Judge Okays Use of Drones Against US Citizen Over…Stolen Cows

The concept of using unmanned military drones to shoot or otherwise harm American citizens has always been a controversial concept. Some aggressive national security hawks portray the program as a necessary evil in the age of terror, whereas other, more civil libertarian-minded people, argue that the usage of military technology against citizens is alarming at best, and possibly unconstitutional in places. “Where will it end?” This latter group often wonders. “Next thing you know they’ll be using drones to get back stolen cows!”

Oh, wait. They have.

In a court case that is sure to make you lose at least some percentage of your faith in humanity, a District Judge in North Dakota has okayed the usage of drones during a 16-hour standoff between police and one Rodney Bossart of Grand Forks, North Dakota. And yes, the standoff was over a group of cows. US News and World Report explains:

Court records state that last June, six cows wandered onto Brossart’s 3,000 acre farm, about 60 miles west of Grand Forks. Brossart allegedly refused to return the cows, which led to a long, armed standoff with the Grand Forks police department. At some point during the standoff, Homeland Security, through an agreement with local police, offered up the use of an unmanned predator drone, which “was used for surveillance,” according to the court documents.

Grand Forks SWAT team chief Bill Macki said in an interview that the drone was used to ensure Brossart and his family members, who were also charged, didn’t leave the farm and were unarmed during the arresting raid.

Brossart faces felony terrorizing and theft of property charges and a misdemeanor criminal mischief charge. Although his charges weren’t dismissed, Brossart won a motion to move the trial from Nelson County—which has a population of 3,100—to nearby Grand Forks County.

For this, the state of North Dakota apparently felt a drone was needed. So they brought it in. And, unsurprisingly, Brossart cried foul in Court over the usage of the device, claiming it was used without a warrant.

…And surprisingly, the Judge threw it out:

District Judge Joel Medd wrote that “there was no improper use of an unmanned aerial vehicle” and that the drone “appears to have had no bearing on these charges being contested here,” according to the documents.

The Judge’s point may or may not be well-taken regarding the issue of the charges, but it doesn’t change the fact that no guidelines have been issued for the usage of drones by the Federal Aviation Authority. Thus, these military-grade weapons can be used for practically anything.

      Ahhh, here’s the scoop:

      “The six adult Brossarts allegedly belonged to the Sovereign Citizen Movement, an antigovernment group that the FBI considers extremist and violent. The family had repeated run-ins with local police, including the arrest of two family members earlier that day arising from their clash with a deputy over the cattle.” ……”A search of the property turned up four rifles, two shotguns, assorted bows and arrows and a samurai sword, according to court records. Police also found the six missing cows, valued at $6,000.”

      Not much of an arsenal for six adults on 3,000 acres? I am sure there is plenty to hunt on that property, but I am smelling somethin “fishy”. Probably couldn’t discover the under ground bunker somewhere on the property. What did the government do: release the 6 cows probably w/tracking devices on the far away pasture, just to confront and search these people? Perhaps, their neighbor who owns the cattle refuses to fix the fence….the cows were consuming the families resources, grass, food (soybean crop?), and water; down right trespassing. Yep, they had to arrest these people to search w/o witnesses.

      How effective in reducing the peoples already present paranoia?

      High 5 sheriff and drone masters for creating some more potential wackos.

      The second site above actually tells what the problem has been; members of this group are refusing to submit or recognizing the rules or taxes, when arrested for traffic, they sue and create nusiance and bankruptcy lawsuits. And some have acted violently..most famous: OK bomber.

      Ahh, a tough one to call, seems I disagree with both groups behavior. We might as well get use to it; surviellence, including drones are here and will be staying to be used against all whom are considered a threat:

    Almost exactly 70 years ago, the Supreme Court greatly expanded government’s power over the people via the commerce clause by ruling the government could legally limit the amount of wheat people could grow, even if it was only for personal use and thus never entered interstate commerce. Presumably, since the wheat never entered commerce, it could not be regulated by the government, but the government argued that it would affect prices of wheat by preventing Roscoe Fillburn from buying wheat. If he grew his own wheat, he didn’t have to buy wheat, and if he didn’t buy wheat, wheat prices would be affected, and that is the argument government used to swoop in and confiscate his wheat. It’s common sense that such confiscation is unreasonable, but the government convinced the Supreme Court that they have a legal right, and so they did confiscate the wheat.

    Since then, the Commerce Clause of the Constitution has been used for every government overreach of the past 70 years, including Obamacare.

    This guy needs to take his case to the Supreme Court. It remains to be seen how the Court will rule, but seeing how the PATRIOT Act is still allowed to stand, and with two government sympathizers on the bench, the Court more than likely will side with the government. Maybe in 70 years we will look back on this decision and see the turning point in government overreach, turning us from a free people into a surveillance state, over cows, just a silly matter as wheat.

I just hope our President when this happens, truly believes in the Constitution, Rule of Law and individual liberties. Someone who will not back down to the U.N. when they call for a New World Economic Order. There is only one candidate, right now, I know of, that fits that description.

    No one at this point can be surprised that a judge is ruling in favor of his fellow government employee’s!!!
    Courts are all corrupt, the judges, the prosecution and the police all lie! All attorney’s lie, that includes the attorney you hire to defend you against the machine.. Even a defense attorney’s first duty is to the court for he is an officer of the court and is dependent upon the judge and the system for his livelihood. If he were to actually do his job, he would find himself on the losing end of a disbarment. So they go along to get along.
    I’d scream jury nullification but judges have recently been throwing out jury verdicts in favor of the state, which is also unconstitutional!
    So to sum it up, we are so screwed it’s not even remotely funny!

      It may be Obama’s strategy but it is our fellow Americans that are flying them, servicing them, buying them, building them, etc. Those that work and live among us. You want to stop Barry then start challenging these people to debates as fellow citizens. Hold them accountable. You can’t go to our churches and our grocery stores and smile at us in the checkout lines and send your kids to play at our houses and then go to work the next morning and do this to us. It’s time to stop pretending everything is ok. If we are too wimpish to have a conversation with these people then we’ve already lost.

      And by the way, when the POTUS ordered that a drone fire a missle and kill a US citizen without a warrant, a trial a conviction or anything appoaching our court system (whether he’s a terrorist or not) he essentially murdered an American. Not only that, the drone pilot and the dude who pushed the fire button murdered an American. These people go to your family reunion or work out at your gym. We have a system for a reason. I’m sure this guy was a “bad guy” but the process is the only thing that stops an arbitrary label being placed on people who challenge the state. What do you have to say in the future to end up on the kill list? We’ve crossed a serious line and unless we tackle this at a grass roots level we are all in serious trouble. Continued….

    So there are a few police who patrol this board. So what ate you going to do here? This “authorizes” the use of drones on Americans. It’s all “legal” now. You going to follow orders? Prolly so right? I mean that pension still looks pretty good right? The 4th amendment is overrated and now this is all legal right? Sooner or later y’all are gonna have to pick a side. You go on and keep doing the bidding of those that steal from the mouths of our children and think that we aren’t watching. I will tell you what though…sooner or later you will be looking into the eyes of “we the people”. It won’t be good.

    As for the rest of us, stop with “the regime” or “the government” or “them” or “they”. They are real people. “They” live among us. Don’t let them hide. “They” have names. Someone lives next door to a drone pilot cop. Someone lives next door to a union thug. Someone lives next to a govt bureaucrat. What do you say to them? “hi how are you doing”?       Barry isn’t flying the drone. Someone’s neighbor is. Someone’s neighbor bought it and services it. This judge is someone’s neighbor. Barry can’t do crap without these people to do his bidding. These people are us. The are right next to us. We can fix this by demanding answers and accountability from the people who are actually doing it. “Barry” is a convienent excuse to do nothing and bend over and accept it.

    As long as the Police had a warrant for this mans arrest at his property I really don’t see a problem here. Whether it was borrowed or owned by the Police Dept. is mere symantics. I’m not saying we should not keep tabs on how, where or why the drones are used, I am just saying that the original warrant should be sufficient.

      Warrants need to be specific. A judge signs a warrant testifying that there is enough “probable cause” to suspect a “specific” crime has been committed. The purpose of the fourth amendment is to prevent the government (police) from just entering your home and searching for something illegal.

      So I gather you are saying that its legal and you wouldn’t mind if a drone flew over your house and was able to view through your windows and even through your roof and see you and your wife in bed. What’s the big deal??? It is for your own safety you know… And as a result they find that there appears to be an item in your house that looks like a sawed off shotgun. So in the morning, as you wake up SWAT is banging on your door with a search warrant that says they have a right to look through your house for a sawed off shotgun… Are you saying your OK with that? As 17 police officers ransack your house, what do you want to bet they find a sawed off shotgun? Whether it is yours or not…

      This is why you don’t want these military drones flying over your house… Furthermore this is also the reason why you better understand what your Constitutional rights are.

    If you’re not doing anything wrong (anything the Government dictates illegal) then why would you worry about this? The Government never oversteps it’s boundaries (Ruby Ridge, Waco) we should let the police have tanks and helicopters but citizens (who never will require the ability to revolt) should be content with hunting weaponry.       If one of those drones flies over my property, it will be shot down by shotgun or rifle, which ever one I need to reach it.

    Nah the government will never use drones over the U.S hmmmm a turn of events and they‘re using them now but they’d never use them to kill a ‘suspected terrorist’ lmao. Stay tuned citizens because the slippery slope just got started and this and future regimes will use these drones with gusto,anything to protect the regime from the people.
