Lawyer: Jailed American Hikers Held in Iran Could Be Released

TEHRAN, Iran (AP) — Two Americans jailed in Iran on charges of espionage could be released after a court hearing slated for Sunday, their lawyer said.

Masoud Shafiei said Saturday the fact that the session in the trial of Shane Bauer and Josh Fattal would coincide with the second anniversary of their arrest may indicate that they will be freed.

The Muslim world also has a tradition of pardoning prisoners for the holy month of Ramadan, which starts early next week.

The two men and Bauer’s fiancee, Sarah Shourd, were detained on July 31, 2009, and Iran accused them of illegally crossing the border to spy. Shourd was released last year on $500,000 bail and has said she won’t return to Iran for trial.

They deny the charges and claim they were only hiking in a scenic, mountainous area in the semiautonomous Kurdish region of northern Iraq, near the Iranian border.

The lawyer said Shourd has not been summoned for Sunday’s trial session, and he thinks that’s another indication that the case is almost over and his clients will be freed.

Shafiei suggested the court could convict the two but then sentence them to time served.

“They’ve spent two years of their life in jail in Iran, which will serve as their sentence. And tomorrow will coincide with the second anniversary of their arrest. My clients could be released should the court hearing be held tomorrow as planned,” he said.

Shafiei insisted the authorities have no evidence to prove espionage, and he pointed out the area where they were detained has a porous border.

“The espionage charge is irrelevant, and the charge of illegal entry is inconsistent with the facts. There was no clear border line and my clients are not guilty. I’ve provided a sufficient defense,” he said.

The U.S. government has appealed for the two men to be released, insisting that they have done nothing wrong.

    Only after it turned out that “hiking” was just a lame excuse for these California lunatics did everyone find out who they were.
    For your information, they had had a history of anti-american activities and propaganda, lived and studied Arabic in Damascus , Syria for 5 years while they were actively working against the US interests.
    They are is lamic converts and as far as I’m concerned they should be tried for treason and subject to the most severe penalty the law could give them.
    Don’t forget that besides bashing America in the Arab world they highly contributed to increasing the anti-american sentiment around the world by the embarassing foolishness of their acts.

    I cannot believe some of you and your comments. You knew nothing of these young people until they were arrested and put in jail in Iran. You knew nothing of their personal lives and now all of a sudden you are experts and know everything about them. Whether or not it was right or wrong of them to go hiking where they did, they are Americans being held by one of our enemy’s, an enemy that want’s nothing more than to see America destroyed. What if they were your own children, would you say the same thing that most of you are saying? I care less what side of the political fence they stand, they are Americans and are humans who deserve to come home to their families. Must be nice to sit on here and be a judge and jury to these 3 young people who more than likely are innocent of any wrongdoing.

      Why does anyone go hiking in this area. Unless armed body guards are with you, you have to examine your sanity. The Ozarks, Cascades, or any mountain range here is just peachy.       What better place to go hiking than the border region of a country half-way around the world- where the US just happens to carrying on a war for what 8 years. Just minding your own business, and allasudden BANG and you‘re being held in another country’s (Who, by the way, isn’t exactly what you would call an ally either). I don’t see a problem with some lawyer, or more likely a team of lawyers drawing a paycheck from the state department for 15 months. Or am I over simplifying the issue?

Why did he smoke pot and go hotdog skiing, bust his face, drop Quaaludes and sleep it off instead of seeing an ER? He was young and stupid.
