11-Yr-Old Girl Saves Baby Bird From Cat, Mom Gets $535 Fine

Today’s shining example of “No Good Deed Goes Unpunished” comes from Fredericksburg, VA, where a young girl prevented the family cat from pouncing on a lost baby woodpecker and her mom ended up with a $535 ticket (and faces the possibility of jail time) for violating the Federal Migratory Bird Act.

Despite the fact that 11-year-old Skylar Capo actually saved the tiny lost woodpecker from a violent death, and then successfully released the bird back into the wild, a Virginia State Trooper was still dispatched to the Capo home where Skylar’s mom was slapped with the $535 ticket.

Why? It all has to do with the Migratory Bird Treaty Act. 9News has the story:

For the 311 million (or so) Americans who are probably not familiar with the restrictions of this Federal regulation, it states the following:

The Migratory Bird Treaty Act makes it illegal for anyone to take, possess, import, export, transport, sell, purchase, barter, or offer for sale, purchase, or barter, any migratory bird, or the parts, nests, or eggs of such a bird except under the terms of a valid permit issued pursuant to Federal regulations.

    Not all woodpeckers migrate. So how would this be covered under a migratory bird act?

      Nowhere in the list of things you cannot do does it say “save.” However, apparently if you save a migratory bird you are what… possessing it? Why didn’t they put the cat down for violating the act?

      She should demand a jury trail as it is her Constitutional right to be judge by a jury of her peers. In fact anyone who is fined by these overreaching fines and regulations should do the same.

      What part of this did she break? If she released it in the same place but with the cat gone, she didn’t take it. Just because she apparently grabbed it from the cat she didn’t possess it, that is like saying that if there was a bike lying across my driveway and I moved it, they would be able to arrest me for stealing the bike. Just because the she grabbed the bird and then apparently immediately released it then she didn’t “possess it”. Possess denotes claiming ownership, she broke NO law!

      Obviously they’re dealing with a criminal ring of ruthless cats & their human minions who take unsuspecting birds hostage and shake down their families for ransom money. They are lower than low…using children to do their dirty work.

      The Special Task Force has been waiting for a break like this in their investigation. On the up side, the District Attorney will probably offer a plea bargain if she sings like a canary and gives up the ringleaders.

      Can’t wait to hear if Lowes is in on the deal, getting a cut for allowing them to hide the victims in the store until the ransom is paid? Or, do the cats have something on Lowes and are blackmailing them into cooperation?

      See it’s all part of the new US Budget plan. We will begin fining citizens for trying to rescue or assist animals wild or domestic. In this case you would need a new Bird Rescue permit to avoid the fine, but realize the permit is not transferrable. If you have the opportunity to rescue say, a cat or a dog, you would need a different permit. We call this “increased revenue.”
      Great plan, huh?

      The comment about why were the police not after the people getting migratory birds after the oil spill who were trying to save those birds — I am a native of Louisiana & I can tell you the people of “the sportsman’s paradise” know & care more about wildlife than the federal government & would never stoop to such a dumb law. This lady and her daughter should be awarded $525 instead of being fined!!!!!!

      Who ever said, go to court and be tried by a jury of peers is a good start, however, court costs and other charges will surmount the original fine by thousands of dollars. She should do what everybody else does when they get a ticket…as for a hearing, ask for many continuances, then appear and hope that the person that originally charged her doesn’t show and case dismissed.

      Burden is on the prosecution not the accused,the court cost are the same as reguardless. If you hire a lawyer, fees can escalate greatly but a jury trial itself is a constitutional right and can no more be regulated through fines and regulatory than free speech or worshipping what ever god you want.
      Trust me i beat a bogus DUI when I filed for my Constitutional right to a trial by jury. All charges dropped all court cost assumed by the state. THEY DON’T WANT YOU TO BRING THE CONSTITUTION INTO THEIR LITTLE SUPPOSED HOUSE OF JUSTICE(OR IN THEIR CASE IT’S JUST THIS)

      Ummm–does anyone remember the little debacle w/Hillary over the dream catcher? She was looking at a 10k fine for possession of eagle feathers that some woman picked up off the ground. Everyone made Hillary out to be an innocent victim because she didn’t know better. Matter dropped. Doesn’t the same apply to this gal? Also, since Madam Hillary is a law maker–I would think she should be held to a higher standard since she should be familiar w/the laws.       This action by the Virginia State trooper is the result of the most pathetic judgement of any law officer on record. Oh, I forgot the trucker who was volunteering his truck and his time to bring much needed ice to Charleston, SC after hurricaine Hugo. Virginia troopers checked the weight of the truck and found it to be a couple of hundred pounds overweight. He was fined over $1,000 .

      Virginia’s motto is:“ Virginia is for lovers” Well it seems that Virginia is for those who LOVE to assess fines and use laws to produce revenue for the state. “When common sense is overridden by rules, only stupidity remains”. This action is a prime example of that motto!

      The story makes it pretty clear. Some uptight lady at the dept. of wildlife saw the bird at Lowes when they stopped they took the bird in so not to leave it in the hot car. The woman was all up in arms about it, showing her “wildlife sheriff” badge and came back to their home a couple weeks latter with the police.

      A clear case of “I have a badge that gives me power”… I just wish those badges also gave people some common sense.

      I was at the dog park last night with my 8 month old Lab/German Shepard letting him run around and burn off some energy with the other dogs when all of a sudden two cop cars came pulling up with their lights on. My girlfriend and I were like WTF. This snobby younger lady walks up to the police all pissed off and says “there he is, right there, the one in the orange collar”. The cops were there for an hour trying to figure out some situation. Come to find out the snobby lady called the cops because this poor old guys dog was “playing to rough” with her full grown Boxer….

      Is this what it is coming down too? Can’t even let your dog be a dog without getting a ticket and going to court? And then this thing about the woodpecker…was this law around when i was 12 and i got my first BB gun, I hope not, cuz I‘m sure I’ve wacked a couple of them in my younger days

    Their mistake was in moving the bird from the yard where it was found. If they had removed the cat from area and hidden the bird in the bushes the momma bird would have found her fledgling and all would be well. The Trooper should have instructed them and given them a warning not a ticket. The Migratory Bird Treaty Act is suppose to keep people from harming birds or turning them into pets. Skylar and her mom were just trying to help the bird not harm it. The Trooper overreacted.

      Can ‘t hide anything from my cat. Had to chase her down and run her out of the yard to get her to leave a chipmunk alone. My cat would sit still and wait….wait….wait….wait…. for Stupid Chipmunk to peek out of the tall grass. When it inevitably did, (that’s why it was then called stupid) my cat would jump at it and S.chipmunk would run into the branches of a forsythia bush. My cat would then again sit down and wait….wait….wait….until S. Chipmunk tried again. This went on and on, over and over…. until I chased the cat away. My cat was determined and very, very patient. She could have done this all day long. So…no, I’d have rescued that baby woodpecker, too. It didn’t have a prayer otherwise, with that cat around.

      Total agreement this is crazy drop the fine!! Reminds me of the time when I was 5 years old and found a baby bird. Not realizing that a box was not the safest place, and then going back later to a half eaten bird. (these people were smarter there was a lid) Then I had to fight off the boys of the neighborhood to keep them from killing the cat, for doing what was only natural to him. What would I have done if Ihad to fight Fish and Game, it’s a good thing this was over 50 years ago.

      maybe the cat already ate momma bird, then what? maybe the girl was placing the baby bird in a safe place due to the “witness protection act.” Why would the wildlife officer need an armed state patrol officer for back-up? i‘m surprised they didn’t bring out the tazzers. they could have just mailed the ticket. looks like government grandstanding to me.

      What about the woodpecker? If it has legal right it has legal obligations.
      Did the woodpecker have an immigration permit? Probably not, it must have been an anchor baby!
      Was the woodpecker trespassing? Yes it was!
      Sue the custodian of the woodpecker (the government) for the damage and emotional stress it has caused by leaving the woodpecker unsupervised.

    This is beyond stupid; we see sheer idiocy of government regulations and strictures moving into the realm of the utterly insane. They saved the bird from a cat, and now the mother of the girl is not only fined, she can be thrown in jail for saving it…if the cat killed it, she would most likely be fined and jailed for the actions of the cat as well.

    We got hit with this twice years ago, once when an American Redstart flew into a store window and knocked itself out just before a storm broke, and a second time when a red tailed hawk crashed through the screening on a friend’s back porch. Both times, the Animal Control staff were less than helpful and Fish and Wildlife were bullies. It’s strange that the F&W staff don’t realize that they are actually promoting a Triple S policy (shoot, shovel, shut up) rather than actually protecting the various animals.

      Let the animal die next time. Walk away and claim you saw nothing. I can’t afford to save a life. I can’t afford to sustain my own life in this economy. Let the bird die.

      S.S.S. has become the only viable solution these days (as much as I hate to say that). I have some “friends of friends” that live in California who’s neighborhood is being threatened by some kind of endangered turtle….the insanity of the over regulation has cause far more turtles to “disappear” than it has saved.

      It’s all a way to get more money from honest people. You can never tell what species is “protected” because they add more all the time. It makes people not want to care for nature. Funny that they care more for animals than humans in America.

      Lorianna – I am forced to agree with you because a friend’s church bought property to build a larger facility in another state. They had to have all these environmental impact studies done in order to actually have the sale completed. The sale went through and when the site plans were presented to their Planning and Zoning, there was a major problem because all of a sudden someone realized that box turtles MIGHT be in the area. Box turtles were never mentioned in the other studies. So, they had to set aside 1/3rd of the property for box turtles that no one has ever seen in the area and pay some outrageous amount to continue to be allowed to develop the property. A parishioner offered 2 acres of wetlands on his property to be designated for box turtles (and actually might have them) but that was turned down. The word extortion comes to mind.

      I know just what you mean. Here in Florida, anyone who has had met the fish and wildlife types once makes sure they never repeat the experience. They are among the most authoritarian, and stupid, govt employees I’ve ever encountered. And among the most powerful.

      So what does fish and wildlife have to say on the subject of the hundreds of thousands of Eagles scheduled to be killed by wind farms EACH YEAR?

      BTW aren’t those wind turbines made by GE? The very GREEN, Obama sucking-up, Newt Gingrich-partnered, China loving, untaxed GE?

      Once again, another progressive law of unintended consequences. Passing laws to protect a species of birds and it ends up punishing an individual. the more people hear about this, the more people will NOT try to protect any wildlife for fear of prosecution.
      We just save a baby robin. Fortunately, it’s not “protected.”

      From the way the bills are written, it’s illegal to even TOUCH a protected species, and that means yes, even to save it.

      Can you imagine if this girl had also set up a lemonade stand. And then saved the bird. Jail time for Mom I’m sure.

      Our society is going down the tubes and the main reason is crazed special interest groups in concert with lawyer politicians who make up and pass lunatic laws/ordinances/rules/regulations. Add the local yokels who enforce those laws and we have these growing examples of “government gone wild”. Sad, really sad.
