Muslim Woman Sues Disney for Not Allowing Her to Wear Her Hijab to Work

Imane Boudlal, a former hostess at a Disney-owned restaurant is suing the company, claiming that she was not allowed to wear her Islamic headscarf while at work. According to her lawsuit, which was filed on Monday, Boudlal says that when she showed up wearing her hijab, she was told to take it off. If she chose not to do so, her other options were to stay out of customers’ sights or — to go home.
According to The Daily Mail, the issue took form in 2010 when the woman was working at Storyteller Café inside Disney’s Grand California Hotel. She had learned while taking her U.S. citizenship exam that it is permissible for her to wear a head scarf to work and, thus, she decided to start doing so. While she hadn’t yet enjoyed this supposed right during her first two years working at the restaurant, she subsequently began wearing it to work.
It was then that Boudlal’s clash with Disney began, as she was reportedly sent home numerous times without pay when she showed up wearing the headscarf. The situation intensified when she refused to wear a bow-tie bonnet and a hat that was offered to her as a cover-up by her bosses; she also declined the option to work “back stage” and out of sight. At that point, she was suspended.
The Los Angeles Times has a more robust timeline of the events at hand:
The lawsuit charges that Boudlal, who is a naturalized U.S. citizen, decided to wear her hijab full time in 2010, about eight months after she began wearing it publicly. She contacted her supervisors at Disneyland to request an exemption to the company’s “look” policy — general appearance guidelines that, according to a Disney website, touch on items ranging from contact lens color and visible tattoos to personal hygiene.
After weeks of discussions with company officials, the lawsuit says, Boudlal received initial approval to wear a Disney-designed scarf, but she was told it would need corporate approval before she could wear it to work. Not wanting to wait to mark Ramadan, Boudlal wore her own hijab to work Aug. 15, 2010, when she says she was told she could either remove the scarf, cover it with a hat or work in a job out of public sight.
Disney spokeswoman Suzi Brown claims that the company did try to offer options to Boudlal and that they were all flatly rejected.

“We presented Ms. Boudlal with multiple options to accommodate her religious beliefs, as well as offered her several roles that would have allowed her to wear her own hijab,” Brown explained. “Unfortunately, she rejected all of our efforts and has since refused to come to work.”
In addition to the headscarf issue, the woman reports being harassed by co-workers and, as a result, complaining to superiors — but to no avail. Managers, she claims, simply ignored the oral and written slurs that co-workers were purportedly responsible for. Boudlal was allegedly called “terrorist, “camel” and other disparaging names.
“It’s been hard,” Boudlal admitted in a response published by the Los Angeles Times. “I thought it was just a matter of complaining and a few days, and it wouldn’t affect my life, but it turns out … nothing has been done.”
It didn’t take long before Boudlal filed a complaint with the U.S. Equal Employment Opportunity Commission in 2010. Last week, two years after the incident originally unfolded, she received a notice of right to sue. Boudlal has been supported by her union, UNITE HERE Local 11, a group that has been battling Disneyland for years over an expired contract and is now being represented by the American Civil Liberties Union (ACLU).
Boudlal is seeking damages and harassment and discrimination training for Disney employees, the Times reports. Additionally, she’s asking that fellow Muslim Disney employees be able to wear their hijabs without restriction (you can read the full complaint here).

Further more, EVERYONE in the company is subject to the same “look” policies. I’m sure that there is a possibility that there is a Mauree (think I spelled that wrong. you know the native people of New Zealand and the surrounding area of the world) employee that wouldn‘t be allowed to display religious tattoo’s. What makes this woman’s hijab any different. Disney‘s employees and their appearences are a big part of this company’s brand and they are very strict about it as they have a right to be. If you don’t like working there GET ANOTHER JOB!!! Don‘t sue because they didn’t conform their entire policy and brand to fit YOU!!!! SO sick of this garbage!!!!

They offered her several options to accomodate her, offering her another position, offering her a way that would not violate her rights and would not interfere with their own dress code. The fact that she worked there for two years without wearing it doesn’t help her case. She was willing to do without it and not say anything, but then out of the blue she decided that she needed to start wearing it? That would be like me working at a place for two years and then saying, “Oh yeah, I can‘t work on Sundays anymore because I forgot to tell you that I’m a Christian.”

There are hundreds of places she could work, she picked the place with this policy. Either this will change the policy which will further Islam in the work place or she will cash in. Interesting she was working at Disney for almost 2 years with the hijab and then decided to make it an issue after she figured out how to play the game. What was the problem of trying to cooperate with her employer and wear a hat over her religious attire? Seems like a very reasonable request to me from the employer who 1) has a dress code; 2) has a sound reason for the dress code (theme park); and 3) attempted to work with this young woman who had been perfectly okay not wearing a hijab before she got a bee up her bonnet to wear it to work without working with the employer.

Like anybody else in America can do, she is free to find a job that does not violate her beliefs. Excluding these facts, she has worked there for two years already with no problem not wearing her head dress. What has changed? I’m sure if she would have mentioned the head dress at time of hire she would have had been told these choices for employment at that time. Maybe the reason she didn‘t bring up the subject at time of hire is that she new it wouldn’t have worked and wanted to get her foot in the door before turning it into an issue and force her beliefs onto disney Corp. and the courts should do the right thing here and throw out the suit.

Disney has deep pockets, and she could also draw attention to Islam concurrently. Lawsuits by Muslims, with C.A.I.R. backing and financial support, are forcing employers to do things the Muslim way or no way at all. Disney will eventually allow all Muslim women to wear the scarf and soon the full burka. Wait and see.

Almost every international banking institution has established a SCF and more and more American companies are starting to set them up. The SCF invest only in purposes that comply with the rules of Sharia Law.
Now a lot of people won’t think anything big but when you look deeper into it you will see the danger. For example if a trucking firm financed by an SCF hauled pigs as one of its loads, it is obliged to pay a fine equal to the proceeds of the total investimate. The SCF board determines who get the money, called “purification”. And, as with zakat, it often goes to terror-sponsoring organizations.

Posted on August 14, 2012 at 8:57amThe various civil rights laws require an employer to provide the opportunity to have reasonable accomodations for a person’s religion. Reasonable accomodation was offered and refused. The religious accomodation requirement has enough case law that it would appear Disney met the requirements. Of course the caveat is a timid and/or liberal administrative law judge could make a “politically correct” decision against Disney. I suspect this will move out of the administrative law arena and in to the court system.

Since they are the only ones in town they are really conspicuous, but since they are not allowed to work it isn’t an issue for the rest of us. All of their sons work in their business, none of their daughters. It must be really odd for them at school. Posted on August 15, 2012 at 12:50pmMy daughter worked for Disney, and at hiring and during the very extensive orientation Disney is VERY clear about the dress code…and so strict are they with the dress code that Disney provides the uniforms even for the simplest of jobs (maids, cooks, cleaners). It’s being “on stage”; they dress you for your role from head to toe. The employees pick the uniforms up, use them then bring them back for cleaning/pressing and reuse. This woman, just like my daughter, knew all of this when she was hired…this is just her ploy to get money for nothing and promote Islam in America.

She can go work somewhere else, where she is permitted to dress as she wishes. A business has every right to be discriminating, without being discriminatory.

Posted on August 14, 2012 at 7:54amBusinesses have every right to set dress standards but I can‘t help but wonder why this didn’t up beforehand. A company would have surely made their potential employee aware of dress standards long before they showed up for work. Any issues would have been discussed during the hiring process.
Of course it’s also possible that this women was looking for trouble much like Fluke was and intentionally applied for a job in which a specific outfit was required. Considering how many positions at Disney require specific costumes be worn, this is hardly an unlikely scenario.

However, I bet in their future hiring process they will discuss appropriate clothing to the specific job and include head coverings.

If you think Disney doesn’t go over that, you are kidding yourself. Disney used to(and I only say used to because I don’t know if they still do) require you to wear Disney issued underwear with your daily uniform. That’s how strict a dress code they have.
You cannot wear any of your own jewelry, hats, hairstyles, etc. You cannot wear a crucifix or any other religious items. You can wear exactly what they tell you that you can wear. And, when you apply for anything with Disney, you have an audition, not an interview. They consider every job to be a position of acting for the audience. So even as someone in a resturant, they want to be sure that you have the right look, can smile and converse in just the right friendly manner, etc.
If you ever go to Disney, you can see this in effect after about 5 minutes. It’s an entirely unique experience. You don‘t see teenagers with spikey hair that look like they couldn’t care less because they make minimum wage like at other parks.

Report Post »I worked at WDW as part of a college internship from 2006-2007. The only cast members who had to wear Disney-issued underwear were character actors, and those were just undershirts and shorts over their regular underwear. Stud earrings, bracelets, watches, and necklaces (including crosses) were allowed as long as they were tasteful and not distracting. The only things they didn’t allow were visible body piercings. I seem to remember hijabs being OK for legitimate religious reasons, but I believe they were special Disney-issued ones. It sounds like, in this case, the issue was that she wanted to wear her own until Disney costuming could get one for her.
