A Mexican judge will soon determine whether Shohn Huckabee, a US citizen from western Texas, will serve out his 5 year drug trafficking sentence in a cell south of the border.

Huckabee claims it’s all a setup by corrupt Mexican authorities, and that he has been tortured. Mexican police say he’s undoubtedly guilty.

It all started in December 2010 when Huckabee, 24, and his friend Carlos Quijas, 36, were imprisoned by the Mexican military for allegedly attempting to whisk 100 lbs of marijuana across the US-Mexico border. Mexican police subsequently charged them with intent to sell, and sentenced each man to 5 years in prison.

For his part, Huckabee claims the whole thing is a setup. He says the first time he saw the marijuana he allegedly intended to smuggle across the border was when he was already in Mexican custody. Three witness have apparently corroborated that testimony — but one of them was killed before trial, and the other two disappeared.

Huckabee had no prior record of involvement with drugs before his arrest at the border. His story — that he entered Mexico to have his truck fixed cheaply — has been verified by the mechanic who did the work. Cell phone records corroborate his timeline of events, and seem to contradict the account of Mexican authorities who arrested him.

On top of all that, Huckabee claims the Mexican military brutalized him, even leveling allegations of torture. According to the Wall Street Journal, Huckabee stated:

“I believe what was done to me was torture. When I did not answer their questions, they shocked me with a wire that was in my hands. My whole body froze up. The pain went from bearable to a point where I couldn’t even talk.”

These allegations of inhumane treatment at the hands of Mexican authorities are consistent with other allegations. The WSJ claims to have interviewed nine individuals, some convicted of crimes, who also allege torture at the hands of Mexican authorities, including a man who claimed the authorities used a taser on his testicles. He apparently showed the WSJ reporter the scars.

As for Huckabee’s Mexican defense team- at this point he has been through at least five lawyers, one of whom was shot last year, but survived. None of the first five lawyers spoke any English.

Currently, civil liberties lawyer Gustavo de la Rosa Hickerson has taken up Huckabee’s cause. This would appear to be good news for the defense, as De la Rosa’s office is responsible for putting seven federales in prison, along with three local police for “disappearing” people, and is pushing two open cases of federal police homicide.

Huckabee will need all the help he can get. Time is reporting that:

“His co-defendant and friend Carlos Quijas was recently transferred to Islas Maria, the notorious penal colony off the Pacific Coast of Mexico, on the other side of the country. Shohn says neither he nor Quijas’ family have heard from him since the transfer.”

The decision of the Mexican court on Huckabee’s final appeal should come next week.

    Just stay out of Mexico, stop going there and taking a risk with your freedom. You break their laws or not, they will put you in jail and do as they please with you.

    What does the diplomatic representative of our great nation say on this matter? What is the response of our government to this allogation? Why is this story excluding these answers? Didi I miss something here? If this is true, our government should demand disclosure and threaten to punish the authorities of that GOD foresaken place. If not, should we????

    Too bad for Huckabee that he is white. He will probably rot there just like Amanda Knox until a miracle having nothing to to with any U.S. assistance occurs. Even that white man shot and killed on a jet ski has not been found.

    Ditto for those 2 white young men (Shane Bauer and Josh Fattal) still held hostage in Iran. When a non-white journalist (Asian) was taken hostage in N. Korea, Bill Clinton was sent and she was released quickly.

    It appears if you are white, don’t count on the DOJ or any American government agency to help you.

    Mexico’s government is corupt, for sure. We know they (Federalies) are crossing our boarder into TX, NM, AZ, and CA all the time. Then they claim we violate their sovereignty with our “fast and furious” debacle (thank you Eric Holder). They do NOTHING to stop the flow of drugs north, except it seems plant some of it on “gringos.” The Mexicans are trying to paint a sordid type of picture of America and Americans.

    We need to bring all of our foreign based troops back to the states and put them on our boarders. We’re spread too thin, and it seems our southern neighboors are poking this tired bear, with constant and increasing instigations.

    I had to pay off a parking attendant (50.00) to get my car out of a parking lot in tijuana after I already paid the fee, and that was 20yrs ago. They do what they want and your gonna keep your mouth shut and get out of there asap.

    RULE #1 – STAY THE HECK OUT OF MEXICO.
    Rule #2 – Stay the heck out of Mexico.

    If we legalize Mexicans – 80% will be great – but 20% will be HORRIFIC and will bolster up the GANGS we already have here in the USA.

    Sure there are good Mexican citizens – but the BAD ones will take over the streets of big cities in the South.
    And then they will spread to Northern cities.

    Ever see “Children of men” ?

    THAT is what we will have.

    We will be rounding them up in the streets and bussing them out because it will have proved to be a HUGE mistake to legalize 40 million illegals.

    Cospiracy Theory 17762011 – .Any possibility this case may be tied/payback for the Humberto Leal Garcia execution scheduled for later this week? It seems the President is even on the “other than America’s” side of the issue as well. Could be the deafining silence you hear from washing clamoring to Huckabee’s aid…..Oh, and I woud not be the least bit surprised that this administration mistakenly thinks the Mexican Govt’ is actually holding a former AR Governor.

    I can tell you first hand, Mexican police are corrupt. I lived there ten years. If you are stopped for a traffic violation, you can ALWAYS pay the officer off.

Mexico will imprison this young man for planted drugs yet our freaking country lets illegal/drug runners, murderers, peices of crap run our country over and let them loose from jails, ICE etc to roam our streets, You know what Washington you disgust me. Your evil..     He just hasn’t cooperated with Mexican authorities properly, that’s all. Instead of wasting money on defense lawyers, he should have offered that same money to the authorities as a bribe. That’s all they were looking for when they planted the marijuana on him. Stupido gringo.

      The border patrol and the National Guard should be allowed to pursue illegals and drug traffickers that attempt to avoid capture by fleeing back across the border. A reasonable distance would be 5-10 miles. They should also be allowed to return fire to protect themselves.

      It costs a lot less to incarcerate prisoners in Mexico. The US should set up prisons in Mexico for Mexicans captured in the US. The US could pay an annual fee for each prisoner held. The corrupt Mexican officials would cooperate because they could make some money from the annual fee and from bribes.

      Nothing would deter crime among the illegal aliens in the US than the threat of being held in a Mexican prison.

      I agree! Why do we put up with their cr@p? And, we have our “president” demanding that Texas commute the death sentence of a murderer to appease them. Wrong (as usual).

      What we should do is pull our troops from Libya, Iraq, Afghanistan, etc. and plunk them down on the border. Then, Mexico should be given an ultimatum to shape up or we take over. Call it a use of the Monroe Doctrine. No more wetbacks sneaking in and no more kidnappings and mistreatment of Americans. And no more Mexican drug gangs. They should be targeted as if they were the Taliban – and they are just as threatening to us.

      This is not mere fantasy; we have a national security issue in as far as that dump to our south has turned septic.

      No, we do not have a president attempting to commute a death sentence to “appease them”. We do have a president, like the one before, trying to follow international treaties so that when this simliar thing happens to American Citizens abroad, they will not be denied to right to see thier consulate.

      As long as obama and Holder are in Mexico must be out (off limits) to Americans. When Bush went out Mexico went on my no fly list. Of course I refuse to spend money in many US states where the people continue to elect corrupt politicans. Hit them in the pocketbook and you will get their attention.

      Don’t necessarily believe this is the whole story. There is a thriving business across the border hiding drugs in the gas tanks of cars. This is done at the mechanic’s shops. The drugs are then driven across the border. The driver gets a fee for crossing the border. If caught, they say they didn’t know the drugs were in the car. The penalty is slight. A Mexican citizen wouldn’t be allowed to enter the U.S. legally for five years.

      There might have been a mixup when he asked to have his car repaired. He should ask is “friend” Carlos Quijas. The Mexican drug cartels are extremely protective of their turf. They may be sending a
      message to the American Anglos to stay out of this business.

      Normally I don’t post on this site because I hate how everyone finds some way to blame everything on Obama regardless of the story (I’m a REAL Libertarian and have no love for him either, but I feel there is a lot of Republican vs Democrat childish ideology in many comments posted), but I couldn’t resist this time…

      I read the other day that President Obama is trying to stop the execution of an illegal immigrant who raped and murdered a 16 year old girl in 1994. Although finding this odd (like most other things he does), I find myself wondering why he wouldn’t invest his “efforts” into helping out an American being held in Mexico due to a setup by a corrupt government? Assuming the Blaze story is true and not “leaning” or “persuading” us to believe something different from the facts, it seems this would be a much more noble cause.
