Federal Judge Fines Longshore Union $250,000 for Labor Revolt Tactics

TACOMA, Wash. (The Blaze/AP) — A federal judge fined a Longshore union $250,000 on Friday for its tactics in a Longview labor dispute, and he warned that individual protesters could face their own penalties for future violations of his orders.

U.S. District Judge Ronald Leighton has already held the International Longshore and Warehouse Union in contempt for blocking a train and storming a grain terminal earlier this month. Authorities have said the protesters overpowered security guards, damaged railroad cars and dumped grain.

A member of the union also attacked a news crew covering the scene, grabbing their camera and telling them to “get the f*ck out of here now.”

“What’s going on out there is awful,” Leighton said. “We have to do something about it, and I’m going to do something.”

The National Labor Relations Board had asked the court to fine the union more than $290,000 to cover the damages and expenses, such as overtime for law enforcement agencies. Leighton said he rounded down to be cautious and ordered additional penalties for future violations, including $25,000 for the union, $5,000 for union officers and $2,500 for other individuals.

In a previous court hearing, Leighton likened the union members to “juvenile delinquent[s]” when he asked the union lawyers whether fines would make their clients behave.

“I fell like I’m asking the parents of a juvenile delinquent to predict their behavior,” he said according to Tacoma’s News Tribune.

He had argued that the union has the right to assess whether the proposed damages and expenses were proper, saying that he believes some of them were excessive and inflated.

“What the court engaged in here is back-of-the-napkin guestimates,” ILWU coast committeeman Leal Sundet said in a statement. “There was no attempt to distinguish events arguably connected with what the union is accused of doing on the 7th and 8th of September 2011 and those events that are unrelated to any alleged union conduct.”

The protesters in Longview have viewed themselves as being the latest front in the struggle for American jobs and benefits during the economic downturn. The dispute has continued to escalate, with protesters resorting to aggressive tactics, including attacking the news crew, that have been a rarity in recent labor disputes around the country.

Union protesters believe they have the right to work at a new grain terminal at the Port of Longview that is currently being staffed by workers from a different union, Oregon-based Operating Engineers Local 701.

Leighton is scheduled to address the larger dispute, focused on different interpretations of port contracts, in a hearing later Friday.

    Union bosses have no problem whipping up mob frenzy because no matter what the penalties are, the cost will be passed on to union members by raising dues. How about if you abhor compelled union membership, you are law abiding, and do not participate in these crimes? Why should I be penalized with increased dues because of these liberal progressive idiots? Unions are the tools of communist / socialist mafia thugs.

      The unions take their example from the federal government and Congress, Truth4Me. The Union bosses want all the accolades, but take money from the pockets of workers to achieve those accolades. The President and his lackeys constantly say the “federal govt” is doing this, and doing that. But the truth is, taxpayers’ money is being used by politicians to ingratiate themselves within the masses — most of whom do not understand that it is NOT the federal govt’s money. It is MY money taken without my concurrence by politicians who want the same accolades as union bosses. Let me tell you — if the current U.S. Supreme Court rules it is ok for the President to force me to purchase government-run health insurance, it is all over for this country. I guarantee you, bHo has a list a mile long of other things he intends to foist upon us as soon as his ilk on the Supreme Court give him this green light. And sadly, I suspect the unions will win on their appeal of U.S. District Judge Leighton’s ruling. Agenda 21 strategists have taken over so much of society, courts, politics, and government — it is probably too late to pull lose from their clutches.

Doing that might prevent other thugs from doing the same things they did. Peaceful demonstration should be all that is allowed and any violence should be dealt with in an equally forceful way.

      Did you notice the issue? The terminal is employing union labor, but from a different union, so this is union vs. union.

      I was wondering why the NLRB would have recommended any punishment against any union until I spotted that the protesting union is disrupting other union jobs.

    Think unions aren’t really violent?
    I worked for a subsidiary of Verizon doing high-speed in mid/high rise residential units in Philly. Now, we were UNION (IBEW). The local building a nice condo on the Delaware Riv. did not want us, ANOTHER UNION, to be in the building. One day, union workers heckled us when we were walking to the const. trailer to get keys for the area we were working in.
    When we got to the trailer, the union reps running the job balked when we asked for the keys. They looked suspiciously, after which the ‘top guy’ had someone call their hall. They asked me who we were, what we were doing, etc.
    Not backing down, I said we had a contract (just like them) with the owner. I also reminded the ‘hall official’ that we were not doing anything they did, or any type of work they even did. At that point, they gave the phone back to the young guy who had called the hall. He told the big boss that it would be ok to let us in.
    At that point, the boss-man looked at us and said “you two stay right here.” He then instructed the young guy (probably a steward) to go in the building and inform everyone that we would be in the building, doing our own work. I thought that was real nice of him to let us earn an income.
    We weren’t in the building 15 minutes when the elec service was cut so as to put a stop to all work on the site.
    Who are these people who think they can have work, and everyone else has no right to the same?
    This is routine in Philly.

      Another little ditty from my own union brothers in Philly.

      I worked for a subsidiary of Verizon which only installed/serviced high-speed internet services (not FiOS) in multi-dwelling properties.
      I was lead technician for our small group of 5 workers. We had little contact with Vz. techs other than occasionally running into each other while at the same property doing our separate work. We were in the same union and the same local.
      One day I had to go out on a job one of our techs had been to twice without being able to find the subs high-speed problem. I was to meet the Verizon ‘phone’ tech at the property.
      After meeting the tech and his foremen, we went to the location where the phone cable entered the building to determine if the trouble was ‘theirs’ or ‘ours’. When I asked the tech for the test # to remove dial tone from the line to listen for noise, he refused. I pointed to the Verizon logo on my shirt and said…”I work for Verizon.” This young, snotty-nose punk said…”not to me, you dont.”

      Wrong answer! Wrong guy!

      I went ballistic, telling him I had worked for Vz longer than both him and his boss.
      This kid denied knowing we were in his union. I said “we better damn-well be, or his union owed the dues paid out by 5 of us over the last 3-4 years. I also told him that I had been at the hall when our entrance to the union was negotiated. I got the ‘quiet-line # to listen to the line noise, btw.
      This kids attitude was common among towards us

      I worked on a unionized fishing vessel when we changed ports the new union rep said I had to give him $400 to keep my job I said my dues were up to date The Union rep then told me not to bitch because he only got $50 of that money.

Thankfully I live in Fl., a right to work state where that union crap will not fly. They are welcome here but they have no power to deny others, and actually have to compete with non-union workers. Needless to say they are a tiny minority.

      Is a police officer or a legally-armed citizen allowed to shoot a person attacking them with a baseball bat?

      I think that if the person with the baseball bat was charging at you waving the bat angrily at you, then you should be allowed to shoot them in fear for your life. You can probably double-tap them, but no more than that once they have ceased their attack. It would be good to check the self-defense laws about this, and to stay well away from these kinds of j erks.

      It looks like if they are attacking you with the baseball bat it could be considered that they are trying to cause you serious bodily harm or worse, and you could defend yourself with lethal force. It would probably be better to run or use karate in this case, or if it is one i diot with a bat and twenty police officers they should be able to subdue the poor mo ron with nonlethal force, and then he should go to jail for a while to take him off the streets.

    The law is the law. We are a nation of laws, no matter how organized or tough you are. Might does not make right. Criminal behavior is punishable. Punish the bastards.

    Justice is supposed to be blind…. Justice is not supposed to say ” Oh wait a minute here, I didn’t see the union label. No harm here. Everyone’s free to go.”

      Ya know what’s funny? I live very close to where the protests are taking place, I’ve seen more than 25 Police cars policing the area at a time, I’ve seen protesters by the truckload acting out, I know some of the Union goons personally. I also know how stupid they act, but the shocking part is, where I live the only place I can find any news about what’s really going on is either in Portland Oregon or the Blaze. There is almost nothing about this in the local news. If it is in the news, its very short and leans toward the protesters so much that people think they are unjustly being targeted by police and city government.
      The average person would tell you that they support these goons simply because they only get one side of the argument. When you tell the truth about what’s happening your shouted down and forced to either physically fight or back off and shut up.

    In a case argued in 1972 in the United States District Court for the Eastern District of Louisiana, (71-1193) came a case which went to the U.S. Supreme Court and became U.S. v. Enmons (410 US 396.) That case became the basis for most of the union violence happening today. The Supremes stated (paraphrasing) that if it furthered union interests, violence was okay. The exact point of law examined is specific, but the jist is as stated, so the unions, who already had a history of violence took the gloves off and they have been off ever since.

    Yahoos in Louisiana started by shooting transformers belonging to the Gulf States Energy folks, they then burned down a sub-station. Lots of folks were POed! I had family who suffered losses due to the power outage cause by the loss of the substation. They were not reimbursed for their losses by the perps. They had insurance, so their rates went up. UNIONS are still able to get away with MURDER, and have done that too. THEY ARE THUGS!

      I’m with you. It should have been either 2.5 million or even 25 million and the other fines for if they do it should be quadrupled as well

      It should be more like $250,000 for the union, $100,000 for the union officers and $20,000 for other individuals.

    I used to be a branch president of a union for a Federal agency. I won’t say which one, because I don’t want my car destroyed or my house burned. But that is the problem: The Unions represent the Unions, the Mob, the Democratic Party and the advancement of Socialism! They NEVER represent the honest, hardworking, dues-paying members. In Washington, where all this crap is going on (and where I live!), there is no recourse but to belong to the Union. We are NOT a “Right To Work State”. We are a CLOSED SHOP state. That is how the Democrats have been able to control the power in this state for decades, and how they will continue to. Queen Christine (Governor Gregoire) is an example of how Union money and Union control works. After several recounts, she beat the Republican challenger, Dino Rossi. Boss Tweed, of Tammany Hall, New York once said, “It’s not the vote that counts, but the count that counts! Keep counting until you win!”

    Until the stranglehold of corrupt Unions is broken, there will never be freedom or economic justice in this country, especially Washington State.

      So true, I was never so surprised to find that all government jobs in Washington State are union. You cannot get a job in the courts, law enforcement, cleaning the streets, or any other “public” job unless you join a union in Washington State. It is so corrupt that the State Patrol has a law that states that if the officer deems it to be unlawful it is unlawful regardless of the legalities of their actions. In other words you will be under arrest in Washington State if the State Patrol officer deems whatever you may or may not have done to be unlawful.

      This criminal organization (the local Longshoreman union) should be permanently decertified by the Labor Department and local jurisdiction, and any contract they had with the local businesses and port authority declared null-and-void. Furthermore, ALL the union’s assets should be frozen/seized, and its local and regional officers investigated under the federal RICO statues. Finally, ALL the individual union thugs who participated should be terminated/barred from future employment by the businesses and port authority, and individually prosecuted. And when ANY of these union criminals (rank and file members alike) are subsequently found guilty, they should be fined and incarcerated to the MAXIMUM extent of the law.

      This is what they do to break up organized crime/drug syndicates. Why should the criminals in this union be treated any differently ? Oh, that’s right… they’re “UNION” criminals who buy/support crooked Democrat politicians….. who control the reigns of “Justice” in most of our big cities, “Blue” states, and the White House.

    Just wonder if they will call their buddy Holder to defend them, it will probably go all the way to the Supreme Court and I’m sure nothing will happen. That’s what makes me sick, the local or state judges that try to do the right thing always get screwed in the end because ppl won’t take their ruling as the final answer.

They are not trained to do those jobs nor do they warrant the longshore pay. They were offered the jobs right up the point of hiring the operating engineers union. That wasn’t good enough. They insisted on longshore pay for the facility jobs and therefore lost out. Tthey feel entitled to the jobs and are throwing a fit because of it. They have filed a recall petition against the sheriff for arresting these “as they call it non-violent” mobsters. The cops tried to arrest the union boss the other day after he and about 400 protesters were holding up a train by blocking the tracks. They had to release him for safety concerns because the entire mob rushed the police when they tried to arrest him.

    It’s about time that the courts upheld the law with respect to union violence and destruction. My respect for the legal system may be returning, but it will take more than one insightful judge to sway me.

      Yes, but the problem is that there was no personal responsibilities for the individuals, just the union paying the bill. Jail time and personal fines from those involved. These “THUGS” have to be arrested and jailed for as long as the law will allow. They are nothing but a bunch of BULLIES.
