Mustang Driver Arrested After Deciding to Burnout in Front of Police Car

Without the badge, two police officers who arrested a Mustang driver mid-burnout at a parking lot car show in suburban Houston may not have made it out alive.

The incident took place after a crowd from the TX2K12 event at Lonestar Motorsports Park traveled to a parking lot in Katy.  Jalopnik reports that a few people were doing minor tire-shreds as they left the scene, but for some reason a Mustang driver “let out a giant F-U burnout” while driving in front of a line of cars that included a Harris County Sheriff’s Deputy.

The crowd did not support the arrest, and are heard in Youtube videos cursing at the officers, some throwing trash at the deputy’s vehicle, and even a few suggest tipping the car over.

Local news called the melee a near riot, reporting that following the arrest the lot was closed off while the crowd left. No injuries were reported.

    The police have to rob a significant number of people every day to pay themselves, parking lots may be public places but they are still private property!

      In the end it causes more petty arrests because we have to collect more money to house the people that are arrested for other petty arrests.       Taking no side, but if you take your foot off the brake while powerbraking you don’t immediately gain traction and lurch forward. Allows way more than enough time to correct. Not sure how you’d slip off the brake while doing that anyway. Suppose it would be possible if you had lil mini-feet.

      Agreed. They have criminalized “everyday life”. Now, just breathing air gets the money flowing in. We used to have fun when I was a kid sleding down this steep hill when it snowed. It was a blast. Now, It is a 100 dollar fine if they catch you. You have to go to the kiddie hill now-OR ELSE.

      Is there a law that says you cannot burn out tires? If so why were the first ones that did it not arrested? Also he was arrested, not ticketed it seems just dumb. For the few of you siding with the cops, lets say you are on your way to work and you are drinking your morning coffee, and a cop comes and arrests you. “Well sir you could have spilled the hot coffee causing you to plow through 30 or 40 civilians” Where does this chaos end? I guess you are also for toddlers in wheelchairs getting rubbed down with explosive detecting pads at airports also?

      What this guy did was illegal, and he should have been arrested.

      What kind of an idiot does a burn out in a crowd like that? Look up all the burnouts that have gone wrong.

      I too am confused on the private property issue. I and a buddy where sitting in a mall parking spot, also in Texas, when another car ran into us while driving perpendicular thru the parking spaces. We called the police and were told it was private property and there was nothing they could do. What is the difference?

      This reminds me of a county wide car show my area has every quarter. Thousands of people would flood into the area. I never asked but assumed it was greatly appreciated by the local business that benefitted from all the extra customers. Eventually the police became so overbearing most people stopped going. They still draw a crowd but it’s probably 40% of what it was.

      well lets arrest all gun owners because they could accidentaly shoot someone. then we can arrest anyone driving a car because that could easily end in someone dying. f the police and the ARMY they have. you will see. In a matter of a few years we will have every last cop armed with assault riffles. a lot are already. when is the last time a cop has protected or searved you. they show up to crime scenes after the crime is committed. protect and serve my ass. they protect thier own and serve the pockets of a ******** gov’t. I am scared for my Country they were all having clean fun, everyone was having a good time, this guy shows his good old American Horsepower, and the cops arrest him, they have these burn out contest all the time at bike shows sometimes until their tires pop, and speaking of police state, I live in Utah, and I see more of my God given rights taken away more and more every year, we used to be able to go up in the foot hills and shoot our guns far away from any houses and not hurting anything, now they are closing off all the land because they say people leave to much trash so now you can get a ticket for shooting around those area‘s but here’s the weird part, you can hunt these area’s still does that make any damn sense? Would it be too big of a deal just to put up signs saying 2k fine for littering for example? Instead of closing the whole place down for just having some clean fun, we are losing our freedoms. This is just another example.

    There is no specific law against “peeling out”. That would be some rather idiotic legislation. It does break several already existing laws however. People have been getting arrested for doing it since powerful cars have existed, this is nothing new.

    And it also wasn’t part of a show. The show was over and a some of the crowd decided they were going to mosey on over to the nearest parking lot and show off a little. The cops warned them they had to stop, and this particular child’s symbolic finger to the cops got him exactly what he deserved.

      @ROWGUE….not trying to split hairs, but I think a city ordinance for exhibition driving or a state statute for careless (or even reckless) driving could fit the bill for “peeling out”….that being said, I wouldn’t have cited/arrested anybody…..heck…..I’d ask if I could have a turn burning rubber.

      The law would be “reckless driving” and it is a catch-all for all kinds of driving styles where there isn’t a specific ordinance against it. It‘s usually used when one crosses a subjective line in the officer’s mind.

      Now before someone goes off the handle (as I’ve already seen posts doing) about the subjective nature of the law, and the fact that these guys weren’t even moving yet, I would suspect that the justification of this arrest comes from the fact that people were so close to the car that they could actually touch it. Had the Mustang actually burned out and lost control, people would almost certainly have been hurt or killed. Notice that the officers ignored all the earlier rev-n-pops that other vehicles were doing, but that this driver took it quite a bit further.

      Certainly there will be cop-haters in this blog that attack them for anything. But consider what the public would say had the driver lost control and killed a few people? They‘d be calling for the officer’s head on a stick for NOT preventing such a disaster.

    Quite a few ponies there. I think we have a group of folks that might not be thinking all this through here. First the “public display of horsepower” is a crime… not a horrible one… but a crime. I have witnessed someone get arrested for it before when it happened before in Texas.Second was that I thought the cops did a pretty good job… they didn’t know maybe the guy had been “saucing it up a bit”. They were surrounded by a rowdy mob. For their safety they needed to remove the suspect and themselves from the scene. How about the crowd yelling kill the cops? Kill the cops! I think that would be what worries me the most. Kid had fun… he’ll get his hand whacked. He’ll live to laugh about it in twenty years… and so will someone else. Good job officers.

    The only thing they could possible charge him with is reckless endangerment. as it was private property they have no legal right to enforce any type of traffic law. in fact unless the provate property owner requestesd the police to do something they cannot even be on the property without a warrant .

    The officer in question would have been better of had he just issued a citation for reckless, and let it be. as it is he could be looking at civil rights violations if the property owner wished to press charges

      The ticket you get for that is excessive acceleration even if the car is just sitting there. Its a stupid ticket, but how is it the guy is being arrested over it? The cops are playing pig. We need good cops but we don’t need pigs.     This is a Very common “parade” after a car show..spectators line up and encourage drivers to do a burnout. Sorry, but this was one of the most controlled burnouts I’ve seen, the car wasn’t even moving! I’ve seen them get so out of control, they drive into the croud. Serious overreaction on the cops part if you as me….

      That’s what I thought. Granted, might not have been the best idea to do that in front of police officers. But, it looked to me like he was in control of his vehicle. For those that think he could have got out of control, he would have had to have his foot on the brake to do that burnout. Virtually no chance of getting out of control. The most that warranted was a verbal reprimand from the police.

      At my son’s highschool, in rual Indiana in the late ’60s, the they had “Senior Burnout Day”. The last day, the Principal would stand with a gree flag and the seniors would line up single file. A sheiff’s deputy would be at the driveway exit. When all was clear, the deputy would signal the principal would drop the flag and it was ‘foot thru-the-front-axle.’ One at a time. Quite a show and no-one ‘poked out their eye’. Country has sure gone to hell since.

      But could’ve. From what the video showed, the other burnouts were very short spurts. Even those could have turned deadly because of the proximity of the spectators. That said, the mustang pushed the boundaries of safety. Having been in the automotive and motorsports field for over 30 years I know how hard it is to control horsepower once it is unleashed. Powerbraking is best done with nobody in your path or vicinity.

      Those people Chose to be there. I understand your concern for safety. I would prefer that public events set up safety ‘disclaimer’ ads warning people before they come to such events. I do not think this would deter the vast majority that want to go to such events.
      I have DOZENS of manuals for my tools. power tools, chainsaws, log splitter ..to name a few. The English sections are 20-30 pages, 15-25 of that are ‘safety’. something along the same line- ya folks should take some responsibility.
      Those people were having fun, I bet most of them have an idea what autos can do.
      just my opinion.

      I agree that the arrest was unwarranted and that the situation would have been better served with an “exhibition of speed” citation. The problem with these types of videos is that we don’t know what may have happened before.
      BTW, my bones are fine, I don’t take pills, I’m not on Medicare and I drive plenty of horsepower.

    How stupid can you be to do something like that in front cops? The raucous crowd is lucky that the driver didn’t loose control of his vehicle and kill some of them. The “OWS” & Obama are doing a good job of turning the people against the cops. I know cops are not perfect, but I worry about them.

      Reckless endangerment, reckless driving, and improper start up would be my guess. Likely arrested for the two counts of recklessness.

      The charge more than likely was: Texas Transportation Code – Section 545.401. Reckless Driving; Offense
      § 545.401. RECKLESS DRIVING; OFFENSE. (a) A person commits an offense if the person drives a vehicle in wilful or wanton disregard for the safety of persons or property.
      (b) An offense under this section is a misdemeanor punishable by:
      (1) a fine not to exceed $200;
      (2) confinement in county jail for not more than 30
      days; or
      (3) both the fine and the confinement.
      (c) Notwithstanding Section 542.001, this section applies
      to:
      (1) a private access way or parking area provided for a client or patron by a business, other than a private residential property or the property of a garage or parking lot for which a
      charge is made for the storing or parking of motor vehicles; and
      (2) a highway or other public place.
      (d) Notwithstanding Section 542.004, this section applies to a person, a team, or motor vehicles and other equipment engaged in work on a highway surface.

      Excuse me, I just skimmed the article and did not see that they moved to a parking lot. I thought it was done at the Motorsports park. At a parking lot the cops were justified. My mistake. I can admit when I am wrong.

    While its cool to see, a single slip of the foot and those Fbombers would be under the car screaming for mommie. Imagine the impound and towing fee, lol. Not including the “ride”, bail and his boss going your fired. OH, and thanks for the video post to prosecute him and they now also know who else to arrest. noobs, you cant fix stupid,

      How many do you want?
      Reckless endangerment, disobeying a police officer, unlawful assembly, trespass- I am sure the owner wants burned rubber on his property — right? Etc. Use your head for something other than a hat rack.

      For life? Really? For a burnout? You do realize that even multiple DUIs doesn’t seem to ban driving for life and just just in Texas or the south, but even in Massachusetts!
