On Tuesday’s edition of “Fox and Friends,“ Judge Andrew Napolitano broke down what legally constitutes an ”act of domestic terrorism” and argued that the Ft. Hood shooting in 2009 should have been labeled as such — but not the recent Sikh temple shooting.

“The legal definition of terrorism is two or more acts of violence, intended to change the policy of the government by scaring the population or by scaring the government,” the Judge explained.

However, when asked whether that definition applied to the Sikh temple shooting in Wisconsin on Sunday, Napolitano said “it does not appear to” fit the legal definition.

Napolitano said the shooter, Wade Michael Page, 48, was “a disgruntled nut job who hated Muslims — didn’t know the difference between Sikhs and Muslims — and thought by killing the Sikhs, he was somehow going to eliminate the Muslim population. It’s an absurd, tortured way of thinking, but it is not domestic terrorism.”

Napolitano clarified his remarks further.

“On the other hand, the Ft. Hood shooter, who killed the military in the place where they work while damning and condemning the behavior of the government. The employer of the people he killed, the government, refuses to call that an act of domestic terrorism,” he added.

“While hailing Allah,” co-host Brian Kilmeade said. “And that’s been verified.”

Napolitano replied, “If that is not a case of terrorism, then nothing is a case of terrorism.”

The federal government ultimately determined the Ft. Hood shooting was an act of “workplace violence”even though the shooter, Nidal Hasan, had documented ties to radical Islam and exchanged emails with Islamic cleric Anwar al-Awlaki.

“I think what’s playing here is politics. I think there is a political ramification to calling something terrorism. It scares people, we look at it more closely. But if you call something ‘work place violence,’ as horrific as it is, it doesn’t scare us as much as it does with the word terrorism.”

    Go Judge…. You hit the nail square on the head….

    The guy from Wisconsin, was a moron, and filled with nothing but hate…

    Personally, I don’t think he cared that the temple was Sikh and not a mosque… He was a white supremacist.. The people he killed were not white, and I think thats all he cared about… His mission was complete…

    What happened there was horrible, and a lose that should be felt across our once great nation… But it was NOT terrorism… it was MURDER…

    Ft. Hood WAS TERRORISM… Wisconsin, was just a horrible, bloody shame…

    My sympathies go out to the families in Wisconsin.

    Glenn should hire the Judge for his own show on GBTV. That I can guarantee would get viewers.

    Judge Andrew Napolitano would bring his own audiences/fans to Beck’s network and make it better for it.

    The is great at articulating common sense and our constitution. He was always great when he guest hosted for Glenn Beck’s show on Fox.

      The Judge has the balls to say it like it is. “Workplace violence”? “Domestic terrorism”?

      This was my first reaction as well and the Judge spelled it out.

      Judge Napolitano, we miss you brother, and you’d really like Texas!

    I am truly concerned that A large segment of America thinks that Sikhs are the Taliban. This being based on the similar Head Gear.
    They are not the same in any way !
    I was shocked to see Americans asked the question on July 4th ” who did they get their independence From?”
    They did not know ! OMG ! stupid is what stupid does
    Going forward the Educational system has to be busted apart and rebuilt !

    While I hate the term hate crime, (cause most crimes stem from hate typically.) the Sikh temple shooting fits that definition. Whereas the Fort Hood shooting is clearly domestic terrorism, no question about it. The government and the media got it backwards as usual.

    Terrorism – (noun) the use of violence and threats to intimidate or coerce, especially for political purposes.

    Both incidents were act of terror, one committed by an Islamic extremist who wanted to instill fear into the hearts of the “infidel”, and the other committed by a skinhead who wanted to instill fear into the hearts of the “inferior”. The fact that there were far less casualties in the temple shooting is irrelevant, and there would have been as many if not more than the fort hood shooting if it were not for Lt. Murphy.

      If not for Lt Murphy? You sure about that? I think you are probably right. But during the Gabby Gifford shooting an unarmed grandma was the 1st one to stop Loughner as he was reloading.

      That cop saved a lot of lives. He was shot and asked other cops to go past him. The Sikhs certainly seem to think so. A group of Sikhs out of NY donated $10,000 to him.

    Gotta love the Judge, his show was the Best fox has ever aired. Now they hardly let him go on longer than three minutes for fear he may say something that contradicts Romneys idiotic talking points.

    Paul would have made him a Supreme Court Justice, to bad… Now we are stuck with what ever progressive Romney or Obama picks to eradicate the Constitution, we deserve whats coming.

      Fort Hood shooter was a whity, but the difference is that he was also a religious minority, so he got protectiony. Both were acts of terrorism, committed by radical extremists, one in the name of allah and the other in the name of destroying melanin.

      Both incidents are clearly domestic terrorism; they were intended to cause large amounts of fear and death in a specific group of people for political/religous purposes. I find myself aggreing with you Judge Napolitano, on many occassions, but not this time.

      Maybe they should start calling flash mobs domestic terrorism as they are inspiring terror on the domestic population. We should also call the EPA domestic terrorist as well as the are terrorizing innocent domestic civilian from building homes everyday. The ATF are certainly domestic terrorist as the terrorize Constitutionally protecting citizens and have caused severalk death in their terrorist actions.
