Kids Fined $500 for Operating Lemonade Stand Outside U.S. Open

This seems like a good time to quote Gawker:

What’s worse than a story about how a group of children were fined $500 by Montgomery County for operating a lemonade stand without a permit outside the site of this weekend’s US Open? How about the fact that they were going to donate their proceeds to a pediatric cancer-fighting charity?

See, officials in the Maryland County found it just flat out wrong that a group of kids would find the audacity to sell lemonade to golf patrons. According to WUSA-TV, a county inspector happened upon the kids’ stand near Congressional, the host course for the U.S. Open, and warned the kids and their parents to cease and desist. They didn’t. So the inspector handed them a $500 fine.

“This gentleman from the county is now telling us because we don’t have a vendors license, the kids won’t be allowed to sell their lemonade,” Carrie Marriott, one of the parents, told WUSA.

“Does every kid who sells lemonade now have to register with the county?” she asked the inspector. His response? The stand was too big to avoid scrutiny.

“Cute little kids making five or ten dollars is a little bit different than making hundreds. You’ve got coolers and coolers here,” he said.

As for the kids, they’re upset too.

“I don’t agree, I think the county is wrong,” said one. “We’re sending the money to charity,” said another.

    It’s no different than the gun laws-only the legal people will be harrassed by “the man”. It’s too dangerous to go after the crooks. When I was building my house( owner builder) the inspector had me doing all the code items that are required. I walked down the street where another house was being built by a “contractor” and the items I had to do were Not being done on that house. Selective enforcement is all over the country-blame corruption, greed or simple stupidity, and maybe a little hate. Don’t expect it to change, maybe get worse in this economy.

    CALLING ALL KIDS……..I say it’s time to declare a new national holiday…….NATIONAL LEMONADE STAND DAY…..August 6th 2011.

    Lemonade stands are an American tradition. It’s how we teach our children about CAPITALISM. I had lemonade stands when I was a kid and now my grandchildren have them every summer.

    I for one am sick and tired of it. Help me get the word out…….it’s simple, facebook all your friends and on Aug 6th have a lemonade stand at the end of your driveway (or any other place to tick them off), make sure you have a video camera handy.

    Take a STAND for CAPITALISM folks.

    Dustyluv, be careful. By federal law any payment over $.50 in pennies, $2.00 in nickles, $5.00 in dimes, or $10.00 in quarters, and I believe $20.00 in half dollars in loose change (these are the amounts of the coin rolls) is not considered legal tender, and business are not required to accept them as payment. Try going into bank with $2.00 in loose pennies to deposit them. They will hand you coin roll sheaths and have you roll them up before you deposit them.

      Secondly your claim that LAWFUL MONEY can be refused is absurd. I helped a buddy pay $23,000 property tax payment in PENNIES. Sat there for 5 hours watching all the public servants count them out.

      I suggest you learn the difference between LAWFUL money used to PAY your debt and “legal” tender used to DISCHARGE your debts. Learn what “discharge means”. You lack the ability to pay your debts UNLESS you use change. Federal reserve notes are NOT money. They are private paper which YOU are charged to use.

    I find it amazing that these so called inspectors, of that county are being paid by the county people and they have nothing better to do than pick on little kids and fine their parents. Makes you wonder what they do the rest of the time.

    Lesson learned: How dare these young children attempt to help other people without allowing the government to take at least 50% in administration costs and then give the other 50% to those in need. What are you trying to do kids? Show the government that we the people can take care of ourselves without the nanny-state stepping in. Welcome to the U.S.S.A.     holder will get right on this case. After all, this is a heinous crime against the state…and the kids didn’t have the requisite Move On person, illegal immigrant, or muslim working the stand…and they weren’t members of any public union.

These kids cant operate lemonade stand but they are building 2 houses next to mine, over 100 workers, plumbers Mexican, framers Mexican, Concrete layers Mexican, A/C Mexican, roofers Mexican and the list goes on!     Regulations are are used to limit entrepreneurship. It starts small and grows. The cost of a cab medallion in NYC costs $100K. Why? To keep out competition. It’s bureaucracy run amok. The guy couldn’t think for himself. Give ‘em a warning if you have to do something, but a $500 fine. Stupid is a stupid does.

    The county needs the sales tax and the permit fee to distribute benefits to those that can’t do anything -like sell lemonade…. the local governments are broke, they are finding ways to fine, levy, tax, permit, license, control, more and more of our lives everyday. We have been referring to this stuff for decades as the nanny state, but we have been complicit in that we continued to allow it to happen, now over those decades we are seeing the oppressive hand of the government pounding us from the top, bottom, and within… its the way of the social justice group, infiltrate, manipulate, discount the law, and then place a boot on our neck… stop this stuff, kids learn a lot from a lemonade stand.

    the fastest way to stop this cr@p is to just ignore it . refuse to pay the ticket, refuse to go to court. refuse the police when they come to take you away ……………….and get it all on video

      Pay the fine in pennies….add a very thin coat of pancake syrup (just a few drops) to them and let it dry first…I got a ticket in a speeed trap and thats how I paid the fine…It was very funny to see them have to count it out They were not happy…It was worth the wait to get my paid receipt…

      Drag the kids into court so they see what happens when their parents fail to respect laws and ordinances. Force the parents to submit proper paper work and business plan that outlines the details of operating that small business.

      Teach the kids to take life seriously and have a plan. Raising money isn’t a fairy tale.

      PATTY HENRY, I agree with you. Government wants control of everything these days. I‘ve heard it said that Gates couldn’t have created Microsoft in today’s environment.       Fewer regulations but not no regulations. Government is the problem… blah blah blah. Please try to think outside of these completely contentless talking points/cliches (if you can). You say “people” prosper when there are few regulations, but of course we mean here a very small and specific few people–like the CEOs that profited from the financial wizardry that led to our ongoing economic crisis. Somehow these points seem to escape your empty sloganeering.

      But let’s not confuse the issue: the country had rules, the parents and kids were breaking the rules, they were warned, and so they have to pay the fine. Pretty cut and dry here. This is clearly a local issue, regardless of how you feel about regulations, and you should not begrudge the county the right to run its own government.

Take about 5½ minutes to listen to this CEO explain it. You will certainly agree, if it were your capital you were risking, you would also be very cautious.       I don‘t know what others said I didn’t read all the comments, but as for me I didn’t say NO regulations, I was just pointing out that regulation does far more to keep people down, than capitalism does.

      And yes I do think 95% of regulation is a bunch of B S….Why not just have common sense and punish the ones that are caught doing wrong, instead of making it harder for people to conduct or start a business just to try to regulate a problem away. You can not regulate a problem away…once you put regulation to paper it is open to interpretation and it becomes a lot more complicated……
