Joy Behar Wonders if ‘Constitution-Loving is Getting Out of Hand’

Joy Behar has a burning question: “Do you think this Constitution-loving is getting out of hand?”
That’s the question she posed to a panel of guests on her show Tuesday night, centered around the GOP’s plan to read the Constitution before the 112th Congress opens. Liberal talk show host Bill Press was more than willing to answer that it’s a “Hollywood” stunt and Republicans might actually benefit from such a reading since they have no idea what’s in it:
There‘s just one problem with Press’s answer (and critique): there isn’t an explicit “right to privacy” in the Constitution. Such a thing was created by justices in cases such as Griswold v. Connecticut and Lawrence v. Texas.
To be fair, Press is probably referring to the Fourth Amendment, which protects “[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.” Constitutional law scholars Robert P. George and David Tubbs admit in their law article that the Fourth Amendment does reference “true privacy rights.“ But an explicit ”right to privacy” as has been written into the Constitution via cases such as Griswold isn’t there. Instead, privacy in those cases “functioned as a euphemism for immunity from those public-morals laws deemed by the justices to reflect benighted moral views.”
In other words, “privacy” has been manipulated into an excuse to overturn laws the justices think are out of date, thus circumventing the democratic process.
But what do they know — they’re just a bunch of Constitution-lovers.

How is it, then, that government thugs are able to force us to choose between stripping us naked with cameras designed for the purpose, and submitting to an even more intrusive sexual assault, from which not even children are spared?
Republicans: show you are worth a damn and pass a law explicitly ending this atrocity, and do everything you can to make Napolitano’s life hell on Earth, and her reign as Commissar of Interal Security as short as possible.
Then force Obama to either authorize a release of his long form birth certificate–surely no one will argue that something the State mandates the REST of us provide to get drivers licenses and passports–or publicly refuse. If he chooses the latter route, I vote for charging him with Contempt of Congress.
Let’s make some things happen. We are living in Bizarro-World.

Your question of how did all this happen is broad enough to a knowledgable person to write a book on. It’s been a long slow erosion brought on by a lack of understanding of the Constitution by citizens, liberal interpretations of the Constitution by many courts, and tons of other factors.
This most recent example that you bring up with the TSA is a continuing part of the erosion. It is enabled most recently by the Patriot Act signed into law in the aftermath of 9/11. It is an horrendous piece of legislation that allows the government many outrageous powers. It, in effect, shreds the Constitution is many, many ways.
We, as citizens, should be especially cautious in any time of emergency. After 9/11 the same patriotic fervor that many felt, and brought us all closer also allowed for the passage of the Patriot Act. Originally, it was supposed to be passed with a “sunset” provision, meaning that it would automatically expire at some point. I think, but am not sure, that it was 10 years. But, like in so many other instances, it’s very easy to give away our liberties to the government, it’s damned near impossilble to get them back.

Posted on January 5, 2011 at 10:47amIt pains me to say this, but I believe Press is correct on this. The Congress voted, in effect, to fund the war. They never voted on a declaration of war because Bush never made a formal declaration of war. The same thing is true of Korea (Eisenhower), Viet Nam (Kennedy, Johnson and Nixon), Kuwait (Bush I), et al.
None of these wars were declared in the manner outlined in our Constitution, and as such, it can be argued that they were done in violation of it. The way it seems to go anymore in our country is something like, if you like the President then it’s okay for them to do what they want. If you don’t like the President then everything they do is wrong. That’s one reason why we need to get back to a Constitutional basis so there is a constant standard of comparison no matter what party is in control.

The Constitution says the Congress shall have to power to declare war. To me, and many others, the interpretation of that is that a formal declaration is required. There are many who disagree with that interpretation.

And then staying consistent with maddening contradictions that is liberalism, that is Obama, from FOX News, Obama made this statement yesterday after professing that Boehner and Republicans will at first play to their base: “But I‘m pretty confident that they’re going to recognize that our job is to govern and make sure that we are delivering jobs for the American people. My hope is that John Boehner and Mitch McConnell will realize that there will be plenty of time to campaign for 2012 in 2012.”
This comes from a man that has been campaigning since 2007 and has never stopped . . . He has never cared about “delivering on jobs” but is now claiming authority on these subjects to render opinion and direction.
Obama and Pelosi, and Reid . . . Democrats in general, they created the mess that we’re in back to 2006. We don’t forget about the role that GW played, that the old Republicans played. We won’t forget, nor will we allow others to forget because honesty and truthfulness is Mr. Boehner’s base, Mr. President. And that includes making sure that the image of Obama, of Democrats, is all that they deserve and not what they create through the manipulation of words and history, performances and rhetoric.
We will not forget where the proper blame is to be placed on all things, or allow the American people to be duped again. That would be Mr. Boehner playing to his base Mr. President . . . If he wants to play to his base he will see to it that all that he does from this day forward is done in aims of destroying your ability to function in your clandestine and damaging ways . . . and reverse the damage that you have already done.

Boehner may bring along his lobbyist pen-pals which would mean whatever the Corporate honchos want, they may get. As far as Joy and the like… If Obama wanted to do the same thing as Bush (when it comes to declaring war), would she support him? Probably. All Partisan. Thats what we’ve become. I was against the Patriot Act because it was only a matter of time till they brought out the body scanners. Replace one fraud with the next and keep the people pre-occupied with the “show” going on. In Opressive regimes, such as the Nazis in WW2, one of the major things they do to the oppressed is remove their clothing because it’s de-humanizing and it takes away the most private thing we have…our own bodies. Think about that next time you’re at the airport. Oh and if any of you have any liberal friends…tell them that saying “well, we have to for our freedoms” (meaning about the scanners) just because thats what Conservatives said about illegal wiretapping and the patriot act, isn‘t funny and this isn’t a game. have a nice day everyone :)
