Nancy Pelosi Wants to Change First Amendment to Allow Regulation of Corporate Speech

The Democratic party’s temper tantrum over Citizens United v. FEC has ratcheted up to a new level – now, instead of arguing that the ruling is wrong and the constitution doesn’t protect corporate speech, they’re arguing that the first amendment does protect corporate speech, so they’re going to change it! At least this time, they’re following the process prescribed by the Founders. The problem is, if you listen to Pelosi‘s explanation for why they’re doing it, it’s a bit…strange:

The bill in question is called the “Peoples’ Rights Amendment,” and its goal is to explicitly allow Congress to regulate corporate speech however it wants:

Section 1.  We the people who ordain and establish this Constitution intend the rights protected by this Constitution to be the rights of natural persons.

Section 2.  People, person, or persons as used in this Constitution does not include corporations, limited liability companies or other corporate entities established by the laws of any state, the United States, or any foreign state, and such corporate entities are subject to such regulation as the people, through their elected state and federal representatives, deem reasonable and are otherwise consistent with the powers of Congress and the States under this Constitution.

Section 3.  Nothing contained herein shall be construed to limit the people’s rights of freedom of speech, freedom of the press, free exercise of religion, and such other rights of the people, which rights are inalienable.

Here are some of the bill’s sponsors trying their best to explain the rationale behind the bill:

“I‘ve introduced a People’s Rights Amendment, which is very simple and straightforward,” Rep. Jim McGovern (D.-Mass.) said at the forum. “It would make clear that all corporate entities, for-profit and non-profit alike, are not people with constitutional rights.

“It treats all corporations, including incorporated unions and nonprofits, in the same way, as artificial creatures of the state that we, the people, govern, not the other way around,” said McGovern.

Rep. Donna Edwards (D.-Md.) explained the basic principle this move to amend the Constitution is advancing.

“In Citizens United, what the court said is that Congress has no authority to regulate this kind of political speech,” said Edwards. “And so all of these constitutional amendments go to this question of giving Congress the authority that the Supreme Court, I think wrongly, decided isn‘t within Congress’s constitutional–our constitutional purview.”

Apparently this bill is Phase I of an attempt to resurrect the defunct DISCLOSE Act.

      Corporations are already creatures created by the laws of the State where they are incorporated under. Corporations are not persons, but artifical entities. Individual have rights, corporations shouldn’t.

      Personally, I don’t think corporations are people, as Mitt has said. I’m more in favor of the “We the People” concept. The United States has a problem if corporations can get people elected by the influence the can bring to bear with the millions of bucks in their deep pockets, even when the people who work for the corporation disagree. There is no Democracy when the owner of a large company can spend unlimited amounts of money to elect the person of their choice. The Founders wouldn’t approve.

      Corporations are not individual people, they are a group of people, just like any other group of people. Groups of people would include unions, PACs, corporations, clubs, etc. The groups are afforded rights under the law just as individuals. Otherwise one could rob a group with impunity. If you have a way to get ALL groups out of political fund raising, I’ll listen. Just carving out the ones you do not agree with is just a case of silencing free speech.

      Influence isn’t the same as coercion – no one is making people vote the way the corporations tell them.

      Also, corporations are tools, and maybe some of these tools are used for communication; Just because those WITH a sign can communicate more prominently than those WITHOUT signs, doesn’t mean that the owners of the sign lose the right to agree amongst themselves as to how their sign should be used.

      There’s no such thing as “corporate speech”; The owners are communicating BY WAY OF the corporate structure. The owners are communicating. They have a right to free speech.

      As for the people who work for the corporation: they aren’t Management. By virtue of their employment agreement, they have agreed that they don’t get a say in how Management

      “There is no Democracy when the owner of a large company can spend unlimited amounts of money to elect the person of their choice. The Founders wouldn’t approve.”

      Money doesn’t elect people. Again, no one is coercing anyone to do what the corporation is telling them.

      In fact, Pelosi is the one trying to silence speech under color of authority.

    Pelosi needs to be stripped of her office; she cannot have it both ways, she is a true flip flopper for when things go against her party and the Progressives cause of destruction of the nation. Impeach her from office with all due haste.

      I agree money is not speech, but it does provide access to speech (i.e. buy pen, paper, email access, transportation, hiring of experts, court fees, etc, but not for bribes, in which case, throw the briber and bribee in jail).

      So would the government be allowed to regulate what your computer does? By regulating the tool you inevitably regulate what the tool’s owner can do with it. As long as I’m not using it to violate the rights of someone else, I should be able to use the tool I own as I see fit.

If not, OBonzo will double down on bypassing congress all together, and the result will be the same.
