Justice Roberts: Going to ‘Impregnable Island Fortress’ After Obamacare Decision

Chief Justice Roberts, to his credit, seems to know a lot of people aren’t happy with his decision, and is being a good sport about it. In remarks on a panel at a judicial conference, Roberts was asked by a fellow judge if he planned to go to “Disney world” now that the Court’s term had ended.
Roberts responded that he was going to teach law in the small island nation of Malta, but decided to spruce the information up a bit with a wry joke:
“Malta, as you know, is an impregnable island fortress. It seemed like a good idea,” Roberts quipped, according to the Associated Press.
The remark drew laughter from the 300-odd judges and attorneys in attendance at the conference, held about an hour south of Pittsburgh.
Roberts was only indirectly asked about the court’s monumental ruling Thursday, and in those instances deferred comment. But Roberts did say he wasn‘t bothered that he couldn’t respond to critics of the court’s decisions.
Robers has been the target both of criticism and adulation from all sides of the political spectrum for his ruling in the Obamacare decision handed down yesterday. And certainly, some of his more angry detractors might like to lock Roberts up in an impregnable island fortress of some kind. For our part, we’re glad to see that the Chief Justice is taking the pressure in stride.

Oh and by the way here‘s hoping you don’t get a serious illness and then hope you don‘t have to rely on Obamacare because you just might die before you can see a doctor since there won’t be many competent ones left.

Roberts must be a “sleeper”. Now that he has lost his supporters, the Democrats will now go after him, he is someone they cannot trust on their side. Forcing Roberts to resign will allow Obama to appoint his own Chief Justice. I wonder if Roberts knows what he did to himself.

Posted on June 30, 2012 at 12:35amIt’s very understandable how people who spend their intellectual capital listening to faux-Constitutional scholars of the likes of Sarah Palin, Glenn Beck, and Rush Limbaugh, two of which could not even graduate from college, could be set-up for disappointment when rulings put forth by the body designed to uphold the Constitution don’t jibe with their ideology.
Face it, the Healthcare Act is deemed Constitutional per the Supreme Court of the land. If you don‘t agree and can’t accept the decision, then leave our great country you anti-American ideologue. If you wave your pocket Constitution in one hand and then denigrate the Supreme Court at the same time, you’re nothing but a hypocrite.

What does graduating from college have anything to do with knowing the Constitution of the United States? There are plenty of college graduates in Congress that know squat about the Constitution. What do YOU know about the Constitution? Judging by your remarks, the answer is NOTHING. Have you read it? You are correct in that the ruling does not “jibe with their ideology” because their ideology is base on the US Constitution. And that ruling WASN’T.
And in your last paragraph, you seem to subscribe to the idea that the Supreme Court justices are perfect and that the court ALWAYS makes the correct decisions. That is an ignorant and naive point of view.

Maybe you haven’t noticed that welfare is a failure.For 50-100 years we have been taking money from producers and giving it to non-producers.
Are there any fewer poor? No! In fact there are more poor.

The only way to fix this country and get people back to work is to slash govt – spending, taxes and the military – and to go back to soup kitchens. Food to stay alive, but never to be comfortable in their poverty.
Let me give you a clue – poverty is not a disease, it is caused by not working, not producing something of value. Simple cure, get a job and work.
People on welfare produce nothing, how can we give them everything they want – cell phones, internet, viagra, free surgery, nice clothes, their own apartment and no questions asked food stamps?

The ruling was based on the fact that the penalty was a tax. However, it wasn’t worded as a tax and indeed was declared to not be a tax several times. So the ruling should have been against the mandate on the grounds that if it‘s not a tax then it’s not constitutional. Since it is a tax (admitted by the Roberts) then it should have gone through all of the normal tax review processes and been called as such, but since it didn‘t even do that it’s back to being unconstitutional.

I still have no clue about what could motivate the “Chief” Justice of the Supreme Court to cravenly abrogate every facit of his chief responsiblity to judge and intepret the constitutionality of case law. By his own admission Roberts invented and rewrote a new law from Obamacare…to the extent that the resultant mutant has no relationship to what was there to be judged. He rewrote and inserted an entirely new law…one that could pass muster as a tax. In this he brought the Supreme Court to the level of an episode from the Keystone Cops of the 1920′s silent films.
I would say the man is merely a fool…but this fool has permanently damaged the Republic. When the Roman republic fell to Caesar and the like, it was because the “mos majorum”…the commonly held since of propriety had gone by the wayside. Rather than a commonly held sense of “right and wrong” based on “Truth”, the roman society had become so multicultural that there were a wide plethora of competing truths. In this environment, true law cannot function…it becomes arbitrary anarchy which cannot protect the citizen from abuse. Out of this always comes barbarism, as each individual seeks the one who will “win” that race…and attach themselves to him as a patron.
Justice Roberts reflects this…arbitrary anarchy… May God have mercy on us…cause next comes Imperial…barbarism. All hail the next Emperor president…

I can only view it as treason with respect to his decision as it was completely unfounded. I’ve run across two instances where legislative experts had evaluated the ACA under the tax law and ruled it out as even remotely possible to interpret it as such (prior to the ruling). As you recall Roberts is the one who kept “leading” the SG on the “penalty tax”. There is no classification for this types of tax (Excise, Income etc). The man effectively facilitated the creation of a new type of tax where private insurers collect the tax.
With that decision Roberts has demonstrated his character and defined his legacy in the annals of US History, and he will be accurately be depicted as a traitor to its citizens, insulted the founders and urinated on the U.S. Constitution. The “spin” would be expected from such a hack, so no, I’m not angry about the spin at all. The joke about the island is just salt in the wounds…

Congress, the President, the Solicitor General, Pelosi and others all stated the mandate was not a tax, yet the Supreme Court rules it is a tax.
Limbaugh predicted Roberts would do this over a year ago. Roberts shoved his middle finger in the face of the American people and 23 States that filed the suit. WHY?

More wake up calls to show us how important it is for us to thoroughly vet and check out those we vote for. Our previous Presidents were really “moderates” – Repub. Progressives. To reverse/restore, we must elect Consv. Constitutional patriots that are strong, ethical, etc. – proven by their records, get rid of as many as we can that aren’t – push for term limits, etc. We need these types in Leadership positions. Then, if we have a strong Senate and House along with a President – if and when an opening comes up for a SC judge, we have a great chance at getting what we need. But that is a lot and will take a lot of work and prayers – we will need Divine intervention. Our first needed challenge is November — need majorities in Senate, House, plus the President.

Though I absolutely loathe the healthscare law (misspelling intended) and wish that it had been overturned, I DO think Roberts helped the conservative cause by severely limiting the libs usage of the commerce clause to impose and justify taxes upon us, strengthened state sovereignty from the Feds and re-phrased the penalty to be a tax (now BO and his minions will have to explain that when he promised no taxes on the middle class).

No personal attacks here but consider a few things. #1 if you are from NY take look at you unfunded liabilities in NY; those things that allow municipal workers (God bless firemen, Law enf etc) to retire at the age of 50 or so with a solid pension including substantial healthcare the next 20+ years. I can’t say for NY but Cali has $500 BILLION in such things. Illinois allocates a full 20% of its’ state budget to pensions and healthcare. In total it’s estimated the country has nearly $100 TRILLION of such liabilities, so you tell me, does ACA help that or add to that? In the end it will add to it by every measure.
The other thing I’m researching is to determine the cost of current visits to E-Rooms by all the underprivileged and trespassers (bottom line is Reagan said everyone gets treated). It appears that number may be as low as $45-$50 billion. Fraud in Medicare alone is estimated at well over $100 Billion. The costs increases come largely from over charges by institutions knowing they will not be fully refunded so they make it up in the over-charge so it simply escalates.
Your comfort in the commerce win is frankly moot given the travesty of this decision. The line that can and will be crossed has been drawn, so what does the Constitution matter? November is key, but it can’t stop there….

First, thank you for being respectful and honest. Your post was thought provoking. And though I’m from NYC I moved away LONG ago when rich, elitist snotty libs started taking over the city. REAL NY‘rs are hard working middle class people who didn’t and don’t expect handouts who lived in small clusters of neighborhoods. But I digress. Truthfully, I don’t care what happens in NYC as they deserve what they voted for.
I am with you totally as I would MUCH rather this bill have died two days ago and we would all be done with it. But it is what it is. I don’t want to focus on what shoulda/coulda been. I want to move on and get in and stay in the fight. Our troops put their lives on the line everyday for our freedoms and we need to do our part and fight the fight here. And if anything, I think this decision helped to galvanize conservatives and the Tea Party. While the libs are crowing over their victory, albeit a fleeting one, we are mobilizing and focused on the Nov elections.
I know we stand together as we have the same goals and we both love our country. We may not agree on everything but no one does.

It‘s why they have lifetime appointments so they don’t base their judgements on politcal opinions. The tea party and other alledged conservatives claim to be constitutionalists, but idiotic comments like yours continue to prove that most don’t have the faintest idea of what the Constitution is, how it works, or why.

Report Post »You should be cautious with your criticism of H20. The bill was not passed as a tax and quite the contrary. Neither the texts of the briefs NOR the legislation use the word TAX. H2O very accurately points out that the people voted for legislators to represent their will. In this case, the people made their choice exercising a God given right in the Constitution and voted for officials that WOULD NOT RAISE THEIR TAXES. The bill was signed into legislation absent the word tax and argued before the SCOTUS as such. Forget SCOTUS, but CJ Roberts chose to apply the word tax to which the people had no opportunity to respond. Roberts should have made a constitutional ruling which is his obligation and found that the people have not been properly represented. This is a clear case of taxation without representation and unconstitutional on its face…
