Liberal Legal Scholar Alan Dershowitz Calls Prosecutor‘s Affidavit in Zimmerman Case ’a Crime’

Things have not been looking good for the prosecution in the case of Trayvon Martin since affidavit written by prosecutor Angela Corey got into the hands of the media. The affidavit has been roundly mocked by pro-Zimmerman observers and greeted either with silence or open horror by pro-Martin observers. In fact, one of the more well-known liberal law professors at Harvard Law School told Megyn Kelley point blank today that the affidavit was so incompetently done it rises to the level of a criminal offense:
“This affidavit,” he said, “submitted by the prosecutor in the Florida case is a crime. It’s a crime. If she in fact knew about ABC News’ pictures of the bloody head of Zimmerman and failed to include that in the affidavit, this affidavit is not the truth, the whole truth and nothing but the truth.”[...]
The prosecution’s goal, Dershowitz explained, is to present all the details and evidence of the case in order to pursue justice, not merely to seek justice solely for one side of the case. And “you don’t indite based on false information,” he told Kelly.
“Now, one of the problems,” he continued, “is because they’ve indited for second degree murder — and there’s nothing in this affidavit that suggests second degree murder, the elements of second degree murder aren’t here — the expectations have been reduced. There’s an article today in one of the… the Daily Beast saying “there’ll be riots in the street if there’s an acquittal.” If there are riots, it’s the prosecutor’s fault. Because she over-charged, raised expectations. No reasonable jury is going to convict based on the evidence I know of second degree murder. So this prosecutor not only may have suborned perjury, she may be responsible if there are going to be riots here for raising expectations to unreasonable levels.”
Probably the most embarrassing part for those crying for a conviction comes when Dershowitz out and out states that “any reasonable judge” would “throw out” the charge of second degree murder.

If that gets you so upset you should stick to the funnies. Indict is one of the most misspelled words used. It happens. If you se a lote of badd spellinng. Like I just did. Yea that’s upsetting. But detracting even from someones article you want to detract from, for one commonly misspelled word or a typo is anal.
Don’t be anal.
I hardly ever use spell check and I spell and punctuate quite well. But I‘m usually talking and typing at the same time like now and it’s so childish when an anti-blogger tries to torpedo me for misspelling. Now I do understand this is supposed to be a professional report etc. However I bet,, hang on. Yes, indict/indite are commonly misspelled/misused words. So relax. Or I’m liable to have to type this ridiculous paragraph over again. :P

When The Blaze just copies and pastes articles from other sites and all they create is the title, they manage to make make spelling and grammar errors in the title itself. it is very funny and sad.

However, we should expect more from published pieces, whether it is a book or an article on a website, in a newspaper or in a magazine. Paid authors and editors combined should be able to do better than that. It seriously detracts from their credibility and professionalism.

Posted on April 25, 2012 at 6:50pmThis reminds me of another case I heard of in which police officers had used extreme force in subduing the suspect. In this case, while the officers in question might have genuinely been guilty of police brutality and could have potentially been convicted as such, most of them got acquitted because the prosecution chose to charge them with what amounted to the equivalent of attempted murder. Incidentally, the victim in that case was also black.

I usually am not a spelling nazi on blogs. But
1) This is a pretty important word in this article.
2) This isn‘t the first time you’ve made the malapropism or homonym error.
3) You’re supposed to be a freaking journalist!
Spell check won’t do it since you used a real word. Just not the right word.

How is that the rule of law? We don’t go for big, unsupported charges based on people’s emotions. We pursue cases based on the facts. Or do we?

Report Post »I am not suggesting total innocence. I do believe he should have made different choices in this situation but I do not think he had ill intent here.
We should all know that this man his family and his CLOSE neighbors have been the victims of young black men breaking into homes and in one case Zimmerman’s NEXT DOOR NEIGHBOR was home and hid herself in a room while her home was being INVADED. (Black or White a criminal is a criminal)
Whether or not Zimmerman is guilty of a crime at this point is almost irrelevant. This man has been tried and convicted without so much as a trial before charges were brought. We have a prosecutor and DOJ that is after points with the likes of race baiting Sharpton while using our Constitution as toilet paper!
This is a dangerous road we have found ourselves on. Because of things like this were true justice is not pursued we are all in danger of finding ourselves in Zimmerman’s cell…..
America is fast becoming unrecognizable.
I am not sure we can recover from the likes of the BHO administration. What a disgrace he and the DOJ have been.

That is EXACTLY the problem with this case….it is about color NOT justice.
This was no child…he was young but no child.
A CHILD could not have overpowered a grown man…a CHILD would not be allowed to roam the streets at night alone! (without the parents being charged with a crime) It is tragic that this young MAN lost his life at such a young age but it does not look to me (based on what is public info) that Zimmerman was out looking for a black man to gun down.
Read about the crimes this man his family and neighbors have had to endure RECENTLY and you may change your tune. (Unless color is all you can see.) When seconds count the police are only minuets away. Would you have done any thing differently? How could you know if you have never been in that situation?
I do not know if a crime was committed by Zimmerman that night but it was NOT murder. (Again based on what I know that is public.) If he committed a crime ANY crime he needs to be tried by a JURY IN A COURT ROOM and we need to let them decide that NOT you, me or the race baiting Sharpton.
By any logical standards this was no CHILD……..

Most liberals want Zimmerman found guilty and the key thown away, but he is standing on the side of justice. I think he is the old fashioned liberal. But this prosecutor is doing this for political reason and probably promised a lucrative job afterwards so she doesn’t care about the sloppiness.

No problem, there are plenty of unreasonable judges. Mark Levin said the same thing about the affidavit the day it came out. The prosecution is required to present all evidence, both for and against, in its entirety, and they presented a couple of little pieces mixed in with supposition, and no evidence meeting the high standard of 2nd degree murder charges.

Posted on April 25, 2012 at 6:01pmI just saw Dershowitz explain this on GBTV. He has guts to say it publicly. I believe he is right. The case is terrible and may very result in an acquittal.
I am concerned about justice in this case. I am considering donating some money for Zimmerman’s defense. It would be a small contribution to try to level the playing field and make sure he has competent representation who will do their job. Its important that the justice system be allowed to work and to the devil with those who threaten violence if “their verdict” isn’t the one handed down.

Zimmerman who is out on bail and his wife are having to go between 4 safe houses and wearing a bulletproof vest because the state has decided that they will let thugs run the state. He has asked for the state to help protect him (as I understand it he and his lawyers have set up what they can for “safety”).. NBPP .. and others have put a BOUNTY on his head .. and NO ONE is arrested? I am so sick of this ..
