Judge Orders Pro-Life Billboard Be Taken Down

ALAMOGORDO, N.M. (The Blaze/AP) — A state district judge Thursday ordered an Alamogordo man to immediately take down a billboard that implies his ex-girlfriend had an abortion.
As we reported earlier this month, the sign on Alamogordo’s main thoroughfare shows 35-year-old Greg Fultz holding the outline of an infant. The text reads, “This Would Have Been A Picture Of My 2-Month Old Baby If The Mother Had Decided To Not KILL Our Child!”
State District Judge James Counts issued the ruling as part of protective order the woman sought after Greg Fultz, 35, had the sign posted in mid-May.
Fultz’s ex-girlfriend has taken him to court for harassment and violation of privacy. A domestic court official had recommended the billboard be removed. According to ABC News:
The billboard cost $1,300, which Fultz paid for with the help of donations. Fultz said the donations came from various individuals who heard about his plan, not from businesses or other anti-abortion rights groups.
Fultz’s attorney said his client is adamant about protecting his free speech rights and will appeal.
“He said he is prepared to go to jail for this,” attorney Todd Holmes said.
“His position is that this billboard is not really about her. It‘s about his statement of fathers’ rights.”
It was unclear if the woman had an abortion or a miscarriage.
Her attorney, Ellen Jessen, said earlier this month that she has not discussed the pregnancy with her client because that was not the point. The central issue is her client’s privacy and the fact that the billboard has caused severe emotional distress, she said.
Jessen didn’t immediately respond Thursday to a call and email seeking comment, but the following Tweets appeared on a Twitter account that appears to be his:

Posted on June 24, 2011 at 9:18pmAside from the obvious fact that the first amendment gives this man the right to say what he wants, I don‘t even see how the woman’s’ privacy was “violated” when her name is not mentioned anywhere in this ad. If for some reason this man has been misinformed about how his baby died, then the woman should show him proof of a miscarriage. Doesn‘t a father have any rights to his child’s medical records? I don’t believe he would have put up the billboard if the baby had died of natural causes. Instead, he and the mother would have been mourning the loss of their child together. As a mother who has gone through the anguish of miscarriage four times, I find this woman’s actions not only disgusting, but extremely offensive. There is a huge difference between a mother loosing her child by no fault of her own, and a woman purposely going to some clinic to have her baby killed. This woman, after killing her child, pretending to go through what I have gone through just to save her image is reprehensible. It only proves the content of her character more that after murdering this man’s baby for her own selfish reason, she then takes him to court. Has this judge ever read the first amendment? And what about the preamble… don’t we stand for LIFE, liberty and the pursuit of happiness (even for the small and defenseless)? When will America take a stand against this wickedness? There is no excuse for killing children when there are so many who would gladly adopt them.

If the photo had been taken at a public newsworthy event, then no reasonable expectation of privacy can be expected. If she had been a celebrity, then any public appearance is a news worthy event, thus paparatzi. Ever heard of a model release form? I suspect she will rightfully win a civil suit against him also.
Critical thinking folks, have to take both sides into account.

Fathers do get the shaft when a woman decides to kill her baby. I find that terribly unfair. The ad could have been more impersonal and still represented freedom of speech.

Posted on June 24, 2011 at 10:55pmI don’t see anything saying the name of the woman involved, nor do I believe that this man is well known by so many people that her name would get out to anyone who didn’t already know her. Also, if she did have a miscarriage, that would be something that the father would be told up front in any normal relationship. Only an abortion or purposeful miscarriage would be hidden from any father.
Keep up the sign, I believe the woman did have an abortion and if that is the case she deserves to be mentally distraught for sometime.
