NBC and Brokaw Ask Romney Campaign to Take Down Ad on Gingrich Reprimand

(AP)  NBC asked GOP presidential candidate Mitt Romney on Saturday to pull a campaign advertisement made up almost entirely of a 1997 “Nightly News” report on Newt Gingrich’s ethics committee reprimand.

The “History Lesson” ad started running in Florida on the weekend, when it is harder for stations to switch ad traffic even if they want to. Broadcast days before Tuesday’s primary, the ad shows former NBC anchor Tom Brokaw saying that some of Gingrich’s House colleagues had raised questions about the then-speaker’s “future effectiveness.”

Under Brokaw’s image is a line that reads – “Paid for by Romney for President, Approved by Mitt Romney.”

The footage was used without permission and the extensive use of the broadcast “inaccurately suggests that NBC News and Mr. Brokaw have consented to the use of this material and agree with the political position espoused by the videos,” NBC’s vice president of media law, David N. Sternlicht, wrote Romney’s campaign manager, Matt Rhoades.

“Aside from the obvious copyright issues, this use of the voice of Mr. Brokaw and the NBC News name exploits him and the journalistic credibility of NBC News,” the letter said. The network asked for the campaign to stop running the ad immediately and revise any other videos or commercials to remove at NBC material.

“As a news organization, NBC News objects to any use of NBC News journalists and our copyrighted material that suggests to the public that we or our journalists are taking sides with any individual or organization involved in a political campaign or dispute, and we request that your organization respect that concern,” the letter said.

Romney adviser Eric Fehrnstrom said the campaign isn’t likely to stop running the ad.

“We just received the letter. We are reviewing it, but we believe it falls within fair use,” he said. “We didn’t take the entire broadcast; we just took the first 30 seconds.”

NBC spokeswoman Lauren Kapp said a similar request went to other campaigns that “have inappropriately” used material from “Nightly News,“ ”Meet the Press,“ ”Today” and MSNBC. Kapp said she was not aware of such uses by other campaigns.

Brokaw said in a statement released by NBC that he was “extremely uncomfortable with the extended use of my personal image in this political ad. I do not want my role as a journalist compromised for political gain by any campaign.”

Brokaw stepped down in 2004 after 21 years as anchor and managing editor of “Nightly News,” but continues to report for the network, including on the 2012 presidential campaign.

Asked about Brokaw’s concern, Fehrnstrom said only, “We respect him as a newsman who has a lot of credibility, but we believe this falls within fair use standards.”

The House ethics panel investigated Gingrich’s use of tax-exempt organizations. The case ended in January 1997 with a reprimand by the House and a $300,000 penalty against Gingrich for misleading the committee and prolonging its investigation.

Romney has sought the release of all records from the probe. The committee did make public its final report as well as exhibits – which amounted to a comprehensive account of its findings. The head of the ethics committee during the Gingrich investigation, former Republican Rep. Nancy Johnson, said the committee traditionally does not publicly release investigative documents.

      Here’s an idea!!! The only candidate that has real, true, loyal supporters that will not vote against principle no matter what is Ron Paul….my guess (by what I see around me) is that he has about 1/3 of the Republican vote. Everyone else is voting on the media fodder and just going to go with the lesser of two evils. Anyone but Obama right??

      Why not vote for the one guy who has loyal followers, because when they are that loyal and you put someone else in the spot you are going to lose a lot of votes…If Paul runs as 3rd party he WILL cut the votes, without question…..but he will also cut the democrat vote, and pull in the probably at least half of the independents…..Paul cutting the votes is not an issue for Paul supporters, we know it will cut the republican vote….but it doesn’t mean Obama will be handed back the office….So it is the Party sheep that is the problem this time….not the 3rd party (if it comes to that) supporters….

      Yeah, your right, Newt was just plain innocent. Apparently having nothing else to do while Speaker of the House, so he just opened started a college course for people to learn the American way. IN short order, Newt was working with all kinds of different groups, non profit and otherwise, to try and “train” new recruits to start a new order. Which would be fine if it was based in the Constitution. Just because the IRS cleared the tax responsibility, this is an up front example of politicians scamming the system.In all seriousness, I have been battling with you Newt people for two days and it makes me disgusted. The only reason I feel it my duty to fight all of you is because Newt is a Progressive, this is the entire reason I got involved in politics, the same reason many people who listened to Glenn Beck ( that is actually LISTEN TO HIM ) decided to get involved in politics.       Romney could get more mileage out of the ad by putting a discalimer like: “NBC and Mr. Brokaw Do Not Want This Shown” at the bottom of the screen. That way, they can get some of the votes that Newt has gotten for “taking on” and “talking tough” to debate moderators (members of the media).

      No…The Democratic base of young people have been taken over by Ron Paul. If the republicans are really nice, they will go where he goes and they will hand Romney the election. That is if the brokered convention does not end up as Ron Paul being the nominee…

      People need to understand we will probably have a brokered convention, 90% of the people do not know this. Newt and Santorum CANNOT get the nomination because they are not on ehough State ballots to get enough delegates to win the nomination…They are in as to get a brokered convention in the end and hoping to secure the nomination on the secon ballot after the delegates are released.

      Of course most people think that Newt and Santorum can still get there. they are in lala land with thier thinking. Only Romney and Paul still have an outside chance to oick up enough delegates. Paul is actually leaving a winner take all state (Florida) to go pick up delegates in Maine… He is working in the Caucus States. he will have a lot of dedecated delegates at the Convention…

      Need to wake up and smell the coffee..

      If that’s your reason for not voting for Romney then you will have to stay home come election day because none of the candidates have the power to repeal Obamacare, and will never get the votes to do so either. Once a big government policy is put in place it stays, see the Federal Reserve as just one example of many.

    By the way, haven’t stories that were once on the side of 4 headline slides show up on the front page? I’m just wondering because the “Just How Rich Is Mitt Romney…” story didn’t make it on the front page. You have to go to ‘The Stories’ and find the title there. Seems like it was buried quite quickly. Dunno… whatever..

    Truth is not something that NBC engages in, but when the do tell it they don’t want it to be exposed. Well, thanks for bringing this ad to our attention, NBC. Not very bright of you, now, is it?

      LOL – that’s about what I thought. Don’t want to give the impression that he as a journalist is connected with any presenting biased reports?? LOL again. This just makes people think about how ridiculous that is in that they have been exposed for their obvious Dem bias and their job is trying to promote/protect the Dems agendas.

    Romney Backed by Goldman Sachs, Bailout Banks

    The top donor to former Massachusetts Gov. Mitt Romney’s presidential campaign, investment banking and securities firm Goldman Sachs, received over $10 billion in emergency lending and bailouts from the Federal Reserve after the 2008 financial meltdown, according to public sources and published reports.

    Goldman backed Obama for election in 2008, and the firm, like many Wall Street institutions, is now backing Mitt Romney for president.

    Romney has long had a close relationship with Goldman Sachs. In 1999 Romney purchased initial IPO shares in Goldman that netted him $1.1 million in profits when he sold them in 2010.

    And The New York Times recently reported that “many of the assets in Romney’s blind trust” are managed by Goldman.

    Today, Goldman is Romney’s largest donor.

    And nine of Romney’s top 20 campaign contributors are big Wall Street Banks like Goldman. But Goldman leads all Romney contributors, having donated $367,200 to his campaign, according to the Center for Responsive Politics.

    Six of those nine top contributors received over $161 billion in taxpayer bailouts, reports ProPublica, the independent, Pulitzer Prize-winning investigative organization.

      Romney has been caught lying quite a bit during his campaign. One of his campaign advisers even said in an interview, that there is no way they are going to repeal Obamacare. They’ll replace some of it, but leave the rest intact. Mr Romney should not be trusted if Obamacare is your main concern. He has never apologized for Romneycare. He defends it. Ask yourselves why…

      Where has Romney flat out lied? I see several areas where Newt has (ABC Story about putting up witnesses outside his daughters, Giving Divorce Depositions), I’ll give him the benefit of the doubt on many other things he says that he conveniently leaves out things or stretches the truth to mean what he wants it to. But just because a Romney aid says something does not mean Romney will be doing it.

      You also have folks supporting Romney that would turn on him in a heartbeat if he was not going to get rid of it. Pam Bondi, Attorney Gen in FL is one of the many suing the Feds over Obamacare. She has already said she will be one of the key folks in his admin to get rid of this.

      So get real folks, you are so hung up on what folks ‘tell’ you about Romney that you refuse to really look at the guy. He has been painted for over 4 years as a flip flopper with no convictions, folks tell you something long enough you start to believe it, but look at his record, not at 10 second sound bites, he has no more of those than any other candidate.

      Florida Attorney General Pam Bondi, a Romney supporter, let the cat out of the bag last night. The Florida Republican told Greta Van Susteren that Mitt wants Romneycare in every state.

      What is it that you are actually ashamed of? And because he has a different opinion than you (and me also) that is cause for distrust? How do you trust anyone under these rules?

      I can’t stand the fact that he has something against Ron Paul….makes me very angry and i quit listening to him when he says the things he says…I know what it’s like to have passion about this. This is a VERY important election and we are all fired up…I think it’s good actually….Me being a Paul supporter I have a strong passion and want to tear down everything about everyone else because i believe so strongly that that is the only way to save this country…..Glenn is doing the same…I have heard him say bad things about everyone….some more than others….but to say he is a lier because he has passion, and you should lose trust….thats a bit much

      trust does not mean you have to agree 100% with someone….trust is you believe that person is doing what he thinks is right and being honest in his beliefs…. I don’t believe he is a secret romney supporter but i think he believes that romney is the lesser of the evils….i disagree….

      Most of us can see what’s going on. Drudge and Beck haven’t just declared war against Newt, they are trying to unleash nuclear salvos every morning and every afternoon against Newt. And of course we all know one of Coulter’s best buds is Drudge and now apparently Glenn, who has for over a month gone off the deep in regarding Newt. I had to turn him off and stop listening. They’ve lost it. What does this say about the Romney candidacy that it can only be advanced in this way? Do these attacks against Gingrich, these smears, in any way obscure the fact that Obamacare WAS based on Romneycare, that chief advisers to Romneycare COOPERATED with the obama team to construct obamacare?

      Why Trump or Paul when there is already a superior libertarian – Gary Johnson.

      Newt is a dirt bag, but he’s got a quality you want in a leader – the ability to tell people to get bent. On the other hand, Romney is as clean as a whistle, but he’s got absolutely no stones. He is going to be one helluvan appeaser as POTUS.

      Decent RINO with no self discipline, or full-fledged RINO with not stones. We’re toast.

      How is he a RHINO? Candidates are allowed to change their mind on issues. Have you never changed your mind on any issues? Are you that enlightened? There are flaws with every candidate.

      Santorum- Big government spender. Wants to save every village in Africa. He is also against “right to work.”

      Newt- Where do I even begin? For one. He did support Romneys health care plan in Massachusetts along with conservatives favorite organization The Heritage Foundation. Do I even need to start talking about his big government spending? (colony on the moon??WTF) Do you want me to get started on immigration?

      I am tired for people looking for Jesus Christ in each candidate. Its not going to happen people.
