Mother, Health Group Sue McDonald‘s for ’Baiting’ Kids With Happy Meal Toys

PORTLAND, Ore. (The Blaze/AP) — A California mother and The Center for Science in the Public Interest have sued McDonald’s Corp. trying to get the fast-food chain to stop using toys to market meals to young children.

The lawsuit was filed in California Superior Court in San Francisco on Wednesday morning by the center and Monet Parham.

They claim McDonald‘s decision to markets its meals directly to young children violates several consumer protection laws because it exploits a child’s vulnerability.

A statement on the center‘s website says McDonald’s is using toys to “bait” kids, and Parham blames McDonald’s for making it hard to tell her child “no”:

“I am concerned about the health of my children and feel that McDonald’s should be a very limited part of their diet and their childhood experience,” Parham said. “But as other busy, working moms and dads know, we have to say ‘no’ to our young children so many times, and McDonald’s makes that so much harder to do. I object to the fact that McDonald’s is getting into my kids’ heads without my permission and actually changing what my kids want to eat.”

McDonald’s is facing increased scrutiny for the practice. San Francisco recently became the first city to prohibit fast-food restaurants from including toys with children‘s meals that don’t met nutritional guidlines. A similiar ordinance was passed Santa Clara County.

    Oh yes it’s soooooo hard for a parent to say NO to a child. *Note the Sarcasm*

    Here’s what would happen when I was growing up: when I told my mom I wanted to go to McDonalds and she said no, it didn’t matter how much I whined and cried about it she would just ignore it and go right past McDonalds without stopping. In other words she was actually the PARENT and made darn sure I knew it!

    I get so sick of parents like this saying “It‘s all someone else’s fault that I constantly cave into my child’s whining and crying.”. It seriously makes me want to go up to people like this woman and slap the ever loving life out of them.
    Even though it wouldn’t do much to knock any common sense into them, but maybe it’ll knock the stupid out of them somewhat. ((And even that’s doubtful.))

    OMG!!! This is why I hate people!!! McDonald’s is making it hard for you to say “no” to your child? MCDONALDS???!!! No, I think its your BAD PARENTING SKILLS that is making it hard for you to say “no” to your child! CRY ME A RIVER that you have to say no to your child so many times. That is how they learn. What are you teaching them by suing McDonald’s? That its always someone else’s fault. Well I say stop blaiming other people for your shortcomings! Parenting is HARD WORK and if you have to say no 1,000,000 times than so be it! Teach your kids how to make good decisions and it will stay with them for a lifetime!

    I have an idea, why not let the parents decide. Parents have the ability to say no to their children. If you can’t say no to your children and learn how to raise tehm, I promise you that McDonalds happy meal will be the least of your problems as your child grows up. Some people are pathetic and will use every excuse to sue to make money and to make excuses for poor parenting and poor decision making. GROW UP AND BE AN ADULT!

      I would say yes, all fast food chains give a toy in their kids meals. Restaurants like Outback, Applebees, etc. Usually give a menu with little riddles and things to color and give them crayons. They also usually give away a cool looking to-go cup for the kids.

      I really see it as a benefit. When you are eating inside a restaurant or fast-food place, the toys & other things give the children something to do. I don’t know why people want to make this out to be a bad thing. Kids aren’t gonna stop wanting to go out to eat because the toys are gone. Now they are gonna go and use the knives and forks for entertainment.

      That is what I was thinking. I can’t thnk of any fast food place that does not have some version of this. If I were Burger King, Sonic, etc. I would offer to help fund McDonalds defense because they are next if this is won by this poor excuse for a “mother”. I don’t even know when parenting went the way of the dinosaur. I remember hearing no a lot as a kid.

    What makes this laughable is this statement; “I object to the fact that McDonald’s is getting into my kids’ heads without my permission and actually changing what my kids want to eat.” Maybe if your kids spent a little less time watching TV and you actually spending time with your kids, your kids wouldn’t know what the heck McDonalds is.

      I totally agree. What this woman lacks is a back bone. I tell my 2 1/2 year old no so many times. He doesn’t get upset about it. Saying no to your child isn’t being a bad parent. In fact, bad parents don’t say no to their children enough if you ask me.

      Keep the government out of my parenting. I have seen what they have done with education and don’t want my child educated in a public school. I feel the same way about these laws. Don’t interfere with my parenting. If I want to give my child a happy meal, I should be able to do so.

      I have an idea this ‘mom’ argues with her kids so ‘no’ means keep asking until she caves. When my kid asks me for something I don’t want him to have, I say no the first time and smack him in the back of the head if he pesters. Hence, no pestering. I say let the kid have the happy meal then send his/her butt outside to play.

      No this isn’t about wanting the government to make her decisions. It’s about getting a payday. Notice the suit was filed immediately after the San Francisco ban. That isn’t a coincidence, this is common.

      Something gets banned or restricted or required to include health warnings. Then people start crawling out of the woodwork to sue the company that produces said item. There is now established law that validates the opinion that happy meals are not only unhealthy, but dangerous. It’s essentially an invitation for lawsuits, which is what they want.

      They know they can’t convince people to boycott and destroy places like McDonalds and Walmart. So instead they attack them via lawsuit. They get laws passed that are invitations to lawsuits and all but guarantee that those lawsuits will be successful. Then they sit back and enjoy the show as the industry gets devastated by a million scam artists looking for a handout.

      God forbid you let your kids watch television. All those toy adds! It must be really hard for them to bring their kids to Target or Wal-Mart and having to tell them “no, you can’t have a new Barbie or Nerf gun.” It’s all TV’s fault. TV should be banned because people can’t make decisions for themselves or for their kids. And just imagine having to explain to your kids what E.D. is. Gimmie a FREAKING break. Grow a pair and raise your kids right! It’s not governments responsibility to raise your family. If it was, they’d all be in boarding schools and not allowed to see their parents.       Just another example of stupid, spineless, weakkneeded, juvenile “parent’s” wanting society, businesses, teachers, etc. (anybody, but them) to raise their children and take responsibility for them. It doesn’t matter that their lack of self-control over the pro-creation ability caused the children in the first place, it must be somebody else’s fault (in the case McDonald’s) for their inability and unwillingness to take responsibility for their own lives and their children’s lives.       BRAVO Ghostofjefferson!! My response is: Don’t go to McDonalds. If enough people are that weak to control their children, than you can go eat somewhere else. If McDonalds feels a decrease in sales because of it, they can pull the toys on their own. Let’s sue the banks and barbershops for giving lollipops to children. What a twisted mentality this country has taken on.

      So it’s easier to file a lawsuit than to just say, “no,” to your child (no matter how many times you have to say it)? This is where we are in society today. People who shouldn’t be having kids, having them anyway, and then not wanting to do their jobs as parents. These are the kinds of parents who want to be their kid’s friend, and hate being the “bad guy” because they have to say no. In the end they control the purse strings, so why blame McDonald’s for trying to sell a product? No matter what they do, all you have to do is say…”NO.” Simple.

Unless her urchins are holding a gun to her head and making her buy them Happy Meals, the problem lies with her, and not the restaurant.       I had 3 kids and a job,, I COOKED dinner every night.. my kids didn’t eat McDonalds.. I didn’t have to KEEP telling them NO.. I said it ONCE.. what is WRONG with these parents.. are they LAZY or do they just have NO BACKBONE..? BTW you CAN buy the toys without a burger so if there was a toy they wanted I sometimes bought it.. Heck my kids thought is was great when they got older we had homemade Pizza on Friday.. AFTER dinner as a SNACK..

      Leftfighter, I’m with you. It is hard to be a parent because you DO have to say “no”. If you didn’t want that responsiblity, you shouldn’t have had kids. Saying “no” to too many Happy Meals and enforcing it is great practice for saying “no” to other unwise and dangerous requests children make as they grow into pre-teens and teens. It is also a great way for kids to learn that they can’t always have everything they want and that their parents have the right to say “no” and enforce it.

      EMM1969- the coffee law suit was actually a viable suit. I got my Bachelor of Science in degree in Business Marketing this past February and the coffee case is one we had to study at great length. You would be surprised at the facts in the case and I definitely believe if hearing them you would change your mind- I know it changed my opinion. Please research how McDonald’s handled the whole thing. The fact that the coffee temperature was scalding hot. The fact that they had received many, many complaints prior, and considering that McDonalds determined the risk of being sued by someone who might end up really injured was worth the profit they would make in the sale of coffee (as it is believed by experts that the hotter the coffee is brewed the better tasting it is). The judge determined McDonald’s behavior was wan ton- reckless disregard for the consequences. Furthermore, the elderly lady was really injured, having to receive a number of skin grafts and debridements.

      I am sorry for going on like this, but when I learned about the actual facts of this case I decided that I would never let anyone make fun of it again.

      In a free society, people can choose where they wish to dine… If this mother is so against the Happy Meal, why doesn’t she just tell her daughter, “No”? I guess suing McDonald’s is easier than just saying “no” to her daughter…
