Man Who Recorded His Own Shooting on His iPhone Speaks Out: ‘She was Talking Too Nice to Me’

Last year, Salvatore Miglino went to his mother-in-law’s house to pick up his son. He was in the middle of a bitter divorce and had only limited visitation rights. But when he got to the house, he was met with flying lead, not the little one.

Firstcoastnews.com explains what happened:

Miglino was expecting a confrontation, so he hit the record button on his iPhone, according to the BSO.

The mother-in-law, 66-year-old Cheryl Hepner, met Miglino outside with the boy’s pillow and bag, and told him that her husband was inside and wanted to talk to him.

When Miglino declined, Hepner pulled a handgun from behind the pillow and opened fire three times, the BSO said.

“She was talking too nice to me. That’s not normal,” Miglino told ABC. “I did my regular routine. I opened up the back door and put the DVD on for my son, expecting Vicki to come out, but the mother comes out.”

“She said, ‘I want to talk to you. She kept asking me to go into the house. The answer was no. The next thing you know I’m getting shot,” he said.

She hit him with two bullets before Miglino jumped on top of her and wrestled the gun away. That’s when both called 9-1-1 with differing accounts of what happened. You can see the video, hear the 9-1-1 calls, and listen to Miglino describe his injuries in an interview with CNN below:

But the plot thickens. In an interesting move not often seen in defense cases, Hepner’s attorney has released a statement saying the defendant is distraught over the incident, and it didn’t overtly try to cast blame on Miglino:

As for Miglino, he is now suing Hepner and told ABC earlier this week he thinks his ex-wife had something to do with the whole thing:

Not present at the shooting was Miglino’s estranged wife, Vicki Miglino, also the child’s mother, and Hepner’s daughter.

“Yes,“ Miglino said today on ”Good Morning America” when asked if he believes Vicki knew of the shooting ahead of time and planned to be away.

“The normal routine is pick up my son at 5 o’clock. She never missed a heartbeat of that,” Miglino said in his first interview in the three months since the shooting. “She was always there. This day, she wasn’t there. So that’s the answer.”

To this day, the bullets still remain in Miglino’s body.

    NO MERCY on this case. It was clearly premeditated. First she tries to cover it up, but even without the video, the evidence is quite clear. Thankfully, there is video and this will be a cut and dry case.

    doesn’t take a brain surgeon to figure this one out. The plan was obvious to get him into the house and shoot him – dead. Then claim he went nuts INSIDE the house (where he probably had some kind of restraining order not to be) and they shot him in self defense. The wife and kid were probably not there to keep them clear of the situation and provide a “reason he went nuts” his kid wasn’t there for his visitation. Dead people don’t get to tell their side of the story. She probably decided to kill him outside and drag his body into the house as a backup plan when he wouldn’t go inside “to talk” to her husband. Good thing most criminals are DUMB. It is easier to catch and prosicute them. Unfortunately it is getting to the point where only DUMB people server on juries, the smart ones have jobs and can think of ways to get out of it.

      Her being a terrible shot is a lot more important than her being stupid in this case.

      I have to disagree on the cliche jury duty joke though. Serving or not serving is a matter of someone’s sense of community and responsibility as a citizen. If you wouldn’t want a bunch of morons serving on a jury if you had a vested inerest in the case, then you shouldn’t be willing to relegate someone else to that same fate. The people who don‘t serve aren’t too smart, they‘re just too self centered to be bothered with anything that doesn’t directly affect them.

    She’s distraught and sorry he was shot? It’s like this nasty, evil gun just jumped up and shot the son in law while she was standing there minding his own business. What a crock. She‘s distraught that she’s on trial for attempted murder and not the son in law.

    Fortunately my crazy (confirmed by two sons and daughter in law) ex-wife lives in Canada where guns are frowned on or she might have taken a shot at me.

    He should have put in in her mouth and pulled the trigger..clear case of self defense here…and we could save the $ of putting her on trial…

      If he had not filmed the incident I believe they would have charged him instead of her, judging by the way the female 911 operator said “OK” (with absolutely no compassion, it seemed like she had already made up her mind as to which one was lying

    This woman reminds me of my brother’s mother-in-law. In her mind, no man was perfect enough to marry her daughter.
    This type of woman is very dangerous. They are capable of doing anything, for their daughters.

    I had a mother in law like that, though she never shot me she was instrumental in causing some severe problems. This mother is a complete IDIOT. She should never be allowed out of jail nor be able to ever see the grand kids, they no not need the evil from her in their lives. The wife, whats up with her? Did she have any role in this???

    Is there a version of this video that wasn’t edited by the morons at CNN? If he recorded this before going to the door of his Mother in laws house, then the part of his story where he allegedly was invited into the house should be on tape. If it is, it’s a slam dunk. Then again, his screams of panic and her callus response for him to get off of her after he dropped her to the ground is enough evidence to put her away. Had I been in his situation, she’d be dead. As soon as I got that gun away, I’d have crushed her neck.

      I was thinking along the same lines! Wouldn’t have killed her, but definitely would have crushed that vile mush of hers and snapped a couple fingers to prevent her from EVER pulling a trigger again!

    This guy is lucky in so many ways. It was far more likely that we’d be reading about a hero grandmother that killed a crazy son in law in self defense, the kid would grow up believing the father was a dirtbag that got what was coming to him…

    Just another manifestation of the madness that has gripped this country. What would posses any person to think it is ok to shoot another person because you don’t agree with what is going on ie a divorce in the family. The story speaks to no domestic violence..so it sounds like a simple divorce..painful yes, rationalizing murder..no!

    I don’t know, but I can’t pull the lesson form this one. Never trust your mother in law?….Always record your encounters with your ex?….Always watch your mother in law hands?…Picking up you son can get you killed?….sadly, but it’s not sarcasm…..

      First things I learned about picking up my son after the divorce:

      1) Always go armed
      2) Never go alone
      3) Never go inside
      4) Always bring a witness or record the swap
      5) Always have a phone in hand
