Man Faces 2 Years in Prison for Shooting Grizzly While Defending Family

Man Who Shot Grizzly in Self Defense Garners Huge Support

This is quite a story. A man charged with unlawfully shooting and killing a grizzly bear in defense of his family, garnered so many supporters at his arraignment in U.S. District Court Tuesday that the judge had to move the hearing to a larger courtroom.

Even in the larger space, however, every seat was reportedly occupied as the man’s family, friends and neighbors vied for a place to show their support.

Jeremy M. Hill, 33, pleaded not guilty to killing the grizzly with a rifle on his 20-acre property near Porthill, Idaho, at the Canadian border.

Because the Endangered Species Act classifies the grizzly as a threatened species, Hill was charged with a misdemeanor.

The trial has been set for October 4 and Hill’s lawyer, Marc Lyons, said he plans to defend Hill on the basis of self-defense and protection of family.

Jeremy Hill’s father, Mike Hill, said his son was concerned for the safety of his children who were playing outside when the mother grizzly and her two cubs happened onto his property in May.

Hill has six children ranging in age from 14 years old to 10 months old and at least five were reportedly home when the grizzly appeared and was later killed.

CDAPress adds:

The bears had gone after some pigs in a pen that the kids had been raising, Mike Hill said.

He said his son shot one of the bears, then called authorities to notify them of the kill. The other two bears ran off.

He said his son could have just buried the animal and not said anything to law enforcement. He said his son is being penalized for coming forward.

“The charges are simply unjust,” State Sen. Shawn Keough (R-Sandpoint), who attended the heargin, told the CDAPress. “Hopefully common sense will prevail. It’s clearly an issue of protecting the family.”

According to her, the community has raised nearly $20,000 for Hill’s defense.

“Clearly, we have a problem with the ESA [Endangered Species Act] when situations like this happen.” Rep. Raul Labrador (R-Idaho) added. “We’re doing everything we can to make sure this man is treated fairly.”

According to CDA, the charge of killing a threatened species can carry a two-year prison sentence, a maximum fine of $50,000, and up to one year of probation.

Gather up all of the bleeding heart liberals and put them in a pen next to your livestock. If the bear comes after them, do nothing.
They can talk nicely to Mr. Bear and ask it not to eat them.

This just goes to show how out of touch and control, our government has become.

Ummm, Why not get your family in the house and call the authorities FIRST before shooting the bear ? Not that I agree with the mental EPA but, either the father isn’t explaining correctly or there is more to the story.. AHH , who cares ? I live in Florida, we have to shoot alligators here.. :~)

because you also should have a write to protect your property. you dont watch a bear hurt your livestock either. it probably wasnt that big of a threat to his faimily. if he owned 22 acres than he probably was a great distance from any help.

If you read it says they were going after his livestock (pigs), I don’t know about idaho, but in PA we are allowed to shoot any animal that destroys or is in the process of destroying our agricultural property, from the neighbors dog to a bear. But in our area it is pretty much farmers and country people, no need to call the authorities over a shot bear, Just skin it up and hand out some meet. A new rug and food for the freezer.

We should also be able to protect our livestock by shooting predator animals. A grizzly can make mincemeat out of old barns, pens etc; – and we should not have to accept spoiling of our goods to preserve wild animals.

A few years ago a freind of mine purchased an old farm property in Effingham Co. Ga. He built a house and then his wife wanted a swimming pool. As they where digging for the pool they uncovered two old graves from the turn of the century. He made the mistake of calling it into the county. In the end to build the pool he had to purchase two grave plots, new caskets and have a service for the bones. To rub salt into the wound his wife refused to use the pool afterward. Lesson learned: Dig another hole, bury the bones, say nothing to the county and especially your wife.

The problem here seems to be that a gun was used. We all know how against guns they are.

I would do the same thing in a heartbeat. No way a bear, no matter what type, is going to hold me hostage in my house. And I’m not going to watch it eat my livestock, either.

The bears were going after the children’s pigs. Kids raise pigs for fair projects, and they sink thousnds of dollars into them and they eventually wind up in someone’s stomachs. Aside from being lethal, as having a grizzly around can be, would you just stand around and let an animal attack and kill your animals on your own property? I still rememeber watching Planet Earth, how when a pack of lions took down an elephant, as the photographers were scared out of their wits in a truck with the windows rolled down. Had I been there, and had I been armed with adequate weaponry I would so have wanted to kill that pack or lions. I have seen lion and leopard hunters when shooting one, they will actually turn and come to get you. A Grizzly will eat it’s own cub if it is lame. Maybe humans are no where near extinct, but I would still defend one over and animal, a tree, or a rock, just as I would defend one animal being attacked by another.

Yes, he does have a right to protect his lively hood, his live stock. Once these bears find a source of food the will continue to return. It‘s like a handout it’s easier than having to track something down and work to catch it and kill it. If this guy lost any pigs and got new ones the bear would just come back for them too. He would never feel safe letting his kids go outside again with out being armed or him watching over them and armed himself.

Shouldn’t he go out into the woods and make sure there are no more grizzlies withing say 100 miles just to be safe, and if they are kill them, just to be safe? Ever heard of bear mace? Really great deterrent unless you just really want to annihilate the grizzly bear population, just to be safe since you now occupy their world and they need to go.

Either the unborn eagle is life or it is not, you cannot apply one standard to one species and another to humans, just because it suits your political agenda. Until you get some consitency in your thought processes, everything else you say is just bunk.

@One Food – Do you know how fast Grizzly’s can run? 30 MPH! Yes, that is right, WAY FASTER than a child. Gathering the family and putting them in the house may spark interest from the MOTHER grizzly and this story may not have such a happy ending. He did the right thing as a mother bear is probably the most dangerous animal one can run into.

I was going to buy a house on a lake here in FL when I was reading about alligators. It is a felony here to kill an alligator, even to protect your dogs. I called my friends who live here as well and they said, “Kill it and call us, we will help you take care of the body” Now that is what I call good friends!!! lol. Although I decided against the house, it was worth taking a chance.

Amazing how liberals run away from their policies when they are shown to be wrong. In the first place the constitution gives us the right to defend our property. The EPA and the ESA are just ways to bypass the constitution. Liberals don’t really care about the animals protected by ESA, they use these regulations to impose policies on the American people that they couldn’t do through constitutional means. Authoritarian, unconstitutional branches of gov’t like the EPA need to be abolished and laws should have to be passed by congress. Hopefully, stories like this will begin to wake Americans up. It is amazing how many are in a deep slumber (or hybernation in the stories vernacular).

Yes, the federal government is “out of control”. Congress has no constitutional authority to make a law which purports to prohibit people from shooting grizzly bears who come on to their private property! If anyone has contact with defendant or his lawyer, give them this: http://publiushuldah.wordpress.com/category/criminal-code-us/
It should come in handy. They should defend the case on at least two grounds: (1) That the Statute under which Defendant is charged is unconstitutional as outside the scope of the legislative powers granted to Congress in the Constitution, and (2) self defense.

Hey “sage” woman… um aren’t humans part of the animal kingdom? (especially since libs are mostly evolutionist) So… bears get to live where they want and not vice versa? Bears can kill to eat but humans can’t kill to eat (or so humans can eat their livestock)? The problem with your “logic” is that you are not pro-animal, you are anti-human. You are a nihilist. This is an indefensible viewpoint. Everything animals can do, you claim that humans cannot. Humans invade their territory? What is our territory? Cities? Where were cities built and how did they get there? So if humans can not tread on bear lands then bears should stay of human lands? Is this all confusing?? It’s called leftist circular “reasoning”. @ “One years food supply”, have you ever seen a bear break into a house? It happens all the time. A grizzly bear can stand up to ten feet tall on it’s back legs, and it is one powerful creature. It will not be stopped by a door or a window. In fact, there was a case some years back where a bear was breaking into a couple’s cabin and the man “went for help”. Of course while he was gone, his poor wife who was left behind was eaten alive. No, sorry, when it comes to my life, or my kids life, I’m not going to “wait for the authorities” who may take all day to get there and find only the remains of me and my family. I’m going to shoot to kill, the bear, that is!

Calling the authorities would do nothing. Has anyone ever had to call animal control over a dog running loose, chasing you and your family? I have 8 days later they came by to see what that was about. Now if you don’t do anything, they will keep coming back, every day. They found food, and will consider it a place to come to eat. Telling the bear “I just called the authorities on you!” Won’t do much of anything. I lived in the country growing up, raised livestock. If you don’t shoot or kill the predators coming after your livestock, they will keep coming back for more. So what then, you just keep inside your home 24 hours a day 7 days a week? How long do you think then“ authorities” will stand guard over you and your children, your livestock and property? People need a dose of reality.

We are as part of nature as bears, wolves, deer, gators or others. We are an apex predator just like the bears, wolve, gators, etc. As such when two apex predators overlap one has to go. The man defended his home territory and family from another predator, period.

      RRJEN
Let’s put bear mace in your hand and see how comfortable you are with your children near a mamagrizzley.

This bear clearly lives where it is illegal to hunt bears. In these locales bears have no fear of humans and humans are twice as likely to be attacked by bears.

      To Peppa

Look lady anyone knows that when a predator and a scavenger find an easy source of food they come back. Grizzly bears are not an animal you want on your property. These things are 800lb killing machines that can easily kill a full grown man let alone a child. So maybe research the animal and find out why it was common sense to shoot the animal, and stop blaming human beings for once. Also as a liberal your gonna get ragged on because your lifestyle doesn’t make sense, your beliefs don’t make sense, and your ways aren’t sustainable.

BHARRISO, I must say that you are totally correct when you talk about what should be done. The U.S. Government has shoved the Canadian Wolf down our throat in Central Idaho and they still let all of those who do not have to live with it make up what ever rules they want.Well it is time we put the Wolves and the Grizzly Bears back where they originated from central California and the New England states even the white house could use a good petting zoo and see how they like that when it is in their back yard and one of their own is in trouble for protecting their family.

Bring them inside and call the authorities, you have no clue. You have obviously never been in this situation, or have no livestock.

First if they were going for his pigs, how does he get his pigs inside without getting attacked, second, a hungry mother bear will go in a barn or a house for food, especially and hungry mother grizzly. Heck in our area a black bear will come in your house if it’s hungry enough because of the idiots like you who say call the authorities. All they do is move the danger to become someone else problem. Like the bears near us from the developments in NJ. All trash fed and not afraid of people. That is a horrible combination.

In this situation the only sane thing is to shoot the bear. Not call the totalitarian extension of the state known as the game commission.

besides, what are you some big government regulate people’s rights on their own property type of person, that is how your statement comes across.

Also this is tall timber country and it is easy to end up with the bear between you and the house. Ask those people who kept calling 911 for help during: Katrina/Black on White Flash Mobs/Greek Riots{what about the people in the bank?}/London/Manchester/Birmingham/Chicago/Philly/etc.

This man had every Right and frankly, a DUTY to PROTECT HIS CHILDREN. Another poster brought up a very basic and true scenario. If an animal finds a food source (livestock) the animal will return to that site again and again…eventually, one of the children will be easy prey.

Sheep look to the shepherd to protect them. Shepherds protect their sheep. Which are you?

Just another example of how Goverment regulation over rides common sense.. I’m sure they will attach a stiff fine, and call it a day, after all, the fines that our local goverments are giving to people for the least infraction of the law are over the top. Here in michigan, we have what I call double jeopardy, I recently drove a friend to the hospital to have a procedure done. After she was cleared and we were leaving, I somehow missed the on left turn sign and made a left turn onto the main street going by the hospital. the ticket cost was 120.00, I was guilty, but I asked to go before the magistrate, and thankfully he was willing to lower the fine to court cost only, 40.00 dollars. I paid the 40 bucks, and within a week, I get a letter from the secertary of the State telling me, I have a choice I can take a driver education class at 75.00 dollars per class, or they will notifiy my insurance company, and I Will have 2 points on my record, plus my insurance will goup.. legal extortion. My point is, our goverment is out of control at every level, including the local as well as the national. People are getting sick and tired of being over regulated and penalized for simply defending ones family, or not seeing a sign and making a mistake.

i’d have killed the cubs too. depending on how old they are, they could become a real problem.

      Absolutely.
Shoot the damn thing, shoot the cubs too; they will be back if you do not. It is your decision to protect what is yours or not. Maybe you are like Grizzly Adams, and want to run out and rub noses with the cute little bear….not me. I envision the freezers full of “1 year supply of food”, some cub soup, and the rug sounds real good.
The only mistake this guy made was involving the police.

You people are crazy. Shoot the cubs? How could you. What a waste!

Why pass up a chance to club them like baby seals and really piss off PETA!?!?

The truth is, is this a conservative site.. and very few of you liberals come here, we know you come to just drive us crazy.. it pretty bad that someone so young and pretty wastes her time coming on here just to stir the pot… I have read or listened to “I have a dream” yet!! Yeah I remember you a very mixed up young woman.. do they pay you to come on here to spread your joy.. what I don‘t understand is why don’t you go somewhere where there are like minded people… truly I pity you.. so young and pretty and nothing better to do than try and make the conservatives angry.. is this your only purpose in life?? Sad if it is!!
