Kucinich Sues Congressional Cafeteria for $150,000 Over Olive Pit in Sandwich

Congressman Dennis Kucinich, D-Ohio, claims he suffered permanent injuries after biting down on olive pit hidden in a sandwich he bought three years ago at a House of Representatives cafeteria. In return, the Ohio Democrat is suing the cafeteria for $150,000.

Rep. Dennis Kucinich, D-Ohio

Kucinich is reportedly suing Restaurant Associates, the operator of the Longworth House Office Building cafeteria, as well as its parent company and food suppliers. According to the congressman’s complaint, he “sustained serious and permanent dental and oral injuries requiring multiple surgical and dental procedures, and has sustained other damages as well, including significant pain, suffering and loss of enjoyment.”

In addition to four counts of negligence, the former presidential contender’s $150,000 claim alleges breach of implied warranty after the cafeteria told him the sandwiches contained pitted olives.

The alleged olive incident is said to have occurred on April 17, 2008.

The Ohio representative is taking his negligence claim to Superior Court and has retained the legal services of Andrew Young, an attorney from Ohio. When asked for comment, Kucinich’s office directed all inquiries to Young who was not immediately available for comment.

    He’s a typical stupid politician. To do $150,000.00 worth of damage, the idiot had to chomp down on the pit several times. I know. On several ocassions, I chomped down on olive pits which were not suposed to be where they were. It was annoying, but never damaging. But then again, I only bit down once each time. Or, could it be that maybe, just maybe, he is nothing more than lying politician who wants implants and wants someone else to pay for them. As a rule, dental insurance plans do not pay for implants. Hey. If dentures were good enough for me, they should be good enough for him.

    That would be a royal understatement of the highest order indeed. There are not a proper listing of words (polite ones anyhow) to do this suit justice; he does have the right to make claims for any and all damages via the courts, yet we shall see how it gets handled.

      I will admit, that part is a first – I have not, until now, heard or seen mention of a suit filed claiming any damages for the ‘loss of enjoyment’. Of course with a member of congress, what part of enjoyment has he not already lost?

      I imagine there is some lawyer out there who will now use this as a claim for damages in any or all sets of lawsuits indeed. One attorney I overheard described the art of claiming damages in a suit as ‘being creative in the description of the same affliction over and over again until it works.’

      Mind you, the same attorney is now in jail for having been ‘creative’ with his legal practice account books and the IRS found out. He is now a guest of the cross bar hotel for a time.

    Now a member of congress is suing over an event from three years ago? Now if this was a normal American making the lawsuit then I could see the incident as a legitimate accident happening and the lawsuit being practicle. Somehow this just defies sense across the board, if the damages to him are real, then he may attempt to make claim for damages; yet I also have to take into account the fact he is a member of congress…

      Good Lord have you ever heard someone claim “loss of enjoyment”? He is ridiculous, there are some very real cases of neglect in the country, this is not one of them. Who hasn’t bit down on a bit of bone in a hamburger or a cherry pit in a pie?
      I started out laughing now I find myself getting ticked off since this opens a path to MORE food safety regulation.

      Have to agree that it is indeed a first for me as well; I found a cow tooth in a box of fruity pebbles as a kid. A rancher identified the tooth, that was the last bit of cereal I ate for many a year, and I have to say it did not affect me very much. To this day I have no idea how it got into the box.

      $150,000!! If he is to get ANYTHING, it should only be $4,876.72. I’ve recently broke a tooth and had it removed and replaced with an implant after I broke half of it off on a piece of rock candy (no joke) but payed for the work myself. Denny, do you really think this is worth the courts time? Yeah, I know it hurts, but like you tell the ‘greedy’ rich people, SUCK IT UP. Oh, better idea, make regulations so this doesn’t happen agian you tool. With all the tax money you pay yourself with as well as great health care we pay for, why don’t you use it, shut up, and quit being a baby. Why the exact number to begin with, here’s the break down:
      $370 – remove tooth
      $2,500 – implant of titanium rod
      $1,000 – For fake tooth cap
      $6.72 – overpriced sandwich with said olive

      What kind of sammcih uses WHOLE olives inside ?
      Its always a tapenade or a gardenaire or sliced olives which are used inside a sammich ,
      and they all are pit-less.
      Whole olives are used as a garnish , and thats on a toothpick outside the sammich.
      So did he eat the garnish ? Beause if he did, he is not only a cheap b@$t@rd , but also confused because the garnish olive has a toothpick thru it , so it has to be pit-less.
      Even olives in a martini are pit-less, usually stuffed with garlic or cheese or pimento peppers or figs and stuff..
      Something is not adding up .

      Well now, hold on y’all….if this is true, he has every right to sue. I work in food service and you have to be VERY careful about what you serve. You are expected a certain amount of professionalism and are liable for any carelessness that results in an injury to a customer.
      That being said….
      Why did he wait 3 years? Unless a complaint was regestered at the time of incident, there is no way to prove fault.

      Well if I remember my business law class correctly (4.0 grade on 4 point scale) you can not sue .. if you can “reasonably” expect that something “natural’ might be in a product .. such as a pit in a cherry or in this case an olive. Same thing when I chipped a tooth on popcorn kernel .. I could expect that… and no I DID NOT SUE. This is frivolus and frankly he should be embarrassed to file such a lawsuit .. but POLITICIANS have no SHAME!

      btw .. I doubt that he was told the it contained “pitted” olives .. who says that? It contains olives … and they can contain pits .. NO MONEY!

      i believe they SHOULD get a pention for serving our country honorably “even after one term”. What they do for us (allegedly) should be respected and honored amongst all Americans and I would gladly see some of my tax money go towards their retirement.

      Just like when I was serving in the Marine Corps, the character of their service should be judged by either their peers or an independant (and fair) panel in order for them to receive payments. This would require the Oversite Commitee to actually do their job….wait….not oversite….someone help me here. Charlie Rangel’s hangmen…Ethics commitee?
      Anyway, some body in congress to oversee the shenanigans of its members and determine, truthfully, the “character of service” to determine bennies.

      He‘ll be banned from McDonald’s for certain. As my mother used to say when we’d complain as kids, “Offer it up as sacrifice.” She was a very devout Polish Catholic. I agree with her now.
