Marine’s Parents Sued Over Displaying a Sign Supporting Their Son (Blaze Interview)

Corey Burr is a Marine fighting in Afghanistan. Corey’s parents, Timothy and Jodi Burr, are also involved in a fight back home in Louisiana. Mom and dad are battling the neighborhood association over this sign posted in their front yard.

Shortly after L Cpl Burr was deployed to Afghanistan last winter, his parents posted the above sign in their front yard of their home in The Gardens subdivision of South Bossier, LA. Almost immediately the neighborhood association delivered a letter telling the Burr’s that they were in violation of a local rule stating “no signs of any kind shall be displayed to the public view.” (Real Estate signs are excluded but also carry a 2×2 size restriction.) Instead of removing the banner, Timothy and Jodi requested an exception be made to the rule. They wanted to keep the sign on display until their son comes home. (Corey is slated to return in March of 2012)
In February, the Burr’s started sending formal requests to the head of the association, but those letters went unanswered until the media got involved. Jodi and her husband even sent requests for a meeting with the homeowners association via certified mail, but those letters went “unclaimed.”
In an interview with The Blaze, Jodi Burr wondered if this is a case of “selective enforcement” of the rules. As she states, “There are all kinds of signs in other yards; School booster signs, signs for pro teams, fence company signs and security company signs.” Jodi also claims that her family has lived in the same home for six years, with several signs posted on their lawn in the past, all without a single complaint from the association. Jodi wonders why nothing was been said about “the three other signs she has displayed for years.” Signs like:
“Welcome”
“The Burr’s – Established 2005″
and
“Blue Star Mom”
The family also displayed lawn signs when Corey was playing sports for the local high school teams, a banner stating “Home of a Parkway Panther” with Corey‘s number was frequently seen on the Burr’s property. Again, nothing was ever said.

A local school teacher, Jodi Burr stressed to The Blaze that she and her husband Timothy are “law abiding citizens” and “would not think of breaking the law, but we have not even gotten the chance to present our case for an exception to the covenant.”
The homeowners association has filed a suit, and the Burrs have responded, thanks to the help of two lawyers doing “pro bono” work on their case. Lawyers representing the homeowners group are not commenting on the suit as this is an ongoing matter. A judge has been assigned to handle the complaint but no court date has been set.
Jodi Burr said that she has heard the suit might make it on the court’s calendar in the end of September and she is “not taking down the sign until a judge tells me to, or my son comes home.”

Posted on July 25, 2011 at 9:33pmMy little street of 9 (yes 9) houses tried to start an HOA a few years ago. Failing that, they tried to amend the covenants that do govern our street. They (meaning one guy who’s wife works for a judge) like to leave nasty notes on our doors about anything that crawls up their butt. His proposal included such things as no more than 4 children per house, no fences, and no outside pets. I got a copy of our existing covenants (regular stuff like how far the house was to be to the street) and wrote a counter proposal. I walked to each of my neighbor’s doors and had a conversation with them, giving them each copies of what we had at the time. My suggestion was instead of 27 separate new rules (instead of 6 old ones), we just treat each other like nieghbors, and talk to one another. Everyone is now happy……except one. Bummer for him. Bottom line, most HOAs just plain suck.

They make you pay for the pool and have a bunch of rules and regulations that you must abide by. Another crap shoot of taking your money. I wouldn’t take the sign down no matter what, judge or no judge. I stand my ground to the end or death whichever comes sooner, unlike the pansies we breed now a days.

Now to the part where the HOA never said anything when they displayed signs supporting their son’s sporting events or local school, and then caused a big stink when they display patriotism. I am president of a HOA in Florida and although we have a similar no sign covenant, our HOA Board has been very lenient with regards to signs. As long as they are not advertising or some other commercial sign or something offensive, we ignor it. Sometimes you have to have a little common sense and be neighborly.
Now for HOAs in general. People know what they are gettng into when they buy a house in an HOA. The rules are meant to keep property balues up by preventing homes from going to seed due t lack of maintenance,etc., parking on lawns, doing major auto repair inthe driveway or inthe street, etc. Most rules are reasonable if understood befre you prucahse the house. Don’t move in thinking you are going to ignor the rules because you are “special”, or challenge by doing what you want and using the “I spent $3000. ” approach when ordered to remove that shed. Personally, I don’t like some of our rules but I would much rather live in a nice neighborhood than one where my neighbor has a boat with weeds grwoing up around it and six cars up on blocks in the front yard.

Designed by attorney’s and backed by some horrible Property Management scam artists…their who deal is to control who gets the money. That’s right. They get to the first people in, they get on the Board… I’ve seen some money “disbursed” (you know “income distribution” ) and you can never get the books, get someone off the board…oh, and they have an attorney who also has a mortgage foreclosure department of separate company. They do things like tell little old ladies “Sorry, but since you didn’t reply to your broken mailbox (her mail box was not broken) 6 months ago, we’ve had to incur $ 30,000 in legal fees and you will have to either pay or give up your home (seriously this was all over the news). IN CA there are 50,000 (count ‘em) 50 thousand HOAS….it’s a licensed to steal…who benefits? Developers, Attorneys and some CROOKED PROPERTY MANAGEMENT COMPANIES who do not (get this) do not even have to have a REAL ESTATE LICENSE if they work only in Residential. They would not know an escrow account if they fell over it. They peaked about 1998 and it’s been a huge brew ha ha since…now most people realize that they are cr@p. GOOD laws in the cities that people get behind and enforce are much better than these CLIQUES what rip off all the rest of the people…and I love how that one blogger handled those creepy people…”LET’S TRY TO BE NEIGHBORS”..wow..what a novel idea!!! Please read the story one more time. They asked the HOA in writing for an expemption. They sent a certified letter to HOA committee for a meeting. None of their actions recieved a response from the HOA committee.
I live in a HOA governed development with a sign rule. We have formally exempted signs supporting our troops. We have a lot of veterans and active duty Guard and Reserve in our HOA. Since Nebraskans love the Huskers, we exempted game day signs.
I guess our HOA is progressive. Oops, liberal, Oops, sensible that rules do have valid exemptions.

Posted on July 26, 2011 at 9:51amWhile I have always stated that I hate HOA’s but you have to follow the rules, if it is true that several signs from the owner, and around the neighborhood, had gone unchallenged in the past, why is this sign being challenged?
Perhaps it‘s due to how long it’s been sitting out there. How long were the other signs out on the lawns (whether their own or their neighbors?) I can see most neighbors being OK with a sign for a few weeks, maybe a month at the most. Especially one the size of this one, it was pretty big. And it’s been out there for the past 7+ months with another 8+ months left to go. Might be a problem.
My last question is, how is this Marine deployed for 15+ months? That sounds more like an Army deployment than a Marine deployment….

As a property manager I have to say that HOA have their benefits and weaknesses. Also as a property manager I dont live in a HOA and I probably never would. Seriously though its not usually property managers that are the problem but some board members that get elected. Sure there is poor managers out there but I take pride in my job to help people and their communities to keep them a beautiful place to live.

Like everything, there are good and bad, but out here and in the WEST in general, the HOA’S were foreclosing on innocent people for bogus claims and were especially hitting retired people. Then they went too far and now most people are aware of their scams (using their own in-house vendors; hiding extra charges in made-up categories). They even paid off a judge!! But as with all things, it came out and now the BOARDS know that the HOA Owners are paying attention. I will never live in another HOA. I will make sure that the community has decent zoning laws (sound; lights; parking etc) but never – ever in an HOA.
IN CA you don’t have to have a license…they’d solve a lot of problems if they did.

But its not because of some scandal its because they do good work. Also the board decides who gets what contracts and they see all the bids. The property manager doesnt make those decisions. Atleast not in Pennsylvania.

If they are there when you buy the house & signed off on it, then you should obey them. If you don’t like those rules, either don’t move there or try to change them. The problem with this case is that it seems the HOA haven’t enforced these rules before or with others & not answered their requests. That’s what gives them the right to complain.

If they can allow (or look the other way) when it’s a sign that supports the school, why not let this one pass too? And they wouldn’t even meet or acknowledge the request for a meeting to discuss a waiver.

A couple of them have annoyed me occasionally but not nearly enough to wish for an HOA. If I was really bugged I could knock on their door and discuss it with them like reasonable people. I would not be offended in the slightest if one of my neighbors put up a sign like the Burrs did. It would remind me that some people sacrifice more than others for this great nation we live in.

All of my neighbors did the same from other states. We don’t bother each other and have room to do as we please. It also means that I cut over 5 acres of grass and trim a lot of trees. But what the hell, it’s mine and I like it. Have you heard the expression “I wish I had enough privacy to pee off the front porch?” My wife wouldn’t like it but I could if I wanted to.

That said, if other signs (outside of signs specifically allowed by the HOA) are being displayed then all bets are off. If displaying a sign is ok for some and banned for others, then the HOA is at fault. And the sign should be allowed to remain.

It is absolutely true we owe our freedom (or at least what’s left of it) to the many soldiers who died to establish this republic and subsequently to protect it. Many young men who join the military today do so to serve their country and be part of the proud tradition of American soldiers. Unfortunately they are not even aware of the Military-Industrial Complex and how it perpetuates wars for profit, at the soldiers (sometimes ultimate) expense. I respect those soldiers who enlist for patriotic reasons but I’m disgusted that they may be the unwitting victims of the greed of the MIC.

Posted on July 25, 2011 at 8:15pmdue to distressed liberty and property my flag flies upside down at my house. i get alot of crap for it. but get what they havent spent a day in my shoes fighting the state tooth and nail ive spent over 100k over the past 5 years battling the state of delaware on several occasions of unconstitutional laws and regulations. i say make the sign 50 x 50 and put it on top the house then it wont be in the yard case resolved attach it to a vehicle or the house and your in the clear

American Legion Post, refused a military honor guard for Dave Garber, a Navy Veterian, ( Their reason) he had flown his flag upside down( because America is in disstress), he was a member of our Tea Party, and he had requested donations be sent to anyone running against Obama. Now I ask you, ” Is this any reason to leave a soldier behind and hurt his family more after Dave’s death”?

But, every few years, the controllers crawled out of their holes and tried it over and over. The last time they came to my house for membership, I brought out a membership application to the NRA. They got up and left and never bothered me again.

My experience is that these homeowner associations form, then elect neighbors that love to sit in judgement of others and get punch-drunk on their own appointed power. The rest of the neighbors are just going to work and don’t have time to bother with stupid meetings to supposedly manage the maintenance to the entrance to the subdivision. Their attitude is ‘bigger government.’ Sound familiar?

Posted on July 25, 2011 at 8:14pmA really nice home near me is for sale and when I inquired, the owners brought up the Home owners association. Dead end. They said it’s almost impossible to sell it even though they reduced the price to well under its reduced worth. Oh, well.

We didnt do anything that they would have complained about but it was plain old underhanded to not mention the covenant. Realtors blow me away, so do car salesmen. Lotus.
