Nanny State Madness: California‘s Proposed ’Fitted Sheet’ Law

When California’s elected officials come back from their month-long recess they face a mountain of proposed legislation (almost 900 bills are lined up and waiting), including a new law (SB432) that would require hotels to eliminate flat sheets. Not having fitted sheets on hotel beds would now be a crime in California. This is not a joke. . .

California, the state trying to deal with a massive $26 BILLION dollar debt, is considering a law that some hospitality industry experts claim would add an estimated $15 to $30 million dollars in costs to an already hurting hotel industry. The low-end estimate of fifteen million is the projected cost to purchase new fitted sheets for the 550,000 hotel beds in the state. Of course the hospitality industry is claiming that these added costs will hurt their business and put jobs at risk.

The fitted-sheet bill is the brainchild of State Senator Kevin De Leon (a Democrat from Los Angeles), whose mother suffered back pains while working as a hotel maid. Kevin has been quoted as saying this was “an issue close to my heart.” It is also a bill that has the support of Big Labor. Sen. De Leon’s bill passed through the State Senate in June, but not before some spirited debate, including a statement from one of the two dissenters, State Senator Sam Blakeslee;

“We are now going to make it a crime in California not to use a fitted sheet? Really?”

If the law passes, who will be assigned to enforce it? Will California be the first state in the union to have “Mattress Police” checking for fitted sheets? Is this really a good use of law enforcement manpower?

There does seem to be a problem as a significant number of workplace injury claims have been filed by housekeeping employees, the LA Times reports:

More than 7,400 housekeepers working in California hotels have filed workers’ compensation claims for injuries they say they suffered last year, including 883 who said they hurt their backs, according to the state Industrial Relations Department.

Just over 10% of the claims filed are related to back injuries, however the reports do not specifically state if the injuries were mattress related or suffered in some other situation.

Media outlets all across the country have picked up this story. Indianapolis’ Fox 59 reports that hotel workers have a higher injury rate

Data from the U.S. Bureau of Labor Statistics show that hotel workers have markedly higher injury rates than other service industry workers on average: 5 injuries per 100 workers, while the average for all service industries is about 3.4 injuries per 100 workers. A 2009 report in the American Journal of Industrial Medicine found that housekeepers have higher (7.87 per 100) injury rates than other hotel workers, including banquet servers (2.82 per 100), dishwashers (5.97 per 100) and cooks (5.99 per 100).

The second part of the bill has a new requirement that actually appears to make sense:

(2) The use of long-handled tools such as mops or similar devices
in order to eliminate the practice by housekeepers of working in a
stooped, kneeling, or squatting position in order to clean bathroom
floors, walls, tubs, toilets, and other bathroom surfaces.

The statistical breakdown on hotel worker injuries did not differentiate between housekeeper injuries suffered while changing sheets or scrubbing bathrooms, so it is difficult to ascertain which of the problems posted in SB 432 would be most effectively addressed by passing the new law.

The question still remains – Are fitted sheets really the most important issue facing California? If the answer to that question is yes, I offer a compromise solution – something called “The Sheet Keeper.”

      California is almost dysfunctional as well as being on the verge of economic collapse. Dwelling on nonsensical laws reveals how far the state has fallen into whirlpool of craziness and nonsense, especially since matters of importance by the liberal controlled government there are given last priority if they given any priority at all.

      They’ve been out of the news for a while, but don‘t regard their absence as meaning they’re back on track. They’re too far down the radical leftist road to ever straighten out without a complete cleansing of the entire state, beginning at the basic population level.

      They will be the first state to implode financially and the first to turn to armed conflict, which, by the way, is occurring right now on a low intensity level.

      Heehee, that was my thought. If they can’t handle the work, I’m sure there are Americans who will. I stayed in a hotel in June in Missouri and the staff couldn’t even speak English. She could say hi and beyond that I got the dumb stare.

      Maid union workers unite. I don’t know though, I think it would be easier to commit suicide with a flat sheet than a fitted–it’s so hard to knot the bottom of a fitted sheet. Sooo time consuming- if your wanting to off your self —may want to pack a lunch first.

Forget that the state is broke and that illegals are pouring into the state and applying for social program benefits.       I used to clean houses for a living. There were women in an age range of 20-something to 40-something. In the 3+ years I worked there, the only complaint of back problems (worker’s compensation claim) was phony and the person was caught in her lies. And you can’t clean a bathroom without stooping, squatting and/or kneeling. It’s part of the job.

      I think more than likely the cause of back trouble with hotel cleaners is those heavy carts they have to push around. I imagine they are heavy.

      Trust me! I used to be a Worker’s Comp nurse case manager for cases in California. Not only CAN and DO illegal’s file (BOGUS) worker’s comp claims–they CANNOT be deported as long as they have a case open, or are receiving treatment for it!!! California is one big CORRUPT group on doctors, chiropractors, physical therapists, and armoatherapists, and herbalists, etc, etc, who all refer bogus cases to one another, putting the “patient” on “TTD” (Total Temporary Disability) status, often for life!!!! The company I worked for, a once huge insurance company for worker’s comp totally closed down ALL California business and let all of us nurses go because they were losing money by the buckets-full. They could not even challenge a bogus case (with photos and tons of evidence) without going through months and months of litigation–again very costly. What a RACKET—the stories I could tell you. Sickening how they, as well as citizens, rip us all off with their well-protected lying and cheating.

      Back pain is difficult to prove. Perhaps if so many of them were not over weight they wouldn’t be having back pains. This new law is absurd! I am nearly 79 yrs old , had 7 children, worked in factories lifting heavy metal, as a computer operator lifting heavy disc packs, and as a waitress as second jobs in addition to my main job in a bank. I had back pain once in my life and taking a break from overwork soon healed it. Too many goldbrickers!

      I am a Workers’ Comp Adjuster and according to CA Workers’ Comp law, illegals are entitled to workers comp benefits. Some will file a claim and collect temporarily disability payments and then they go to work elsewhere using a different name. So now they are collecting benefits plus their pay from their new employer. If you tried to prosecute them for fraud, they leave and go back to Mexico. Six months later they are back in the states working again. They just keep using different names and ss#.

      Not funny. I am UNITED STATES CITIZEN and I am forced to work as a housekeeper at minimum wage even though I EARNED two vocational certificates right out of high school, I am a married mother of two, AND I am a full-time university student. Oh and by the way, my English is perfectly fine. I love it when SOME, NOT ALL, people like to make incorrect assumptions. Just because I’m a housekeeper, doesn’t make me any less of a person. Thanks to those idiots in Washington, I have to work a minimum wage job, even though I am completely overqualified for a better paying job. I agree that this bill is a waste of taxpayer dollars, let’s all be nice and not make such negative assumptions. It’s people like me that everyone else forgets about.

      How do you think they survive???? they get an illegal job, get paid “under the table” get hurt, always the back (hard to prove different) get hook on all kind of medicnes (drugs) given by the insurance company, paid by the employer…..then they are “permanent disable” move back to their country…. and guess what…..
      The insurance company send their check to their country. They dont have to pay taxes or anything else, but if their checks are late.. they call the insurance company right away complaining.
      If they have to come back to a doctors visit, guess what…. the insurance company pays transportation, meals, hotels, etc, etc, etc.
      That is where your money and my money are going….

      Yes, here in California, illegals are allowed to file work comp. As someone who had a serious spine injury and went through work comp in this state, I can tell you how insane the system is out here. I’d guess at least 90% of the other claimants I cam across in Southern California were Hispanic, most of them not english-speakers, and there was no penalty or punishment for illegals… on threat of being deported. And most of the other claimants I spoke with were openly and admittedly faking their injuries and taking advantage of the system. Makes it impossible for the honest folk.

      If someone will sponsor me, I’ll gladly move myself, my mom and 100 yr old grandmother from CA. I live in a small rural town 80 miles from Reno. The majority of people are “stuck” here….our unemployment rate is close to 16%. A lot of people would move, but they cant afford to. The fruit-and-granola state isnt all loonies. Unfortunately the idiots with all the money get heard while the sane people are trampled upon. PS anyone notice when you apply for a job you have to be able to speak Spanish? People cant get a job in their own country because they dont speak a foreign language…how ridiculous is that??!!! I’m Caucasian and fast becoming an endangered species. I need the wildlife federation to come in an save me I guess. Maybe I can relocate by putting a windmill on my roof and get a green tax deduction at the same time?

      Why should California get serious with the big issues, they will be bailed out by us anyway. Get to the important issues, like workers comp for illegals. Odd, nobody (I think Glenn did mention this) mentions that many minorities (Legal) lost jobs as a result of the illegal population taking the jobs at hotels. I’m sure these minorities are really interested in the facts (sarcasm). If you think California legislators are funny, Massachusetts had a few joke bills as well: While riding in cars, dogs would have to wear seatbelts (the “rep” that put this one up said he was asked to do so by a constituent…I’m sure if that person asked him to jump off a bridge, he would have) and, the topper, every year a law which would allow a person to use any bathroom they wanted (male or female) is brought up. So, if you happen to see a hot women walk into the womens bathroom, you can say to yourself “I feel like a women today” and follow her in. Or, how about if you are a freak that likes little girls, you can head right into that bathroom (or a teacher who likes her students a little to much). So, California is nuts and apparently close to being as nuts as Massachusetts. Solution (which will never happen in MA or CA is to vote them out, but the stupid people won’t do it).

      Americans were doing ALL those jobs. The reality is that if the wage is proper, Americans will do any job. The problem is the wage is not proper because the companies don’t have to worry about being reported. Prior to all the illegals doing the jobs, people actually got paid a great wage doing these things (my sister used to work the farms in the summer for instance). The argument that “Americans” won’t do the job is completely false. It is based on lies propagated by those who want illegal labor. This labor is akin to slave labor whether you wish to admit it or not. The same reason given for keeping slaves is the same reason companies use today to hire illegals. It is the same reason the South gave for keeping slaves: “American‘s wouldn’t do the job”. That is NOT a reason to violate the law or validate why someone who has broken into our country to live here.

      U are crazy! americans won’t do those jobs and when they do they are the ones who complain! you need to do some new research and realize that illeagles arnt monstors. they are humans, who were unfortunately born into poverty and come to the US to try and make a difference in their lives. So if you hate foregners coming to your country so much, then vote for some people who actually care about the whole world, not just how much money they can shove into their pockets and how many bombs they can drop a year.

      Becoming a citizen costs an arm and a leg, and I bet more than half the american population couldn’t pass the tests needed to become legal! People need to get their heads out of their asses and see that the US is not so wonderful, they just rob and steal and take all they can……and leave the rest of the world with absolutley nothing. these people arnt poor because they choose to be poor. They are poor because they were born poor, just like their parents and their parents parents, who would be working on farms selling their hard labored crops for dirt cheap or in sweat shops making the clothes you buy in walmart.       Our money has already been used. California has received more Obama stimulus money than any other state. If I crunched the numbers, they’ve gotten more than most states combined.       the unions and the federal government have usurped our capitol. Believe me, we do get out and vote. But even though we are making our voices heard, The People‘s Republic of Sacramento has given in to the federal government’s trashing of our states constitution. Either we kick these unions out of our government, or the formerly soft sound of secession will ascend into a loud roar. Just keep in mind that most of the residents in California are NOT represented in our capitol. And those of you bad-mouthing my state have no idea what you’re talking about.       I know to the rest of the country Californians appear ignorant, liberal fools, but this is not the case entirely. There are MANY conservatives here, it‘s just that our votes don’t count, LITERALLY. The amount of voter fraud that goes on in this state is beyond compare. They bus them in over the border to vote REPEATEDLY with “absentee” ballots. They have illeglas vote at the polls, then when you show up later in the day, “sorry you already voted – here’s a provisional ballot (that won’t be counted)” We even had the head of our local county registrar of voters CHANGING THE SIGNATURES of absentee ballots, so that they could vote in the voters name. (she has since been fired, but so what? damage done) We had one country vote at 101% in 2008. No, the thing Californians should be held accountable for is allowing this crime to continue, not for those frauds in office. WE, the CITIZENS of California, did NOT put them there. Other than the large cities of Los Angeles, San Fransisco and Sacramento (and a few hippie beach towns) MOST of California CITIZENS are conservative. We just have no voice. The “officials” seem to be more concerned with a “fair vote” in foreign countries than they are for a “fair vote” here.

      I have found the biggest problem in California is that it’s “anything goes” attitude attracts the socialists and outcasts from other states. Combined with the tens of millions of communist-anarchist leaning anchor babies from Mexico, and that sir, is how California was lost.

    None of this surprises me. As a third gen Californian, I’ve seen over-regulation play a major role in destroying the greatest State in the union. Add to this type of imbecilic government intrusion, the liberal agenda of a welfare State, illegal immigration, DREAM Act passage, union thuggery, high taxes and over-bloated State and local governments…and it’s no wonder the eighth largest economy in the world has been driven into the dirt by >30 years of liberal rule. How big is our State government, you ask?

      65Mustang-this used to be a GREAT State. We were once the 5th largest economy in the world, and at one time, were the “engine’ that drove the US economy…sending federal tax dollars to other states for their needs. Now…as California goes, so goes the US…into the ditch because this State has been driven into the ditch from the liberal agenda. Anyone that wants to see where we’re going as a country, only needs to look at what has happened here in California.

      Careful what you say. I SWORE- swore. I’d never live in CA. Alas, my husband’s job was suppose to relocate us to Arizona, but first he had to do 3-6 months training here in California. That was last October. Those of you who may have not had a US public education can figure out the math. We have recently asked the company, “so, what’s up with this relo? are we moving on to Az. or not?” The response was devastating. With the economy the way it is and so much uncertainty, the company is reluctant to move forward. We were told that we are not a priority- right now. And, what may be worse, if things don’t turn around, the program may fail altogether and my husband may end up laid off. I would have NEVER moved here knowing it would be for more than just a couple of months. AND- for what it’s worth, CA. is everything it is cracked up to be.

      I don’t know, I think that the government has done some pretty nice things for us over the years. I agree that there can be too much of a good thing, like this sheet thing, but overall I still give the U.S. Federal Government a better grade than any other country in the world.

    I have a better idea. Make it illegal for people to lie about their ability to lift things, crouch, kneel, etc, when they apply for a job that requires those things. Rather than collecting disability checks, these people should be fined for lying on their job applications.

      Sure. Because collecting a disability check is not a burden on anyone. If changing sheets and cleaning toilets is too difficult for them, one would think that they could have gotten jobs putting burgers in a sack.

      For what it’s worth, we’re talking about SEIU members here, not your average worker. I’m not claiming that their injuries are fake, but I don’t see the state making laws to protect hard-working people from the “dangers” of lifting hay bales, repairing tractors, installing fence.

      I don’t care from what angle you look at this, it’s ridiculous.

    Indeed the nanny state is running out of control in the state of CA. And watch for the inevitable and final collapse under the weight of the taxes and legislation the people there will continue to suffer as more and more massive taxes and regulations descend upon them.

    Obtain a copy of Glenns book “Broke” and read the first chapter on the decline and fall of Rome and the Spanish Empires — this is the pattern happening to both the state of California, and on the larger scale America unless we turn it around.

      You realize that you probably just raised the next initiative for CA. Someone out there is saying, “now that’s not a half-bad idea!” Think of all the time patrons will save not having to slice through every tender piece of their ribeye! OMG! Think of the new jobs created. They can hire 5-10 workers who just hand carve steak into little pieces. Day after day after day. But, of course there will be some who will accidentally stab themselves or hurt their wrists from cutting all that steak and before you know it, the state will need a new policy enforcing restaurants to use robots or something.
