(The Blaze/AP) — Colorado prosecutors charged a former neuroscience graduate student with 24 counts of murder and 116 counts of attempted murder on Monday, in the shooting rampage at the midnight showing of the new Batman movie.

James Holmes appeared just as dazed as he did in his first court appearance last week, but at one point exchanged a few words with one of his attorneys in the packed courtroom.

The attack at “The Dark Knight Rises” left 12 people dead and 58 others injured, according to reports.  After Holmes was arrested, police said they found that his apartment was booby trapped, and, though the breakdown of the charges was not clear, Holmes was also charged with one count of possessing explosives.

At the request of the defense, District Chief Judge William Sylvester barred video and still cameras from Monday’s hearing, saying expanded coverage could interfere with Holmes’ right to a fair trial.

However, here is an interview with Peter Banda of the Associated Press, who has more information on how Holmes comported himself:

Attorneys also were arguing over a defense motion to find out who leaked information to the news media about a package the 24-year-old Holmes allegedly sent to his psychiatrist at the University of Colorado Denver.

Authorities seized the package July 23, three days after the shooting, after finding it in the mailroom of the medical campus where Holmes studied. Several media outlets reported that it contained a notebook with descriptions of an attack, but Arapahoe County District Attorney Carol Chambers said in court papers that the parcel hadn’t been opened by the time the “inaccurate” news reports appeared.

Security was tight for Monday’s hearing. Armed officers were stationed on the roof of both buildings at the court complex, and law enforcement vehicles blocked entrances to the buildings.

Investigators said Holmes began stockpiling gear for his assault four months ago and bought his weapons in May and June, well before the shooting spree just after midnight during a showing of the Batman film “The Dark Knight Rises.”

Analysts said that means it‘s likely there’s only one main point of legal dispute between prosecutors and the defense.

“I don‘t think it’s too hard to predict the path of this proceeding,” said Craig Silverman, a former chief deputy district attorney in Denver. “This is not a whodunit. … The only possible defense is insanity.”

Under Colorado law, defendants are not legally liable for their acts if their minds are so “diseased” that they cannot distinguish between right and wrong. However, the law warns that “care should be taken not to confuse such mental disease or defect with moral obliquity, mental depravity, or passion growing out of anger, revenge, hatred, or other motives, and kindred evil conditions.”

Experts said there are two levels of insanity defenses.

Holmes’ public defenders could argue he is not mentally competent to stand trial, which is the argument by lawyers for Jared Loughner, who is accused of killing six people in 2011 in Tucson, Ariz., and wounding several others, including Rep. Gabrielle Giffords. Loughner, who has pleaded not guilty to 49 charges, has been diagnosed with schizophrenia and is undergoing treatment at a Missouri prison facility in a bid to make him mentally fit to stand trial.

If Holmes’ attorneys cannot convince the court that he is mentally incompetent, and he is convicted, they can try to stave off a possible death penalty by arguing he is mentally ill. Prosecutors will decide whether to seek the death penalty in the coming weeks.

Holmes was not expected to enter pleas on Monday.

He ultimately could verbally enter a plea to the anticipated dozen first-degree murder charges, or his attorneys could enter it for him. Prosecutors may file multiple counts of attempted first-degree murder and other charges against Holmes, who booby trapped his apartment with the intent to kill any officers responding there the night of the theater attack, Aurora police said.

Sam Kamin, a law professor at the University of Denver, said there is “pronounced” evidence that the attack was premeditated, which would seem to make an insanity defense difficult. “But,” he said, “the things that we don’t know are what this case is going to hinge on, and that’s his mental state.”

Friends in Southern California, where Holmes grew up, describe him as a smart, sometimes awkward youth fascinated by science. He came to Colorado’s competitive neuroscience doctoral program in June 2011. A year later, he dropped out shortly after taking his year-end exam.

Sylvester has tried to tightly control the flow of information about Holmes, placing a gag order on lawyers and law enforcement, sealing the court file and barring the university from releasing public records relating to Holmes’ year there. A consortium of media organizations, including The Associated Press, is challenging Sylvester’s sealing of the court file.

On Friday, court papers revealed that Holmes was seeing a psychiatrist at the university. But they did not say how long he was seeing Dr. Lynne Fenton and if it was for a mental illness or another problem.

The University of Colorado‘s website identified Fenton as the medical director of the school’s Student Mental Health Services. An online resume listed schizophrenia as one of her research interests and stated that she sees 10 to 15 graduate students a week for medication and psychotherapy, as well as five to 10 patients in her general practice as a psychiatrist.

Authorities said Holmes legally purchased four guns before the attack at Denver-area sporting goods stores – a semiautomatic rifle, a shotgun and two pistols. To buy the guns, Holmes had to pass background checks that can take as little as 20 minutes in Colorado.

One development over the weekend brought more grief. A woman who was critically wounded and whose 6-year-old daughter was killed suffered a miscarriage because of the trauma, her family said Saturday. Ashley Moser’s daughter, Veronica Moser-Sullivan, was the youngest person killed in the attack.

    If they don’t execute this murderer with a firing squad IN PUBLIC there is no justice done. Ammo is cheaper than the proposed liberal methods. It may deter future maniacs. And it will rid the land of evil.

    This idiot had no thought or concern for the lives or liberty of others. He lost his rights and our respect for his life and liberty when he took that of others. I pray to God justice is executed, and that we DON’T support this guy with food, shelter, water, and other services on our dime with our resources, his entire life.

      If he did do this than Yes! obviously he should be executed. I fear that they will execute him before the truth comes out that he was not alone, and in fact he might have been drugged up and planted there, while someone else killed the people? I don’t know, other than something smells about this investigation and the whole story.       I would like to pose a counter thesis:

      I think this was not a set-up, but a crime that is now being ruthlessly exploited by the Lefties.

      That nobody saw his face was not entirely disconcerting – he was wearing a helmet, a gas-mask, and the area of the shooting was under tear gas – seeing anything more than the muzzle flashes would have been difficult, provided you were actually looking in that direction. Not the first time a perp’s face has gone unseen.

      If this was a set-up, evidence of that would already have come to light – this one has a p1sspot of scrutiny on it.

      No, I think it was a grand mal crime, and the Left is simply using it to fuel anti-gun sentiments.

      You could be right but here are some things that bother me:
      There were eyewitness reports about a person in the theater that answered a cell phone and went out the fire exit, and did not return. It was the door the the shooter came in. Though that was reported the first day, I have not heard thing more about that. I have not heard anybody looking into that lead. If that is the case there was a second person involved.

      He wore a mask the entire time so no one in the theater saw his face?

      Where are the security camera footage?

      We have seen psychos do things like this before, as we saw at Virginia Tech, though this does not seam like the average nut job loosing it.

      We hear that he acts like the joker in prison and spits on the guards, which does sound like the character, and yes he does have the hair to look like him. But why was he waring full body armor including a mask so one one could see him?

      So he shoots up the theater, armed to the teeth including body armor, as though he is going to fight the world. Except he walks outside and police apprehend him without a fight?

      Why are not those officers made to heroes, as we NEVER see people like him caught alive?

      We see generic congratulations from the Sheriff to everyone involved?

      I would say it would be some out of the ordinary bravery from some individuals to accomplish that?

      Why don’t we get any details from how it happened?

      Why did he shoot like crazy in the theater, go outside and get apprehended and then admit that he booby trapped his apartment, with a bunch of bombs?

      But he did not bring any bombs to the theater?

      Why was his school and everybody he knows told not to speak to the media?

      Why did the sheriff within 10 hours of reporting on this say that “You should not believe everything you read on the internet..” ? That is a very odd thing to say after such a tragic event..

      In the same press conference as he gave out a a new phone number for tips… 2 things I found strange about that:
      1. Why have a new phone number?
      2. He said: “… the new number was is for those that want to call in new tips, if you want to…” That does not sound like someone that is getting ready for a full investigation, in fact it sounded like he would rather no one cal! I would expect him to say: “Please call with any information that you might have”…. but that is not the way he said it.

      He also was so thankful for Home Land securityWhy are they involved with a case starring the lone nut? Where these the same people involved with Fast’n Furious?

      Most of us can’t imagine that our government would be involved with this, where civilians die, but it would not be the first time, fast and furious has killed thousands…

      The other thing that does not add up. If you want to make a statement, and color your hair as the Joker and go and kill all these people, you would expect a video or something like the Virginia Tech. It sounded like he was a raving psycho “spitting on the police” etc.. But what do we see when he comes to court?

      We see a vegetable, that is strung out on drugs, that is barely there…. I would expect to see a statement or a nutty salute like the crazy guy from Norway who killed 70 people last year.

      I agree. Something isn’t right. I saw the whole hearing and he was on another planet, and not someone that is that calulated, and now pretending to be crazy.. .. I would not be surpriced if he dies soon from natural causes like Breitbart ! And that his apartment building will soon be demolished.

      I don’t know who in addition to the terrorist was involved in 9-11, but all I do know is that the towers did not collapse at free fall speed by a fire alone? And the countless witnesses that heard many explosions.
      Building 7, that was not near the towers collapsed, and it was reported on the news almost 10 minutes before it actually did? There are so many questions unanswered, and our government did not show any interest even trying to find the answers….
      Let me presume that you are a hard working honest patriot, that when you heard the left cry foul about 911 it made you turn your ears off. That is what happened, to me. But when I looked into it, and the data and evidence for both sides of the issue, I was very disturbed.

      In this day and age of security cameras being EVERYWHERE, it is interesting that there is ZERO FOOTAGE of James Holmes leaving the theater – there were TWO security cameras on the side of the building that Holmes was found on. There is not any footage of Holmes ENTERING THE THEATER as well. His red hair would be easy to spot on ANY security camera footage.

      ALSO Holmes was found LOCKED in his car, he APPEARED to be drugged or on drugs. AND ALL THE ‘BALLISTIC ARMOR’ was shed AROUND THE OUTSIDE OF THE CAR.       2nd photo shows the AR15 outside the rear door, not next to the car -

      The gas mask was found about a hundred yards further down towards the end of the theater building. As the police arrived within 90 seconds, that means Holmes would have exited the theater after shooting 70 people in 60 – 90 seconds, exited the theater, removed all the armor, but took the mask with him, dropped it 100 yards from the rest of the body armor, go back the 100 yards where the mask was found, get into his car and lock the door before passing out INSIDE his car.

      The cops had to BREAK A WINDOW of his car to get inside it with him passed out.

      People somehow think that we as Americans are immune to corruption! I guess they got the Kool Aid from public school and television?
      Truther is a badge of honor and bravery. Had the people that are “Truthers” today, lived in Germany they would have known about the concentration camps and would have seen the danger of Hitler in the 20′s, and done what they could to expose him, as many of the older generation did, it was the Kool Aid drinking youth that had been conditioned in school that fell for it first, and after Hitler through the brown shirts killed the opposition that more and more of the people not hearing the dissension, started to believe.
      I think that we are getting there, if people don’t wake up! and NO it will not stop with if we get rid of Obama! If you think so then you already drank the Kool Aid.

      Our government has been lying to us in many ways for years, and it appears that the majority thinks it is OK if the lies come from their side of the isle..

      Thanks for the great link. You would think that a news reporter would have this all over television? But it seems that the news reporters are agents for “the ministry of truth” or just part of the propaganda machine.

      The fact is that most that see your post will not click the link, and if they do, won’t read the page. Most have as a mission a supernatural ability not to see the obvious, that 2+2=4, unless they are told by media they trust i.e. Fox News, or CNN, or Glenn Beck, that it is so….

      Does any of you ever wish that you never looked into any of these matters? Sometimes I think I would be happier if I only watched some useless sports instead. I could memorize stats and worship a team.
      In other words be Fat Dumb & Happy! I got the Fat thing down, and Dumb one to if you ask the Becktarts here.. but it is hard to be happy when you see what has happened to my country, and wondering what life is going to be like in 10-20 years here?

      But then again exposing truth and waking people up has to be more rewarding than having a team of roided out idiots beat another one…

    I feel that America should adapt to punishments utilized in other countries! If you are caught stealing, chop off a hand. If you rape someone, have your genitals removed. Kill someone, and be killed. This will save time, money and stress of family members who have to live the ordeal again. Holmes should be taken to the prison yard, and shot by the victoms family!!!!!!!!

    but bear this in mind:

    Holmes will be charged for murder ALSO FOR UNBORN BABIES KILLED AS A RESULT OF HIS SHOOTING RAMPAGE (we know of one already).

    So, then, explain how abortion is legal ……………

    The media and the courts need to update this total to 13 dead, to include the baby in the Mother’s womb, that just died.

    He’s been charged with 24 counts of murder. Two counts for every murder victim. It should now be updated to 26.

      You do know that you can only execute him once right people? Oh, and I suppose in addition to the death sentence I guess they will give him to 1536 years in prison right and fine him 500,000,000 dollars. Pfttt….. let’s get some truth in sentencing already. They are going to spend 10 million dollars executing this clown. Yep, great justice sytem we have here. A fricking bullet costs a buck.

      Actually, wouldn’t it be interesting if when people commit multiple murders, they are executed once for each death they caused?

      I mean, suffocate or electrocute him until he dies, then have EMTs bring him back around, then do it again…

    How did he LEGALLY ATTAIN any guns if he was being seen by a Psyciatrist?

    He had to of lied to get the guns as there are 2 questions about ever being treated or diagnosed with a mental illness on the application to buy a firearm …. thank the ACLU for the state not knowing this information.

      Actually, it is if he/she had been adjudicated with a mental illness, i.e. judged by a court, etc.

      But it doesnt matter. Gun laws are bogus and are designed for only one thing, to keep guns out of the hands of law abiding citizens. IF he had not been able to get guns legally, he would easily have been able to obtain them illegally. It really isn’t that hard, criminals do it all the time.

      Obtaining guns is irrelavent. What you do with them IS. For anybody not using firearms legally, they should be punished. Don’t punish the 89,999,999 gun owners that DON’T do something horrific with a gun.

    Moronic fool is guilty and deserves severe punishment for the things he has done. That being said… I am a little confused by the charges as well…

    Charge him with 12 murders… WHEN he is found guilty, he will be behind bars for the rest of his existence… Typical life sentence on average is about 14 years… Which would net him 168 years (providing he doesn’t earn himself a seat at the Injection table).. So 12 counts, or 24 counts doesn’t really matter… But I AM curious how they ended up with 24 counts of Murder….

    Holmes extensive planning and attention to detail will undermine any insanity defense (the only possible defense) his lawyers may put forward – IF his team is wise, they will plead GUILTY and attempt to avoid what would be a very long, drawn out and very difficult trial which will undoubtedly end in a GUILTY verdict anyway – this would likely be Holmes’ only chance of avoiding the death penalty.

    Insane or not, this individual needs to be taken out of the public permanently. If he is truly insane and not responsible for his actions, then he cannot every be restored to the public and a death sentence is fitting and even humane. If he is not truly insane, then he cannot every be restored to the public and a death sentence is fitting.

    Well the miscarriage brings the death count to 13, right? May God bless the family….so sad.
    I read that Dr.Fenton doesn’t have a very good track record in the medical field, but before I post more I will get the facts, if that is possible from the media.This whole story of Holmes reaks of cover up for some reason. The timing is one thing odd and this guy’s looks went downhill in a short period of time…strange to me.

      If the number is correct, perhaps some victims were pregnant women/unborn children. We do know that one woman who was shot miscarried her unborn child as a result of her injuries – this would most certainly be added to the death toll.
