Judge Slaps Down Oakland Cop For Shielding Nameplate From Occupiers

(The Blaze/AP)- A federal judge in California has ruled that an Oakland police officer who covered his nameplate during a November Occupy protest seriously violated court-approved conduct standards for the city’s police department.

U.S. District Judge Thelton Henderson issued the ruling against officer John Hargraves and Oakland police Lt. Clifford Wong. Wong was accused of failing to report Hargraves‘ actions to the department’s internal affairs unit.

The Police Department later ordered Hargraves suspended for 30 days and demoted Wong to sergeant, according to The Chronicle. So far they are the only known reports of disciplinary orders against Oakland police during the Occupy protests. Hargraves is still on the job while he appeals his suspension.

The San Francisco Chronicle reports that Henderson has not decided whether to hold contempt proceedings against the officers, but did say in court that:

“If safety were considered a legitimate basis for violating laws and policies, there would, in essence, be no laws or policies governing police conduct,” Henderson said. He said it is a crime, as well as a violation of police policy, for officers to conceal their name or badge number.”

Hargraves has said he concealed his nameplate to protect himself and his family after an Occupy protester posted the name and address of another officer and called for burning down his home.

Hargraves and Wong’s lawyer declined to comment.

      I I know firsthand what it is like to have these nut jobs threaten not only me, but also my wife and kids. Many times I would have loved to hid my identity for fear of one of these radicals actually acting upon their threats. But I did not, and as a public servant I followed policy. Being a law enforcement officer is the toughest job on the planet, and we do our best to hide our feelings and often anger and show professionalism in the face of danger, harassment, and baseless attacks on our character. People expect too much from police, the expect us to solve their problem in 2 minutes that they have spent 20 years creating. People expect us to enforce the law except when they are the violators. The OWS movement is a perfect example. We allow them to protest, but when they infringe on the rights of others we must enforce the law and that is when they get bent out of shape and their true colors show. They have no Honor!

      Legislation should be passed pronto that holds demonstrators legally and financially libel (equal and severable) for all damages caused, and until the costs of the actual damages have been paid, they would be ineligible for any government services or monies whatsoever, including student loans, welfare stamps, unemployment, disability, etc. etc. etc. Demonstrate peacefully with no damages or costs to the cities, great.     I understand the officer’s names should be public but the only address that should be public knowledge should be that of the precinct office where they report for work. Any posting of private address’ for any officers and/or their families should be prosecuted as violation of privacy, a threat to public safety (puts officers in doubt of doing their job to the fullest extent because they may be concerned for their families) and violation of officer safety rules and regulations. Lets get to the heart of the problem here. The officer shielding his name is just the symptom not the problem. The person that posted his address should be prosecuted.

      Meh. Every time there’s a story on here where someone disagrees with the actions of a person, someone else usually comes up with their address pretty quick. As Ghost implied, it’s simple to find addresses these days. What SHOULD be prosecuted is someone who posts an address and encourages harassment or violence toward the person involved.

      And while the officer hiding his identity may be a symptom of the issue, it’s also a major problem. Secret police? No thank you.

      The only right to privacy you have is the protection the fourth amendment affords against unreasonable search and seizure. There is no such thing as a right to privacy, or volation of privacy laws.

      Now like someone else already said if you post the person’s address and tell people to go kill them and/or burn down their house then that’s a crime, but it has nothing to do with privacy.

      You can also opt not to be a public employee with a name badge on your chest. Further, your tax records are public record, as are your property holdings. Public record dude, meaning, fair game for anybody to say out loud. That gives anybody that wants the information access to your name, occupation and address, all courtesy of the thing known as “public records”.

      I was able to go overseas to do my job knowing that my family was in a safe neighbor hood. Take that away & you can find yourself someone else or be on your own.

      I don’t think it is any different than a police officer. They did not observe police brutality but they want to get rid of any & all police so they will throw any & all charges against them.

    I understand the officers concern, but name badges are a way to deter officers from taking the law into their own hands or committing crime themselves. An officer is held to a different standard than the public and unfortunately so his is family. They do get the benefit of that officers knowledge, protection, Health care and pension which are all provided by the citizens of that state. I am not advocating punishing officers or their families, I am simply saying standards should be high for the ones we pay to protect us.

      Even though I agree that an elected official or an officer of the law should be held in high regard, they do not, however, need to be held to a subjective standard. Our Constitution is the supreme law of the land and so everyone should be held to that from “top” all the way down. The application of the supreme law of the land has not been applied across the board in a long time…. I can supply many examples if you think that I need to. We should all be held equally to just laws that prohibit life, liberty, and the pursuit of happiness. I do not see where this law is just or in following of the Holy Bible. If there is a problem with pets biting people where the owners do not make restitution then there is already a law on the “books” for taking “liberty” away by causing harm. For those that would say “the Bible has nothing to do with this country and should not” need to take a hard look at the founding of this nation, or just read the inaugural speeches of the first 10 presidents, then say that G-d had nothing to do with the people who started this nation.       Problem is they won’t confront you like a man, they will hide and attack while you sleep, follow your kids to the bus stop and drive by and abduct them or shoot them where they stand.

      These people are cowards and only attack when anonymous and in a pack.

      We should all form community militia and defend ourselves and yes even attack these cowards.

    Occupying public property and making violent threats toward a police officers is also a crime and unconstutional, yet the judge didn’t seem to notice. Apparentlly only crimials have constitutional rights in Oakland.

      But look at how peaceful they look, Really well done peace shields, (except the one anarchy shield). Colorful masks, heck even the gas mask matches their outfits..I remember the crappy shields the evil Tea Party carried into the peaceful protest…Oh, wait…that was Libya…I can say for certain that bringing a shield to a protest, you have no intention of keeping it peaceful…I feel sorry for these officers..I’m going to write down all the addresses that they post and send them all lists of homes for sale here…Plus employment info in our law enforcement…Cheaper than Caly, and our justice system and population here respect our officers and the jobs they do. There is NO OWS here, and never will be.

      why are the people that posted police addresses etc on line and encouraged others to burn their house down not in jail? for life?
      I think that’s calling for murdering the police and his family…murder..premeditated…put them in jail and make it stick.

      Post this judges name and address and photos of him and his significant other. See how he likes it. Occupy his lawn. Keep him up at night. Urinate on his flowers. Crap on his car. Just turn the tables on this clown and he’ll get the picture soon enough. The occupy movement is now making enemies all over this country. Their actions will not be tolerated much longer.     Yes! Keep punishing the law abiding citizens!! We haven’t thrown a couple of Border Patrolman into prison in a couple months or is it the deaths of Border Patrolman count as a buy for a couple months? California you are being over run with zombies and you don’t even know it!!!! I remeber the glory days in the Marine Corps when we didn’t have “name tags”…….Oh yes Oakland PD get ready for a lot more “law suits” directed at you in the name of “justice”!!!

      The US Constitution now says we are required to wear name tags? With how many video cameras are present in these protests I am sure a name tag helps identify real and perceived violations……..of course the “protest doctrine” says “when caught by law enforcemnt squeal and struggle like a stuck pig”……

      I only want to know someone’ name if they were rude (or incompetent) or I want to be personable (all the time) & don’ want to refer to them by number (badge #) or hey you.

      Do you really like Mexico where the cops are bought or they are dead. Knowing the names of the cops really helped the cartels. It can happen here too.
