Nanny State Alert #412: FDA Proposes Calorie Counts on Menus

The Nanny State has been busy lately! First, they were tearing down 60-year-old basketball hoops that did nothing more than bring joy to a Delaware family. Then it was deeming “water balls” deadly (even though no one had died from exposure to them).

And now this.

The AP reports that “Required as part of health overhaul legislation signed into law last year….”

…many restaurant diners will soon know more about what they are eating under menu labeling requirements proposed Friday by the Food and Drug Administration.

The requirements will force chain restaurants with 20 or more locations, along with bakeries, grocery stores, convenience stores and coffee chains, to clearly post the amount of calories in each item on menus, both in restaurants and drive-through lanes. The new rules will also apply to vending machines where calorie information isn’t already visible on the package.

The calorie counts will apply to an estimated 280,000 establishments and could be on menus by 2012.

Required as part of health overhaul legislation signed into law last year, they are designed to give restaurant diners information that has long been available on packaged goods cooked at home. The FDA estimates that a third of calories are consumed by eating out.

“We’ve got a huge obesity problem in this country and its due in part to excess calorie consumption outside the home,” says Mike Taylor, FDA deputy commissioner for foods. “Consumers generally when you ask them say they would prefer to have that information.”

But don’t expect calorie shock when ordering at the movie theater, where a tub of popcorn can contain well north of a thousand calories – movie theaters are exempt, along with airplanes, bowling alleys and other businesses whose primary business is not to sell food, according to the FDA. Movie theaters pushed to be left out after guidelines published last year included them.

Alcohol will also be exempted, according to the agency. Margo Wootan, director of nutrition policy at the advocacy group Center for Science in the Public Interest, says that could be misleading to consumers.

“I think it’s going to be confusing if customers see the calories for soft drinks and juice labeled on the menu but not other drinks such as beer and wine,” she said. “It will make it seem like they are better choices.”

Still, Wootan says the guidelines are a positive step.

“You won’t have to get out of line and go back to some poster by the bathroom and look at some item in a tiny font size,” she says. “It will be right there on the menu where you are getting your other information about what to order.”

The idea is to make sure that customers process the calorie information as they are figuring out what to eat. Many restaurants currently post nutritional information in a hallway, on a hamburger wrapper or on their website. The new law will make calories immediately available for most items.

Menus and menu boards will also tell diners that a 2,000-calorie diet is used as the basis for general nutrition advice, noting that individual calorie needs may vary.

The labeling requirements were added to the health bill with the support of the restaurant industry, which is facing a smattering of different laws from cities and states. New York City was the first in the country to put a calorie posting law in place. Since then, California, Seattle and other places have done so.

Dawn Sweeney, president and CEO of the National Restaurant Association, said the calorie postings will provide customers with consistent information.

“The new standard,” she said, “will help chain restaurants provide the same type of nutrition information to consumers in any part of the country.”

      I am not sure I understand why you want me to explain why liberals in control of education wish to keep people stupid and easy to control, as it pertains to this subject. When I say no country benefits from a growing number of idiots, you either agree or disagree. Clearly if you think the education system dominated by the “liberal left” is resulting in a growing number of idiots, then you perhaps agree with me? Or are you trying to make a point in which I am wrong? Either its right across the board, or its wrong across the board.     When I eat out it is for one of two reasons. Either I am on the road and didn‘t bring anything with me or I am getting something ’special’. I could really give a flying f*** what the calorie count, sodium level, trans fat status or ANY other nutritional value is!!! The ONLY thing that concerns me is does it taste good and if I get it while travelling, is it fast. I also think that I am smart enough to know that if I get something out of a vending machine it probably isn’t busybody, progressive, administration approved.

    Keep your hands off my double Whopper with cheese and Snickers bar!

      The thing is, YOU SHOULD care about what you are eating. That is part of the problem, too many people do not care about their own personal health. If you only care about what taste good regardless of sodium levels or transfat, then how is this any different from the homeless person who doesnt care about spending money on food or trying to get a job because its much tastier to drink alcohol and pee on the side walk? How is it different from a child who throws a tantrum just because everything he is given doesnt taste like cookies? The point of being an adult is to be wiser and have an understanding of the cause and effects of our decisions, of which we can try to pass on down to our children.

      What you eat effects perspective, mental health, depression or lack there of… we need to “incentivize” responsibility and caring, not this abusive type of “i dont care” mentality. You have the right to eat only ice cream for breakfast lunch and dinner every day, but God knows it also makes you an idiot and no country benefits from a growing number of idiots.

    The problem isn’t food… It‘s all the crap that isn’t food that is added. This stuff causes you to eat more, crave more & more and then you’re fat. Europeans and elsewhere did not have obesity problems until the American diet was introduced. Take out the crap in the food and get rid of GMO‘s and we’re good! You can look all of this up anywhere, pick your search engine and stay away from the G word.. Google is not your friend!

    i think this is a half-baked idea, ..

    on the one hand, because its only directed companies with 20 or more chain stores, it will help us target the companies that use strange things int heir food that make their products 500% more fatty than things you get in home-style restaurants, or make yourself at home

    but on the other hand, these same chains are the ones putting things into our food that they are not required to even tell us about

    how about making a law that forces mcdonalds to tell us exactly what drugs and chemicals we are all addicted to???

    Call me crazy, but I agree with this line of thought. While the government should not dictate what you eat and what businesses can sell as food, they should however, give the correct incentives for healthier eating. In other words, forcing choices on the public is bad but giving incentives to let them make the choice is good.

      I believe in personal responsibility. This in fact FACILITATES personal responsibility. When a person gains 200 pounds eating fast food, he now can’t blame the restaurant who clearly showed him what he was putting in his body.

Anyone who orders from a FAST-FOOD restaurant, expecting for it to NOT be a death-threat (basically) against one’s own life, then they deserve to die of heart disease.     I agree and think it should go farther Picture this you walk into your near-by healthy fast food shop walk thru a scanner and your menu is selected for you with various options say you have a hankering for a big greesy bacon cheese double burger but the scan tells you can only have a salad[no fix-ins] and a glass of diet water Whats the right thing to do?       Its not Communism but it is low level tyranny. Its the Federal government getting in your face when you go out for dinner forcing you to look at a message they have mandated. Its not customers demanding the calorie information, its the Washington bureaucrats. What’s next? Little blubs about how red meat kills, next to the steak entrees? Vegetable entrees have to be printed in larger letters? Take fries off the menu altogether and make them a special order item? If you don‘t resist tyranny when it’s small, you won’t have a prayer when it gets a good head of steam behind it.

      I feel sympathy for you. You are either a product of the nanny state or a lib., or both. If you don’t know if something is calorie packed or not you do need obama care, perhaps like so many others, to remove your cranium from your rectum.

      Do you not know that printing menus cost money? …especially when you are reformatting them .. perhaps we should see who will PROFIT from this .. they always seem to play the angles and we end up paying while SOMEONE makes out like a bandit .. how about little hometown restaurants? .. this could be a BIG problem for them.

      I am not too stupid to figure out that some things are not that healthy and may add calories to my meal … Sour cream, cheese, bacon, ..YES PLEASE!

      Looks like fun. I’d like to try it and would. But I don’t think this a huge problem of government overeach.

      Those things are more or less airtight (you don’t see water leaking in). When you climb in there is a fixed amount of oxygen present, which declines with every breath and is not replenished. If a person is active in that bubble – which is the point – the oxygen level declines more quickly.

      So you start with about 20.5% oxygen, a percentage which declines with every breath once this thing is zipped up. If you were to stay in this bubble, at some point, of course, you pass out and then die from lack of oxygen.

      The problem with oxygen deprivation is that the person suffering from it loses judgement at the same time the oxygen content in his or her blood is becoming low. People in this state often are unable to understand and react to the problem. OSHA has incredible strict rules about anyone entering a “confined space” that might be or become oxygen deficient simply because so many people have died without even realizing they are in trouble: they get a little confused, then pass out, then die.

      This is a simple thing really. How long will the oxygen in that bubble last with a person exercising within it? If they pass out and die, is that their fault? Or the owners of the bubble?

      The fact is, many, many people have died from oxygen deprivation at least in industrial settings. Putting a person in a small, confined place with a fixed amount of oxygen is a recipe for death.

      Does ANYONE really read those calorie counts? I see them labeled all over.. here‘s the thing IF I go out to eat it’s because I am either hungry or hungry and out to eat NOT COUNT CALORIES.. they haven’t figured out IF they keep pushing this it will become like all the other things people IGNORE..

      I never bother counting calories and don’t think that it needs to be required of any business. Alot of chain stores already provide them and can be found on most food products in stores.
      I have some medical issues so have to watch what I eat including fat- but that is not that big of a deal since I can find the information at most chain restaurants or on food packages and think about all those books that have been published for years available.
      This new requirement will only burden the food business. I think about how much longer it will take to read the menus or how much fun it will be waiting in line behind the people who keep changing there orders. Yep, I just know how we will all be wanting to just say “thankyou!

      I was in California the other day and they had that on the boards at some restaurant I went to. I couldn’t figure out what that was at first. I thought it was codes for the meals… like you order a #1, or a #820 or so.

      Sheesh, I really don‘t care how many calories are in whatever I’m getting. Who cares if it is fattening, just go for a jog later… Exercise trumps what you eat. I base my menu choice on whatever sounds most delicious.

      Hopefully, along with this vital information on the menu they also make it mandatory to advise the patron how many illegal workers are employed by the establishment too. This way a true patriot can take their business elsewhere.

      I never read food lables. Personally I don’t care about how many calories, fat, or carbs somethign has. If it tastes good I’m eating it.
