‘Am I Dying?’: Hospital Video Captures Man’s Shock Death During Sleep Study

If you’re from the Atlanta area and considering taking part in any medical studies, be sure to check whether sleep is involved — you might never wake up. Brandon Harris’ family recently found this out to their sorrow when the Atlanta man went to a sleep study at a nearby facility and ended up dead due to multiple disorders that made it risky for him to sleep on his back. The Huffington Post reports:
The last hours of Brandon Harris’ life were captured on film after the Atlanta man unexpectedly died during a routine sleep study.
MyFox Atlanta reports that Harris‘ family has filed a lawsuit against Emory Healthcare claiming that the hospital could have done more to prevent their loved one’s death.
The family told MyFox Atlanta that Harris, who was mentally handicapped, was “very overweight, and suffered from congestive heart failure, cardiomyopathy, diabetes and high blood pressure” and that those conditions made it risky for Harris to sleep on his back for long periods of time.
The Georgia legislature is now considering a bill regulating sleep study facilities following the unexpected death. Video of the strange event is below, courtesy of Fox 5 Atlanta:

Hey, you’re in horrible health and it makes you miserable to sleep on your back. Would you liek $400 to participate in my study of your own free will? It requires that you sleep on your back. Of course, we won’t shoot you in the head if you flip us the bird and walk out the doors in the middle of the study, but if you want to force yourself to keep sleeping on your back to the point where you die, that’s your choice.
The story is mildly interesting, but the after-effects demonstrate how quickly our populace jumps to the Progressive solution.

If the family believes that they were negligent and the medical group thinks they had no obligation to screen the candidates and the procedure they used they should take it to court. The other option is to settle out of court.

If this guy had all of these issues, than why didn’t a family member stay w/ him? Why wasn‘t this info passed on to the tech’s? Not to mention that the guy appeared to be on his side in the video!
So, these guys are going to sue this sleep study place, to recv compensation, due to health issues that the clinic had NO part in! And legislation will be enacted to tell what a sleep study has to do! IF, the techs had these records of the danger, then maybe the techs liable, but NOT legislation!
Though I doubt that is the case. He was doing a sleep study to SEE if he suffered from apnea, which means this knowledge wasn’t known! Just INSANE! America is a Sue happy nation, Blaiming others, and as long as I get my pay out, who cares if these new laws & Regs will dictate over PRIVATE Businesses!! VERY SAD!!!

If this man had congestive heart failure he was probably too old at this point to endure many procedures or any operation for that matter. Anyone with that many health risks should not have taken part in this.

These signals, which are generated by your brain and muscle activity, are then recorded digitally. Belts will be placed around your chest and abdomen to measure your breathing. A bandage-like oximeter probe will be put on your finger to measure the amount of oxygen in EEG (electroencephalogram) to measure and record brain wave activityyour blood.
EMG (electromyogram) to record muscle activity such as face twitches, teeth grinding, and leg movements. It also helps in determining the presence of REM stage sleep.
EOG (electro-oculogram) to record eye movements. These movements are important in determining the different sleep stages, particularly REM stage sleep.
EKG (electrocardiogram) to record heart rate and rhythm.
Nasal airflow sensor to record airflow
re microphone to record snoring activity.
I am guessing his sleep tech fell asleep or went to lunch instead of watching the monitor. Sad.

The family wants to give blame but at some point the man or his family agreed to have the sleep study. There are risks. Trying now to sue is like sour grapes.

They just reassured him he was ok untile it was to late. When someone in this situation ask for your help and thinks he diying and you do nothing. Leagal action should be taken.

Posted on March 7, 2012 at 7:46amI worked in a sleep center and I agree that the tech must have been sleeping (happens too often) or out of the room where the tech monitoring equipment was. When he showed distress and asked about dying, she would have spoken with him if she had been in the monitoring room. They have intercoms into the room and can converse with the patient at any time. All sleep centers should have board certified polysomnography techs. This is tragic and just going by what was in the article, I think a law suit is appropriate.

Report Post »I now have a VPAP machine, which puts out higher pressure than a CPAP and stops pumping air intermittently to let you breath out against the higher pressure. I can sleep any way I want.

If they had a case, they should go to court and if we had loser pays, including the prosecution lawyer, then no one would take the case unless they had clear evidence of negligence.
Lawsuits are appropriate and the correct action to deal with negligence, Not silly “Brandon’s Law” regulation. The result of “Brandon’s Law”: more expensive health care and stupid unnecessary procedures put in place in all businesses, including those that are already doing what they should.

Thinking it seemed a bit like quackery, I asked EVERY step of the way … “you sure my insurance is going to pay for this?“ The answer was ALWAYS ”yes, fully”. So I did it. HUGE mistake. It was a MISERABLE experience. Since I had trouble sleeping with all that crap stuck to my body, in a strange environment, knowing people are WATCHING ME, they decided I had sleep apnea. After the “study”, it became clear to me it was nothing but a marketing gimmick for a CPAP machine! Something tantamount to sleeping with a gas mask on your face. Oh, and insurance doesn’t pay for THAT … hence the hard sell and every step of the way. Oh, nor did my insurance pay for the stupid “sleep study”, which was a few THOUSAND dollars. Seldom have I ever been that angry. I gave my “doctor” of several years a piece of my mind and parted ways. Since I couldn’t afford it, it went to collections and ruined my credit.
lessons learned:
1) never trust the provider’s opinion, they do not have your best interest at heart
2) ask for a statement of fees from all providers before “service” is rendered
3) confirm the level and degree of coverage directly from insurance
4) get everything in writing
Oh, and this guy DIED because of rule #1, as he took part in a marketing gimmick by non-healthcare/salespersons for CPAP machines! They are in the same category as timeshare

But do we need more regulations? More laws? No! We just need a big lawsuit or two and the free market will correct itself. You wont save this guy or anyone else with stupid regulations and laws. But it makes the politician look like a hero in the sheeples eyes.

If you can’t breathe well sitting, walking, etc., you are NOT A GOOD SUBJECT FOR A SLEEP STUDY, you have too many medical issues which need to be dealth with first!!! Did his family explain the fact that he can’t breath laying down?
Wrong of his doctor to refer him for this study, wrong of the study unit, wrong of his family, wrong of Medicaid or Medicare to approve this study for payment, but herein may be the crux of the matter, bilking Medicaid or Medicaid (no one really checks on the toal health picture if it is an approved procedure!).
God rest this man’s soul, and you can no longer blindly follow your doctor’s order, you MUST BE YOUR OWN ADVOCATE or YOU MUST HAVE SOMEONE BE WITH YOU AND BE YOUR ADVOCATE. This has been true for a number of years now due to lack of time on the doctor’s part (the doctor only has minutes with each patient!). It will be more true under OBAMACARE.
