New Video: See the ‘Saggy Pants’ Dispute That Got College Football Player Booted From Plane

SAN FRANCISCO (AP) — A University of New Mexico football player who was arrested after wearing saggy pants on a plane at San Francisco airport insists in a video showing part of his exchange with authorities on the aircraft that his pants were up and he had done nothing wrong.
The San Francisco Chronicle obtained the video and a link to it was on the newspaper’s website Saturday.
“My pants are up sir,” a seated Deshon Marman tells the captain, who along with someone who appears to be a San Francisco police officer, is standing near his seat. “I’m not doing anything. I paid my fees, and I’m ready to go.”
The Chronicle said it obtained the three-minute video from a passenger who was sitting near Marman during Wednesday’s incident and did not wish to be identified.
What the video does not show is Marman‘s repeated refusal earlier to follow a boarding agent’s advice and pull up his pants, Elise Eberwein, a spokeswoman for US Airways, told The Associated Press on Saturday.
“When he was asked by our employee at the Jetway to please pull them up, that employee was told to pull them up for him,” she said. “And that exchange continued to the door of the plane.”
Marman’s pants were so low they were “exposing areas that most people would not want to see” and violating the airline‘s expectation that customers won’t dress offensively, Eberwein said.
Attempts by the AP to reach Marman were not successful. A call to his attorney’s office Saturday afternoon was not returned, and calls to listings for people with his mother’s name in San Francisco were not returned or went unanswered.
News reports have identified his attorney as Joe O’Sullivan and his mother as Donna Doyle.
Marman said in an interview with KGO-TV this week that his pants were slightly below his waist, and he was unable to lift them up because he had bags in his hands.
O’Sullivan told the Chronicle that nothing was visible once his client sat down.
“The issue should have been over,” he said.
Marman was arrested on suspicion of trespassing, battery of a police officer and obstruction after refusing to leave the plane on the captain’s orders, according to police. Police have also said he injured an officer while being taken into custody.
“He’s refusing to get off,” Eberwein said. “The captain’s thinking, ‘What if he refuses something else in the air?’”
Marman was released on bail Thursday. Prosecutors have until July 18 to file any charges against him.

He broke the airlines rules, which is a private company, he refused to take care of the problem and refused to leave the plane. That’s when the law intervened. He refused to leave private property. You do not have a right to fly on a airline. It is within their right to refuse anyone service if the customer breaks their rules. You have a choice, comply with their rules, fly on another airline, or find another way to get to your destination.

Most probably wouldn’t to avoid a confrontation. In this case authority (the airline) did the right thing. There are basic public standards of dress and displaying your butt crack in public is not a recognized community standard.

Wow! I didn’t think of the private property angle, but you are correct! The airline is a privately-owned, for-profit business. They need and want passengers, and from a purely demographic standpoint, they really DO RESERVE THE RIGHT to disallow a certain kind of attire, if it may offend their other passengers. Not doing so could hurt their bottom line!
Also, this is yet another reason why America does NOT need or want communism.

Posted on June 19, 2011 at 12:57pmAs a frequent flier, I’ve seen worse. last time, I had a window seat, and this gay guy on the aisle was drunk, and wouldn’t get up to let me pass and I was forced to “squeeze” by his legs. When returned to my seat, he said “What’s your problem, etc” And I looked at him and told him I wasn’t going to “play games” with him, and he stood up and let me pass. But he was so drunk, the gay steward keep feeding him alcohol. I was going to punch and kick the guy, he was so offensive. But I kept my cool, and he calmed down knowing everyone was looking at him. Whatever his problem was defused, and he seemed “normal” after the incident I had the flu and was in no mood for “games”. He eventually passed out in his seat.
This video proves this situation might have been “trumped” up. I see people all the time on flights with real problems, and most passengers, pilot and flight attendants just tolerate it.

His routinely addressed the men who were questioning him as “sir”, and insisted that his pants were up. We here do not know how low his waist line was. Obviously they were lower than most people would find appropriate. However, the authorities blew this way out of proportion. It is not right to refer to him as a “punk” simply because his pants were allegedly too low at the waist. Objectionable, perhaps, but not enough reason to interrupt the entire flight.

That’s kind of a hard line, but on the other hand, I was brought up that way myself. It’s always about respect and being respectful and respectable. I agree that sagging pants are not “art” or accepted expression, but an “in-your-face” type of intended insult. How low America has been dragged down by liberal progressivism!
We are not third world hacks, intimidating voters, beating our women and living in impoverished squalor. We are Americans. We need to raise the bar back up to a level fitting of Western civilization and Judao-Christian decency.
Even if a person is not religious, the basic ideas, even without the theology, are solid gold and result in a clean, civilized society with standards. When I was a kid, adults wore hats when they left the house, and took them off indoors. Same with the military. People had manners. Profanity or vulgarity was not displayed in public. There are better ways of opposing popular consensus than by letting your butt hang out. Uncivilized and barbaric!

On the other hand I have to wonder just how low were his pants. If they were way too low he could have at least pretended to cooperate. I’m sure if he gave in a little they would have backed off.
Whether it is fair or night flight crews have the authority to issue orders the passenger may not like.

However, this man was hurting no one, breaking no laws, not instigating a scene, not threatening anyone, and was not endangering the airplane nor anyone on it. The authorities may have felt they wanted to make an example out of him, but they blew this situation way out of proportion, and violated this man’s civil rights.

I suspect the words he exchanged with the crew or ground-crew member were some cause for concern. An airline captain is not an idiot and is NOT on a power-trip. He’s responsible for everyone on the aircraft.

First, in my opinion, I wouldn’t want to sit where he was sitting with his crack exposed to the upholstery. I don’t even sit on toilet seats without paper protection, what’s the difference? The man was asked repeatedly to pull up his pants. He could have set his belongings down for this simple job that would have taken a second. Some athletes & “stars”? seem to think they are above the law, on the airplane or on the ground.

Actually, I’m mixed on this one.
First and foremost, the law is the law. If the local laws specifically define this attire as ‘exposure’ or ‘indecent’, then the law must be enforced.
Second, the airline is a private business and the aircraft is private property, and as a commercial pilot I know the Captain has the FINAL SAY on all matters onboard an aircraft. He is ultimately responsible for the safety of ALL PASSENGERS, and should not put up with the LEAST bit of disruption. Once in flight, you are stuck with the passenger until landing. If a passenger is unruly on the ground, it is ABSOLUTELY best to eliminate the problem prior to departure. Once airborne, the Captain is busy and does not need to be disrupted by unruly pax.
Lastly, California’s Unruh Civil Rights Act, “makes it illegal to discriminate against individuals based on unconventional dress or sexual preference.” As such, his dress may be protected by California Law.
This will end up in the courts.

It was a homosexual thing that started in prison and became a part of urban culture due to the phenomenon of the assimilation of some homosexual affects into the culture. You end up with a jungle mentality. Color of skin is not material to the subject. I do not want to see a white kids underware strutting along in front of my wife and children, no more than anyone elses. I do not want the cross dressing freak show in front of my children, and same goes for women who fail to cover themselves. Funny how fast this nation has fallen in just fifty plus years. In the 50s, if a vehicle rolled up into the parking lot of your local grocery store with the THUNG! THUNG! THUNG! base noise, accompanied by “I am a bad Mo—- F—-r…” Every man in hearing distance would have pulled the driver out, and thumped him into reality. The liberal God haters knew what they were doing with their rules of policical correctness, that they castrated the average male in America with. The one thing most males fear most now, is being labeled a racist, homophobe, or sexist. I for one do not fear their labels. Trash is trash, regardless of color, sex,….

I don’t think a wing wang was showing, and as much as I enjoy women flaunting whatever it is they bring to the fashion table, I have seen some tops on a lady or three that might offend someone (they definitely didn’t offend me though). Too each there own …as long as its more than pure nudity, a fig leaf, or more than 3 inches of plumbers crack (and that number is arbitrary at best), I think they might spend their time better elsewhere. Perhaps the captain or security personnel forgot to take one of his or her meds. That being said security is a tough job though, it would just be nice to see stories like this and such things as searching babies relegated to history as we become more acutely aware over every little nook and cranny of the world of security. VV Victory and Peace .

I’d just smile and look away because they were working their azzes off supporting a family (most likely) but I loved the comment my hubby made, that, “they might only be plumbers, but they know which way “it” drains(cleaned it up) and they do make good money, and everyone needs them. He was arrested FOR REFUSING TO LEAVE THE PLANE at the command of the pilot. Now, even that was over-reacting. Escorting off the plane is clearly sufficient. Arrest? More crimes where committed BY his arrest than by sagging (or slipped) pants.
WHAT IS WRONG WITH AMERICANS TODAY? HAVE WE ALL BECOME SOUP-NAZIS? (Don’t answer that. I already know.)
