A Missouri mother is becoming a bit of a folk hero after facing charges for attacking her son’s alleged heroin dealer with an aluminum baseball bat.
Sherrie Gavan of Imperial, near St. Louis, was arraigned Monday on charges of third-degree assault. According to the St. Louis Post-Dispatch, she tried everything to protect her son, Clayton, including change his high school. But when all of her efforts failed, the desperate mother drove to the home of 21-year-old Joshua Loyd — her son’s presumed heroin dealer — and struck him with an aluminum bat. She claimed that she went to Loyd’s home to tell him to stay away from her son and her family, but after witnessing Loyd retrieve an item from his car, she became fearful. That’s when she returned to her car to get the bat.
“I don’t know if I can say that what I did was right,” Gavan told the Post-Dispatch. “But it was the only thing I could do in the moment.”
A Facebook support page has generated to date, 640 “likes.”
Several people showed their support for Gavan outside the Jefferson County Courthouse.
“I think it’s ridiculous,” protester Nicole Vaporean told the Post-Dispatch. “The police should have done more.”
According to the report, Jefferson County Sheriff Glenn Boyer said that while he understands Gavan’s frustration, police are still required to uphold the law.
“How can we as law enforcement turn our backs on someone who has been assaulted?” Boyer told the paper. “I understand her intentions, but we have laws.”
Below, Gavan relays the events that lead up to the incident:

Posted on March 13, 2012 at 6:25pmGive that mom a medal. This is what’s needs to be done in every neighborhood in our country. If every citizen gets pissed off enough to drive these drug dealers out of their neighborhoods, pretty soon we won’t have drug dealers any more. That’s what we need, because the law enforcement sure as hell hasn’t done their jobs. Another thing that will help our ever declining moral backbone, is for the fathers and mothers do the same to people that call their daughters and mothers a bad name, I’m including Bill Maher and every other liberal pundits and so called comedians. Once they realise that they can just go around calling their daughters and mothers a vile name, they will stop.

Posted on March 13, 2012 at 11:18pmWait a second…you are suggesting that we go around beating people who call their daughters and mothers bad names with a baseball bat?
First of all, why? Even in kindergarten you are expected to be able to deal with getting called names without resorting to violence. Yet grown people should take up arms and assault others for being mean?
Second, why are you singling out females? Are boys and men so worthless that their feelings and honor are below regard? Or are women and girls really so weak-willed, cowardly, and pathetic that they are unable to stand up for themselves?
Third, what if the name your mom is called is accurate? What if she really is a wh0re? What if your precious daughter actually is a filthy slvt? Is telling it like it is really worthy of getting brained with an aluminum baseball bat?
Chivalry is outdated. And white knights like you who insist on sheltering women (even though the law and the justice system is overwhelmingly in their favor already) make me absolutely sick.

Posted on March 13, 2012 at 11:23pmFurthermore, what ever happened to Freedom of Speech? Last I checked, I am allowed to call anybody I want anything I want under the full protection of the law. Yet you are not only recommending that we throw the 1st Amendment in the trash, but also that we resort to violent vigilantism to shut people up.
You’re one deluded SOB, you know that?

Report Post »In my opinion, the reason the little drug dealing weasel took three hours to report the “attack”, is probably because it took him that long to remove all the drug paraphernalia from his house, and stash them someplace else.
Also, it gave him time to drink a lot of water, to thin down any drugs or alcohol in his system, in case he was urine tested at the police station.
Doctor Nordo
Posted on March 13, 2012 at 11:37pmIt’s not illegal to fail a urinalysis. You could pee out pure MDMA and unless it could be demonstrated that you are actually under the influence there wouldn’t be a damn thing the police could do about it unless you were on probation.
In almost every single case, the only way to arrest someone for drugs is if they are caught possessing them.

Report Post »woebegone
Posted on March 13, 2012 at 6:24pmWhether or not he was arrested, I’ll bet you dollars to donuts he will sue. The problem is he will win, and likely should win. This represents a profound failure in policing, but one we have created. My advice to her–after she loses and appeals, she should sue the police department. Every part of me hates to say that, but the truth is that the police target and hate reasonable people slightly off the beam and are weirdly aligned with criminals going about their business of destruction. We created this. Time for a rethink.
Report Post »woebegone
Posted on March 13, 2012 at 6:09pmHere is the problem. As much as I understand and applaud her intentions this is why we have law enforcement. The unfortunate truth is that law inforcement is much more interested in catching me for meaningless speeding or not wearing my seat belt than actually catching real criminals–why because I pay a fine and criminals cost. It is a really sad and disturbing thing that law abiding citizens are much more policed and whipped into line than the real criminals. I’ve seen crack dealers doing business openly down the street from the police stopping a “rolling stopper’–is it any wonder why people mistrust the government? Still, I have trouble with beating people with a baseball bat, I have as much maybe more trouble with the police saying they have to follow the law in a town where they don’t clear out the drug dealers. It’s not like drug dealers are subtle.

Now think what must be going through her son’s mind that his mom is willing to love him this much. Hopefully this will have an effect on him. I wish there were more stories like this to read about. I loved the story a couple years ago about the dad in Florida storming the bus to confront kids who were picking on his disabled daughter. Most the stories I read about parents sticking up for their kids are the ones where the child wore a lesbian shirt to school or a big bad Christian band made their kids look are bad pictures. This story was refreshing.

Posted on March 13, 2012 at 11:45pmYep, because mom potentially getting locked up for 5 years (the maximum penalty for 3rd degree assault in Florida) and being totally unable to influence her son for that time is really a good idea, right? Besides, unless the dealer got the kid hooked by slipping heroin into his YooHoo like a friggin’ roofie, then she wasn’t doing anything to solve the problem. Her kid obviously has issues, and assaulting his dealer isn’t going to fix those issues.
Unless he fixes himself, then he will simply find himself a new dealer. Mom can’t beat them all.

Actually, the “judge” is there to conduct the proceedings in an orderly fashion and maintain the safety of all parties involved.
1972, the U.S. Court of Appeals for the District of Columbia said that the jury has an ” unreviewable and irreversible power… to acquit in disregard of the instructions on the law given by the trial judge…. (US vs Dougherty, 473 F 2d 1113, 1139 (1972))
