Judge Strikes Down Controversial Collective Bargaining LawMADISON, Wis. (AP) — Wisconsin’s law taking away nearly all collective bargaining rights from most public workers was struck down Thursday by a circuit court judge but the ruling will not be the final say in the union fight that brought tens of thousands of protesters to the Capitol earlier this year.

The state Supreme Court has scheduled arguments for June 6 to decide whether it will take the case and Republicans who control the Legislature could also pass the law a second time to avoid the open meeting violations that led to the judge’s voiding the law Thursday.

Gov. Scott Walker pushed for the law as a way to help balance the state budget. His spokesman had not seen the ruling and had no immediate comment. Spokesmen for Republican leaders in the Legislature also did not immediately return messages seeking comment.

Walker and Republican leaders have said they would pass the law again as part of the state budget next month if necessary.

A spokesman for Republican Attorney General J.B. Van Hollen, whose office defended the state, did not return a call. Ismael Ozanne, the Dane County district attorney who argued for striking down the law, also did not immediately return a message.

Dane County Circuit Judge Maryann Sumi ruled that Republican legislators violated Wisconsin’s open meetings law during the run-up to the bill’s passage in March. She said that renders the law void. She had previously put the law on hold temporarily while she considered the case.

Sumi said violating the open meetings law betrays the public’s trust.

“The court must consider the potential damage to public trust and confidence in government if the Legislature is not held to the same rules of transparency that it has created for other governmental bodies,” she wrote in a 33-page decision. “Our form of government depends on citizens’ trust and confidence in the process by which our elected officials make laws, at all levels of government.”

The law called for public workers at all levels, from janitors at the state Capitol to local librarians, to contribute more to their pension and health care costs, resulting in savings to the state of $300 million through mid-2103. The law also strips them of their right to collectively bargain any work conditions except wages. Police and firefighters are exempt.

Democrats see the law as an attempt to weaken labor unions, who have been among their strongest campaign allies. Senate Democrats fled to Illinois for three weeks in February and March in a futile attempt to block a vote in that chamber.

Republicans passed it without them present, using a hastily called meeting to put the bill in the form needed to do that. The calling of that meeting with less than two hours’ notice is what led to the lawsuit.

    Um… the law itself was not struck down. The procedure used in passing it was considered illegal by the judge, and that in effect rendered the law of no effect. Perhaps that’s a technicality, but it seems an important one to me.

      In essence, the judge rewards the idea that you can flee your state to avoid a vote which won’t go your way, and the majority—lacking a quorum– is utterly helpless to due it’s democratically elected duty. Judges of the law who implicitly or explicitly sabotage the laws and constitutional process they swore an oath to defend and uphold deserve an ouster.

      Unfortunately your choice of a Reagan quote is neither relevant nor applicable to this issue of PUBLIC EMPLOYEE unionization. Private sector unionization is fine…hey, if a group of workers want to strive for substandard mediocrity, then have at it. If workers wish that they can get paid the same for doing half the work as another of their coworkers, and conversely, if a worker doing twice the work as thier useless co-worker and is happy to earn the same, then so be it. But public employee unions make a pretty sweetheart deal for their members….they dictate to the taxpayers what they will pay them, instead of taxpayers telling workers what they can afford to pay them…a little butt backwards, don’tcha think? Not only that, the unions spend millions upon millions to get their liberal tools elected to office so that those same unions can then “negotiate against” those very same elected officials for the wage and benefit package of the union members. Gee, can you say conflict of interest? And don’t give me that mythical b.s. line that union campaign $ are needed to “offset” the big business contributions to conservative candidates. Anyone capable of any research knows that big corps contribute at the very least equally to both parties….think about it.

    This ruling will be struck down as an abuse of discretion. She has no leagal authority to rule on a legislative session “rule”. The legislators are free to make their own rules – it’s part of the seperation of powers.

    It won’t stand, but I can’t figure out for the life of me why they didn;t just revote.

    The point of the open meeting law is to provide notice to the public. The pubic damn well knew what was going on with the collective bargaining legislation. Everyone in the country knew what was going on, so the notice intention was obviously fulfilled.

      You’re probably on to something. A few years ago, Ohio‘s court ruled that the way the state is funding it’s schools is unconstitutional. The state didn’t even bother looking for a different way, they just continued doing what they’ve been doing. Nothing is being done about it.

      What was struck down was the process the law was passed with, there is no reason to think they won’t pass it in a couple months, as noted in the article – and when they do, the onus will be on the unions to show how the law violates their rights (which it does not do, it redefines them).

      Can’t wait to see how many WI teachers will either take time off from their part-time summer jobs OR interrupt their summer vacations to try and stage a repeat of their last protest…

      Whats the point of voting on laws if some bias corrupt judge can step in and over turn it? Legislatures need to protect themselves from a situation like this and create a new law BARRING judges like Sumi from presiding over a case like this when there is “conflict of interest”.

      AS I have said on here folks we are in a lot of trouble, this country legislative and governmental structure is corrupt to the core. NOTHING will ever change until they are ALL removed from power.

      Isn’t this the second time she has struck this down. I suggest someone look into her bank records or her sons bank records to see if any union money is floating around. I believe I heard that it was Wisconsin where collective bargaining was started and it’s only fair that it is where it stops. Good for Wisconsin.

      The Republicans brought this on themselves. They had the votes. They didn’t need the Democrats to show up once the budget issues were removed and the union negotiating aspects were in a stand-alone bill. Why didn’t they abide by the 48 hour rule instead of digging for a loophole? And once the judge stayed implementation, all the Republicans had to do was withdraw the bill, reintroduce it, wait 48 hours and then vote. The judge even said so in her initial ruling. She’s now said it again. Why don’t the Republicans just do this instead of wasting months and thousands of taxpayer dollars, which the Republicans claim they don’t have, fighting this in the courts? If I was a Wisconsin resident, I’d be seriously pissed even as a supporter of the bill. The Republicans seemed determined to make this as difficult and expensive as possible. It’s like they want the voters to throw them out. What a band of idiots.

      It is all corrupt from the local governments to the federal government. This has been a long time coming but they forget about the Amercian Spirit. The belief in the founders and what they were trying to do, oh ya, and the fact that true Americans really don’t like being told what to do by anyone especially a government slug.

      Civil servants have no need to collective bargaining! Their pay is based upon the collective bargaining at the private sector!

      This is not about bargaining for wages and benefits. This is about power over the tax payers!

      “….. violated Wisconsin’s open meetings law …..” The Legislative branch make there own open meeting rules!!! Is she as a judge, telling the Legislative branch what its own rules are?? Talk about corrupt, abuse of power…vote the judge out…

      This judge is a pure left wing activist – a shame and a sham on the court system in America. Where the heck does the Constitution lay out collective barganing as a RIGHT? These lefty morons are gonna wish they had never been born if they keep up this fight against the fabric of America. It is time to stand up and be heard more clearly Patriots, it is time to do marches and protests (peacefully of course) to let them hear us in BIG NUMBERS, before it is too late.

      2. Exercise frugality (live with your means)
      3. Restrain the infliction of injury (live by the Rule of Law, protect good guys)
      4. Encourage entrepreneurship and free enterprise (don’t over regulate)
      5. Protect property, and the earnings of citizens (have a military to protect America, not police the world)

      I am from Wisconsin and the whole thing stinks to high heaven, They try to have a vote and the dems flee, union threats, republicans were receiving de@th threats, Corrupt judges, corrupt attorneys, voting corruption in the supreme court election with several dems voting in more that 1 county, the recount cost us over a million with the outcome unchanged, with the republican holding on to his 7000 lead. The list goes on and on. We are trying very hard to get our state back and the unions don’t like it one bit.

      Doesn‘t it irk you a little that the Republicans could have had this resolved long ago if they’d just said “Ok, we’ll take a mulligan and go again in 48 hours” rather than flushing your tax dollars down the toilet by insisting on trying to make a point by forcing this through the legal system? This solution was apparent from the moment the Democrats pulled their Great Escape. Here you are months later and what have you got to show for anything?

      Hey Admin, I think ” mid-2103″ should read 2013? Don’t want any of the trolls having an aneurism over a typo.
      Secondly, what is with the state(s) submitting to inferior courts on these issues. The Constitution is very clear about this issue.
      Article III
      Section 2.

      The judicial power shall extend to all cases,
      –to controversies to which the United States shall be a party; (Arizona?)
      –to controversies between two or more states;
      –between a state and citizens of another state;
      –between citizens of different states;
      –between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subject

      Can anyone point to the authority of federal courts in this matter?

      Big surprise that a nut job liberal circuit judge would overstep her authority to rule on a legislative state law. I hope when it goes to the State Supreme court next month that they rule she had no authority to even hear the case much less rule on it and remove her from the bench.

      The Budget needs to be passed in a month. This is textbook Democrat. Let it vacillate in the courts until it’s politically prudent, then when there is no time left start the theatrics again. Meanwhile coming up with no plan of their own. I give it 2 more weeks before we start to hear about a government shutdown because the mean Republicans won’t compromise. What a joke. As a resident of Wisconsin it’s embarrassing.

      then you must agree that Clarance Thomas should excuse himself from any case about national health care, Mrs Thomas is a tea party activist and has advertised herself as a lobbyist who has “experience and connections” and appeals to clients who want to overturn health reform,and oh,he “forgot” to claim that 600 grand his wife made.from fighting health-care reform.can’t have one with out the other.

      Not only the SEIU but the AFL-CIO as well. Both unions represent public employees in Wisconsin. In additon, both Judge Sumi and her husband made contributions to Scott Walker‘s opponent in the governor’s race.
