More Curious Connections Emerge in Case of Couple Fined $7,200 for ‘Wake Up America’ Sign

Last week, The Blaze covered the story of Clara and Johnnie Russell and the massive fine ($7,200) levied against them for posting this sign on their property outside of Fort Worth, TX:

The more digging we do into this story, the more questions arise:

  • If the Judge in the case has ties to one side of the argument, why has she not recused herself?

The Judge who levied the huge fine has ties to at least one of the board members of the complaining HOA. These photos used to live on the Facebook page of  Kathy Kornegay Chruscielski (HOA board member and personal friend of the Judge Lynn Marie Johnson).

 

The photos of Judge Johnson previously seen here were removed at the request of photographer and friend of Judge  Johnson, Kathy Chruscielski. They were all photos posted on Ms. Chruscielski’s public Facebook page. She has since made the photos of Judge Johnson “private.”

 

Additionally, Thomas Stewart, the current president of the HOA is a supporter of the Occupy Wall Street movement as well as President Obama.

Pro-OWS Photos Posted By HOA President

Following the attention brought to this story here and on the Glenn Beck Radio Program, the current President of the Remuda Ranch Estates Homeowners Association – Tommy Stewart – was given op-ed space in the Fort Worth Star-Telegram to explain the position of the HOA.  Curiously missing from the op-ed was any specific mention to the actual story of the Russells and the HOA. The vague reference is here:

A noncomplying sign that was the subject of recent news reports was posted for about six months before the homeowner was approached by the HOA to take it down. Other signs removed at the HOA’s request include an Avon sign, a swimming pool company sign and a sarcastic sign that read “Jack is my new best friend.”

HOA President Stewart’s op-ed continues:

Title companies are responsible for notifying buyers of deed restrictions, and a notice is posted at the subdivision entrance stating that deed restrictions are enforced.

In our initial interview, the Russells told The Blaze that they were not aware of a Homeowners Association when they moved to the area. They also claimed that they never paid dues to an HOA or signed membership papers with an HOA. Clara and Tommie Russell actually offered proof that there was not an HOA when they purchased their home.

Clara Russell told The Blaze that the judge refused to consider any of the photos of other signs spotted in the subdivision and also denied her the opportunity to question the HOA president about the notice of violation.

Last week the Russells appeared before Judge Johnson again, this time to argue that they could not afford to pay the judgement and certainly could not post the 200% bond required to appeal the case. The judge did not rule on Clara and Johnnie’s appeal, delaying any further discussion of the issue to December 1st.

Oddly enough, when Lynn Marie Johnson was running for office last Fall, she issued a statement letting voters know they could expect fair treatment from her.

It is important that the Justice of the Peace take into consideration the seriousness of the offense, the threat to the community, and sound legal principles before the bond is set.

Is a small yard sign a threat to the community or a serious offense?

Aside from the curious connections between the Judge and the members of the HOA board, the size of the fine slapped on the Russells brings the question of fairness to the front of this story.

As stated above, Clara and Johnnie Russell are due back in Judge Johnson’s court on Thursday, December 1st.

In advance of that hearing, they will also be guests on Glenn Beck’s Tuesday program on GBTV.

    This is easy. Appeal to a higher court right off the bat. Get a lawyer and countersue for fees and costs, damages and anything else. Tie up the pseudo HOA in court. Since their sales contract states there is no HOA or development community and no money changed hands at settlement transferring the dues or rules of an HOA to the new omeowners the suit automatically gets thrown out and the HOA is held for the damages.

      Its not easy when you don’t have the money. If you already can’t afford the fine, you can‘t pay a lawyer and you can’t afford to lose. I know you said to sue for lawyer expenses, but the lawyer will still want some money up front and losing has to be considered.

      13th, ACLU actually stood for American Communist Labor Union and right around WWII it was changed to American Civil Liberties Union. Interestingly enough, the board and the members did not change, it was to hide the ‘Communist’ title from the public.

      This JP‘s tie’s and abusive fee’s should be published and pushed to the forefront in order for the public to do what is just and remove her come election day.

      Al, I don’t think that contract is connected with the HOA. Looks like a real estate sales contract. The other party was probably someone who bought years ago. The realtor messed up. Checked the wrong box. The deed restrictions for the HOA would be filed in the County Recorder’s office. That constitutes “constructive notice.” Aside from apealling what clearly appears to be a politically-motivated decision, I would bring in the Realtor for contribution by way of negligence in obfuscating the existence of property use restrictions.

      The Title company didn’t catch it, and the county clerk filed it without addendum. At this point it’s pretty much a you-snooze-you-lose situation for the HOA. This property cannot legally be forced to obey the HOA, since the owner signed in good faith and no legal entity caught the mistake, if there is one.

      (Pictures of other violations should not be admissable in any event)

      This is obvioulsy a politically motivated attack against a conservo-libertarian property owner by a Marxist-progressive HOA president. That alone warrants the case be tossed out and the claimant slapped with legal fees.

      Yes, hire a lawyer pro-bono and have him sue for fees agaisnt the HOA, the claimant individuals on the HOA, and even the judge, who can be unseated at the state level. At the very least the HOA must hire prepresentation, and since they do not collect dues (and really have no case), that comes out of someone’s pocket. You’re talking BIG BUCKS for a lawyer tot ake on a losing case.

      This is EXACTLY what should be done. Conservatives look like hypocrites when pointing at the OWSers and accusing them of not obeying laws and city ordinances…..and then excuse Conservatives for displaying THEIR free speech rights.
      Citizens do not need a team of expensive lawyers when appealing an issue where there is “black-letter-Law” involved….there‘s either a HOA or there isn’t. When you need a team of lawyers is when an appeal is based on some vague term like “intent”
      ANY of the local media would jump on this news story of a Judge violating the terms of her office…..the story has to be about THE JUDGE and not a homeowner wanting to put ugly, unrestricted signs in their yard.
      This has to be about a JUDGE and a SIGN…..and NOT what is on the sign.
      I‘m very glad my neighbors can’t fill their yards with signs advertising ANY of their beliefs…or whether THEY consider some sign to be “tasteful”…..which is in the eyes of the “beholder”
      Anybody else see the hypocrisy of criticizing other people’s rights of expression, but demand they have the right to “express” ANY opinion they choose to express.
      YOUR sign is ugly….but MY sign is tasteful.
      Same one-sided viewpoint toward a homeowner clogging residential streets…..to where firetrucks and ambulances not being able to drive down the street to someone in need…with the CARS OF PEOPLE ATTENDING THEIR BIBLE STUDY in their home. An Amways sales meeting in a home would also clog residential streets..

      Actually, no.

      The sales contract is between the old owner and the bew buyer. Liability for the non-disclosure of the HOA is a matter for the title insurance and the old owner. If the new owner has damages due to their undisclosed membership in the HOA and they have mitigated their damages, then they can go after their title company. The title company would then go after the old owner.

      The HOA is unaffected by the sales contract. The HOA’s authority over the property is limited to what is allowed in the deed restrictions on the property. Selling the property doees not alter the deed restricitons. So far, the article has not told us what the actual deed restrictions are for the property.

      It is easy to say: “its judges like her that need to be forced off the bench”. But in reality it won’t go very far.
      Point of fact; In my county, there is a Magistrate (a very strong Democrat, but appointed by a Republican Gov.) who was one day locked out of her office by a high ranking official of the Dept. of Social Services and told to tender her retirement papers. The Dept. of Social Services had solid iron clad proof that she was commiting felonies with State funds and vehicles for her personal gain. A Felony conviction for you or I, but early retirement for her, because she is a minority. A very high ranking State Senator later submitted her name for a County Magistrates open position. The Governor received more calls aginst her appointment than any issue he ever faced. (and he had all the facts presented to him by State officials) But he was afraid of her minority status and that of the State Senator. He buckled and she is now passing out jail time to those who come into her court, instead of receiving jail time of her own.
      Go Figure. And some fool thinks there is justice in this world. Kiss my grits.

      HOA’s and especially Condo Associations are notorious for junk like this. How the suit against the Association works is if they [the association] over spends their budget for the Association attorney, then they can implement a special assessment to cover further costs to the Association for attorney’s fees, just like having an unlimited bank account.

      Not only does the homeowner who filed the lawsuit have to put up front money to hire their attorney, but would also be paying their share of the Association’s attorney who will be defending the Association from them. There is no Attorney who will take a case involving suing an Association on a “if you win we’ll take a portion and if you lose we don’t charge you,” trust me .. been there done that. $15,000 to get started.

      Recalling a board member is tough to do also, if not impossible, but it can be done. We managed to get 3 of them at one time.

      @catb Its been tried in the past that is why if you buy a home with any restrictions you are required to sign that you agree to adhere to their rules and thus they are not unconstitutional. However unfair they may seem they do serve a purpose and in many cases serve that purpose well and with good intentions. This HOA was a voluntary one and thus cannot be forced to abide by their rules. If it was truly mandatory then the title company is liable and should pay all lawyer fees. Any way I look at this there is no reason why these two individuals should pay anything and I’m sure there are good lawyers out there that will take the case assuming that his/her costs are part of the damages being sought.

    The HOA is negatively affecting the value of the real estate in this subdivision. Who on earth would move to Texas without doing a search on HOAs for an area? And, WHO on earth would buy property in a subdivision run by this kind of HOA? Somebody better wake up and smell the coffee. They are cutting off their noses to spite their faces.

      I think the article showed the title search – showing that there is no HOA. To me it is clear the HOA is annexing the property.

      Can you say cronyism? The judge apparently writes the law down there.

      Unfortunately, if you want to live in a home built within the last 20 years or so here, you have no choice but to join the HOA. You have to agree to join to be allowed to buy. It’s insane. HOA’s have way to much power but every session of the Legislature HOA reform bills get shot down or just die in committee. Your only option is to buy an older home (and some of those neighborhoods even have HOA’s) or build/buy in the country.

      I moved to Tx 18 months ago. I checked out all restrictions and made sure there were none. I also moved to cowboy country where they still honor the code no matter what political persuasion. You will find things like this in Austin, DFW, San Antionio and Houston. Stay away from those places. I also refused to move to a county were you car’s emissions had to be checked. I drove older cars so I dont’ have to pay high rates of insurance. Look before you buy. In this case this woman is totally wrong for the fine and charges. It’s again is legislating from the bench. Glenn come on down to Purmela Tx only 288 in the zip code running over 200 in our cowboy, soldier, Ft Hood honoring church. I am sure some soldiers here would love to talk with ya and some great sold out cowboys too.

      Enicom doesn’t respond to questions, he’s a hit and run type poster. Responding might bring him into a fray where he has to think for himself, so his handlers have given him strict orders to post boilerplate and run.       LIRIADAVILA, The Progressives are everywhere indeed. I don’t think we could have ever imagined the depth of this movement. The more we expose them for what they are we see that they always have a backup plan in place. They mock us, betray us, and could care less. However we should never assume that we will defeat them. They are much more powerful than we originally anticipated and have massive funding behind them.

    There’s not even a legal question here. An outside body with no legal governering power over you cannot step up and start giving you orders. There isn’t even legal precedence for this kind of nonsense, and it defies logic, reason and common sense. The people with the yard sign have provided legal evidence that they are not a part of, nor bound to, this corrupt HOA. Were I them the sign would be up, and multiplied a thousand fold, in my yard along with me standing on the front porch smiling and flipping the HOA the bird.

      I would agree that this should not happen, however, I’ve verified that “restrictions” on properties have been in place for 100′s of years in this country. We are all aware that Judges will not uphold the Constitution because it would interfere with their day-to-day operations in their courts. This is an effective method of “control” by having the courts not only allow, but also enforce actions that are clearly not constitutional. These restrictions where put into perpetual enforcement by a land owner before sale of land – so thus a person who owns land can place a perpetual restriction on the land. Ask any lawyer or Title Insurance Underwriter what it would take to remove a restriction (short of LAW change).
      You could liken this to a sale of a car – owner: You can purchase the car, however, you can’t change the color, window tint, or size of the tires.

    I’ve house-hunted recently, and it was listed right in the MLS that a house was under by-laws or restrictive covenants. I‘d say the law is on their side if this wasn’t disclosed. I wonder if the title company might be responsible for failure to report, and/or the previous homeowner.

    As far as the JOP goes, she needs to be removed. But they’re like weeds – another one will pop up.

      This how has had its charter pulled twice by the state for noncompliance. Our contract also said no mandatory how when we bought there. Imagine our dismay when we found out there was one. We had already started building before they made their presence known.

    Everything is so upside down now that even when a state passes a law, a judge can over turn it and get rid of that law. This judge is just like those in California. If they don’t agree with the choice of the people, being judges they just change it to what they want. It is only going to get worse with all the judges Obama is placing out there. Most are not even qualified to sit as judges. We are is deep trouble.

      The realtor contract states that there is no mandatory HOA. That is correct. When this HOA was formed the minutes of the meeting say that it is voluntary and not mandatory. That has never been changed, according to the minutes of the association.
      Mr. Stewart writes that there is a sign at the front saying that deed restrictions are enforced. What he fails to mention is that sign was placed there only a few months ago. Before that, there was nothing to indicate to a person looking at homes that there was an HOA.
      Some have said that once they knew the rules they should have taken down the sign (posters on here, not residents of Remuda). However, when other signs of all kinds (including a Texaco sign on a 20 ft. pole) are allowed, who would think that a little sign in a ditch would be a problem? No one on the board bothered to talk to the Russells personally before filing suit. You would think if they were wanting community spirit, they would have at least walked across the street and talked to them.

      Your statememts are lies. The HOA tried for months to get the homeowner to take down the sign before they told them F you! From what I hear the HOA files suit in JP court only after other remedies are refused. Interesting how someone who did not know about the HOA and was not a member voted in 2 HOA elections (2009 and 2010).

      Good luck. The Ft Worth Star Telegram is a VERY left leaning paper. I quit subscribing years ago. The paper is losing money and readers hand over fist and gets worse every day.
      Unfortunately, Texas has its share of A-hole democrats. They move in from other states, start dressing like and try to be a native Texan, then start trying to work their liberal progressive magic that has worked so well where they came from. Its a shame.

      These people should think about filing a suit against the State for violation of their rights to fair and due process and that witch of a liberal judge should be impeached for cause.
