Mich. Cops Can Now Steal Your Cell Phone Data — ‘Without the Owner Knowing’

It’s a scary scenario. You’re driving down the road and get pulled over by a state patrolman. After checking your license and registration, the officer asks for your cell phone, and then uses a futuristic machine to download all your data. In Michigan, it’s happening.
CNet.com reports the Michigan State Police (MSP) are using “extraction devices” to download personal information from motorists’ cell phones, including contacts, videos, GPS data, and pictures, “even if they’re not suspected of any crime.”
“The handheld machines have various interfaces to work with different models and can even bypass security passwords and access some information,” CNet says. The MSP have admitted to owning five of the devices.
The ACLU isn’t happy. In a press release last week, the group continued its mission to have the MSP hand over records indicating how the information is being used. For three years, the release says, the MSP has been giving the ACLU the run around. In fact, it’s now come to the point where the MSP is demanding over $500,000 in processing fees to fork over the data.
“We should not have to go on expensive fishing expeditions in order to discover whether police are violating the rights of residents they have resolved to protect and serve,” the release said.
“Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags,” a brochure from device manufacturer Cellebrite says about the tool’s capabilities. “The Physical Analyzer allows visualization of both existing and deleted locations on Google Earth. In addition, location information from GPS devices and image geotags can be mapped on Google Maps.”
The ACLU also says the data extraction can take place “without the owner of the cellphone knowing.”
The group is now threatening to sue in order to get the data.
“This seems like a pretty obvious violation of the 4th Amendment prohibition of unreasonable searches and seizures,” Business Insider writes. “If a police officer can’t look into your trunk when you get pulled over, they certainly can’t download your photos and text messages.”

PRAY FOR DISCERNMENT and follow your “gut” instinct.
We could also ask for his/her phone, too, could we not? Worth a try.
Of course a polite, “No, Sir“ or ”No, Mam“ followed by ”when hell freezes over” might work…. or not.

Posted on April 20, 2011 at 10:08amThere are already laws about officers searching cell phone’s without P.C.. So everyone take a deep breath and relax. The case law already exists and if it doesn’t exist in Michigan, it will very soon. It is still a great little gadget for law enforcement when there is P.C.. You can get everything you need on a suspect and it is on digital file for court. Excellent! I doubt departments are spending the money to enforce driving /w cell phone laws. You can bet that if an officer nabs a gang banger who just got done gang raping a girl and you want to know who his friends are, you have this neat little tool find out.

Report Post »While i respect your right to your opinion, and to voice your opinion, I feel as though It would be a great injustice to leave this thread without voicing my disgust for the manner in which it was conveyed.
Technology is indifferent to morality. Devices like these are only tools, it is a hard heart that uses it for ill purposes. These devices can be used legitimately as a forensic tool, and I’m sure that the majority of the law enforcement officers in Michigan use this tool in the manner for which it was intended, but as mentioned earlier, it only takes one bad cop to tarnish their image. Should tasers be outlawed because of the Ohio cop that brutalized a woman? No. Should firearms be banned because they can (and have) been used for ill intent? No. Therefore, you baseless assault of a person’s character by using a discombobulated string of non arguments having almost nothing to do with the issue at hand has no place in a civilized discussion such as this.
In short, I’ll summarize this reply with words that someone as asinine as your self can understand.
FART, OR EAT MORE FIBER! EITHER WAY, REMOVE YOUR HEAD FROM YOUR BUTT!

Posted on April 20, 2011 at 10:06amWe should all carry a copy of the Constitution & Bill of Rights at all times. Pull it out whenever something like this happens. Ask the “official” to point out exactly where in these documents it states he has the right to do…. insert violation of your choice…..
Use your phone (most have audio/video/picture capabilities) to record his answer. If your phone can’t do this, request a disinterested party to witness the event. Have them sign an affidavit.
Bet ya dollars to donuts the “official” will just melt away…… they don’t want that headache.

Texting while driving
Effective: July 1, 2010
Public Act 60 of 2010 added MCL 257.602b to the Michigan Vehicle Code. The new subsection prohibits a person from reading, manually typing, or sending a text message on a wireless 2-way communication device, including a cell phone, that is located in the person’s hand or in the person’s lap while operating a motor vehicle that is moving on a highway or street in this state. Global positioning or navigation systems affixed to motor vehicles are not considered a wireless 2-way communication device for purposes of the subsection.
The subsection includes exceptions for operator’s reporting traffic crashes, crimes, and other emergencies. Additionally, there is an exception for police officers, law enforcement officials, fire department members (paid and volunteer), and operators of emergency vehicles when using a 2-way communication device to carry out their official duties.
MCL 257.602b is a primary enforcement law; a violation is a civil infraction punishable by a civil fine.

Funny – here if you are young (16-20) and are pulled over for anything, even randomly, an officer WILL request to search your vehicle and if you refuse or ask for a warrant they will find “probable cause” to search your vehicle. If they do indeed have this device, I‘m sure they’ll be using it randomly. Failure to comply will mean big, big headaches. I’ve told my under aged kids to request to call their parents when this happens prior to allowing any search etc. So far I‘ve never received a call and they’ve never been searched, i.e. been sent on their way. But their friends who make their own decisions have had the contents of their vehicles completely emptied. Why wouldn’t an officer also download their phone info as well.

I once attended a training class (a week long) where we were taught how to talk someone into allowing us (consenting) to search their vehicle without a warrant. As I sat in the class, I remember thinking sure, this will work on a law abiding citizen, and someone that has nothing to hide but a hard-core convict will tell us to kiss his ass! The verbiage went something like this and it has a bit of a rhythm to it:

Sir, are you aware of the fact that people in this area transport firearms and drugs in their vehicle? NO.

Sir, I would assume that you would not mind if I look (search) in your vehicle to make sure? NO.
Keep in mind, this law abiding citizen has just forfeited his/her right to a search of their vehicle and ANYTHING found will be admitted into a trial. Face it, if they get you into a rhythm of saying the word NO, you may say it without realizing what you have done. Then, they place you in the back of the police car, for safety reasons while they search. All the while knowing that if you are locked in that car with the windows up, they will never be able to hear you revoke that consent.
I have had this tactic used on me three times in the last ten years. Be prepared for the attitude you will encounter when you outsmart them at this game. They are usually quite pissed.
KNOW YOUR RIGHTS, THE GAMES THAT WILL BE PLAYED AND THE RULES OF THE GAME. BE PREPARED, I FEAR IT IS ONLY GOING TO GET WORSE!

The best thing a person can do is remain absolutely silent, and give no indication that he even hears the officer, except to produce a license and proof of insurance of course. The only exception is to request a warrant if they demand a search, then go right back to absolute silence and stone cold non-movement.

If they have a judge on site of the stop to give them warrant to illegally search you, you have to contact a lawyer and allow them to violate your rights and then pursue it in a court of law AFTER THE FACT.
Of course, you have no chance of winning against the cops in a court of law that is corrupt and gives them the benefit of the doubt in every circumstance, even cold blooded murder in front of a train station full of juveniles.
It’s called no refusal checkpoints for a reason, because you have no recourse other than to allow them to violate your rights up front, and pursue them afterwards.
Of course, you could try to run away… Swarzenegger “Running Man” style… Maybe Patrick Swayze “Escape from New York” or “Red Dawn” style… maybe even Ripley escaping from the prison planet on “Aliens” style…

It is understandable for the people to do so. Either turn over your phone or all of a sudden you are being threatened with traffic tickets, searches, possible arrests, just plain harassed. Yes it is an abuse of power, and yes people should stand up to violations of the Constitution, but it is understandable why people give in, especially if they have been raised to believe that all police are our friends. Unfortunately not all police officers are, and a large percentage of police chiefs who are more politicians then law enforcement officers are not. Sometimes all citizens are in a position to Defend the Constitution of the United States. Report abuses. If you see it happening take pictures and even better videos.

The biggest mistake, outside of not knowing your rights, is to try to get into a verbal debate with an officer, or even engage in casual conversation. They’re taught to subtly fish for information out of any conversation, even “friendly” chats. Say “no, unless you can produce a warrant please” and then say nothing else, at all. Don’t even look him in the eyes, keep both hands in plain sight, and do not make any gestures or give any indications that you have even vestigial emotions.

i was thrown in jail for almost 9 hours one night for attempting to smoke a cigarette, in my OWN jeep. Top off, doors off, and what appeared to be a wreck with stopped traffic both ways, i rolled my jeep to a stop as an officer approached. it became evident they were looking for someone and stopping traffic not due to an accident. as the office was looking over my ID and another questioning my passenger, i reached for a smoke in my pocket T. I was told i could not smoke. I laughed and began to smoke anyway. it took all of about 30 seconds for me to wind up on the hood of my jeep, cuffed and stuffed and ran downtown. yes, because i didnt listen to the officer that told me not to smoke.

The phone companies also require a warrant before they will allow anyone to access any information on any customers.
If anyone is caught giving this information without proper authorization they will be fired and then prosecuted.
I know this because I work in telecommunications.

Posted on April 20, 2011 at 9:45amYou’re not being stripped of your rights, actually. If you voluntarily give an officer permission to search *anything*, then no warrant is required. You should politely but firmly refuse, as IS your right, unless they produce a warrant specifically citing what they’re searching for, where they’re searching, and that is signed by a bench judge.
This goes for anything really. If they want to “look around”, they often ask directly first and most people get nervous and say “yeah, sure”. Just say no, and again if they press it or get mouthy, politely request the warrant. Ultimately no matter how snippy they become and how much they try to intimidate you, you have the law on your side and they know it.
They’re taught basic psychology on how to get you to give up your rights voluntarily. Simply know your rights and say as little as possible outside of “show me your warrant please”. You will win.

It’s called Property Forfeiture. The laws regarding the government’s ability to seize private property have been changed and reinterpreted. They get around the Constitutional proscription against at-will property seizures by agents of the government by charging the PROPERTY with a crime. Not a person. You have no standing to protest in a court of law as YOU are not charged or being tried.
It doesn‘t matter if you are ever charged with any offense or whether you’re judged innocent or guilty, as they are charging inanimate property with a crime and not a person. Therefor the property gets no Constitutional protections, as property is not given Constitutional protections.
Accounts abound of police seizing money & property from motorists with no probable cause other than that the money/property was there, and they weren’t “satisfied” that it wasn’t involved in some unknown criminal activity.
People carrying money to purchase a used/vintage vehicle from private buyers and others with perfectly legitimate reasons to be carrying a few hundred or a few thousand in cash, even when proof was offered for the purpose, have had their money seized and never saw any of it back. The same things occur with other property as well.
There have been documented instances of entire police departments participating in such illegitimate seizures as a means to generate revenue for their department and the city/township.
It‘s extremely frustrating when the police seize your property without just cause and you find the courts won’t even allow you to file against the seizure or provide evidence or testimony in defense.
They can now seize and search your communications without a warrant, seize any money or property they find, and you as a citizen don’t even have to be arrested or convicted, and you have no ability to be judged by a jury of your peers.

After all being a Caucasian means I’m in the only legally targetable class, in other words no ACLU or army of televised social advocates dercying fowl play.
When confronted with requests to search, or question your answer should always be. NO search, even if they present a warrant, as some searches exceed the scope of the warrent and get thrown out because they do. And “I want to call my lawyer.” is the only correct answer to any question or statement from officers.

No, you have rights and you are advised to exercise them. Unconditional obeying of an officer’s commands is what allows them to get away with things like this. The few times I‘ve been pulled over I’ve refused to cooperate by remaining silent when they go on their 20 questions fishing expeditions, and am none the worse for wear.
If they don’t have a warrant, and you are not directly suspected to have committed a crime, then you politely refuse. Ultimately, they have to leave you alone, and will.

The purpose, I assume, was so that he would have his contact list of people to call to bail him out. I know I don‘t memorize anyone’s number anymore. This would be an easy time for them to download all his personal information.
This is wrong through and through, even if the guy is being arrested. I know I have apps that have my banking information for multiple banks, and a password saver app that stores certain passwords that I can never remember daily. And at that point, the cop would have access to your social, BAM, there goes your identity if the cop isn’t flying straight.

I’m about as law-abiding as they get, so short of a traffic violation I would never be in an arresting situation. In any case, I would respectfully refuse to turn over my phone to the police, unless they had a legal warrant. I do agree, this is a slippery slope and is a direct violation of the 4th Amendment and needs legal clarity.

Effective: July 1, 2010
Public Act 60 of 2010 added MCL 257.602b to the Michigan Vehicle Code. The new subsection prohibits a person from reading, manually typing, or sending a text message on a wireless 2-way communication device, including a cell phone, that is located in the person’s hand or in the person’s lap while operating a motor vehicle that is moving on a highway or street in this state. Global positioning or navigation systems affixed to motor vehicles are not considered a wireless 2-way communication device for purposes of the subsection.
The subsection includes exceptions for operator’s reporting traffic crashes, crimes, and other emergencies. Additionally, there is an exception for police officers, law enforcement officials, fire department members (paid and volunteer), and operators of emergency vehicles when using a 2-way communication device to carry out their official duties.
MCL 257.602b is a primary enforcement law; a violation is a civil infraction punishable by a civil fine.

Posted on April 20, 2011 at 4:19pmIf you want to keep your cellphone from being easily “slurped” by some over-eager jack-boot and don’t mind digging into the phone, simply open the phone, locate the micro-USB connector, and break the connections to pin 2 and pin 3. These are the ‘Data +‘ and ’Data -’ pins. If you’re creative, you might be able to include an internal hidden switch. The phone will still charge normally with the pins disconnected, but will not transfer data through the cable (or a ‘dock’) until pins 2 & 3 are re-connected.
For many people that don’t connect their phone to a PC or other external device that needs data access to/from their phone, disconnecting the USB data pins won‘t affect the phone’s operation.
It turns the USB port into just a fancy charger port with no data transfer capabilities. They can connect whatever they want, but the can‘t get what they can’t connect to.
What are they gonna do at a traffic stop on the side of the road, do a forensic-electronics investigation? No. The cop will think either your phone’s not working right (good cover story…”good luck sir, the stupid thing’s been broke for a week”) or that their fancy new toy has broken down and send it away for maintenance.
Will they make it illegal to carry a broken phone?

No, when they try slurping your phone and it doesn’t work, and they question you, you say “You broke my PHONE with that stupid thing!?!? Are you going to cut my car’s brake lines or come burn my house down next!?!?
If they’re bothering to slurp your data in the first place, you’re already going to be charged/ticketed or arrested for something whether there’s anything on the phone or not, or if they can access it or not. At the worst, it gives you some misdemeanor charges you can use to bargain a plea with.
At best, the confusion & embarrassment at the scene might let you walk away and possibly add another disincentive for them to continue or expand this blatantly un-Constitutional breach of 4th Amendment Rights.

Be polite, that shows you have respect for the uniform. Only a total @zz cop would be angered by your refusal to submit.
Tell them, “I was advised by a friend of mine who is a fellow officer to say, I do not agree to allow any form of search. I do not surrender any objects.”
That sends the message you have a friend who is a police officer (I can say that, the rest is up to you)
If you aren’t friends with at least one officer you should be. It gives you a perspective of what they go through and if you prove to be a responsible citizen they will share valuable info with you and maybe help if you get in a jam.
Be polite, be respectful. Most cops I know are upright men and women. It only takes one bad apple to leave a bad taste in your mouth.

3) This is an allegation of abuse based on a lack of information showing that there isn’t abuse. A typical liberal view of our police. We shouldn’t be echoing these sentiments. The laws protecting the people from abuse are still in place. If lived in fear of “could have” we wouldn’t have police at all.

They don’t even want to be your friend; they are doing their job [as perceived by themselves in their War of "us against Them" ] You and your Rights are an obstacle.
Generally, during a Traffic Stop for violations, the Cop cannot demand evidence or search for evidence because the charge is a mere Traffic Violation, not a Crime.
If the Officer stope you for a violation and during his contact, discovers what he believes is evidence of a crime, the Traffic Stop changes faces to a criminal investigation. With that said, he can now begin to seize things and search, anywhere in the vehicle, including the trunk, but not into a locked briefcase, without a further warrant to do so. In this case, if the cellphone can be shown to potentially harbour evidence related to the crime, like Drug Peddling/Dealing, he may look inside. Now, looking inside has changed to a digital invasion and exploitation of the device.
This reasoning eminates from the belief by the officer that evidence will be destroyed if you leave in your car. There are exceptions to the circumstances that are dictated by the location of the stop etc…
We are seeing a trend where our Police, Firemen and Teachers are marching in the streets with Communists, Socialists, and Marxists, who hate our way of life and disrespect our laws and Constitution. This must be stopped!
A new police officer is so happy to be hired, he/she willlingly places hands on the Bible and swears an oath to support and defend the US Constitution as well as the State Constitution where he is living. Does he mean it? Probably in his momentary dream. As soon as he/she gets to work with the department he begins to be programmed effectively to see The Constitution as an obstacle and your mentioning of it, marks you as a Crazy and or malcontent.
They attend Seminars to learn techniques and approaches to nullify your resistance or to circumvent your Rights.

If the state police stopped me in such a situation, I’d call the county sheriff and make sure every thing was in view of their dash cameras, then I’d call the lawyer who advertizes “For the people!”
