Liberal Legal Scholar Alan Dershowitz Calls Prosecutor‘s Affidavit in Zimmerman Case ’a Crime’

Things have not been looking good for the prosecution in the case of Trayvon Martin since affidavit written by prosecutor Angela Corey got into the hands of the media. The affidavit has been roundly mocked by pro-Zimmerman observers and greeted either with silence or open horror by pro-Martin observers. In fact, one of the more well-known liberal law professors at Harvard Law School told Megyn Kelley point blank today that the affidavit was so incompetently done it rises to the level of a criminal offense:

“This affidavit,” he said, “submitted by the prosecutor in the Florida case is a crime. It’s a crime. If she in fact knew about ABC News’ pictures of the bloody head of Zimmerman and failed to include that in the affidavit, this affidavit is not the truth, the whole truth and nothing but the truth.”[...]

The prosecution’s goal, Dershowitz explained, is to present all the details and evidence of the case in order to pursue justice, not merely to seek justice solely for one side of the case. And “you don’t indite based on false information,” he told Kelly.

“Now, one of the problems,” he continued, “is because they’ve indited for second degree murder — and there’s nothing in this affidavit that suggests second degree murder, the elements of second degree murder aren’t here — the expectations have been reduced. There’s an article today in one of the… the Daily Beast saying “there’ll be riots in the street if there’s an acquittal.” If there are riots, it’s the prosecutor’s fault. Because she over-charged, raised expectations. No reasonable jury is going to convict based on the evidence I know of second degree murder. So this prosecutor not only may have suborned perjury, she may be responsible if there are going to be riots here for raising expectations to unreasonable levels.”

Probably the most embarrassing part for those crying for a conviction comes when Dershowitz out and out states that “any reasonable judge” would “throw out” the charge of second degree murder.

    Oh My Gosh! Professionals should know which word goes where. I do hope you meant indict, not indite. Don’t trust spell check. It makes you look stupid. Great story, ruined.

      Your being USED by Dershowitz, GLENN… Justice, Sharpton, Panthers and Obama ALL need someone else to BLAME for the violence… Alan D. blamed COREY (and oddly, did not know??? that she was a Republican put in the position of Trayvon trial, by Republican Gov.Scott???)… BLAMED Angela Corey for any violence yet to come… I’LL BET, that Alan D. CALLED you, GLENN to be on your show and NOT the other way around…. YOUR BEING USED GLENN… OPEN YOUR EYES!

      First off.
      Calm down.
      If that gets you so upset you should stick to the funnies. Indict is one of the most misspelled words used. It happens. If you se a lote of badd spellinng. Like I just did. Yea that’s upsetting. But detracting even from someones article you want to detract from, for one commonly misspelled word or a typo is anal.
      Don’t be anal.
      I hardly ever use spell check and I spell and punctuate quite well. But I‘m usually talking and typing at the same time like now and it’s so childish when an anti-blogger tries to torpedo me for misspelling. Now I do understand this is supposed to be a professional report etc. However I bet,, hang on. Yes, indict/indite are commonly misspelled/misused words. So relax. Or I’m liable to have to type this ridiculous paragraph over again. :P

      Marie, there are very few stories here on the Blaze that do not have spelling and grammar errors. When The Blaze just copies and pastes articles from other sites and all they create is the title, they manage to make make spelling and grammar errors in the title itself. it is very funny and sad.

      @Crazyrabbit — regarding the average comment post, I agree is isn’t a big deal to overlook misspellings. However, we should expect more from published pieces, whether it is a book or an article on a website, in a newspaper or in a magazine. Paid authors and editors combined should be able to do better than that. It seriously detracts from their credibility and professionalism.

      The prosecution indited a man with serious offense without a grand jury….That in itself is a 5th amendment constitutional rights violation. Basicly the trial is already over….This is just a show for the native getting restless and a multi-million dollar waste of tax dollars

    This reminds me of another case I heard of in which police officers had used extreme force in subduing the suspect. In this case, while the officers in question might have genuinely been guilty of police brutality and could have potentially been convicted as such, most of them got acquitted because the prosecution chose to charge them with what amounted to the equivalent of attempted murder. Incidentally, the victim in that case was also black.

    Please learn the English language properly. It’s “indict”, not “indite”. Two completely different words.

    I usually am not a spelling nazi on blogs. But

    1) This is a pretty important word in this article.
    2) This isn‘t the first time you’ve made the malapropism or homonym error.
    3) You’re supposed to be a freaking journalist!

    Spell check won’t do it since you used a real word. Just not the right word.

    Why can’t this inept and scoudrel of a prosecutor be indicted and arrested for not including ALL the facts and evidence in the affidavit and pursuing an unsupported charge? How is that the rule of law? We don’t go for big, unsupported charges based on people’s emotions. We pursue cases based on the facts. Or do we?

      This case diminishes us all. There is NOTHING that I have seen or heard that would indicate that this man had MURDER on his mind that night.
      I am not suggesting total innocence. I do believe he should have made different choices in this situation but I do not think he had ill intent here.
      We should all know that this man his family and his CLOSE neighbors have been the victims of young black men breaking into homes and in one case Zimmerman’s NEXT DOOR NEIGHBOR was home and hid herself in a room while her home was being INVADED. (Black or White a criminal is a criminal)
      Whether or not Zimmerman is guilty of a crime at this point is almost irrelevant. This man has been tried and convicted without so much as a trial before charges were brought. We have a prosecutor and DOJ that is after points with the likes of race baiting Sharpton while using our Constitution as toilet paper!
      This is a dangerous road we have found ourselves on. Because of things like this were true justice is not pursued we are all in danger of finding ourselves in Zimmerman’s cell…..
      America is fast becoming unrecognizable.
      I am not sure we can recover from the likes of the BHO administration. What a disgrace he and the DOJ have been.

      He stalked and murdered an unarmed child who was returning from the corner store with ice tea and skittles and was on the cell phone with his girlfriend. He should have been charged immediately.

      The ‘child’ was in the process of killing Zimmerman when he was rudely interrupted by Zimmerman’s firearm and Martin deserved his fate.

      You are acting as if there are no dangerous young black men involved in gangs, rape, drugs, assault and burglary. ( There are young white MEN doing the same things btw)
      Would you be this upset if it were a young white man and Zimmerman was black?
      That is EXACTLY the problem with this case….it is about color NOT justice.
      This was no child…he was young but no child.
      A CHILD could not have overpowered a grown man…a CHILD would not be allowed to roam the streets at night alone! (without the parents being charged with a crime) It is tragic that this young MAN lost his life at such a young age but it does not look to me (based on what is public info) that Zimmerman was out looking for a black man to gun down.
      Read about the crimes this man his family and neighbors have had to endure RECENTLY and you may change your tune. (Unless color is all you can see.) When seconds count the police are only minuets away. Would you have done any thing differently? How could you know if you have never been in that situation?
      I do not know if a crime was committed by Zimmerman that night but it was NOT murder. (Again based on what I know that is public.) If he committed a crime ANY crime he needs to be tried by a JURY IN A COURT ROOM and we need to let them decide that NOT you, me or the race baiting Sharpton.
      By any logical standards this was no CHILD……..

      You base your statement on what? You are making the assumption that she is competent and ethical. Based on the explanation from Alan Dershowitz (among others), it appears that she is lacking in one or both of those qualities.

      Dershowitz maybe liberal but I find most of the time honest. Most liberals want Zimmerman found guilty and the key thown away, but he is standing on the side of justice. I think he is the old fashioned liberal. But this prosecutor is doing this for political reason and probably promised a lucrative job afterwards so she doesn’t care about the sloppiness.

    Hope this prosecutor gets NIFONGED that’s what she deserves. Duke Lacrosse all over again no evidence to support true wrong doing but doesn’t matter blacks want blood and Al Sharpton and Jessie are out there whipping up the hate and the crowds. Think can speak for most whites we’ve had just about enough of this nonsense.

      Wow guys tell me I am not hearing what I think I am…..All we should be wanting is TRUE JUSTICE not a race war!!!! Our leaders should be going after the Black Panthers as hard as they would the KKK!!! The ONLY reason they don’t is because they ( this administration ) needs us at each others throats!!!
      If we continue to look at our different colors we will not see the injustices going on around us by the EPA,DOJ,TSA ect.
      This should NEVER have been about a young black man getting shot by a trigger happy white guy but about true JUSTICE.

    No problem, there are plenty of unreasonable judges. Mark Levin said the same thing about the affidavit the day it came out. The prosecution is required to present all evidence, both for and against, in its entirety, and they presented a couple of little pieces mixed in with supposition, and no evidence meeting the high standard of 2nd degree murder charges.

    This whole thing is ridiculous! Their is an eye witness to the fight.
    Zimmerman was back to his truck when Trayvon attacked him.
    If Zimmerman was stalking him they would not be back to his vehicle which means that Trayvon stalked Zimmerman!
    The fact that the press keeps calling him white when he is Hispanic is a sure sign of trying to fuel the racial fires.
    The major news organizations are about as sick as it gets when you have out & out lies about a story just because of left v’s the right BS going on!
    This is not a F***king game it’s peoples lives you A&& holes.
    Theirs a guy laying the hospital all because of how this story was reported.

    I just saw Dershowitz explain this on GBTV. He has guts to say it publicly. I believe he is right. The case is terrible and may very result in an acquittal.

    I am concerned about justice in this case. I am considering donating some money for Zimmerman’s defense. It would be a small contribution to try to level the playing field and make sure he has competent representation who will do their job. Its important that the justice system be allowed to work and to the devil with those who threaten violence if “their verdict” isn’t the one handed down.

    Wow………I knew I didn’t like that smiley, smirky Angela Corey. Looks like her desire to be in the limelight and her willingness to indict Zimmerman to soothe racists like the NBP’s and Sharpton is going to backfire on her. I hope it does too.

    Some people may not like Alan Dershowitz but he is a brilliant attorney.

    Wheres the control of whats being done here? The end result is bound to be declared a war on race. Martial Law is right around the corner and the way he is using his power of mandates with no backlash from Congress…. his power is huge.     Zimmerman is innocent. What happened to ‘innocent until proven guilty’??? I guess when blacks want you arrested all of this ‘constitutional rights’ business goes out the window. The state of Florida is has a cowardly government. They should not have arrested a man for protecting his own life. They made up facts to arrest a man because he killed a black in self defense. I am tired of riots and the threat of riots from blacks are anyone else. That is why we have the police force and the National Guard…..to protect people and property from rioters and other things. We also have the 2nd amendment to protect the individual. Let the riots begin…I look forward to them. Zimmerman should be free.

    The Martin case really has nothing to do with Sharpton and the Panthers. They’ve been called to create chaos and meyhem along with OWS, and the Martin case is a convenient excuse…especially because there will most likely be an aquittal. They’ve already greased the skids with misinformation and inflammatory rhetoric.

    Zimmerman is being persecuted not prosecuted under the law and the State of Florida .. I live in Florida .. Zimmerman who is out on bail and his wife are having to go between 4 safe houses and wearing a bulletproof vest because the state has decided that they will let thugs run the state. He has asked for the state to help protect him (as I understand it he and his lawyers have set up what they can for “safety”).. NBPP .. and others have put a BOUNTY on his head .. and NO ONE is arrested? I am so sick of this .. I have contacted the Governor ..if you would like to also .. please feel free … you can use as county Charlotte and the zip as 33981 ..

      Here is something else you are NOT hearing on the MSM … the Sanford City Commision has rejected the Chief of Police’s regisnation .. the same people who asked him to step down .. now that more FACTS are coming out they want to wait.

      Naw, I saw one very vocal member of the City Council REJECTING the letter of resignation. She ran the entire gammet and then some. Most of all-she RAN THE CHIEF’S OWN RECORD through the gammet. Turns out-that Community HAS a voice. The voice says, this guy has done a good job and we will NOT QUIT on him.

    Alan Dershowitz has enough integrity to turn against his own liberal mob. The Al Sharptons of this world are doing exactly what whites did to them a century ago…as a black mob seeks to lynch Zimmerman despite a fair trial so far.
