‘It’s Perfectly Constitutional’: Kansas Governor Signs Bill Blocking Islamic Law in Courts and Government Agencies

(The Blaze/AP) — Kansas Gov. Sam Brownback has signed a law aimed at keeping the state’s courts or government agencies from basing decisions on Islamic or other foreign legal codes, and a national Muslim group’s spokesman said Friday that a court challenge is likely.

The new law, taking effect July 1, doesn’t specifically mention Shariah law, which broadly refers to codes within the Islamic legal system.  Instead, it says courts, administrative agencies or state tribunals can’t base rulings on any foreign law or legal system that would not grant the parties the same rights guaranteed by state and U.S. constitutions.

“This bill should provide protection for Kansas citizens from the application of foreign laws,” said Stephen Gele, spokesman for the American Public Policy Alliance, a Michigan group promoting model legislation similar to the new Kansas law. “The bill does not read, in any way, to be discriminatory against any religion.”

But supporters have worried specifically about Shariah law being applied in Kansas court cases, and the alliance says on its website that it wants to protect Americans’ freedoms from “infiltration” by foreign laws and legal doctrines, “especially Islamic Shariah Law.”

Brownback’s office notified the state Senate of his decision Friday, but he actually signed the measure Monday. The governor’s spokeswoman, Sherriene Jones-Sontag, said in a statement that the bill “makes it clear that Kansas courts will rely exclusively on the laws of our state and our nation when deciding cases and will not consider the laws of foreign jurisdictions.”

Muslim groups had urged Brownback to veto the measure, arguing that it promotes discrimination. Ibrahim Hooper, a spokesman for the Washington-based Council on American-Islamic Relations, said a court challenge is likely because supporters of the measure frequently expressed concern about Shariah law.

Hooper said of Brownback, “If he claims it has nothing to do with Shariah or Islamic law or Muslims, then he wasn’t paying attention.”

Both the Washington-based council and the National Conference of State Legislatures say such proposals have been considered in 20 states, including Kansas. Gele said laws similar to Kansas’ new statute have been enacted in Arizona, Louisiana and Tennessee.

Oklahoma voters approved a ballot initiative in 2010 that specifically mentioned Shariah law, but both a federal judge and a federal appeals court blocked it.

There are no known cases in which a Kansas judge has based a ruling on Islamic law. However, supporters of the bill have cited a pending case in Sedgwick County in which a man seeking to divorce his wife has asked for property to be divided under a marriage contract in line with Shariah law.

Supporters argue the measure simply ensures that legal decisions will protect long-cherished liberties, such as freedom of speech and religion and the right to equal treatment under the law. Gele said the measure would come into play if someone wanted to enforce a libel judgment against an American from a foreign nation without the same free speech protections.

“It is perfectly constitutional,” he said.

The House approved the bill unanimously and the Senate, with broad, bipartisan support. Even some legislators who were skeptical of it believed it was broad and bland enough that it didn’t represent a specific political attack on Muslims.

“This disturbing recent trend of activist judges relying upon the laws of other nations has been rejected by overwhelming bipartisan majorities in both the Kansas House and Senate,” Jones-Sontag said.

The measure’s chief sponsor, Rep. Peggy Mast, an Emporia Republican, also has said all Kansans, including Muslims, should be comfortable with the new law, but she did not immediately respond Friday to telephone and email messages seeking comment.

Rep. Scott Schwab, an Olathe Republican, acknowledged that the measure merely “made some people happy” and that a vote against it could be cast politically as a vote in favor of Shariah law.

“Am I really concerned that Shariah law is going to take over the Kansas courts? No,” he said. “I’m more concerned about getting jobs to Kansas.”

The Michigan-based alliance advocates model “American Law for American Courts” legislation. Its website says, “America has unique values of liberty which do not exist in foreign legal systems, particularly Shariah Law.”

During the Kansas Senate’s debate on the bill earlier this month, Sen. Susan Wagle, a Wichita Republican described a vote for the measure as a vote for women’s rights, adding, “They stone women to death in countries that have Shariah law.”

Hooper said supporters of such proposals have made it clear they are targeting Islamic law.

“Underlying all of this is demonizing Islam and marginalizing American Muslims,” he said.

    Way to go Kansas! So now the rest who have not done so, need to follow suit. This is our country and our Laws and no one should consider instituting anything except the U.S. Constitutional Law as originally written with the Spirit and Intent for that it is written. This nation is Under God and if she is going to remain will have to stay her laws that are pleasing to God.

      It may come to that to get them out. It is according to if they want to draw down or not. They have all but drawn down on the American people using people to tie up the courts with frivilous law suits and tying the courts up with stuff like this that everyone should know. We owe those people nothing, but they owe us to allow them to come here and be a part of this great land. If they didn’t think it was so freaking hot, then why did they bust their chops getting here. What would happen if we werent here to produce or grow food? Now its coming to fruition and people are still like that could never happen. I kept all my emails I sent to Glenn and other prophecy blogs and I can’t believe how much stuff has come true! I wish people would read the Bible and discover the different levels of understanding there is. Like ELS, different levels of understanding. I think we would end up in the 3rd. I believe its because Israel is going to nuke Iran. Most people don’t know this but Syria has tons of chemical and biological weapons. People say prior to the first gulf war russia moved planes into Iraq and moved saddams weapons of mass destruction to guess where? Syria, “the Bekka Valley”! We have military in there guarding some of the Bios and chemicals. But I don’t think our Gov. knows about the Bekka Valley. This came about in two Books, called the Bible Code 1 and 2. We have never seen Damascus cease from being a city, yet the Bible predicts this coming judgement on Damascus. Some people say its been destroyed before, but they don’t realize the bible says, it will cease from being a city any longer! Not sure what ya want to know but ask away!

      We’re one nation under the consent of the governed not God. Brownback should be consistent and demand legislation that our courts do not follow Biblical law either. After all, people have used the Bible to create mischief throughout history like the Inquisition, laws that would send interracial couples to prison and send their children to foster care, and a whole host of despicable acts.

      It might be a good idea to insist immigrants go thru a 6 week course on American laws, the Constitution and the Bill of Rights. After the course is finished, they take an oath to uphold OUR laws. If they don’t like it, LEAVE.

      Just a comment about what happened when 2 worlds collided. Years ago a local businessman was driving home from work and his home was several miles outside of the city. As he had done hundreds of time, rounded a curve (night-time) and was hit head-on with another vehicle. The businessman was killed instantly and never had a chance to swerve etc.. The other driver survived, no charges, and sent back home to his native country. He had been driving without a driver’s license and had been in this country about 3 days. His “homeland” country drove on the “left-side” of the road. NO CHARGES FILED AGAINST HIM. Free to go back home.
      And the beat goes on!

      15 trial court cases, and 12 appellate court cases, where Shariah was found to be applicable.Circuit Judge Richard Nielsen in Tampa Florida decided in a lawsuit against a local mosque ruled that any decision should be made “under Ecclesiastical Islamic Law.”Judge Joseph Charles of New Jersey refused to grant a Muslim woman a restraining order against her husband, who had sexually abused her. The basis for the judge’s ruling was that the husband had no “intent” to rape her, but was simply following what he believed to be his right under Sharia law.

      True, many of our laws are based in Christianity, but not all of Christianity is contained in our law.

      Uh, I think there’s some confusion here. Judges make decisions based on US law or by precedents set by by other US courts interpreting US law. Making decisions on any other basis is grounds for impeachment and removal from office.

      Dang right this new law is “Constitutional.” So would be a new law saying that Kansas will not be obligated to adhere to the agreement between the Federation and the Klingons. Judges are required to follow US law, not Federation or Klingon law, regardless of any future treaty they might make.

      It would also be Constitutional to pass a law which states that the fourth through thirteenth dimensions of the universe are not recognized as part of Kansas and that only lifeforms that exist in three dimensions can apply for a driver’s license.

      Kansas, are you vying with Arizona to be the stupidest state om the US of A?

    Freedom of religion is great except when it calls for the death of anyone the doesn’t support said religion. Our founding fathers never imagined that Muslims would infiltrate our country and change our fundamental law, the US Constitution. If people that come to this country can’t accept that we have our own rules, just like their country does, and they don’t want to follow those rules, then they need not come.
    The problem is that they know that our stupid government will let them slide on our laws and they will eventually take over. Bye the way, Press 1 for English.

      Actually they did see the danger from Muslims. One of our first military conflicts was against Muslims. Jefferson published the first American copy of the Koran with a stern warning in the preface. Does the phrase “from the shores of Tripoli……..” ring a bell???

      The problem with Europe is they’re producing far less kids than the muslims. The older population is dying off and the younger generation isn’t getting married. They’re up SH_T Creek, without a paddle! These people are Satanic! I’m not for Genocide, but I’ll fight for my country and fellow people when push comes to shove! People keep saying Democracy can succeed in muslim countries. It can‘t and it won’t! I watched Hannity the other night with the imam that wants the mosque by ground zero, he stated our constitution goes hand in hand with sharia law! Was he sniffing to much Glue or what? I wish hannity would have taken his shoe off and thrown it at him! Sharia, doesn’t belong anywhere other than in hell! The only reason he stated that was because, it does go with what they want!     The sole purpose for Muslims, with Obama’s help, is to bring Shariah law and their religion to this country. For the CAIR representative, Ibrahim Hooper, to argue that the law will promote discrimination is a joke. I grew up when the phrase, “better dead than Red” brought fear….now it’s the Muslims.

      I was born in Lawrence when my parents were in college; then to Tribune until I was 6. One set of grandparents were wheat farmers and the other were bankers. Christmas was always interesting. {: I used to love going there in the summers!

      Wow nelly, I do remember the summers in Americus, the most spectacular lightning storms and tornados I have ever been through. That counts for even North Dakota, Nebraska, and Colorado. Plus the few years I spent in Missouri. Kansas is the only state that I really clicked my heels together and wished, “There is no place like home (Colorado), there is no place like home.”

    Let us look at this from a sane point of view. A state could pass a law that would ban Dr Suess from being used in court, UK law, Canadian law, and Ohms law. The only law that can be used in USA court is constitutional law, or established state law, which is based on the US constitution. SOOOOOOO. Why would anyone at all challenge this law? Only if they don’t believe in the US Constitution, or really want to use their Dr Suess Law Degree, that they got from Harvard.

      It’s supposed to be the law, but that particular camel has got it’s nose a little into the tent with the help of a few idiot judges. Only way to cut it off at the knees is to do what brave Kansans did. They simply said no law will come before constitutional law. Good luck to the shariah folks argueing that before the supreme court. They were smart to not mention shariah. Point: very few muslims in this country are here to be free, the want to spread theirr religion, or destroy America. That is my opinion. If push came to shove they would support shariah law, and the takeover of this country. ( I will grant some would out of fear)

      It seems to be happening all over the world. Almost every conflict in the world today has Islam at it’s heart. They move in and begin to agitate for “change”. As the percentage of Muslims increases, so does the unrest until eventually fighting breaks out. That is where we are today in the world. When Islam says they are being discriminated against – look out. It is not a religion, it is a theocracy.

    If shariah law was permitted in the courts, what would happen if a muslim started beating his wife for a muslim reason and an American stepped in to protect her? Protecting a woman would become obsolete. It might work in a third world country, but not in America.
