Judge: McDonald’s Must Pay Employee for Weight Gain

SAO PAULO (AP) — A Brazilian court ruled this week that McDonald’s must pay a former franchise manager $17,500 because he gained 65 pounds (30 kilograms) while working there for a dozen years.
The 32-year-old man said he felt forced to sample the food each day to ensure quality standards remained high, because McDonald’s hired “mystery clients” to randomly visit restaurants and report on the food, service and cleanliness.
The man also said the company offered free lunches to employees, adding to his caloric intake while on the job. His identity was not released.
The ruling was signed Tuesday by Judge Joao Ghisleni Filho in Porto Alegre.
Ghisleni said McDonald’s could appeal the case, and the Brazilian headquarters of the chain said in an e-mailed statement Thursday it was weighing its legal options.
McDonald’s also noted that it offers healthier food choices.
“The chain offers a large variety of options and balanced menus to cater (to) the daily dietary needs of its employees,” the company said in the statement.
McDonald’s headquarters is in Oak Brook, Illinois.

I wonder if we can sue clothing stores for making us wear cloths or TV stations for making us fat while watching TV or Mc D for causing us to spill hot coffee on ourselves while driving over a speed bum (oh yeah…they already paid for that one..5 mil?…)

Sounds more like the employee was a glutton and took advantage of the free food above and beyond a normal caloric intake needed for his size and build. McDonalds should ask for payment for the over gorging.

Let me start this by saying… I know millions of people eat McDonalds food everyday in this country, and most of the people actually like the food. My comment to follow is NOT meant to be a slam against anyone that wants to eat there. Personally, I don’t care if you eat at McDonalds 3 times a day, 7 days a week, this still is a free country and people can eat what they want.
With all that said… I think their food tastes absolutely dreadful! There, I said it and feel better for it. Man, talking about food sure has got me hungry.

Forthcoming: French Fry tax, Hamburger tax, already have “soda tax” in addition to regular sales tax in Colorado and other parts of the country), milkshake fat tax, etc. ad nauseum.
Didn’t the feds recently ban potatos totally from schools and WIC approved purchases or something like that?
That’s what you can expect when you allow the government to usurp authority and charge taxes or fees on anything they wish.
Income taxes are PROGRESSIVE and were unconstitutional until a past PROGRESSIVE Administration much like Obamao’s forced it through and, like Social Security and every other PROGRESSIVE legislation, lied to the American people about how it would work, how much it would costs, how they would pay for it ad infinitum.
They got the camel’s head under the tent with the cigarette and alcohol taxes which so many Americans thought were just the greatest thing since sliced bread. Then, eventually, and within the last few years have PROGRESSED the legislation to where they now ban smoking EVEN ON PRIVATE PROPERTY AND in many cases (e.g. Government subsidized housing, etc.) people’s OWN HOMES!! It‘s GREAT AIN’T IT? How much more of this crap do you folks want?

I wouldn’t have been surprised if that court decision had happened here in the US, but I wasn’t aware that Brazil was a frivilous lawsuit country as well. If it had been some hot Brazillian babe who gained a bunch of weight and they showed the court a picture of her before & after pics in a Brazilian thong I’d say it was a slam dunk case, but this guy? Common!

See, the average Joe who is “paying” into the “FREE” system with their taxes, will be unfairly charged. Why should they pay for my unhealthy choice? So, I will be charged extra according to my weight. Now it will start off with only the “Reallllllly” fat folk. Then it will trickle down to the folk that are 50 lbs over, then 25lbs. Then they will say that a 6 ft. 5 in. man should weigh 185 lbs. We are not on a slippery slope anymore,…we are sliding down the ramp now.

OH, and emotional and behavioral problems from them feeding me ice cream with excessive sugar after I walked in on my own free will and ordered it. Because of the sugar high THEY put me on, I’m not responsible for my actions when I beat my wife and kids.
With a little luck and a good lawyer, I should be living on the settlement money and sunbathing on a beach sipping drinks with a little umbrella within a year. At which time I can start planning my lawsuit aimed at the bar that has the audacity to serve me those drinks I’ll be ordering. Because of them getting me drunk, I won’t be responsible for running down those pedestrians. They will owe me and the families of those pedestrians big time……… I’ve got it made!!

I don’t know about Brazilian law, but I doubt a private business can fine someone for gaining weight unless he‘s got a contract and that’s stated explicitly in the contract. Sounds more to me that they’re telling to reimburse him for all the food he ate (the “flavor testing” thing) and the free food he gave to employees. This story is as fishy as a McDonald’s fish fillet. Too ridiculous, too simpleminded too absurd to take at face value.
Of course, it could be yet another example of Michelle Obama’s desire to establish a world government and a liberal attempt to DESTROY FREEDOM and force us to eat the “healthy alternatives at McDonalds!!!!
