MSNBC Anchor: Palin‘s Use of American Flag Could be ’Breach of Federal Law’

Martin Bashir, it seems, is not a fan of Sarah Palin. And during his MSNBC show and “Clear the Air” segment, he went looking for a way to roast the possible 2012 candidate who is now on a national bus tour. So what tool did he use to blast the woman even many of her detractors see as patriotic? The American flag.

According to Bashir, Palin could be breaking the law by displaying the American flag on her tour bus:

Here’s what he had to say:

In fact, the whole thing could be in breach of a federal law because the United States Flag Code establishes important rules for the use and display of the stars and stripes, the flag of the United States. Under standards of respect and etiquette, it’s made clear that the flag of the United States should never be used for any advertising purpose whatsoever. Yet that’s precisely what Sarah Palin is doing. She’s using the flag of the United States for her own financial purposes. She drapes herself in the stars and stripes and makes millions of dollars in the process. This has got nothing to do with the presidency and everything to do with filling her pockets. And by raising her profile, she raises her income. It is as simple as that. So she was right when she said that hers is not a campaign bus. It‘s a cash bus and she’ll keep it rolling for as long as she can.

NewsBusters quickly takes Bashir to task, especially reminding him that the U.S. Flag Code is not federal law:

The only problem: the Supreme Court ruled in 1989 that flag burning is protected by the First Amendment. If flag burning is protected speech, certainly displaying the flag on a tour bus is legal. Or do the rules not apply to Sarah Palin? In Bashir’s warped sense of reality, conservatives like Palin would be arrested for flying the American flag at rallies in which they promote causes that Bashir does not support.

The Congressional Research Service, a non-partisan organization that provides legal analysis to members of Congress, clarified that observance of the Flag Code is “purely voluntary” in a 2008 congressional report: “While wearing the colors may be in poor taste and offensive to many, it is important to remember that the Flag Code is intended as a guide to be followed on a purely voluntary basis to insure proper respect for the flag.”

Considering Palin’s profile has been raised so much in the last week, she can expect attacks like this from the left. But attacks like this are a weak attempt at a nuanced smear campaign.

      That was, besides Kid Rock wearing an American Flag outfit whenever he played the Super Bowl, my FIRST instinct to point out. But, it would be easy enough to say that Obama’s campaign logo “simply utilized Red, White, and Blue“ and ”was constructed to be circular, not reminiscent of a flag by any means.” To which I would likely respond, “Yes, and that‘s not a flag on Palin’s bus – it’s a red and white striped bedsheet.”

    And where was Martin Bashir a few weeks ago when that college egg-head tried to burn the flag New Orleans? He wasn’t there, but a lot of angry patriotic people were. That is, if he really is concerned for the well being of one of our nation’s symbols, then shouldn’t he have been covering what was going on in New Orleans a few weeks earlier. Nope, he’s too busy looking for an excuse, any lame excuse, to bash Palin and other conservatives.

    By the way, his interview with Breitbart was precious. Breitbart took him down and refused to let Bashir corner him. I don‘t think he’ll mess with Andy again.

    Martin Bashir is a moron. As the article points out, the US Flag Code is just that – code. it’s not federal law. Further, it is voluntary. Finally, I don’t see a US flag on the side of the bus. What I see is what appears to be a furled flag with red and white stripes – but I do not see a blue field emblazoned with white stars or anything else that confirms it is, in fact, an image of the United States flag. So sad to watch how these moronic ******** try to light huge fires with a magnifying glass on a glacier. Just pure stupidity. (and I’m not a fan of Palin)

      Idiot yes,and indeed the code is a voluntary set of rules but bear in mind that the pornographer Larry Flynt was thrown in jail for 6 months for wearing the flag as a diaper. I‘m not sad about that and I don’t mean to imply that the two uses are at all alike but there is precedent for punishing someone for mis-use of the flag. Problem I’ve seen over the years is that mis-use is often in the eye of the beholder only.

      Bashir was the guy who did that hit-piece on Micheal Jackson. I am no great fan of Jackson‘s but I watched him worm his way into Jackson’s confidence, allowing him to believe that he would be presenting Jackson’s side of the various controversies.

      If I recall, the U.S. flag code is a guideline, and carries no punishment. This is why you see so many flown at night with no lights, why you see so many tattered and torn flags, why our own president doesn’t put his hand over his heart always during the pledge or national anthem, why people fly it at half mast without presidential declarations, why people lay them on the ground or fail to burn them if they do touch the ground, why people burn them or pee on them in protest.

      Having said all that…

      Sarah has made this VERY CLEAR – UNWAIVERINGLY CLEAR – THIS IS A TOUR TO RAISE AWARENESS OF FOUNDING PRINCIPLES AND HOW GREAT AMERICA IS. She is not schlepping books or t-shirts for sale.

      It is given a place of prominence and solitude.

      It appears to be clearly INTENTIONAL, that the flag is honored by having its own distinct location, as NOTHING else is on that side of the bus… NOTHING!

      I would note that Sarah Palin does NOT have a flag on her bus unless there is one that can’t be seen. She has pictures of flags, but no flag on her bus. While I am not sure of the exact wording of the statute he is claiming, it would seem to me that they meant actual physical flags, not paintings or other symbolism. Just as a “stars and stripes bikini” i would say is not a flag.

Also cutting down a small forest to complete your list may contribute to “Global Warming”, excuse me I meant “Climate Change”, oh my, I’m so confused, I meant “Global Warming Disruption”.

      Why don’t you try investigating ALL of the federal laws that THIS administration is breaking on a DAILY basis!!!!!!!!!!!!!!!!!!!!!!!!!!!!

      This is right up there for forbidding students to wear shirts with American Flags on them, but it’s OK to wear shirts with Mexican flags. Our entire country and heritage is under constant assault by these vermin. Does anyone but me get tired of hearing from them?

      Bashir is a good one to be calling anybody else just “in it for the money”. What does that make HIM, when he is shilling for a corrupt and immoral “Progressive” administration for money? The words Media Wh**re come to mind . . .

      ok check his green card! I did not see the flag on the side of the bus. I see blue and a couple of red and white stripes that could symbolize the flag? It is funny that the Left does not mind if we burn the flag but they have a problem with it being on the side of a bus. That is funny.

      How about when someone in this country, such as California, sets it on fire and mocks it? Huh? Cover that about 2 years ago. I believe they were illegal aliens that NO ONE, not one person, did anything about. Everything that we are afraid to confront, knowing that it may be unrighteous or politically incorrect, says a lot about your character. I realized a few years ago, in fact, when I began watching Glenn on CNN, that my whole life is based on my character and my righteousness. I then, began to be tact and diplomatic, but telling the truth and speaking what I felt. I remember once when someone from India, which I was working with, said something derrogatory about my country. I put him in his place. I told him to get out of my country and because our country has freedoms, he was allowed to say such things, but then I also had a right to argue the point. He went to my boss. My boss called me into his office and told me because the guy was a foreigner, we had to be quiet. I then said, NO I will not. This is MY COUNTRY not his and went back to work. Nothing ever happened, but the Indian kept clear of me. I also told my boss that if he didn’t talk to the other guy, defending me, that he had poor character and I would lose respect for him. He was a Christian Supervisor and he did have a talk with the guy. Later, he told me, he prayed about it and felt he should talk to that guy. He told him about our Constitution and our right to free speech except for him.
