Labor Dept. Will Enforce Federal Wage Laws on Behalf of Illegal Workers

In a written statement to CNSNews.com Wednesday, the U.S. Department of Labor confirmed that it will enforce federal wage laws on behalf of anyone working in the U.S. “regardless of their immigration status.”

According to the report, the department’s written statement corroborated an earlier comment made by Labor Secretary Hilda Solis. Responding to a question by CNS Monday, Solis spoke of “partnership” agreements she had allegedly signed with several Latin American countries — Costa Rica, the Dominican Republic and El Salvador — to protect the rights of  “documented and undocumented” migrant workers in the United States.

CNS notes:

The Labor Department’s determination to make U.S. employers treat illegal aliens taking jobs in the United States as if they were U.S citizens or legal immigrants seems to contradict the Immigration and Nationality Act. That act says “employers may hire only persons who may legally work in the United States (i.e., citizens and nationals of the U.S.) and aliens authorized to work in the U.S.” and that the U.S. government “protects U.S. citizens and aliens authorized to accept employment in the U.S. from discrimination in hiring or discharge on the basis of national origin and citizenship status.”

During the signing ceremony featured in the video, Solis stated, “No matter how you got here or how long you plan to stay, you have certain rights. You have the right to be safe and in a healthy workplace and the right to a legal wage. We gather here today to strengthen our shared commitment to protect the labor rights of migrant workers in the United States. Unfortunately, due to language barriers and immigration status, migrant workers can be those that are most vulnerably abused.”

Responding to a question on whether Solis intended for both documented and undocumented laborers to be protected under U.S. labor laws, Solis stated:

“It has always been the case under previous Republican as well as Democratic administrations,” Solis started. “All we’re doing is enforcing the law and we’re allowing for other individual groups and partnerships with other consulate offices to work with us in expanding our reach in information. What we’re trying to avoid is that vulnerable communities be abused and that there be an increase in more underground activity, economic activity that goes untapped, those monies that are being paid to workers.”

    don’t know who wrote this but it makes more sense to me than 99% of what I hear, see and read these days. I especially liked the quote attributed to Winston Churchill at the bottom of the page. I could not have said it better.

      So not only do they get to steal our social security, medicare, medicaid, jobs, etc, but now they get to be paid equaly to a citizen when they are ILLEGAL ALIENS AND SHOULD BE DEPORTED. Now I ask this question, how is the labor department going to know if labor laws for ILLEGALS ARE BEING ENFORCED? Because if they know they are ILLEGAL, and do not deport them, they themselves are BREAKING THE LAW and should be disbanded and imprisoned. On another note, the next item is for the left to give them voting rights so they can stay in office. Since their massive voter fraud the organizations like acorn have been exposed, they have to get those ILLEGAL VOTES IN THERE SOMEHOW.

      First and foremost I am from the position that once you use the term illegal alien than any discussion regarding rights afforded to citizens should end abruptly. Having said that the context here as reflected in many of the posts focuses on no answer to the wrong question. The question is why EMPLOYERS keep hiring these workers. Notwithstanding the errors in the SS system there is no reason to request proof of citizenship and a SS number, which can be verified. I submit that a good number of employers knowingly hire illegal workers. These employers need to be charged, convicted and fined for such hiring. Perhaps a per occurrence fine of $250,000 will have some impact on the practice. A good start would be the landscaping, maintenance, home cleaning, construction, restaurants, auto repair and small manufacturing companies. Focusing on the individual illegal alien trying to obtain work is inefficient and ineffective. Cut off the head of the beast, the companies that hire them as there are a lot less of them.

      She was very pleased with herself, telling the Christian Science Monitor, “What better example could I set if I encouraged my staff to go and purchase and seek how we could acquire a vehicle that would for me would send a signal that we’re for supporting our American workers, American-made products, fuel efficient as well.”
      The only problem is that the SUV was built in Canada, by Canadian workers, using all Canadian parts:
      Solis proudly arrived at a media breakfast hosted by the Christian Science Monitor today in the shiny silver vehicle, which she has dubbed the “bullet.”
      Looks like Hilda shot herself in the foot with her “bullet.” if she’s not already shooting blanks.

      Everyone here should realize this might work out to our favor. Think about it, employers hire illegals because they work for a lower wage. Now illegals know they won’t be deported, and know they can complain if they are paid less than minimum wage. That means they have to pay the illegal the same wage, and there may still be an extra fine for hiring one. Sooooo, what is the incentive to hire illegals again?

      Just sayin, this might be the stupidest move they could make trying to get the illegal vote if they end up making it cheaper to hire Americans. Could solve the immigration problem if illegals can’t find jobs.

      I‘m a caucasian male that was born in Texas 72 years ago but lately I’ve been tempted to illegally immigrate to Mexico so that I can illegally immigrate to the USA. Why not ? The illegal immigrants (10 to 12 million) have ALL the privileges and benefits of American citizens but don’t have to pay social security or income taxes. If they committ a crime in the USA, including murder, they simple cross the border into Mexico and they become untouchable. How can a bureaucrat like Solis enter into an agreement with a foreign country concerning illegal immigrants without the approval of Congress ?

      It’s amazing how bureaucrats (not elected) in Washington DC can make up new “laws” while completely ignoring existings laws. This starts with Obama and trickles down to the lowest level of government. Isn‘t it part of the US Congress and Senate’s responsibility to establish laws in the USA ?

      Sounds great except they are not the ones hiring them, EMPLOYERS are. Time to crack down on the practice of hiring them, the second crime committed here after the worker being illegal. There is no good reason not to check the immigration status and SS for all workers. A rather large number of employers are knowingly hiring these individuals. Perhaps a per occurrence fine of $250,000 and some jail time for the owner will deter the practice. The posts here are all interesting answers to the wrong question in this case. We need to close the border and aggressively deport illegals. But employers need to stop hiring workers they know are illegal.

    If they start enforcing minimum wage laws for illegal immigrants, then this eliminates the largest reason why employers hire illegals in the first place, so this may lead to less illegal immigration due to fewer lower-then-minimum-wage jobs available. I don’t see the downside.

      You are right. It will chase out the illegal workforce maybe. But only if the ones ignoring the rules now become afraid to hire illegals. There is no inforcement on illegal hiring now, everyone knows that, but if there is enforcrment of the minimum wage payments to illegals, employers will not hire then. They want cheap labor, not minimum wage labor.
      I think this may backfire on the idiot do-gooders and the illegals will be force back home because of no work.

      And working hard to keep his job. He sees the polls and knows he has lost some voters so he will get new ones by usurping Congress and the people. This is the next step in his plan to give illegals amnesty. The republicants are as much to blame b/c they continue to sit back and do nothing.
