Muslim Women to Sue Abercrombie & Fitch for Alleged Hijab DiscriminationAbercrombie & Fitch (A&F) is no stranger to controversy and conflict. In the past, groups have accused the company of racism, sexism, and not paying employees in a timely fashion. Now, two Muslim women are reportedly set to sue the clothing giant in claims that they were discriminated against.

The first woman, Samantha Elauf, says that she was not hired by a Tulsa, Oklahoma store because she was wearing a hijab (Islamic headscarf). The other woman, who has not yet been publicly named, claims that a San Mateo, California branch fired her for refusing to remove her religious headscarf.

The Equal Employment Opportunity Commission, responsible for protecting Americans in the workplace, is bringing a lawsuit against A&F on behalf of Elauf (the commission is also examining the second case). The trial for the case is set to begin on July 18. According to NewsOK:

The case, filed Sept. 16, 2009, in federal court in Tulsa, accuses Abercrombie & Fitch of refusing to hire Samantha Elauf, then 17, because her hijab, or head scarf, violates the company’s “Look Policy.” Title VII of the Civil Rights Act of 1964 protects workers from discrimination based upon religion in hiring and in the terms and conditions of their employment.

The second case, involving the woman who claims she was fired for not removing her headscarf, will likely be filed sometime today by the Bay Area Council for American-Islamic Relations and The Legal Aid Society. In this instance, too, the company’s “look policy” was at the root cause of the allegations. Mail Online has more:

The company has become well-known for its controversial ‘look policy’, which provides strict guidelines governing how employees dress.

It stipulates that staff must represent ‘a natural classic American style’ and instructs them on everything from how to wear their hair (clean and natural) to how long they should wear their nails (a quarter of an inch past the end of the finger).

Both cases pit company and employment policies against individual religious beliefs.

What do you think? Should A&F reserve the right to create these clothing policies, or are they violating individual rights by doing so?

UPDATE: The woman in the second case has now been identified as Hani Khan. SouthSanFrancisco Patch has more:

Hani Khan, 20, said it was the first time in her life she had faced discrimination since she started wearing a headscarf in kindergarten. As a Muslim, she chooses to wear a headscarf, or hijab, that covers her hair, ears and neck as part of her religious practice of modesty when in public.

      exactly. i’m really sick and tired of equal-ling ourselves to death. we’ve got to have standards and allow companies to have standards. now if they didn’t hire her because of race, that would be a different thing (companies should hire the best and brightest based on true merit). however, there IS such a thing as business dress and every day dress in this country. the girl CAN dress business dress for her job and then put on her every day dress (aka her religious dress) upon leaving work. it’s called being in and out of uniform. this is a private business and as a private business, it has a right to impose a certain uniform for its employees. she can take it or leave it.

    I’m not racist and I actually really enjoy diversity but I honestly want the burka/jihab wearing, Sharia Law following, jihad loving Muslim people out of my freaking country. I have two degrees, am well read and have traveled the world; in other words liberals, I am not an ignorant hillbilly as you’d like to say. These people do not fit in with our culture, nor do they repect it. Get out and stay out. If you don’t think that the plan of many Muslims is to take over this country then you are living with your head in a hole. We need to press the next administration to not let any more Muslims in this country. I’m sorry to those Muslims who respect the US and are peaceful but we have to protect our country.

What about women and children’s rights in your religion. Girls are mutilated as children. Women have no rights, can be killed for being raped. Children are molested, where are their rights. No worries there Abercrombie & Fitch, you have a great case. Its just a move on your company to get you to comply using hateful tactics.

If this is the case, you need to explore other media than the left-wing sometime. Broaden your horizons and see that America is a good country! Sure, it’s not perfect, but no country is. We are the most open minded of any country on the planet. We openly squabble about everything fm religion to politics w/o slaughtering one another. We may find other cultures offensive to our sensibilities, in line w/the best of the Enlightenment tradition, but we don’t try to exterminate them. In fact, we often use our power to end extermination bids of one group against another. Witness — the Balkans. We used military power to stop the extermination of muslims at the hands of Serbian so-called Christians, who forgot Whom they serve. We put a stop to Saddam and his murderous sons, sparing the lives of countless Iraqi muslims, only to see our efforts spit on by muslims and Iraqi Christians set upon by salafists.

      You need to examine America more closely, dig in, and find a society that is open and willing to come to the aid of the underdog.

      When you apply for a job, any job, you should research the company and see if their policies fall in line with your values. This dress code has been public knowledge for years. These women saught employment with the intent to take the company to court. This is financial Jihad.

      As far as the cross goes, as long as it fits into the dress code it should not a problem. Even as a proud christian, I would not wear a cross to work or flaunt my religeon to unwilling crowds because there is a time and a place for everything. I wear my heart on my sleeve and I live my faith. As long as I do this I don’t need to put on a show for everybody to notice. They ask me about my life because of the way I lead it, not the way I dress.

      It’s like any other employment. Dress code. You have the choice of either abiding by the dress code, or to not work there. If the burka, or the hajib, or what ever else is not included in the acceptable dress code, then go work someplace else.       I agree with Dimmuborgir. The Muslim women in this case would have a hard time explaining why they wanted to work for a company that sells clothing known to be immodest by their standards and promotes sexuality. I think they did it so they could sue as well. There are other places they could work that would not violate their standards. I don’t drink because of religious reasons, so I wouldn’t apply for a job at say, a bar that served alchoholic drinks!

      I’m not a fan of Abercrombie $ Fitch with what they’ve done in the past, but I would support them against these Muslim women in their wearing the hijab. One must represent the company for which one works. If you want to work there you wear what the company wants.

      This is an important probably heavily supported by the Muslim money. I hope they (Muslims) fail. However, the I see the Tulsa one failing and the California one succeeding.

      The first one is under burden of proof that she wasn’t hired because of religious beliefs, the second did not follow employee policy and they had a right to dismiss her as much as someone who wore a dirty tee shirt with dirty fingernails. The muslims learn quickly from Affirmative Action, don’t they?

      A&F, as with any business, has the right to set dress code and uniform policies for their employees. As long as no manger discriminated on the two ladies specifically for the religious association that the headscarfs carry, then they should be fine. A&F has a look that they want to portray, that’s their whole business model. Selling to teens and young adults on how to look. It is only natural that they’d want their employees to, at the very least, be as close to the image of what they are selling. Until they sell those headscarfs in the store, they can require employees to follow their uniform /dress policy.

      Oh no, I understood completely. I‘m saying it’s idiotic to get information so wrong. Why would someone insult Russians in an article about Muslims? Because of ignorance; they honestly don’t understand anything about customs, cultures, or (potentially?) even the very group they’re trying to insult.       When (hijabed+) muslima girls mix with non-muslim girls, it‘s usually to provide an in for her brothers to ’court‘ the kafir sluts while appearing as a ’safe date‘ due to the muslima sister’s ‘friendship’ with the kafir sluts…

      Maybe I’m just hateful and racist, but I have a funny idea… I think A&F should be able to fire anyone they want for not doing something they want them to do. If they have a policy to only hire black people, that’s fine, if they want to hire only women, that’s fine, if they only want to hire people with dots on their heads, that’s fine, if they only want to hire non muslims, that’s fine, I can choose to support or not support them with my certificate of appreciation (the dollar). It is a private company and they should be allowed to discriminate all they want, but then, we as consumers, are allowed to discriminate against them as well with our money.
      I have a sneaky suspicion the mooslims are doing this for a quick lawsuit or a quick out of court settlement, perhaps if a&f was sharia compliant, they’d drop the case.

      On a side note, would those women object to a&f if they had naked women with only their hijabs on?

      not to mention… why would they be allowed to break a dress code, where as, other people cannot. that is called arrogant & selfish any way you look at it. i don’t think jews are allowed to where their yamakas/kippahs in certain jobs with certain dress codes…

      Aye, my cross is on a James Avery style ring and rather inconspicuous. Because I am an observant Christian, I would NOT apply to work at A&F because their products and ads go counter to my ethical and moral code which I work to align w/the Bible.

      It does seem a ploy to beat up A&F financially.

      Sorry — Rose-Ellen, they should lose in court, if it’s a fair court. It is similar to the cabbies in Minneapolis who refused to take fares fm people who were carrying liquor or had guide dogs. They wanted a “dust-up,” too.

      Like the camel, give a muslim an inch, and he/she wants the mile that went with it.

      Assimilate, muslims, if you want to make this your home. If not, go somewhere else to live.

      A company has the right to decide how they want their employees and dress, mostly because they have learned what their customers want the employees to look like. If they do not look acceptable to the customers then they lose their business which means that they could lose their company. If people do not like the rules that a company has set up for their employees, then they need to look for a job somewhere else. These rules that they have set up is for every employee so where is the discrimination. This is what the governments intent is, it is only to try and drive the capitalist companies out of business.

      It would be if that was the company’s publicly stated policy and a condition of employment that no religious symbols be worn. Similar in the way that some places require no visible tatoos as a condition of employment. If a person is unhappy with the dress code at A&F, they should seek employment elsewhere. Period.

      No Rose she shouldn’t win. The private company has a right to a dress code. They made a choice to work there. Sounds fishy. Everyone will start claiming religious views say I need to wear my pants down below the waist. Who is to say what is a legitimate religion? If were free to our personal “religious” beliefs then the whole system will be screwed. Separation of church and business eh? It’s stuff like this that is tearing us down.

      I won’t deal with anyone in a headscarf. If they are the salesperson, I skip it. If they are at the register, I go to another register. I won’t support wearing of headscarves because they are representative of Islam and thus of Sharia law which has no place in a Western society.

      I was a manager at A&F for a while. I know the games that are played in the hiring process. A&F is always scared about being sued because of their hiring strategy. Only certain people are hired, and those that are not are given the “I’m sorry, you didn’t meet our current hiring needs” response. “You’re always welcome to apply again in the future.” I’m surprised she was hired in the first place. As far as her being fired for her religious garb, only one of two things happened. (1) She was let go for being flaky or having ridiculous availability (A&F doesn’t fire much….unless the person is a joke or drastically underperforms). Or (2) She started wearing the hijab only after she was hired….and that’s probably more likely the case. I agree that this was probably a set up.
