Loughner Denied Bail in First Court Appearance

PHOENIX (AP) — The nation got its first look on Monday at the 22-year-old loner accused of trying to assassinate Rep. Gabrielle Giffords. Jared Loughner, head shaved, a cut above the right temple and his hands cuffed, scanned a packed courtroom and sat down.
His attorney, who defended Oklahoma City bomber Timothy McVeigh and “Unabomber” Ted Kaczynski, whispered to him.
The judge asked Loughner if he understood that he could get life in prison – or the death penalty – for killing federal Judge John Roll, one of the six who died in the shooting rampage at Giffords’ meeting with constituents on Saturday in Tucson.
“Yes,” he said, standing at a lecturn in his beige prison jumpsuit. A U.S. marshal stood guard nearby.
The judge ordered Loughner held without bail.
Throngs of reporters and television news crews lined up outside the federal courthouse, where the hearing was moved from Tucson because Roll was a longtime judge at the federal courthouse there.
Hours earlier, the nation observed a moment of silence for the victims of the rampage, from the South Lawn of the White House and the steps of the U.S. Capitol to legislature beyond Arizona and the International Space Station.
There, Giffords’ brother-in-law, Scott, the commanding officer, spoke over the radio. Flight controllers in Houston fell silent.
“As I look out the window, I see a very beautiful planet that seems very inviting and peaceful,” he said. “Unfortunately, it is not.”
“These days, we are constantly reminded of the unspeakable acts of violence and damage we can inflict upon one another, not just with our actions, but also with our irresponsible words,” he said.
“We’re better than this,” he said. “We must do better.”
On a frigid morning outside the White House, President Barack Obama and first lady Michelle Obama stood side by side, each with their hands clasped, heads bowed and eyes closed.
On the steps of the U.S. Capitol, congressional staff and other employees did the same.
At the Supreme Court, the justices paused for a moment of silence between the two cases they were hearing Monday morning. Arizona’s chief federal judge, John Roll, was killed in the attack.
The president called for the country to come together in prayer or reflection for those killed and those fighting to recover.
“In the coming days we’re going to have a lot of time to reflect,” he said. “Right now the main thing we‘re doing is to offer our thoughts and prayers to those who’ve been impacted, making sure we’re joining together and pulling together as a country.”
In total, 19 people were shot in the rampage outside a supermarket where Giffords held here meeting. Giffords was shot in the head, and remains in intensive care.
Among the six people killed were a 9-year-old girl who was born on the day of the Sept. 11, 2001 terrorist attacks and was interested in public service, as well as one of Giffords’ aides.
Loughner was tackled to the ground minutes after the shooting began, authorities said. He has been silent every since.

But by all means let him have his day, weeks, months, years in court. Maybe something can be learned. No hate here. Just common sense. Some people around here should try some. You might even like it.

Posted on January 10, 2011 at 8:39pmActually, I believe the spirit of that law translates into ‘assassination” and should carry a higher penalty upon conviction in my opinion. This Judge does have a higher standing in the community, as does the congresswoman than other citizens. They are important for the government to run effectively (philisophically speaking). Fot that alone he should get the chair. For killing a 9 year old girl? Death by gator ingestion. Unless we can find a huge whale that will dogest him slowly….or that thing in “Return of the Jedi” that digests its food for 1,000 years…..according to C-3PO.

I understand filing for the federal charges but it just seemed like a weird statement as if the other deaths didn‘t matter and that the killing of the federal judge is what’s going to land him in jail for life or worse.

He was, however, caught in commission of MURDER red handed. Mentally ill or not, he’s guilty of committing murder. Pleading insanity doesn’t remove the fact that he killed six people and was caught red handed doing so. There is no DOUBT of his guilt. You do, however, believe that being mentally ill gives people the free pass to commit murder. I‘d say that’s a bit more dangerous then people here believing he should get executed for his crime.

The purpose of justice should be to prevent future threats. This can be accomplished both proactively through law enforcement involvement with the community, but it also comes in a very serious and grave, but nevertheless necessary, consideration as a society through our justice system, as to which individual breaches of the social contract are so egregious, so likely to repeat (given the nature of the crime, the psychological profile of the offender, the preponderance of evidence based upon similar circumstance, and the cost-benefit such an individual poses (can they contribute more than they’ve already harmed? Are they likely too? Is there a high cost of control?), that he or she must be permanently incapacitated from society? Whether through imprisonment or death is immaterial. In a legal system, the former has the advantage of being cheaper, while the latter does not create an industry whose interests lie in seeing more convictions.
So I say, if he’s going to do it again, kill him. Punishment is not just–prevention is.

And besides, if they do release him, I believe he will then go back to Arizona for the death penalty and they will surely give him the needle. This guy will NEVER get out of this prison he has built for himself (mentally and physically). He needs to prepare for his next ‘girlfriend’ in prison, cause they will be surely be waiting for him. Even hard-time criminals don’t like cowards who shoot down innocent bystanders because they hear voices OR because they have a beef. I just hope God can get to him before continues believing there is no God. Eternity is a very, very, very, long time to be without HIM. We are only living in this life temporarly until we get to the next life (eternity). What you do in this life, will prepare you for the next, in one place (Heaven) or another (Hell). Don’t believe me? Read C.S. Lewis‘ book ’Mere Christianity’. Now this man (Lewis) TRIED TO PROVE THERE WAS NO GOD, but was in for a real shock thru ancient texts and everything he could get his hands on. Read specifically pages 55 and 56. Lewis, a hardened atheist, PROVES to himself and to others who read his book, that God was real, so real, that, well, you just have to read the book to find out what happened.
