‘Like Food Nazis’: Did a Calif. Health Dept. Come to Homes to ‘Confiscate’ Contaminated Raw Milk?

Did Health Department Officials Try to Confiscate Contaminated Raw Milk in California?

Organic Pastures, a dairy farm run by the McAfee family near Fresno, is California’s first raw milk dairy farm that has certified organic land as pasture for its herd. Earlier this month, though, the farm was placed under quarantine due to reports of harmful bacteria found in samples of some dairy products and cow manure.

The California Department of Food and Agriculture cleared the farm on Friday after eight days of quarantine as now meeting all food safety and sanitation standards. What some found unusual, however, is how individual customers of the dairy products were contacted, some even saying officials tried to “confiscate” their legally-purchased milk. Although, officials have said they did not try to take milk for individuals but were simply informing all people about the recall of the contaminated milk.

Natural News reports the founder of Organic Pastures Mark McAfee said he was told by one of his customers during the quarantine time frame that she was called repeatedly by the health department of L.A. County and told to give up her raw milk. Here’s more of McAfee‘s account of the events as told to him by one of his customers that has milk dropped off at her home from the dairy farm via UPS:

[...] they showed up at her house and demanded that she give her raw milk to them. She was getting ready to call 911 for the Sheriff’s department and have them removed from her front doorstep, and she was threatening to use her camera to take a picture of them and post it on Facebook for harassing her over her raw milk… The investigators left after she told them she was not going to give them the raw milk and to get the Hell off her property.

This is what’s going on, it’s like food Nazis, it’s incredible what these people are doing, trying to collect food from people’s houses, that have not made them ill!

McAfee stated that a secretary had mistakenly given out his customer’s contact information. Later, he said, the San Diego health department contacted him to for names and addresses, but he refused to provide them.

The Blaze contacted the California Department of Food and Agriculture, which gave the farm the green light to start distributing its products again on Friday. It said it was standard protocol for customers to be contacted during a time of contamination. A spokesperson for the CDFA wrote in an email, “Generally, during a recall, it is standard practice for health officials to use a dairy’s distribution list (usually retail outlets, but may include individuals) to verify that the producer has notified its customers in compliance with the provisions of the recall.”

The Blaze has also contacted the L.A. County Health Department for more details on their protocol in food contamination situations. Angelo Bellomo, director of environmental health for the department, emphasized that this issue was not between raw and pasteurized milk but about informing the public on a potentially contaminated product during this time period. Similar to any food recall, Bellomo said contact is made to sites that may have the product in question. Usually these are commercial entities, but in the case of Organic Pastures, eight individuals were on the list. Bellomo said phone calls were made to ensure they knew about the recall. One site visit was made, but he said no one was at home at the time and the inspector left.

Raw milk, according to the Real Milk campaign that is run by the Weston A. Price Foundation, is unpasteurized, unprocessed, straight-from-the-cow dairy. Advocates of raw milk say it tastes better and preserves more of the health benefits than the average gallon jug consumers can get from the grocery store. The group states that  concerns about contamination over milk not being pasteurized — a process that heats the milk for a length of time to kill pathogens — are exaggerated.

The U.S. Center for Disease Control maintains that pasteurization is necessary to make milk safe and states that studies have shown it does not degrade the product’s nutritional value. The U.S. Food and Drug Administration also debunks what it considers “myths” about pasteurization’s effect on dairy and also believes milk products should be pasteurized.

Where and how raw milk is available for purchase in the United States varies by state. (Image: Farm-to-Consumer Legal Defense Fund)

Legality of raw milk sales in the United States varies. Most recently, raw milk dairy farmers in Minnesota — a state that allows for raw milk sales at the farm where it is produced, according to the Minneapolis Star Tribune — are in a legal battle where a 2-year-old got seriously ill from a bacterium he obtained after drinking the milk given to him from his parents. The parents are seeking damages for medical expenses associated with the incident, which happened two years ago. The Star Tribune reports a judge recently said the parents should have been aware of the risks associated with raw milk but still ruled that the farmer had been negligent. It is expected the case will be heard by a jury.

Although law varies by state, in California where raw milk sales are legal, those cartons must contain the following warning: “Warning – raw (unpasteurized) milk and raw milk dairy products may contain disease-causing micro-organisms. Persons at highest risk of disease from these organisms include newborns and infants; the elderly; pregnant women; those taking corticosteroids, antibiotics or antacids; and those having chronic illnesses or other conditions that weaken their immunity.”

Natural News considers the recent events in California as “food police” reaching “right into your refrigerator.” In a separate case, a Wisconsin judge ruled in Oct. 2011 that individual families owning their own cow are subject to the rules and regulations of the state. If the milk was not pasteurized, they couldn’t drink it:

“It’s always a surprise when a judge says you don’t have the fundamental right to consume the foods of your choice,” said [Pete] Kennedy [with the Farm-to-Consumer Legal Defense Fund].

Oregon is going through its own legal issues over raw milk due to a recent E.coli outbreak that sickened 20, including four children. The Oregon Dairy Farmer’s Association is pushing for a crackdown on unpasteurized milk, according to the Oregonian. Only small farms can sell the raw milk within the state.

Watch this video profile from The Oregonian of a mother telling why she and her children are fans of raw milk:

What are your thoughts on the raw milk debate?

This story has been updated to reflect that McAfee’s customer said it was L.A. County Health Department officials who came to her house to “confiscate” the milk. The Blaze spoke with an official and updated the story accordingly to reflect the department’s protocol, which includes contacting those who may have contaminated products but did not involve confiscation of the milk.

I’ve been a city boy all my life and stopped drinking store bought milk many years go. It’s illegal in my state so crossed the border and got some raw milk. It was so good. I happen to know it’s good for me and will continue to buy it. Sure it’s more expensive and my body is worth it. I’m 70 years old and very healthy

I personally believe it is your own decision. The government has NO BUSINESS making that decision for you. The best case I would make for the state is they should have all information, pro & con , for milk and all other foods. hen it is your decision.

My entire family grew up drinking milk fresh from the cow and never had milk related problems, and never had a DoH inspection of any cows, either.
What we put into our bodies or who we buy (it) from is none of the government’s business.

My dairy farmer friend drinks it straight from the cow (well almost). She and her children are some of the healthiest people I know. Never sick. Personally, I boil the raw milk, then chill it in order to skim off a thick layer of the most delicious cream you’ll ever taste. After the first couple of gallons of raw milk straight from the farm– we’ve never gone back to indigestable homogenized milk.
Anyone who tells you that humans are made to digest molecularly altered (homogenized) milk is lying.

Of course it’s illegal to buy raw milk. It takes money out of the pockets of those that pasteurize and homogonize the milk. I grew up on raw milk because my grandma had a cow. The only time I didn’t like it was when the cow got into an onion patch (talk about free range, this cow had a big yard to roam in). Up until I joined the Navy in 1984, she would make sure if she knew I was coming that she had a gallon of fresh cow’s milk in the fridge for me. I absolutely love it and wish I could find it again. We actually drank it skimmed, because she made butter with the fat, if Grandpa didn’t drink it.

if one wants to drink raw milk go for it, but I would want to know the source of the milk and how it was handled. We had goats and there where times that the milk was unfit to drink. We would filter the milk and yes most time pasterize the milk. I personally don’t care for warm milk so No drinking straight from the teat. My average breakfast was 2 raw eggs chased by a quart of milk.

I am also just about as far right as one can be, and I drink raw milk every day. I eat organically, avoid GMOs, and my basic philosophy is to try to get as close as possible to the food God provided for us in Creation. It ticks me off when people call me a hippie, though, for liking raw milk and cloth diapers and organic foods!

The propaganda that the government is spewing is really what makes me angry. They are saying that raw milk is deadly. There have been ZERO deaths due to raw milk in the past 50 years, but over 260 due to pasteurized milk…and raw milk is illegal??? They just can’t control it, that’s why they hate it. Quit telling me what I can and can’t eat. Oh, and recently a judge ruled that you don’t have an inherent right to consume milk that you own from a cow you own. So I can own the cow but can’t drink the milk? Seriously??? This is just stupid.

I actually used to be against all this raw and organic stuff because I associated it with this hippie environmental movement (it still turns my stomach for cloth diapers to always be advertised as “green” as if that’s the only reason someone would want to use them). I wish conservatives had a louder voice in these things I care about, because now I have to defend my “crazy” ways to my friends and family!!! The next baby will hopefully be a home birth, or at least a midwife birth with no medical interference or drugs. We drink raw milk and have an organic garden, and we have chickens for eggs. We want to do more eventually, but we’re taking it a step at a time.

Around the time of the Industrial Revolution, populations began moving off the farm and into town. Cows were kept in tight quarters standing knee deep in fecal matter. They were fed the leftovers from the whiskey distilleries…ie: grains. Cows stomachs aren’t meant to digest grains, but grass. The combination of diet and filthy living conditions is what first caused deaths from raw milk. This is when pasteurization was invented. While it’s touted as a remarkable discovery, all it really did, IMHO, was treat the symptom instead of providing a remedy for the root cause of the poisoning.

When cows are kept clean and healthy and allowed to graze on grass, and handled and milked in sanitary conditions, the risk is so incredibly low for getting a food borne illness. Besides, in studies on raw vs. pasteurized milk, when harmful bacteria are introduced to raw milk, the good bacteria present in the milk attack and kill off the harmful bacteria in a similar manner as how human white blood cells attack bacteria and viruses in your system. Pasteurization kills the good with the bad, and basically strips milk of all it’s nutrient value.

Wrong, wrong, wrong. First off, you have the side who is willing and will take responsibility for themselves, then you have the group that wants everything made safe for them like they are toddlers in a child-proofed home. Those who can read proper labeling and make up their own mind about a product and its’ risks vs. its’ rewards are the ones calling for less government intervention and control. The group that wants to just skate through life expecting everything to be safe and nothing to possibly have a sharp corner, are the ones crying out when they get salmonella from eating raw eggs or excessively old food that has been sitting in a warm place.

You are conflating these two separate groups as a single entity and it is easy to see why. It is obvious to all the most dull of us that you are part of the toddler group. Have a nice day.

I drank raw milk from the time I was born until I was in my early 20s, then again, later on, when I had a child who had problems with pasteurized milk, we started getting raw milk – WHICH SHE COULD TOLERATE. Seems that pasteurization not only destroys bad bacteria but other bacteria necessary for proper digestion in SOME people. This daughter was breastfed until she was a year old – she’s allergic to soy formulas, so goat milk or raw milk is all she could safely tolerate. If they did that, they might run the risk of having a morally and mentally strong person on the jury. There are numerous cases where they have specifically hand-picked dullards and morons to be jurors and then the judge can and will be able to tell them “ the law” and what they as jurors “must” do. There is nowhere left that you can get a real jury trial. Anymore, all you get is a trial by tyrant judge through a group of middlemen who are moronic and threatened with criminal prosecution for developing their own opinions on anything. The Jerome Ersland case is a good one to point to. And if you don’t like police, I’d submit the murder of Sergeant of Marines, Jose Guerena as evidence that we live in a police state and reason to distrust every government employee.
