Minnesota Man Thrown in Jail for…Failing to Put Up Siding on His Home

A Minnesota man was arrested and thrown in jail — all because city officials said he had not properly put up siding on his house.
Officials in Burnsville, Minn. cited Mitch Faber with “having an unfinished exterior” when, nearly four years after he started it, his home’s stucco project was not complete, Fox News reported.
Faber told Minneapolis ABC affiliate KSTP-TV he always intended to finish the project, but that he ran into financial trouble when the economy took a turn.
His first encounter with the city happened in 2007 when he got a letter saying the siding needed to be finished.
“We were in the process of finishing,” Faber told the station. “This wasn’t something that we were trying to avoid doing.”
There were two more letters in 2009 and another in 2010, which required Faber to appear in court. That’s when, he told KSTP, he was instructed in no uncertain terms: Finish the siding or go to jail.
In order to comply, Faber and his wife spent $12,000 to put a stucco facade over their house’s plywood exterior. It wasn’t enough: Last November, Faber was arrested after city inspectors concluded the work wasn’t up to code.
According to a statement on the city’s Facebook page — posted after the story made local headlines — a judge issued a bench warrant for Faber’s arrest after the inspectors determined the work was not complete. He was arrested during a routine traffic stop.
“I’m walking around in a green and white jump suit, I had to shower in front of a sheriff, I was shackled, my wrists were handcuffed to my waist — for siding,” Faber told KSTP.
After two days, a judge released Faber but still required him to submit to electronic home monitoring.
In a statement to KSTP, Burnsville communications coordinator Marty Doll said the city provided Faber “ample opportunity (nearly four years) to remedy the situation before issuing a citation…the city’s practice is to only issue citations for property maintenance issues (such as this one) as a last resort.”
Still, he defended the city’s actions, albeit admitting the situation is “unfortunate.”
“Code enforcement is an important part of making sure all neighbors can take pride in their neighborhoods,” he said in a statement to Fox News. “The city agrees it unfortunate that this situation was not able to be resolved in typical fashion.”

Its been an eyesore, watch the video and notice there is no grass anywhere, its been that way since I was in High School 20 years ago. So action by the city is long overdue! he has ample time to fix it. This story is very misleading saying back in 2007 it all started back in 1991. Even then he has had 4+ years to get it fixed since the first notice. I am glad action was taken by the city. This house is right on the main road entering the neighborhood so you had to drive by it all the time. The neighborhood is a typical middle class neighborhood. For this guy to blame the recession as the reason for not getting it done is ludacris he has had 20 years. Just wanted to share a little background for everyone

Posted on March 21, 2012 at 9:47pmIn California I was purposefully letting the grass die on the front of the House because we had a contractor scheduled to rip it all out and new sprinklers and lawn installed and landscaping. Well the psycho yard police in our city fined us for letting our lawn die they didn’t even knock on the door and ask why it was dead.
Morons we were doing it to get rid of the old lawn I cussed their azz out on the phone they said ok we didn’t know you must follow the rules as long as you fix it you are ok.
Just getting the fix it ticked BURNS you up especially because the neighbor across the street lets his lawn get as tall as three feet and he never got any warnings and half the time it’s that tall it looks like an abandoned home.
So why did we get a ticket and he never gets one?

(I live at the end of a dead end street) The city inspector happened to be a black man.The guy accross the street from me and myself where the only ones on our block that had Mcain/Palin signs in our yard. Growing up in rural Kentucky, the poorest had tar-paper-sided houses. Tar paper was even available PRINTED to look like stone or brick. Of you had more money, you put a veneer of wood or brick on the front of the house – after all, that’s the part people see. If you had a bit more money, you veneered the front AND 2 sides, but the back was still tar paper. Even today, you see many homes with brick fronts and wood backs.
Not everyone is wealthy enough to afford everything these fascist communists want us to buy – $50 light bulbs, $50,000.00 unicorn-dust-solar panels, $60,000.00 electric cars ($210,000 actual cost) which actually run on coal, etc.
Not to mention, we’ve got one of them depressions going on.
People are doing well to keep up with payments on their home. Payments toward their $300,000.00 mortgage on a house now worth $120,000.00.

The professors at the colleges started teaching Marxism during the 60′s and these are the results. The media had it wrong. …….BUT then she said it HAD been 7 years that he hadn’t done anything with his siding and stuff was flying off the house. AND it was bugging the neighbors. I suggested a fundraiser and work party to help them —-rather than jail time.

Codes are there for the protection of the residents (safety codes) and to guarantee soundness of the structures (engineering codes) and to prevent the loss of value due to properties that are left to deteriorate. This includes not finishing the exterior in a normally accepted style and according to the construction codes. I am glad for the codes as they protect me. I will admit that sometimes there are some codes that need adjustment, but this is not one of those times.

Burnsville is a nice community and has a lot of high, medium and low income housing. The City Council does a fairly good job of making sure we don’t have areas that turn into slums. This couple had 4 years to get the job done. I’d say they were given ample warning and opportunity to fix it up. They needed a wake-up call. Remember how Rudy Guilliani changed New York by starting with cleaning up litter and other minor infractions? Crime came down and community pride went up. How would you like to live next to an area that the city lets get run down? Let a few more go and pretty soon you have a slum. The rules are published. You don‘t have to live here if you don’t want to. If you want to live in a slum, move to Minneapolis and ignore the gunshots and gang crime in the neighborhood.

Last year alone, the Federal government passed 80,000 pages of new laws, my State and Local government passed thousands more. What person with a life has time to review even a small portion of these things? That is the problem with Government. We vote people whom we expect to represent us, however, almost all only represent themselves. Heck, Ron Paul gets ostracized because his reputation is that he refuses to pass any new laws. I say we should all push to elect ONLY those that have the same mindset. Instead of passing new laws we need to undo most already on the books. Our founding fathers had most of what was needed in place already. Those that came after them slowly stripped away our freedoms.

Burnsville is one of those Notsee City Councils who walk on the rights of citizens. They whitewash crime, and build cages for the Welfare class, then drive by and say “ooooh we are getting them out of the ghetto!!?” The fact is that you are just bringing the drugs closer to your high schools. This man did nothing worse than build an ugly house. It was the back of the house and I bet with the size of his yard and all those trees no one ever saw it. Burnsville is a major suburb like you would find anywhere. Nice on the far side but getting seedy on the urban side.

Give me a thriving economy over the regulation of roof tiles or surface rust on a fence.
In my County if you drive a pick-up and have any tools, ladders, etc. you are considered a commercial vehicle and are required to have DOT Numbers listed on the side.
Failure to comply results in a $500 fine.
If I wanted to make a few bucks painting my neighbors fence or installing a mailbox, I could be arrested and face a year in jail for “contracting without a license”, and the neighbor could recieve a $5000 fine.
I received a 62.50 ticket the other night for riding a bicycle on a sidewalk without a Light.
I was told I could not pull a permit to PAINT on a building because I was not a registered ELECTRICIAN. All I would simply have to do to paint “TRANSMISSIONS” on the side of a building was to become an electrician by studying and taking a 30 hour test.
My local code enforcement,Your Public “Safety Officers” fine people $100 a day for surface rust on a fence post or some chipping paint. I am so glad they are here to make me safe.
I am not opposed to the 10% of logical and neccesary codes, but this revenue generating racket is out of hand.

BUT he did drag his feet for 4 years he had a ton of time to get something done even if it took asking the city for help I wonder if he tried that or just get on local TV and plead for help I bet he could have gotten some free siding by doing that.

The HOA didn’t cause an issue, it was the city. It wasn’t because his house had nothing covering it, it just wasn’t siding. He had finished the house, according to the article. Although, one corner of the house wasn’t exactly perfect, so they sent him to jail. If you read the FB page, you will see that the prosecutor follow due process. Maybe, he should go to jail, with the judge.

Posted on March 21, 2012 at 10:00pmHOA’s are worthless in most places the city likes them it’s a way to get the home owner to pay for what the city should be doing like street sweeping and the mail man to have an easy job sticking everyone’s mail in a big ugly mail stand were you need to drive to get your mail every day.
City’s love HOA’s for the saving they get from them and pushing the expenses onto the general public it’s a hidden TAX people GET it.

Posted on March 21, 2012 at 9:11pmthis reminds me of my state (california) has what we all call yard nazis who drive around and put warnings of fines for the most petty things, over here we are not allowed to have anything visible in the side of the house and been giving warnings for people who forgot to bring the empty trash cans in.
Apparently they can nit pick anything wrong with your yard or whatever they can see of their backyard and claim its a violation of some kind. Got a neighbor who dedicates his life in reporting us to them at every moment… so we built tall fences.

How much smaller government is there than the city government? I attend City Council meetings when there is a topic that I am interested in and/or will directly affect me. Participating in local government is the most basic form of citizenship. If you don’t participate, try it. It will be boring but it is the closest to the true town hall meeting that remains.
I feel sorry for this guy because hard times hit and he apparently couldn’t afford siding. BUT, as a home owner I am concerned about the value of my property and the condition of other houses in my neighborhood affect that value.
