Judge Rules Against UK Doctor Who Was Fired for ‘Inappropriate’ Christian E-mails & Language

Making it illegal to state one’s personal faith in the work place? This could became a reality in the United Kingdom after a judge ruled against a Birmingham, U.K., doctor who was dismissed after he sent a motivating prayer to fellow staff members at his hospital.
Unfortunately for Dr. David Drew, Employment Judge David Kearsley ruled that the motivational religious message was inappropriate and that his dismissal, as a result of refusing to comply with demands he not share faith materials, was appropriate.

According to Drew, 64, his issues with fellow Walsall Manor Hospital staff members began unfolding in 2008. It was during that year that a senior nurse reported that Drew was undermining her. As a result of the accusation, he was suspended and an investigation was undertaken. In the end, the charges waged against him were dismissed. But his problems didn’t end there.

Following an independent review of his conduct, a report concluded that Dr Drew’s religious language was inappropriate in a professional business setting.
He was told that such communication was unacceptable and that his religious beliefs should be kept to himself.
The report also criticised Dr Drew for sending a text message to a colleague, Rob Hodgkins, reading “Have a peaceful Christmas” which was perceived as an “aggressive and unwelcome intrusion” into his private time.
Dr Drew, a father of four who lives with his wife Janet, 61, in Sutton Coldfield, West Mids, refused to adhere to the report’s recommendations and was dismissed for “gross misconduct and insubordination” three days before Christmas in 2010. He lost an appeal last April.
While speaking in an employment tribunal last week, Drew said that he was made to feel like a “religious maniac” and that he was merely attempting to rally and inspire his fellow workers. The judge, however, ruled that his behavior was unwelcome and that the decision to bar it had nothing to do with an anti-Christian bias. The Telegraph continues:
…Kearsley ruled that if complaints were made about Muslim or Hindu doctors who had quoted from holy texts, they too would be asked to refrain from such behaviour.
Similarly, if an atheist consultant caused unease by trying to educate his colleagues about “the works of Richard Dawkinsor Christopher Hitchens”, he or she would be treated in the same way, the judge said.

The eight-day tribunal clearly wasn’t favorable for Drew, who was accused by the hospital’s chief executive, Sue James, of producing a “toxic environment.” James said that he consistently complained about co-workers and that his religious mentions were divisive.
In the end, the judge ruled that the hospital was not anti-Christian in its handling of the situation and, as stated, that individuals of other faiths taking similar actions would have been punished accordingly.
“There is no need for such assertions in professional communication nor was there a need to make religious references if they are considered inappropriate and if they hinder proper communication,” the judge concluded.
In the end, Drew lamented the judge’s decision and said that it would have severe ramifications in the workplace.
“This means that you cannot be yourself in the workplace, you cannot say ‘I am a Christian’,” the doctor proclaimed. ”Other people who have got other religions won’t be allowed to either but of course what religion other people are because it is more visible. For example we would be in meetings when one or two of my colleagues who are Muslims would go across into a corner to pray.”
Others, too, agree with Drew‘s assessment of the dangers of proclaiming that stating one’s faith in the workplace is inappropriate.
“This is like the shutting down of identity. This approach to Christians is like forcing them to deny their identity — being Christian isn’t something which you take off when you go to work,” said Andrea Williams, who directs the Christian Legal Centre, a group that defends believers in the workplace. ”To say that it is not appropriate to say that you are a Christian at work is to totally misunderstand our history, our heritage, freedom under the law, freedom of religion, it is deeply illiberal, it is wrong.”

It could just as easily be said by a homosexual in an American workplace, “This means that you cannot be yourself in the workplace, you cannot say ‘I am gay’.” In many jurisdictions and many workplaces, that will get you fired just as fast if not faster than what happened to this doctor. Fail to conform to gender stereotypes in manners of speech or dress, gay and fired. Place picture of same-sex spouse or life partner on your desk in the exact same size, picture frame, and place on your desk as your heterosexual colleagues, gay and fired. Mention in passing, off the clock conversations that after work you’re going to a place or event particular to homosexuals, gay and fired.

See how that’s directly analogous to the story here? And did nothing about the examples I give sink in? As a heterosexual in the workplace, you can display a photograph of your wife and no one thinks a thing about it. If I displayed a photograph of my wife, at the minimum, even without working for an evil corporation with bigotted HR directors, I can expect, at a minimum, to get preached at day in day out by my turbo-Christian co-workers and even open harassment from those who only give lip service to the ways of gawd, but are really being evil just because that’s the way they were raised to think.
You don’t want to hear about my homosexuality and Atheism, but I don’t want to hear about your heterosexuality and Christianity EITHER! The doc in this story is finally having to come to grips with a fact of working life that non-heteros and non-Christians have dealt with for a very, very, VERY long time.

I have worked in California in all atheist, 90% gay/jew hate-the-christian-with-all-your-might movie studios and TV shows, and even there we would tell eachother to “have a Merry Christmas” and nobody ever got fired for that. I would not expect anyone to fare so well if they carried a Bible with them everywhere or if they were constantly preaching, but that kind of stuff is not mentioned above. So what is missing from this story, I wonder?

The quote is selective on the part of the author or the blaze report. It would appear to specifically pull out the most non-controversial communication to promote and reinforce a biased. How’s about we see the entirety of the communications from Dr. Drew and hear from the folds who felt they were unwelcome intrusion and inappropriate. But of course that would not serve the purpose here or get the intended reactions.

This is written by a very respected medical journalist in England called Phill Hammond who was a whistle blower himself. This guy (Drew) did the right thing. He was trying to protect patients and staff and the hospital management offered him money on condition he sign a gagging order not to speak about it. He is a hero man. They just used his religion against him to get him out….

I was removed from my job because of my Christian Faith. I was in charge of 650 students attending school. The similarities to the complaints made against me are amazing. The same sorts of arguments and accusations against me. Hostile work place. People felt offended because I was a Christian. I was doing professional development on the Constitution for officers who swear to uphold the Constitution……they said I was insensitive to those who did not believe in the Constitution and that I was insensitive to their cultural differences by making them read it and talk about it. I was removed from my duties and placed in an administrative role because it was deemed that I was “too controversial to be around students”. It is here already in your military people. I am living proof.

I am humbled by your words of “Thanks” because I do this job because I really do just love my counrty and know that God has Blessed us to live in the Greatest Country on earth because it is trully the only Becon of true Liberty that is left as far as governments go. We need to educate our citizens as to why our Country is so great. Ask anyone….most dont even know why or have a coherant answer. Even from the young officers I was working with …they had no answer….usually they would answer some thing about our natural resources or a “slogan” of freedom but could not put a meaning to freedom. I would have to explain that it is our form of government that makes us the greatest country on the earth. And that government was established by the Constitution. If we dont educate our people on the Constitution and its true meaning….we are lost as a country. Education is the key.
Report Post »As a note to NEMO13 – I would ask these young officers to define what Domestic Enemy meant to them…since that is part of the oath they took. The most common reply was …..a stare and a shoulder shrug. One young officer actually told me that she did not believe in the Constitution and that it was just a formality to getting the job to have to take the oath. She followed that up with” the Constitution was written by a bunch of old white, bigoted, mysogenistic men”. It was she who initially filed the first complaint against me.

In being silenced the churches in America, body of Christ, have unknowingly prostituted the body of Christ contracting with the gov. for exemption in exchange for required silence against reproving sin of our leaders. The gov. affectively tells churches they can not talk about political people for or against. The church with 501C3 tax exemption status can not even endorse a Christian political candidate over a say muslim candidate for an office. This corp. tax status has allowed the gov. to become part of the headship authority of churches in America. The result is churches have unknowingly prostituted their Christ headship with the gov. Furthermore, the exemption always existed and the corp. contract never needed to be applied for by churches. Study the issue.

Posted on May 4, 2012 at 9:38amIn the US, the laws, regulations and private business rules are very similar. It is against the law to discriminate on the basis of religion, among other categories. The behavior model is “You can believe any thing you want. You can not act it out in the workplace.” Two issues are involved here. One, people are not exposed to topics that are considered discriminatory. Two, the employer limits financial risk.
I expect that respondents to this story will say that this is unchristian. Remember it protects us from having a Muslim freely spout his slop also.
In 2002, I was brought into a business as a turn around specialist in Human Resources. The first issue I had to resolve was the termination of an employee who was fired for reading an Arabic newspape during break. The employee was from Iran. this was 5 months after 9/11 and employees were frightened of this employee because the employee came from Iran.
The situation had some real problems.
1. The employee was a political refugee from Iran.
2. The employee was an Armenian Orthodox Catholic, not a muslim.
3. The paper the employee was reading was a Orthodox newspaper.
4. The employeewas reading in Arabic because the paper did not come in an English language edition.
5. The employee was fired in the breakroom in front of other employees.
6. The employees cheered as Security led the employee was walked out of the break room.
