Local Government Tries to Regulate Businesses Out of Existence So They Won’t Have to Compensate the Owners

The practice by local governments of using the power of eminent domain has a long and storied history in America. Indeed, it’s written into the constitution that governments can seize private property, provided they use it for a public good and pay the owners “just compensation.”

The first of these requirements has been eroded down to nothingness since the case of Kelo v. City of New London. However, the second one has remained in force, and been an effective deterrent against governments taking away property willy nilly, since all the costs would add up in theory.

Unfortunately, Ventura County in California has found a way around this limit by using zoning regulations to make it so prohibitively difficult for businesses to exist that the owners just pack up and leave of their own volition. This video from Reason Magazine explains the extremely sleazy approach involved:

The video centers on two local businesses – one of which, the Pine Mountain Inn, has been around since the 1930s, and hosted the likes of the Hell’s Angels.

The inn was forced to close down in 2002 when the owner, Tom Wolf, had a heart attack. Yet now it’s being stopped from reopening because, according to the county, this building has numerous zoning violations, including an unauthorized chicken coop.

There’s just one problem – not only is the idea of an unauthorized chicken coop natively ridiculous, but according to the business’s owner, there is no chicken coop on the premises at all. That’s right, the authorities have resorted to accusing the Inn of violations for buildings that don’t exist on the property.

Why? According to the video, because the local government doesn’t like the fact that there are human beings living out in the rural parts of Ventura County and spoiling it for the wildlife.

“They wanted a complete open space with nothing but deer and frogs and no people,” says Tom Wolf, the owner of the Pine Mountain Inn.

And no, this isn’t just the railing of a bitter business owner. There is an actual policy on the books in Ventura County that prevents any economic development of the rural areas in Ventura County. Fair enough, but what about the businesses that already exist in those areas? Apparently, the county’s proposed solution is to basically force all the rural residents into the urban center so as to get rid of all these messy, environmentally unfriendly humans.

And this, too, they could probably do, if they just used eminent domain to take over the land that the Pine Mountain Inn is on, and paid Wolf for his property. But Ventura County is too cheap to do that, and so they’re trying to use bureaucratic red tape to force Wolf to close his business rather than just seize it and pay him up front.

Wolf sued Ventura County back in 2010 over this behavior, and it’s unclear whether there has been any movement on the case since the suit was filed. Unfortunately, he‘s not the only one who’s been targeted using this underhanded, sleazy approach to land management. Another restuarant that has suffered similar treatment is a Bed and Breakfast called “The Wheel,” whose owners say they’ve been hit with every conceivable safety violation under the sun in an effort to get them to close down.

Fortunately, there is a group that is trying to help – namely, the Ventura County Coalition of Labor and Business, whose executive director has a very good question about these kinds of cases, according to Reason’s article on the same subject:

“If there isn’t someone complaining, and there isn’t really a serious public health and safety issue, why do they spend so much of their time pursuing these kinds of cases?”

Why, indeed?

      There is an easy fix to these sort of things: (1) everyone should fully support businesses whom city officials are trying to use eminant domain on in order to steal their land, (2) make each person who votes in favor of stealing land via eminant domain personally liable and able to be sued in a court of law by the home/business owner.

      More of the UN Agenda 21 happening all around the states. Keep fighting back and contact your Senators and Representetives and tell them NOT to impliment Agenda 21. The UN has no business telling America how to run our country. The UN wants us all in apartment complexes in city clusters so the land can be used for their benefit. Land is more important to the UN than people.

      That is the best way to deal with this – LEAVE! Starve off any state that allows this kind of treatment – take your tax money and go to a more property-friendly state – while you still can! Support the states and cities WHO SUPPORT YOU. Don’t keep giving your tax money to states like California who encourage the invasion of illegal aliens and run their states into the ground and use regulations like weapons. California is a HOLE and the “big one” can’t come soon enough for me so I can enjoy watching that state slide off into the ocean complete with all the illegal alien Mexicans who have invaded it.

      I lived in the Bardsdale area of Fillmore, under Ventura County jurisdiction.
      I lost my home after the 1994 earthquake, not because of the damage, my home was hit hard, I called county inspectors to inspect the home, I was yellow tagged.
      At the time of the inspection, it was noted that my brother was living in the granny cottage behind the garage.
      I was notified by Ventura County Building and Safety that my power was going to be shut off because of the natural disaster.
      I hired a structural engineer to review the property, he stated in writing that the home was safe to occupy while repairs were made.
      I took a copy of the letter and met with Bill Windroth, I believe he was head of building and safety.
      He looked at the letter, then asked if my brother was still living in the granny cottage, evidently the previous owner had an issue with Building and Safety regarding the granny cottage.
      He demanded I have my brother vacate the granny cottage and gave me 30 days, an extension of cutting my power which he only has the right to do under an emergency.
      After the earthquake there were few homes to rent, it took just over 30 days, I met with Mr. Windroth once my brother was out, he stated I was too late and cut my power.
      I fought back for a year trying to restore my property and power, I failed, I eventually lost the home.
      I hope Bill Windroth rots in hell along with all his spawn.

      So this is the situation… give up and abandon the State to the illegal aliens/“Mexicans”, refuse to pay Federal taxes, and wait for ‘the “big one”’ to slough off the State into the ocean thereby losing vast number of human lives, which God cherishes even though you do not.       Here’s some info on it from Wikipedia :

      Agenda 21 is an action plan of the United Nations (UN) related to sustainable development and was an outcome of the United Nations Conference on Environment and Development (UNCED) held in Rio de Janeiro, Brazil, in 1992. It is a comprehensive blueprint of action to be taken globally, nationally, and locally by organizations of the UN, governments, and major groups in every area in which humans directly affect the environment.

      This is not even a conspiracy. The EPA tried enforcing this recently against that couple in Idaho.

      This is something we all need to actively fight back against and communicate our outrage over to our congressman. Unless you like the idea of global government. Even so called “conservatives’ are pushing this agenda too..

      A lot of people saying they left California because of the government abusive regulations? What are you going to do when there is no place left to run? The first thing you should have done is bought a shotgun. Then become a vocal second amendment supporter. When you behave like ******* you will get picked on, of people know they will need to fight they think twice. This ideology that you should not be there is the brainchild of probably a handful of people. Why do you think take Mexican and black communities are united and get better results than their white counterparts? It is because the government fears the. White people packing up and running doesn’t really put the fear of God into people.

      I suggest everyone not familiar with Agenda 21, do a quick search and read one of the many sites on this U.N, mandate signed and delivered by Bush Sr., Clinton, Bush Jr., and Obama. Its one scary plan.
      It encompasses all the Federal, State and most local governments. Sustainable growth, reclaim the wild areas, stack and pack everyone into cities and population control. Not a peep out of our Main Stream Media.

      I have seen this same tactic used in Connecticut. A local cider mill-petting zoo-large animal vet was regulated and taxed out of business because the town wanted his land for “better usage” meaning they wanted his property to build McMansions on so they could collect more revenue for the town.

    Yep, that’s Ventura County…. where the Sheriff refuses to process Concealed Carry Applications, even though a judge has ordered him to do so….. Ventura County is also trying to close shooting ranges on FEDERAL Land, even though the county has NO jurisdiction…. where left-wingers can make death threats on the internet and in the Ventura County Star, kill your pets and paint swastikas on your property and the Prosecuting Attorney will REFUSE to file charges. Where illegal aliens rent garages and NO ONE cares. We‘re moving to Arizona to escape this Nazi Hell but we’ll be back when it’s finally time to pull the Nazi Hell down around their ears!

      I know how you feel to a degree.Stop and consider though.He may have been at the fight alot longer than you.He may see where he isn’t effective at the fight by living in the jurisdiction.Too many reprecussions.He may just be exhausted.Its one of the tactics sleazeballs use.Wearing you down is part of it.Unless he has left the fight all together don’t necessarily count him out.Please don’t turn your back on him either.You will need all the help you can get dealing with these people.I use the term people here very loosely.

      I escaped CA 3 years ago. It took many years of planning to make the escape, and 2 weeks to execute the plan.
      I got tired of high costs, low wages, the need to know 4 different languages, and the gang violence.

      My sister and her husband live in Ventura County. They are socialists / borderline Communists, receiving their indoctrination at Cal Poly SLO.

      Here’s the fundamental problem with that line of “logic”; that you’ve been taught by Glenn Beck: Extrapolation.
      For example: Isolated, alleged cases of Eminent Domain abuse DOES NOT logically extrapolate to the fulfillment of the “Agenda 21” conspiracy. This is true in exactly the same way that the flooding of our monetary system with printed dollars DOES lead to inflation but DOES NOT lead to the imminent collapse of the currency and Hyper-Inflation.       just finished watching the video CG. took alot longer because i had to stop and rewind because alot of it was not making sense to me. things like if people are more educated they’ll make more money and will consume more then will the poorly educated, with lower incomes that threatens our sustainability.       I would suggest to all of you to read the book “Eco-Tyranny – How the Left’s Green Agenda will Dismantle America” by Brian Sussman. Everything that is happening in our country and how America has reached this point will all make absolute sense.       A ) If you get an education, you are more qualified for higher paying work.
      B ) If you are more qualified for higher paying work, you have a better chance of finding a better job, even in the disastrous Obama economy.
      C ) If you have a better job, earning more money, you will spend more money and buy better things than if you had less money. This results in increased consumption, more money moving around the economy.
      D) Therefore, the more people who qualify for higher pay, the more sustainable we are.

      @ redwolf. that’s not what she was advocating. maybe i didn’t say it 100% correctly. the lecturer said after showing the quote that what she was advocating was for people to have less education than more. she wanted limited education, specifical only agenda 21 type education for our your to make them more accomodating to the ideas put forward by the UN to re-do America. watch the videa to see why i had a hard time with it, and sat smh. things like they want to take the right of private property and force all of us into tiny multi housing units and return the rest to nature. if you do have a sizable lot they want 65% of that lot THAT YOU OWN can not be developed by you, and the remaining 35% only 10% of that can have a building on it. through posters here that are by far and away smarter then me tried posting info on agenda 21 but if was only half grasping the magnitude of it. the video posted link by CG cleared it all up for me. what i can‘t understand is and why i had to replay sections of it is i couldn’t believe(i was shocked) that so many are actually trying and succeeding on getting this BS through an beginning to implement it here in the USA. mindboggling. this was in no way trying to make a dig at Chiefgeorge if he took it that way hi most humbley apologize, and thank him immensley for providing that link so i could better educate myself on this desaterous(sp?) propesition.

    The federalists’ (progressives) swore up and down that the opposition (conservatives) were wrong to assume that a federal government, if ratified (radically) and implemented (incrementally) would most assuredly attempt to usurp power over the states and in turn, the people. They were wrong!!! In that particular era and moment in time, perhaps the people needed a singular entity to oversee the republic. I submit that in the tradition of progressivism, it is time for we the people to accept the irrefutable fact that we no longer need a federal government to oversee our republic!

    I bought a small home in Bremerton (Bremergad) in Washinton State.
    I am a veteran, a retired Federal employee living on a small pension.
    My greatest fear of all is not criminals, or terrorists, or even the constant influx of illegal Mexicans, although this is a major concern.
    No, my greatest fear is the very Government I worked for and served for 4 years active duty in the Navy.
    I fly the Tea Party flag (The Gadsden Flag), and not the stars and stripes at my home. Why/
    Because the “Republic for which it stands” no longer exists. It died a death in November, 2008 of suicide.
    Please, God, let that Republic be resurrected. I will then be pleased to fly the Stars and Stripes, Until then, only the yellow flag with the rattlesnake and Don’t Tread On Me will fly.

    If you want to jump all over me, go for it. I took the oath, served the watch and did my time in the military myself. What we have today is NOT what I swore to protect and defend!

    PS- I swore to protect and defend agains all enemies both foreign AND DOMESTIC!

      I’d explain to you that civil service was always solvent.Since it was paid for with aftertax dollars the advisors planners and institutions could be held responsible.Unlike ss.That it was cry babies like you that compalined about what the civil service workers got.The fact that they paid for it and invested didn’t enter your small little brains.Instead you hollered unfairness and discrimination and got it switched to ss.[Prior to that the only reason to consider the switch was for streamlining and tax purposes.They decided that wasn't a good enough reason].

      Thank you brother:(screwed retiree) My sentiments exactly – My service both military(USMC) and civil as a contractor in Iraq and Afghanistan was not to let these bureaucrats take away everything we have.
      I live on the other side of this state (WA) and being regulated for all types of agricultural BS plus taxes that is attempting to close my small cherry orchard.

    In Washington State there is a similar situation around Lake Crescent. The lake has several houses on it and is a very nice, glacier fed lake. From what I understand it was only in the last several years (under ten) that it became park (National) land. Now the convoluted policy is that you can only sell your property to a family member or to the Park……… and if to the Park, the Park will remove “hazardous” materials (and pray they don’t send YOU a bill) and let the structure go back to nature. It is their goal to rid the lake of all inhabitants as soon as possible.

    To me this is a disgusting policy. We need an administration that can be bothered to understand and reverse policies such as this and the one in this story.

    It is possible to benefit from as well as preserve nature.

      I hear you loud and clear! Also note that in order to just drive into Public Lands or Public Utility Lands,
      including FEDERAL LANDS, we are required to purchase a permit called the Discover Pass in the People’s Soviet Utopia of Washington State.
      The pass is issued to the license of ONE vehicle only, and if you want to go in a pickup instead of a passenger car, you will have to have a license for that vehicle as well!

      GET THIS: It also applies to OUT OF STATE VISITORS!
      Failure to comply or have the license displayed earns the violator a $99 ($100?) fine.

      They got rid of jet skis too. And I think that you can’t even sell the house to family. I think you have to will it to them. I heard also that they are paying the owners and exorbitant amount of money to basically live int he houses until they die and then the park gets it. I love to hike the trails around there. They will shut those down too soon…wouldn’t want to step on some moss and kill it now would we.

    Something like: The government shall not take private property from living American Citizens without their consent, except in cases of felony convictions for acts of terrorism, organized crime or violence, and even then, only as specifically prescribed by law.

      Look up Agenda 21 and you will see how the scheme works. The most thoughtful on the topic of explaining it, is a power point presentation I discovered on the entire matter given almost Beck style, with their own words, books etc. just youtube it. He speaks from a hotel type of setting.

      The reason I would not “stand my ground” is that I don’t live in the cottage .. it is a summer home .. and I don’t go to it (moved over 1,000 miles away but when the housing market tanked I was stuck with it) .. plan on selling in the future .. but I do not want to lose my investment. Those who live in the area full time .. back in the woods .. I really don’t think the government would want to mess with. Most of their families came in the 30′s – 50′s to work in the factories from the south — Kentucky and Tennessee .. when those closed they moved full time to their cabins in the woods and for the most part live off the land and do odd jobs. These are proud people who can take care of themselves .. and don‘t want the gov’t messing with them.

      A National Emergency like a complete Financial Collapse, would nagate the necessity for any Government Force on the population. Government Centers would be set-up in Metropolitan Areas to assist citizens with Food and Medical Care. People would go willing to big citys thinking they are going to get help. And when you got there, you wouldn’t be allowed to leave, and any weapons or firearms you have, would be taken for public safety. And the Government wouldn’t need a large military force, to watch over the people, because they would be the only ones armed…….

      What I have writen here is not anything that I know to be fact or truth, it’s just a scenario of a possibility.

      The problem with sueing these “governments” is that it is the citizens that have to pay the bills. The decision-makers can just keep on going and use the government teat to pay the court costs and suits that they lose.

      What we need is to allow the individuals to be brought into the suit as a party AND PAY THESE COSTS when they exceed the authority of the office OR the law that set up the law. This goes for U.S. Congress, the executive, the state and local government officials as well as the non-elected people who are usually the ones which cause the problems.

      You are so right,We can’t do that until we remove the immunity clause.We need to remove it from most govt workers.Its only by carrying personal responsibility that they can be brought into line.The idea of immunity was first and foremost given to police due too certain cases where the perp was shot .Right or wrong the officer was sued.Unfortunately it began to proliferate to other govt workers.Most of which shouldn’t have been employed in the first place, let alone given immunity.

I am now shunned because I dared to speak out against the “heroes” of WW2, Korea and Viet Nam because I mentioned that they won the War (WW2) and when they came home, they voted DEMOCRAT and voted in the Great Society (The Welfare State), supported Gun Control, Affirmative Action (giving a leg up on Black veterans over the whites- been there, SEEN that!) and got us where we are today.

      Its called secession.Yes it can be done.It was done in the civil war.That is what the civil war was truly all about.Federal law versus state law.Not slavery like you may have been misread to believe.The north used that as a tag line.They wanted to free the slaves alright.They wanted to ship them back to africa.Most of them got to the north and wern’t allowed to work or make a living.Many of them caught on to the norths tricks and obsfucation and went back south.Another thing many don’t know is that many blacks fought on the souths side.It was done by choice not force.
