’s my gun.’ And soon as I said that he grabbed me by my neck, slammed me against the wall, snatched my gun out the holster, started waving it in the air saying ‘gun, gun, gun,’” King said.

King also told WCCO he said nothing disrespectful to the officers and made no sudden movements that could have warranted the reaction from police.

“Then four other officers just came and slammed me on my face, one of the officers had me by my head just banging it on the sidewalk,” he said.

The permit was eventually discovered but King was reportedly taken to jail anyway.

WCCO has more on the incident:

King says officers eventually went for his back pocket and his wallet to get his weapons permit.

“And he goes like this to show them that I have my card and they stopped beating me,” said King.

King was then taken to the hospital before his last stop, jail.

It should be noted that King was previously arrested and not charged after recording police in April — a video he says showed an abuse of power. Additionally, he was acquitted of manslaughter in 2008 after his pit bull mauled to death his 7-year-old son. King’s attorney, Michael Padden, says his client, then “has zero criminal record.”

WCCO incorrectly identified the attorney as “Mike Patton.” The Blaze recently spoke with Padden and verified his identity.

“It takes a lot of courage to come forward in this type of situation. He doesn’t want to see this happen to other people,” said Padden.

Still, King was ultimately charged in the most recent incident with misdemeanor obstructing the legal process, according to KAAL-TV in Minnesota.

“There will be no plea and we’ll take the case to trial, if need be,” said Padden.

King says a bystander was able to capture the attack on video, a portion of which can be seen in the video at the top of this report. Padden is reportedly coordinating with Internal Affairs and hopes that street video from Minneapolis Police cameras will also shed some light on the incident.

Minneapolis Police told WCCO they cannot comment on the case because an open civilian review authority investigation is currently underway.

KAAL reports that several dozen people staged rallies in Minneapolis Friday denouncing police brutality following the incident.

“No justice, no peace. Prosecute the police,” the groups could be heard chanting.

According to the Minnesota Department of Public Safety, residents are prohibited from carrying their handguns while at the following places:

  • School property
  • A childcare center while children are present
  • Public colleges and universities – may have policy restricting the carrying of weapons on their premises by employees and students while on campus
  • Private establishments that have posted a sign banning guns on their premises
  • Private establishments who have personally informed the permit holder that guns are prohibited and demands compliance
  • Places of employment, public or private, if employer restricts the carry or possession of firearms by is employees
  • State correctional facilities or state hospitals and grounds (MN Statute 243.55)
  • Any jail, lockup or correctional facility (MN Statute 641.165)
  • Courthouse complexes, unless the sheriff is notified (MN Statute 609.66)
  • Offices and courtrooms of the Minnesota Supreme Court and Court of Appeals
  • Any state building in the Capitol Area of St. Paul described in MN Statute Chapter 15B unless the commissioner of public safety is notified (MN Statute 609.66)
  • In federal court facilities or other federal facilities (Title 18 U.S.C.§ 930)

We searched Minnesota’s statute database and could not find any mention of a restriction against carrying a pistol into an establishment that serves alcohol, however, concealed carry holders are generally discouraged from carrying places like bars, especially when drinking alcohol.

Further, Minnesota statute 624.7142 says it is a crime to carry a concealed handgun when under the influence of alcohol. It is unclear whether King had been drinking that night.

      What a dummie – he got what he deserved!. After all the articles on the net and news about people up there being arrested with carry permits tou think folks would avoid all those states. That whole area is on my no fly list. If people would skip these states and spend their money else where people woyuld be fired and vote in people with common sense. It’s craze up there. Like NYC and Bloomie will let you carry and recognize your carry permit, if you pay $1200.00 for a temp. permit.

      Incorrect on “printing”. Minnesota has both concealed and open carry enabled with a CHL. Ergo, if he was carrying it on a necklace around his neck (in a holster) or concealed, or anything inbetween (so called “printing”) makes no difference, legally. You can print in MN in other words (same in Ohio and many other states with open carry).

      Dont know about Minn law, but Florida law and restaurant carry law says no alcohol while carrying legally. One drink puts you in the wrong.

      May not have anything to do with this case. Guess more facts will have to come out. Dont worry Al and jesse should be there by morning. Maybe.

      If the officers are found to have used excessive force, this gentleman will be paid handsomely. I dont think there is a need to call for executions or shootings yet.

      Doesn’t matter. Every state needs to be an open carry state (without requiring a permit). I don’t think obtaining a permit to carry concealed should be required. Criminals already have the guns and will carry concealed anyhow. Simply carrying a gun is not a crime, no valid cause of action. Police have NO legal obligation to protect us (as seen here, they do what they do best and that is attack people). Bower v. Devito. Only person you can count on to protect you is YOU.

      I notice that the first place mentioned that you cannot carry a gun in a school….. Of all places a school is the one place people should carry a gun is on school grounds….. That is where most of the mass shootings take place….. How many school shootings have we had??… How many might lives might have been saved if there were someone there with a gun to stop the shooter??….. And just know this, making LAWS to forbid people from carrying on school property will not stop the person that is going to bring a gun for the purpose of shooting everyone,because they are planning to break the LAW anyway in the most terrible way.

      Not in Florida, in fact any officer that attempts to arrest or detain for seeing a “print” of a firearm, is Personally subject to fine. Including the department for which they serve. Florida state preemption law holds all officers and their department accountable to State Law over local codes. Failure to comply can result in fine and prosecution as well as civil action.

      KEYSTONESTATE….. I once had a gun confiscated by the police, went to jail, and charged with a crime for carrying a small pistol….. All of which under the constitution is my right to do….. This was before CC permits, you were not allowed to conceal it, but under the constitution why would that be wrong???…. You were however allowed by law to OPEN CARRY, but how much trouble will come if you do this???!!!……. And they have a LAW to defeat the open carry so as to make it IMPOSSIBLE, to carry agun….. It is called armed to the terror of the public…. if someone so much as thinks about complaining about your open carry, BAM there you go…. The government is in the process of disarming it’s citizens…. How many times have you here about a guy arrested for something that has nothing to do with guns or violence, but they take all of his guns away and never will he see them again??….       The problem is that it is already on the computer screen or communicated by dispatch when you run a ‘wants and warrant’ on anyone, you can bet that if he has a carry permit, it will come up. That officer knew ahead of time that this guy had a carry permit!

      Do the police not understand that things like this are EXACTLY why the public is becoming more and more distrustful of our men in blue?
      Do they not know that one of the things our gun rights are for is so that we can protect ourselves even from our own Government? Or do they still teach our officers the constitution any more?
      I do not believe we should take up arms against the cops but man this is not good at all!!!!

      Don’t Know about minn. but thats not true in most states!
      As long as they a reasonable attempt to cover the gun (under a shirt,jacket)
      it is not“open carry”.

      Now If they see it while they are flogging you I don’t know how that works!!
      Other than painfuly.

      Having just taken my class for “Permit to Carry” in Minnesota, the permit allows open and concealed carry. There is not a Concealed Weapons permit in Minnesota, it is a Permit to Carry. Even so, the law allowing for the Permit to Carry states that if you are under the influence of Alcohol, you must NOT have an alcohol level of .04. So, this article is speaking about abuse, not the fact that the man may or may not have been legally intoxicated. Since this man has had some legal issues in the past, it brings into question how innocent he actually is/was.

      I think this man was clearly in violation if the gun was visible, however, a discreet “hide that gun better” was called for. In such cases as this, an ancient law should be resurrected; police abuse should be rewarded with ‘full outlawry’ for the police officer that does it. That way, the people whom he’s beaten over the years will haunt the remainder of his existence.

      The two cases are not identical, but see what happens when someone bangs your head against the sidewalk? This was an adult doing the slamming, but King is twice the size and a lot tougher than tiny Zimm. Plus, the police thug did not hit King with full force, or he would have killed him.

      If he was visibly drunk or causing a commotion then the officers may arrest him, even if he has a CCP. However, since there is no mention of any of this, then until more information comes to light, I think the police are in error here and should be kicked off the force for brutality. Keep in mind we don’t know all of the facts, this is just an opinion!

      The cops are wrong. Again (Bike incident). He needs to sue the department in a big way. Proper concealment, even if open carry is allowed, goes a long way to avoid riff-raff such as this and I couldn’t care less if he was in a night club or not. I hope were not seeing an emerging pattern here with LEO’s.

      I’ve read here that most crimes are committed by blacks. Of course the police are suspicious of a black guy whose got a gun hanging out there. They probably read this website! This isn‘t about the right to carry guns it’s about Blazers believing that a blacks are dangerous, particularly blacks carrying guns. Particularly if they’re drinking.

      Now once you get it out of your head that this is about the right to carry, and really about a scary black guy with a gun hanging out for everyone to see, you’ll realize the police action was completely justified. What would you think if some big black guy was walking down the street with a firearm by his side? Would you think he was a fine gun carrying American? Or a scary black guy?

      Of course these cops went after him. They’re people just like you.

      I hope that this gentle men’s story adds up; I pray it does. If let’s say he walked out of the bar and deliberately, but in subtle fashion flashed his waist band as a taunt to provoke an incident, in front of the cameras. I would like to see ALL video taken on all the devices between ALL parties. Every cop and everyone in the party. This means the last year of all the footage of these cops, and the entire footage of everyone accompanying those involved. Both the guy with the gun, but more importantly the guy with the camera and the guy who uploaded it. Get the entire story because it’s important.

      If these cops in any way have a history, and the state has a 10-20 life law, give’em 20 years mandatory. Every last one of them that’s dirty and was involved and carrying a gun commited a felony while carrying a firearm..

      If you can find evidence that this was an orchestrated and planned incident, charge the camera man with conspiracy and aiding and abetting in a crime. Give the man with the gun 20.

      If there’s evidence of both, charge all of them and let the jury decide.

      I live in Oregon and have a C.C.l I’ve carried a gun for about twenty four years. I have been pulled over for one thing or another. When I’m carrying , I hand my driver license I also give them my conceal carry license. They ask where the weapon is and I tell them on my left hip, I also offer to show it and have never been asked to surrender it. The police have the right to inspect and can confiscate it four twenty hours. Here in Oregon its not a big deal. Now there is no law that requires a C.C.L. to inform the police that we are armed. It’s good manners to do so and the officers appreciate the information. These cops need to fired and legal charges brought against them. Shameful cops acting like thugs.

      Just to clarify some facts that are wrong in this story:

      1.) We have a Permit to CARRY in Minnesota. This means it allows us to carry concealed or open. There is no legal difference between the two and printing of a concealed firearm is not mentioned in the law so therefore has no legal weight.

      2.) You can drink and have a BAC of 0.04 or lower, but if you are drinking in public and carrying you better expect to be arrested because you will be over 0.04 with one or two beers. No law mentions carrying into a bar and is legal.

      3.) You can stow your gun in the “rear most compartment” of your vehicle in the parking lot of any of those illegal locations. The ammo and gun must be separated if it is stowed in a vehicle while you are not present, otherwise if you are in your vehicle the gun must be on or about your person.

      I am in OHIO and I have a concealed carry permit. I would NEVER think of carrying a gun anywhere except to my gun club and in my church. NEVER CARRY A GUN IN A BAR.

      The ONLY reason a person would carry their gun is to SHOW OFF or to pretend they are someone they are not. However, MAYBE this guy was in a dangerous bar, and then, why would anyone go someone that was dangerous unless you are looking for trouble.

      However, these cops were PLAIN WRONG in kicking the snot out of this guy. I HOPE THIS GUY DOES SUE. I don’t even carry my gun in my car. I only have it because I belong to a gun club and must carry my guns to and from the club. If I am out with my friends drinking, I NEVER CARRY MY GUN – NEVER because I KNOW exactly what COULD happen. DUH.

      But, having said all that, clearly the police were in the WRONG and I am sure it will be proven in court.

      It’s interesting that anyone thinks it is okay for ANY restrictions are okay on weapons of any kind on any kind of government funded property or anyplace excepting private property in which the owners have required disarmament as a condition to entering the property. The Bill of Rights does not give governments any wiggle room here. It states, “…the right of the people to keep and bear arms shall not be infringed.“ By acknowledging that government has the right to take away or prohibit weapons on ANY property in order to ensure ”safety” is giving leeway to the inevitable…taking away firearms completely. If government is allowed to deprive us of our rights in order to protect us, then government is what we need protected from. These laws should be challenged over and over again until the government gives up. Even concealed carry permits violate that concept. It acknowledges that the government has the right to determine when and if a citizen has the right to defend themselves. Sorry, folks, but it will be colder than the absolute cold of darkest space before I ask a government employee if it’s okay to kill someone attempting to harm me, my family and anyone around me. I grew up in Montana. We took guns to school, not inside, but mounted in racks in our rear windows, so we could hunt. Nobody ever stole anything. Why? Because they would have been killed. We don’t need fewer guns, we need fewer people who believe they need permission to keep and bear arms.

    If found guilty by all available evidence, these “officers of the peace” should be charged with criminal negligence, assault, breach of peace, and potentially attempted murder in the second degree (i.e. slamming someones head into a wall can reasonably cause death). This is why more responsible adults should carry, if you have 20 responsible adults with guns then a rouge officer of small group might think twice on how they act and react to a situation, and even if they don’t, then the offenders will be forced to calm down. For those that say that citizens should not interrupt or get involved with police actions, I would refer you to the start of this country and the Declaration of Independence. Yes, the individual might in fact be a bad guy, but police officers do not have that right to make that choice in the end, the people do. If it is your belief that an officer is “better” than a citizen, then you should go back to England under a kings rule. Remember, police officers do not prevent crimes, nor protect people, they investigate and bring criminals to the courts for judgment.

    If I have 10 seconds to protect my family, I’m not going for the phone….

      I agree, one of the biggest problems with our media is they are opportunists looking for politically correct stories to tell in order to further legitimize certain ideologies….Context is everything and unfortunately in our sound bite world context is rarely communicated thoroughly and accurately. Having said that if this is being accurately conveyed not only should these policemen loose their jobs they should be prosecuted for assault and bodily injury and forced to pay fines and hospital bills and damages. My concern is that I am seeing an alarming trend of officers who think they are above the law because they wear a badge and a gun. I know there are many brave men and women in law enforcement that don’t have egos and do their very best in a very difficult job, but these types of incidents must be met with strong consequences when found to be unwarranted.

      . You don’t really need to train a pit bull to kill children. Certain subsets of that breed are vicious by nature and genetics. The owning of certain breeds of dogs is seen as macho in some segments of society, and the man could very well have just gotten an ill bred monster in waiting. That’s offering the benefit of a doubt. However, with the evidence we have just in this story, the assault he suffered at the hands of LEOs is not warranted and he should file suit.. given the information we have so far.

      Where did it say he trained his dog to maul his kids? I love dogs and I opposed breed bans BUT animal husbandry definitely plays a part, a big part in an animal’s behavior. Incorrect breeding or improper handling of a dog with certain drives cause most of these cases. Some dogs are aggressive by nature, that doesn’t make them bad, it just makes them unsuited for most homes. Dogs need to be bred for a job, not for apperance, and people need to understand the nature of thier dogs and thier drives.

      The way things happen at these type situations, why in the world do the police continue to respond so fast to a call for help? If they just slow down, the emergency will already be over and taking a report and cleaning up the bodies won’t put them in a situation that could cost them their job. Issue brooms and shovels to the police and let the people take care of themselves. It’s what the people want. The posts show this to be true. (sar)

    I have a CCW and FIRST OF ALL – I would not bring a gun to a NIGHT CLUB.
    Second – I would not bring a gun to a night club.
    and THIRD – I would not bring a gun to a night club.

    There MUST be more to this story – because the police just don’t happen to be walking by and notice a gun.

    If they acted incorrectly – they need to be held accountable.
    BUT in their defence – they have a crap job protecting people from jerks who DONT have a CCW permity and bring a gun to a night club.

    Write this down – if you feel you have to being a GUN to a night club – better off NOT GOING to the night club.

      Correct, MN is a permit to carry state, no need to conceal unless you want to. I carry mine open wherever I’m allowed to. And you are allowed to carry in bars/clubs but I wouldn’t recommend it.

      @ blazedbanned, my thoughts exactly, if he really understands his conceal carry laws,he would have known that he can not carry a fire arm in to a place that serves liquor ,only if the establishment makes 515 or more on food sales and 49% or less on liquor sales and they must post this notice on the doors,also they have to post a sign that states that no one can carry a fire arm on the property, conceal carry people are held to a higher standards when we carry guns and we should be,because we have to know the laws.

    Well when we keep surrendering liberty for safety this is what you get. Instead of a conversation with a seemingly law abiding citizen, we have beating. Police who think they can confiscate cameras and beat a man with a legal weapon. But we are much safer, thanks to all who think beiong safe is living.

      There will be no further details, there rarely are. The details provided tell that the man was filming cops and got “arrested”, then suddenly the cops surround him, apparently doing nothing wrong, and act like flipping idiots screaming “gun gun gun!” after they’d disarmed him, then beat him. Nothing merits that, since clearly he didn’t draw the gun on them.

    Something needs to be done. Police are either running scared, or running amok, and they seem to be loosing it. I realize sometimes they are put in awfull positions, but this kind of thing is just not right. We have the right to have guns, and carry with a permit. the police have no right to do something like this, beat first, ask questions later. I hate to see cops loose their jobs, but this group was out of control. Very glad there is video.

    does Minnesota allow a conceal carry weapon in a bar?????
    I went through the course and most states do not allow a conceal carry weapon in a place that serves alcohol.

    These officers should be fired and charged with assault. Instead we the tax payers will give the victim a large sum of money and these officers will get a slap on the wrist and use the same gestapo style tactics on someone else in the future. Wake up America.

      I hate to say it, but maybe since he’s a black guy he might get some justice against the out of control cops. Contrast this with the Texas guy and his helmet cam-we’ll see how that plays out.
      We all want to support the cops, but this b*llsh*t is getting all too common. Really makes you wonder where the cops will be when TSHTF and the PTB want to confiscate legally own firearms from law abiding citizens like the man in this story.
