Judge Halts Eviction of Occupy Wall St. — Would Allow Protesters to Return With ‘Belongings’

A judge has issued a temporary restraining order against the eviction of Zuccotti Park in New York City and the new rules imposed after the protesters were kicked out, the New York Times reports. The move will apparently allow protesters to return to the park and resume the occupation. The Times published a copy of the ruling.

A hearing over the issue is set to take place at 11:30 am ET.

During a live press conference this morning, NYC Mayor Michael Bloomberg explained that the city will wait to receive the official ruling before re-opening the park. But he reiterated that he had always planned to do so.

However, he said that there will be some major changes — amendments that the Occupiers will certainly dislike. “In the future protesters and the general public will be welcome…but will not be allowed to use tents, sleeping bags…,” Bloomberg said.

But while the mayor claims that these rules will be instituted, the judge’s ruling says that no regulations that were instituted after the occupation began can be enforced. This would mean that the tents and tarps could very easily re-emerge. Clearly, there’s a disconnect.

A press release from the National Lawyers’ Guild reiterates that possessions will be allowed:

New York, NY: At around 6 AM on November 15, 2011, attorneys associated with the New York City Chapter of the National Lawyers Guild working as the Liberty Park Legal Working Group obtained a temporary restraining order against the City of New York, various City agencies, and Brookfield properties directing that occupiers be allowed back on the premises with their belongings.

Earlier, at approximately 1 AM, the NYPD began massing around Zuccotti Park “aka Liberty Park.” In the following hours reports surfaced that the NYPD entered the park with police in riot gear backed up by numerous police vehicles, including a bulldozer, evicting occupiers. In the process they destroyed property and arrested dozens of occupiers and protestors including NYC Councilmember Ydanis Rodriguez and District Leader Paul Newell.

In the coming hours, days and weeks the LPLWG will pursue all legal options to enable the occupiers to continue to exercise their first amendment rights to speech and assembly for speech. Attorney Yetta Kurland, one of the attorneys from the LPLWG, said, “This is a victory for everyone who believes in the First Amendment. We will continue to fight for everyone’s right to continue the occupation.” In response to the injunction, Daniel Alterman, also an attorney with the LPLWG, stated that, “This is a victory for all Americans, for the constitution and for the 99%.” Gideon Oliver, another attorney with the LPLWG reacted by saying, “The LPLWG has been fighting to ensure their right to free speech from day one of the occupation. The occupiers right to free speech is based in our most core legal principles and we will be here till the end to fight for those rights.”

NBCNewYork.com interprets the rules as being halted:

Hours later, a judge granted a temporary restraining order prohibiting the city from enforcing rules of the plaza that she said were published “after the occupation began.” Bloomberg said at a City Hall briefing that the city had planned to let people back into the park at 8 a.m. but decided to keep it closed while officials evaluated the order.

Still, there seems to be much confusion on what the order means. The Times reports that not even those cleaning out the park are sure, and even let some protesters into the newly-cleaned are before telling them they had to leave again:

The park was declared to be open and about a dozen of the protesters who had stayed in the area through the night and the early morning were ushered past metal barricades and into the newly pristine expanse.

Two people who entered the park by vaulting over a low wall were directed by police officers back over the wall, but they were permitted to enter from the sidewalk.

However, after people had been in the park for about 10 mins, security guards working for Brookfield Properties announced that everyone had to leave. Some inside the park said that the guards pointed to an electrical wire lying on the ground and announced that there was a “maintenance issue.”

During his address, the mayor also admitted that there have been threats to businesses, among other issues. ”It had developed into a situation which was preventing people from expressing their views,” he explained.

Bloomberg reported that there were “just under 200” arrests in and around Occupy Wall Street.

    You know, as much as I am repulsed by Bill Clinton and was outraged by his actions when he “occupied” the Oval Office, the incoming POTUS needs to take a page from his book and fire every single federal judge and replace them with constitutional adherents.
    I’m fed up with lefty commie lawyers giving every single progressive cause a pass and urinating on patriotic citizens while using the Constitution for toilet paper.

      I agree with you emotionally but, you really do not know the law. Whether we hate it or love it, they are entitled to to use their First Amendment rights because a park is a traditional public forum. In order for the gov’t to win they must meet strict scrutiny. The law or the gov’ts actions must be compelling narrowly tailored with no less restrictive alternative means. The gov’t may try to use safety and some of the law breaking as factors in their argument to meet the strict scrutiny requirements. Hopefully it works. The best way to cure bad speech is more good speech, not censorship. Don’t get me wrong, the majority of them are idiotic college kids that are upset with their choices (and adults) that don’t want to choose responsibility. These people have cost the taxpayers a ton of money in this charade.

      For better or worse, Federal judges are appointed for life. They can not be fired, only impeached. That is one of the reasons that the integrity of the people in Congress and the Presidency are so important.

      Let’s remember that when AG Gonzales was attacked by the two Jewish Senators, Schumer (D) and Specter (R), an attack that was carried forward by the Jewish owned New York Times, it successfully ended the AIPAC scandal case against the Jews, Rosen and Weissman. Gonzales did nothing illegal. It was a purely subjective attack levied at him in order to remove him. When he was replaced by the Jewish, Mukasey, the investigation did not proceed, and the Jewish, AIPAC and its betrayers of America walked.

      Did he fire judges? I thought it was just the AG’s. I’m not sure if POTUS can relieve judges once they are seated. I may be wrong but I believe they have to be impeached for misconduct before they are removed.

      Sorry but you don’t know the law.

      They are breaking a multitude of laws simply by “occupying” the park. You cannot simply set up a makeshift city wherever you like. There were no rules written after the occupation began, they just weren’t enforcing any of the ordinances that were already on the books. Bloomberg just finally decided to start enforcing the law because his approval ratings were sinking faster than the titanic.

      1. Clinton fired AGs, not federal judges. The POTUS replaces judges when they retire; he doesn’t fire nor impeach them. Bush did a similar thing in 2006.
      2. The judge in question is a state Supreme Court judge. Not a federal one.

      What right does this communist judge have to do ruling to let them back on private property when it is apparent that the owners of the property want them gone since the security guards for the company that owns it was making them leave.       Not sure if all replying to the post realize that the park is NOT on public land. There is no right to be on private property uninvited. Look at land encroachment laws. I’ve been wondering if the owner of the land is allowing this or if he has been run over like all the New Yorkers in the area. We need to be careful. We are at risk of becoming a land where few laws are enforced and anarchy reigns.

      Well said. It seems that people cannot distinguish between free speech and their own desire to shut up any opposition. The Constitution BARS the government from deploying any military against US Citizens. There’s a REASON for that.

      What does need to happen is that those who own property in the area need to have a course of action to deal with animals defecating in the streets and the like. The NYPD needs to start locking up those who aren’t following the law. The rest need to be allowed to spew their misguided communist agenda, as is their right.

    The park is privately owned by Brookfield Properties. If they want to clean up their property and return it to it’s intended use, as a public park accessible to everyone, then the judge is way out of bounds and should be overridden immediately.

If they were, those people would be in jail or concentration camps. “Nazis” would not allow this to be happening. But it has gone on long enough. Most of these so called protesters don’t even have a real cause. They just want to party like it was Woodstock. They are messy, slovenly, disrespectful, and immoral.Hightide is right, it is an occupation not a protest. These people don‘t have the courtesy or integrity to be respectful of the park’s property or that of the business around the area. These “protesters” only want to create mayhem. They are nothing like the Tea Party. I would not want my name to be associated with them. They are an embarrassment to this country!

      If it is a private lawn, then let the owners decide whether they want them there or not. I haven’t seen the owners of the park come out and say “Hey protestors, get off my lawn!”. If he did, then they still have to abide by the law, and the laws enforcing no camping and tents were enacted after the protest began.

      The Tea Party certainly created their own form of mayhem through civil disobedience by tossing that tea into the harbor… If the Tea Party (myself included) decided to camp out on the Capitol lawn, the Federal Reserve or the White House lawn until changes are made to this corrupt government, I would certainly support that..and I wouldn’t want any cowardly jackbooted Nazis trying to break up the protest in the middle of the night like the cowards that they are.

    PUBLIC SALES of merchandise (WITHOUT LICENSE OR TAX PAYMENTS)
    PUBLIC VIOLATION of payment for Park and protest PERMITS

      Good point here the thing to do is put several cops there 24/7 and arrest EVERY minor offense. Lock ‘em up and if they get out at the first hearing okay, but they have a record for the 2nd, 3rd etc offenses which will eventually lead to overloading the court system.

      How is it a constitutional “right” to “Occupy” private property. The very term occupy has implications of war. This judge had no right to issue such an injunction. An injunction should only be issued if 1) the case presented has merit 2)the non issuance of an injunction will cause irrevocable harm.

      Call the first street Precinct and express support for the eviction. The police have been suffering invective calls all night, and could use some support. Show them that the 99% are NOT these ragamuffins who only read(?) the NYT.

      The protesters do not have any recognizable right to stay in the park. They can peacefully assemble, then they have to leave. That’s all the Constitution guarantees. The city has the right to require permits to protect the health and safety of the public, including the requirement that such a large protest get permits in advance, which the Tea Party did in DC.

      yes the authorities do have the right to stop it. OWS has been removed en masse because their group is violating the park’s rules of use. Their group is also responsible for creating a public health & safety danger.

      OWS has by their own words, classified & defined themselves as an organization/group. Also they can be legally viewed as such because they have an orginization/group bank account and that account is funded by solicited donations. Also, as a group they have solicited, in writing & in person by a designated representative, donations of physical goods from private companies and invididuals. As a group, they have accepted those donations.
