Nevada Man Sues DMV For Rejecting ‘GOPALIN’ License Plate as ‘Vulgar’

A Nevada man is suing the DMV after his request for a vanity plate reading “GOPALIN” was allegedly denied. The DMV reportedly denies personalized license plate requests expressing what it considers to be “contempt, ridicule or superiority of … political affiliation“ and deemed GOPALIN as either ”vulgar“ or ”inappropriate.” Meanwhile, James Linlor, the man suing, claims that when he later requested a “GO OBAMA” license plate the DMV happily obliged. The Douglas County resident reportedly filed his complaint July 15 in U.S. District Court in Nevada.
The Las Vegas Sun reports:
The complaint alleges Linlor requested a personalized license plate of “GOPALIN” in 2009 and 2010, but the DMV denied his applications, stating the request was “vulgar or obscene or expressing superiority of political affiliation.”
Linlor says he tried again in June 2010 — this time requesting “PALIN,” “PALIN12” or “PALIN16.” The DMV’s Special Plates Committee, which reviews applications, again denied his requests, deeming them inappropriate because they were “political,” according to the complaint.
According to the Nevada Administrative Code, the DMV rejects personalized license plates with any combination of letters, numbers or spaces that “express contempt, ridicule or superiority of … political affiliation.” It can also deny plates it deems “inappropriate.”
After a hearing before an administrative law judge, the lawsuit claims the judge reversed the DMV’s denial of Linlor’s requests for plates with “PALIN,” “PALIN12” and “PALIN16.” The judge determined the DMV wasn’t authorized to deny requests simply because they were “political,” according to the complaint.
But even after the judge’s decision, Linlor alleges the DMV denied his request for GOPALIN yet again and said he learned the DMV had actually issued other political license plates, including “GOGREEN,” “DMOCRAT,” “AL GORE,” “KERRY,” “EDWARDS,” “DEAN,” “HILLARY” and “RONPAUL.” Conversely, Linlor said requests for “REPBLCN” and “BUSH,” were rejected by the DMV.
To make matters worse, Linlor allegedly applied for a “GO OBAMA” plate he claims was approved by the DMV.
One DMV spokesman, however, said a GOPALIN plate had been issued by the department in 2010 and that he would not have denied such a request:
Bruce Breslow, director of the Nevada DMV, said Monday he’s not sure why Linlor brought a lawsuit this month because the “GOPALIN” plate was issued Dec. 30, 2010.
The DMV, however, is reviewing its policy about personalized license plates and likely will have the director or a deputy director make decisions about whether to approve such requests in the future, he said.
“I would not have denied it,” Breslow said, referring to the “GOPALIN” plate.

Many years ago a judge allowed public sector employees to hold state elected offices even though it is specifically forbidden in our constitution. They continue to vote themselves big raises, pensions and all sorts of other benefits the private sector can only dream of.

We use to be a fairly conservative state (The Peoples Republic of Boulder – 43 sq miles surrounded by reality – was always the exception because of CU). Since the 1990s (I came her in the early 1980s from NY), it has slipped way too far left as can be seen by our US Senators Udall and Bennet; the gov’s race here was a terrribly botched job by the Repubs in 2010, just terrible. Anyway, CA residents trashed their state and now they are doing same here. You move to a state or country based on the good stuff you like about, not to drag you liberal/stupid failures with you to implement at you relocation home.
Reminds me of how grasshoppers operate: devour and destroy the fruitful crops and then just move on leaving your devastation behind. Evil.

Nevada turned from a red state to a solid blue state in ‘08 because of the California ’refugees’.
Montana, (although beautiful), is little more than a sub-division of California. Complete with Ca. motorcycle and drug gangs, progressive politics and policies. I was sitting around with some folks after church one Sunday and they were all talking about their Ca. home and reminising about it. They asked me if I had ever been to Ca.. I replied, “No……Not until I moved here!” My joke didn’t go over too well with them because they know that the invasion from Ca. is not all that welcome. That was 15yrs ago. Missoula with it’s liberal college is not a fit place to live…..IMO
Now I fear that the same thing is happening to Wyoming. The invasion there is slower it seems. But it is happening……..Where do I go next? I think Wy. is the last best place. I only hope they will hold out for conservatism. Maybe the cold and wind will keep the really crazy ones out!

I’ve seen Wynn on TV a couple of times and like what he has to say so not all are bad there. You would think after BO’s comments about Las Vegas that this place would get their act together. Oh well. Still, it takes a lot for me to put a state on my s-list. So far only California, Vermont, New York and Minnesota are the only states (Would condemn all of New England, but some of these states are actually seeing the light so they haven’t been added to the list yet; lol). Anyway, for those out west who are suffering with the mas liberal exodus that is California, my heart’s out for you. Maybe you can somehow say to those folks not in my state. Anyway, take care. :)

I never put bumper stickers on my vehicles because I think it looks trashy… but you may have inspired me to change my mind.
I just watched High Noon yesterday evening on Netflix for the first time in years, and it brought me to tears to watch Will Kane’s friends *rationalize* their way into cowardice and betrayal. That movie is just so true to life. Marshal Kane could have run away, everyone wanted him to run away, to avoid the fight, and they left him all alone when he resolved to do what was right.
Avoiding a fight is always the SMART thing to do, but it isn’t always the RIGHT thing to do. Watch the movie (again if you’ve seen it before) and look for yourself among the townspeople. All of us are there with our fear and selfishness and it isn’t pretty.
Also, I do not think it is right to use MLK as the reason for hiding beliefs you otherwise like to share. MLK could have avoided any confrontation and in fact his own murder if he had just hid his own beliefs, never marched or preached. I guess in hind sight he should have avoided the fight? You don’t believe that.
In closing I will quote the Christian ***** Spiritual that no doubt Reverend King has sung, “This little light of mine I’m gonna let it shine. Hide it under a bushel? No! I’m gonna let it shine.”

Report Post »I purposely put the sticker on my truck just to watch them lose their minds in my rear view mirror. I like to smile and wave real friendly like when they flip me off and stuff. That makes them almost loose their minds and control of their car they get so mad! Pretty funny!!
I have dealt with the screaming and yelling and arm waving, but it’s getting worse. I don’t want my truck getting vandalized over a Palin sticker. It’s not worth it. I’ve had my fun with them. And like I said, I am trying to avoid a shooting incident. Because I WILL defend myself. Keeping the sticker on the truck was just asking for trouble around here.
If I’m going to stick to the MLK pledge of non-violence, I need to not go looking for it!
I think the guy who wants the Palin plate may regret it some day…..maybe!

My wife and I decided not to put anymore bumper stickers on our cars or political or religious signs and symbols on our property for fear of liberal vandals. They have openly made comments about keying cars with bumper stickers they don’t like. It‘s scary that we are intimidated enough by their immoral deeds and threats that we can’t express our views too. I am a vet and a former police officer to top it off. Once in Nebraska I even had the police backing me up and scolding the two guys who wanted to pummel me for no reason. The police tried to get it through these guys heads that I had every right to shoot them and they were lucky to be alive. But around here, the way things are now, I am more worried about getting the short end of the stick in court if I am involved in an incident where I am in the right but a liberal court sees it differently. I was told by someone who was watching the elections, that the Conservative was ahead, then just winding down to the end, the lights went out and when they came back on…Reid was ahead. There was speculation that they had switched it around during the blackout. Oh, but the libs wouldn’t do that…would they?

but rejected ….
