Jan Brewer’s Immigration Lawsuit Against Obama Administration Thrown Out

PHOENIX (AP) — A federal judge Friday dismissed Arizona Gov. Jan Brewer’s lawsuit that accused the Obama administration of failing to enforce immigration laws or maintain control of her state’s border with Mexico.

The dismissal by U.S. District Judge Susan Bolton comes in a counter-lawsuit filed by Brewer as part of the Justice Department‘s challenge to Arizona’s controversial immigration enforcement law.

The Republican governor was seeking a court order that would require the federal government to take extra steps, such as more border fencing, to protect Arizona until the border is controlled.

Bolton said Brewer’s claim that Washington has failed to protect Arizona from an “invasion” of illegal immigrants was a political question that isn’t appropriate for the court to decide.

The judge also barred some of Brewer‘s claims because the issues were dealt with in a 1994 case by Arizona and can’t be litigated again. Court precedent also requires the dismissal of some claims, Bolton wrote.

“While Arizona may disagree with the established enforcement priorities, Arizona’s allegations do not give rise to a claim that the counter-defendants (the federal government) have abdicated their statutory responsibilities,” Bolton wrote.

Brewer said in a written statement that she wasn‘t surprised by Bolton’s ruling.

“It is but the latest chapter in a story that Arizonans know all too well: The federal government ignores its constitutional and statutory duty to secure the border. Federal courts avert their eyes. American citizens pay the price,” Brewer said.

The Department of Justice issued a one-sentence statement saying it was pleased by Bolton’s decision.

The DOJ sued the state of Arizona last year in a bid to invalidate Arizona’s immigration enforcement law. Bolton put key parts of the law on hold, such as a provision requiring police, while enforcing other laws, to question a person’s immigration status if officers had “reasonable suspicion” the person was in the country illegally.

Brewer has asked the U.S. Supreme Court to hear her appeal of Bolton’s ruling.

Brewer’s attorneys had argued that her lawsuit was necessary to help bring relief to Arizona from the burdens of being a busy illegal entry point into the country.

The governor‘s lawsuit didn’t seek a lump-sum award, but rather asked for policy changes in the way the federal government reimburses states for the costs of jailing illegal immigrants who are convicted of state crimes. Such changes would have given the state more money.

Justice Department lawyers, who asked the judge to throw out the lawsuit, argued successfully that federal court isn’t the right place to consider the political questions raised by Brewer.

The judge also agreed with their contention that several claims by the governor should be thrown out because a court rejected similar legal claims in a 1994 case brought by Arizona, and an appeals court decision prohibits Brewer from moving forward with her case.

  The border can be closed. I will not support any Pres. candidate who does not have that as part of his platform, but the most troubling thing I saw in this article is a court decision making a law instead of a legislator. Either, why can courts do the job of legislators, or why do we need legislators?

The nation is being invaded from the south, we just saw the vid of the HS student refusing to do the mexican pledge of allegiance where the student stated her teacher said TX belongs to Mexico! There are other vids out there of people saying similar things, they are infiltrating to reclaim the southwest through sheer occupation. And every state including the federal govt is assisting them in doing it by offering tons of incentives for illegals to offering “press 1 for english”!!
  
  There is another larger concern in securing our southern border from terrorists. Where do they think the drug cartels who are killing ppl left and right are learning some of their tactics from?! Hamas and Hezbollah have been active in central America and have clearly worked their way into Mexico, you can be sure all those coming across the border are not all Mexican! Beck had and Iranian on a while back talking about how the Iranian revolutionary guard is coming through too!

  Any actions to build a fence, Imam, would be stopped by the Federal Gov as controlling immigration is part of their job description, not the states. It angers me, as I live in AZ. Citizens south of Tucson have their land trashed, they can’t protect themselves or stop the immigrants coming through their lands and if they try to with a firearm or weapon, they can be prosecuted. It‘s disgusting really and ****** me off to see so called ’republicans’ and conservatives not even trying to back Brewer. If our Fed Guv’t was REALLY concerned with terrorists getting into out country they would have manned the border with our army first before writing that massive invasion of rights known as the Patriot Act. If our Fed Guv’t was really concerned about the safety of its citizens they would have confirmed our sovereignty first (strengthen the borders) and made moves to ensure our rights were preserved.   It is a POLITICAL question? Bolton, you are full of crap. I am fed up with the justice system chewing up the American people and spitting them out and ignoring their duty to abide by the constitution. It was perfectly okay for the federal government to try to intimidate and bankrupt Arizona with a suit, but this it to be ignored. I am an Arizonan, and while many think it only affects border states, they are wrong. Along with them travelling to other states, terrorists use the drug cartels to slip through our borders. With Fast and Furious in place, no telling how many walked right in. Our government (and specifically Obama) do not care.

Maybe if they lived right next door to a single family home that had EIGHT family’s living in it making a mess of THEIR neighborhood they would be singing a different tune, or if they went to the emergency room and found it PACKED with illegals so that their kids broken arm had to wait 12 hours to be fixed and then knowing that the illegals will NEVER pay their hospital bill and the tax payers will get stuck with it and if it goes on too long the hospital will just SHUT it’s doors because they are losing to much money!!! Ya to all you liberals out there, YES Arizona was hoping Brewers law suite would made a difference but you can’t win when liberals have stacked to court system against you..   Irrespectove of what we may expect – THIS IS STILL a Nation of Laws. We must adhere and cannot reserve the right to enforce the Law at our discretion. They are legally bound and we MUST hold them to accounts.

  If federal law trumps state law;then how can states such as california have sanctuary cities where they openly say they will subvert federal law. Why doesn’t the federal government arrest these state legislatures or city council members under RICO laws? why can’t any policeman verify the legality of a suspect and arrest them if they are found to be illigal? All the crap coming out of the Courts is because the Liberal Democrats, many of whom have been in office for 30-40 years!, have stacked the courts for their political policies and ambitions and the Constitution and the People be damned!

This is one reason we have the right to keep and bear arms. If the Feds or the State cannot protect us, we will protect ourselves, even from the Feds or the State!

This ruling, as well as the DC Judge’s ruling throwing out a Congressional lawsuit against the President for violating the War Powers Act for “lack of standing” are clear proof that all three branches of government are now actively involved in removing the Constitution as the basis for our government’s authority.

They are all now engaged in turning our Union into a European-style government where there are NO established limits on the government, and where the party in power can literally do anything they want, so long as they are in the majority.

Now that’s a shocker. All I can say is ignore the ruling, impeach the judge and use the National Guard to defend your state. A ruling by a corrupt judge is not law………and that is the law.

  Impeaching a Federal judge is the same process as impeaching a President (except that the Chief Justice needs to preside at the impeachment of the President).

Considering Bolton is a Clinton appointee not surprised. But, this is clearly a constitutional issue not political. The federal government has a constitutional duty to protect the states. “Provide for the Common Defence in preamble and article 1 sec 8. As well as Article 4 sec 4 to protect against each state from invasion.

Nice to see we have federal judges abiding by the constitution.
