Judge Napolitano’s Open Letter to John Boehner: A Common Sense Guide to What Needs to Be Done

In an impassioned plea to Speaker John Boehner, Judge Andrew Napolitano outlines what needs to be done to help resolve the fiscal crisis faced by America.

For those unfamialir with Napolitano, he  is a former New Jersey Superior Court Judge and is now a political and legal analyst for Fox News Channel. He started on the channel in 1998, and currently serves as the network’s senior judicial analyst, commenting on legal news and trials.

Opponents to raising the debt ceiling will find it to be a pretty stirring video.


Here is the full transcript of the letter:

“Dear Mr. Speaker,

When the Founders at the Constitution Conventional in 1787 created the House of Representatives, it was fashioned to act as the voice of the people within the institutional checks and balances of the Federal Government.  That’s why the entire House faces reelection every 2 years.  That’s why Constitutionally, you don’t have to even be a member of Congress to serve as speaker. And that’s why the Constitution allows for thousands of members of the House for our current population.  It is the people’s house, and the people spoke last November.  They cried out against a government completely out of control.  After President Bush grew the U.S. debt by $7 trillion dollars in 8 years in office, and President Obama added $4 Trillion in just 2 years in office, the people cried out against big-government policies that are sabotaging the economy and taking over our lives.  And because they cried out, you are no longer just John Boehner from Ohio.  You are now the second in line to succeed to the presidency.  You are the Speaker of the House of Representatives.

Mr. Speaker, the House of Representatives has just 8 working days left before the August 2nd debt ceiling deadline, and by wide margins in whatever way the question is asked, Americans do not want to see the debt ceiling raised.  They’re sick and tired of paying interest on borrowed money; money borrowed in their name.  The Federal Government borrows so much money from so many sources, Mr. Speaker, that no-one knows for sure just how much it owes to its lenders.  It already appears that it has exceeded the legal limit set by the congress at $14.294 trillion, and they actually at this moment in time are closer to $14.5 trillion.  The White House is putting intense pressure on you and on Congress to raise that limit.  The President’s apologists have even suggested invoking the 14th amendment to bypass the will of Congress and borrow money without legal authority.  Given the way the White House has run roughshod over your House in the matter of the “not-war“ in Libya that our military is still ”not” engaged in, the word of the President’s lawyers that there is no presidential power in the 14th amendment to borrow money on his own can hardly be trusted.  This is a president who does not regard the Constitution as a limit on the exercise of governmental power.  But the President can only get away with violating the Constitution, Mr. Speaker, if you let him do so.

If you stand up for the will of the people, you will restrain him.  This is the moment of truth for the Congress, Mr. Speaker.  The scare-mongers and the chicken-littles in DC will tell you that the sky will come tumbling down if the debt ceiling isn’t raised, even though your colleagues, Senator Pat Toomey and Rep. Tom McClintock, have introduced legislation that would prevent the United States from defaulting on its debt obligations.

I have two words for you, Mr. Speaker.  Stop it.  That’s right, just stop it.  For too long our government has spent beyond its means and in our names, sinking us and generations as yet unborn into deeper and deeper debt.  And you, Mr. Speaker, can stop it.  The President stands with the big-business, big-banks, big-government complex, and against the American people.  He’s even prepared to defy the laws of economics.  But the American people are not ignorant as he thinks they are, and you know that.

Mr. Speaker, you have the opportunity to do something that no standard bearer of small government has ever been able to do in our modern era; get the government to live within its means.  You can do it by standing firm with your colleagues in the Congress who are leading the call for change.  You can stop it.  You can force the Federal Government to make the difficult decisions to bring itself within its means and begin to loosen the chains of debt that have been foisted on our country by a centuries worth of progressive big-government architects.  End it this summer, Mr. Speaker.  Stop it.  Tell the President, “not a penny more.”  Stand up for the American people, bring government within its means, and begin the restoration of our republic.

If you do this Mr. Speaker, if you restrain the federal beast, you will become one of history’s great champions and heroes of freedom.  If you don’t, we‘ll all go through this again the next time a president wants to spend beyond the government’s means and chain us all down to more debt.

Mr. Speaker, don’t let us down.

    Dumb letter, from a guy that called Pres Harry Truman a war criminal for ending WWII with a nuke rather than allowing more than million American serviceman to be killed. the Judge is also a supporter of Ron Paul who in an actual vote in Congress could not get himself to vote against supporting the mass murderers of Hamas. the Judge is an ass and his legal reasoning and understanding of the Constitution is usually rather silly. All Boehner needs to do is to show some leadership instead of acting like the presidents fan club, pass a small funding bill to cover the debt ceiling for 6 months with enough budget cuts and then send it to dingy Harry and the pres

      I don’t agree with the Judge all the time. WWII Issue was one of them. Many social issues have me on a different side of the fence also. But on this I do agree with the Judge. His Libertarian/Constitutional leanings insofar with the debt are a bullseye In My Humble Opinion.

      HUCKLEBERRY, trolls are clueless; afterall, most have had government education – hence, no real understanding of the Constitution, Civics, or American History. They only speak to their agenda and never go outside the box they have been put in (sort of like Obama and his teleprompter), and never take a breath to hear and digest what the other side has to say. They are probably not married and have no children so they have no vested interest in the future, even though they will be directly affected in the long run. They have yet to figure out they are being used, but that will become abundantly clear when they are cast aside and those of us remaining will be the ones to help them up. Pity and pray for the people being paid to help destroy the country that gave them the right to write on The Blaze.

ENOUGH is truly ENOUGH…We are NOT undertaxed, nor does the Fed underspend…To the contrary, WE THE PEOPLE are OVERTAXED and the Fed OVERSPENDS!       I’m currently reading the book, “The Good War: an Oral History of World War Two” by Studs Terkel. Suggest that people read it. Folks on here that think this type of graft, corruption, posturing etc is only limited to obama, Bush, Carter et al., will be shocked at just what was going on back in the 30‘s and 40’s. Obviously it is way past time to make a stand and now is that time. But it will take generations to get it fixed as it has taken generations to get us here today.

      The house should pass a bill that says the U.S. shall upon a debt ceiling not being passed, first pay off Debtors, Soc Sec. Payments, medicare, Military payments first, then make cuts in other programs until the budget is balanced. Then let the Senate vote it down or obama veto it. Put the monkey on the democrats back.

      Hey Gag, if your so smart then how come you don’t know that Obama has already rejected your short term fix? He said he would not sign on to a short term “fix” or “kick the can down the road”. And Obama is also rejecting any meaningful spending cuts.

      The Judge is a Libertarian and a big supporter of Ron Paul as our next President. I trust the Judge. I believe he is a very wise man, steadfastly supportive of our Constitution and our freedoms. For this reason and because, above all else, I greatly value my freedom, I will also be voting for Ron Paul in the primary.

      Are you really as dumb as your post suggests? There is no such thing as a small funding bill to resolve a temporary condition. Congress has proved time and time again they will spend everything in the coffers and ask for more in a heartbeat. There is no honor among the whole damn bunch. Cut it off, here and now. Boehner can be a hero or be another schmuck like Reid and Pelosi. It is time to become real in dealing with the nuts we have elected to office.       Geigergag, I couldn’t disagree with you more! The Judge is a constitutional purist, pure and simple. He has more constitutional knowledge, and more knowledge regarding the original intent of the Founding Fathers than the vast majority of college history professors, and certainly more than 80%+ of the American people. As far as your comment about his legal reasoning being “silly”, that is such an absurd statement it doesn’t even deserve discussion! And your comment about the Judge‘s opinion of Harry Truman’s use of the atomic bomb on Hiroshima and Nagasaki fails to even mention that the Judge’s complaint had to deal with unleashing the bomb on non-combatants in cities that were not legitimate military targets, which is no different than Hitler’s bombings of London, Coventry, and others for the purpose of terrorism.

      The Judge is a supporter of Ron Paul because Dr. Paul is also a constitutional purist and a believer in original intent who has been known for many years as a most ardent supporter of the Constitution and the original purposes cited by our Founders for establishing this Republic. I listen to the Judge every opportunity I have to do so, and the Judge does not show any more or less deference to Dr. Paul than he does to other constitutional conservatives, and his knowledge of the founding of the Republic, the Constitution, and “original intent” is unimpeachable.

      His letter to Speaker Boehner is right on target, and the Speaker would be wise to heed

I have found that any of his citations of the Constitution that I have heard him state are accurate. Please prove him wrong by citing your answer in the Constitution. As for your suggestion that Boehner simply “kick the can down the road” by passing a temp. solution bill – the alleged president has already said – on TV – that he will not do this.

The judge is correct – not one more penny, nickle, dime, quarter or dollar above what you take in.       Not to mention they are lying to us about how many are here! Hell, when Reagan had the first Amnesty there were between 10-20 million “reported” illegals here that was around 30 years ago with 1-3 thousand a day coming in, simple math says there should be 40-50 MILLION of them here now. I think that the old number was very low, I think the real number today is much higher than reported. Hell yes that is a lot of money on social services that is wasted. We have thousands wanting to come here from the UK, but they have to wait upwards of 10 years all an Illegal has to do is sneak in and wait for the routine amnesty. We have had at least 2 now, NO MORE! NO Third Chance for profiting off of breaking the law.

      Surely everybody knows that the society security funds pays foer just about EVERY thing….Handouts. That is why Bushe’s plan was right….anyone under 30 or any new member to the work force should have the choice of having SS payments deducted from his/her pay or to keep it and invest it or simple put in a savings account. I have always paid in at least a couple of hundred $ every month to SS for over 30 years. That would be quite a nest egg(over 600K) if I could have invested that or could have kept that money each month. But to have it “stolen” from my earnings andwas not put aside for me or for future SS receipients but was/is used to pay for all these welfare programs and the coffers are running LOW!

    YES, contact the leadership and your rep daily. First, why are they negotiating with dems for a bill, they only need to negotiate within the gop to pass one? Then dump it in the senates lap, clean bill, no ammendments, no sending it back. Then it is the senate’s fault, as much as they might complain Ried will have to bring it to the floor. Second, why do they persist with this insistance that we will default, or they won’t pay ss checks unless the debt limit is raised? There are a whole slew of other options to economize, we know it, they know it. I/we do not like this insistance on raising the debt limit, even if the game is to offset it with “cuts”.
