O’Keefe Group at Risk? NH AG Investigating After Undercover Vid Shows Them Posing as Dead Voters to Get Ballots

The New Hampshire attorney general‘s office is investigating after a video surfaced that appears to show people using the names of deceased individuals to obtain ballots on the day of the state’s presidential primary, the New Hampshire Union Leader reported.

The 10-minute video is from activist filmmaker James O‘Keefe’s Project Veritas, and is meant to expose flaws in New Hampshire’s lax voting regulations by showing poll workers readily handing over ballots in the names of dead individuals still on voter rolls. New Hampshire doesn’t require photo ID to vote as long as the person is registered.

In the hidden camera footage, O‘Keefe’s phony voters approach workers at multiple polling places and receive a total of nine ballots using the names of recently deceased individuals. No fraudulent votes appear to have actually been cast, with the person leaving after receiving each ballot.

New Hampshire state law makes it illegal to use a false name to obtain a ballot. It’s also a crime to make an audio recording of someone without their consent or to “record an election official without permission.”

According to the Union Leader, state Associate Attorney General Richard Head said his office became aware of the effort on Election Day and began investigating immediately.

“That investigation is ongoing,” he said. “Based on the information received on Election Day and the information on the video, we are undertaking a comprehensive review of voting procedures with the Secretary of State.”

U.S. Attorney for New Hampshire John Kacavas told the newspaper he hadn’t heard of the video as of Wednesday.

“If it’s true, it’s troubling to me,” he said. “I’m certainly going to look into it.”

But not every ballot attempt appears to have gone smoothly. In one incident, the Boston Herald reported, an individual was stopped from obtaining a ballot because a poll worker recognized the name of the dead man, who had passed away two weeks earlier. The individual left before police could catch him, the newspaper said. That incident is not in the video.

Nashua City Clerk Paul Bergeron is outraged, according to the Nashua Patch, and said he believes the filmmakers should be prosecuted to the fullest extent of the law.

“It’s against the law to steal, so if you go out and steal and then put up a video and say, ‘Look, I stole something,‘ that’s a crime,” he said. “What these people did was a crime. They stole a person’s identity and used it to try to obtain a ballot that would be used in a state election.”

And if the filmmakers crossed state lines to record the video, Bergeron believes they may have committed a federal crime as well.

“They recorded it without election officials’ knowledge, which appears to be a violation of our New Hampshire wiretapping codes, and some of these are out of state residents, so I don’t know if violations of wiretapping or ID theft could hold up in court, but if they crossed state lines to commit these crimes, it may be a federal crime as well,” he said. “This is serious. We won’t tolerate voter fraud, regardless of what the intent might be.”

The Republican mayor of Manchester, Ted Gastas, is also furious, telling the Union Leader, “They should be arrested and prosecuted to the fullest extent of the law.”

UPDATE:

O‘Keefe maintains Project Veritas did not commit any crimes because they didn’t actually vote with the ballots they obtained, he told Boston Fox affiliate WFXT-TV.

In an interview with the station, he also defended the tactic of surreptitiously recording poll workers.

“There’s no expectation of privacy in the areas that we visited, these public areas,” he told WFXT. “In fact, news reporters film polling all the time so I think that’s under the rubric of journalism. So I think what we did is moral, ethical and necessary. We need to expose wrongdoing.”

O’Keefe has also reached out directly to The Blaze. We’ll be following this story as it further develops.

    Acorn committed voter fraud in Indiana in 2008. In my county alone they fraudulently even registered Jimmie Johns restaurant to vote. No one has been prosecuted in any of the cases of voter fraud in Indiana for the 2008 election.

      its Ok I went to the Virginia DMV 11-12-11 the day after my b-day and they want a valid birth cert wit the stamp fealable from the state for notorization. Had a fire 2011 Feb lost most of my records and presented my copy from my military record my dd214 and so on and it wasnt good enough to renew.
      Told the BI I bet if I were mexican or from pakistan i would have no prob the cop didnt like my tude as he said.

      Acorn did not commit voter fraud. Acorn paid people to register voters and their payments were based on the number of voters registered. So what you had was a case of some crooked people handing in false registrations in order to make more money. In most cases Acorn reported and removed the false registrations. In other cases, in some places they were forbidden by law to destroy completed registration forms. So at worst Acorn could have been guilty of registration fraud but until Jimmy John’s, mickey mouse, etc actually votes its not voter fraud. So no one has been prosecuted because there was little if any voter fraud occuring.

      First: I lived in NH most of my life. Back in the late 90′s Nashua NH was voted best place to live in America twice. Within months each time, the place was overwhelmed with people from Mass. looking for jobs and places to live. Since that time NH’s political winds shifted left. If they want to keep NH they have to find whatever loopholes they can.
      Second: Does anyone remember when the big networks used to do this type of investigating. It‘s a very lazy media that doesn’t like it when others do what they don’t want to or are unwilling to do.
      Third: How do you expose the problems in the system if exposing those problems is illegal? O’Keefe should be thanked by the State of NH and NH should reevaluate the way the voting is handled. If “poor minorities” can show ID to buy booze, how is it an inconvenience to show that same ID to vote?

      Here’s the e-mail I just sent to Richard Head and several other agency members, as well as others in the NH executive branch – all their e-mails are available…just google Associate Attorney General Richard Head:

      I suppose I’d want to prosecute someone to cover up my ineptitude, too. Of course, I don’t have the power and resources of a state government to pull it off.

      Before you blow your mouth off to reporters, you might want to consider some things. Does it make sense that people can’t record election officials, or any state officials, without their knowledge in public places? Who is the law trying to protect? Is it the voters?

      If someone asks for and receives a ballot specifically to demonstrate the weakness in your system, yet doesn’t use that ballot to cast a vote, are you prosecuting based on the intent of the law? Or are you simply trying to be vindictive?

      Anything which benefits the left is not only OK, but is encouraged. It may be “Wrong” to obtain ballots in the name of deceased persons but if they don’t use the ballots, no real crime has been committed. The real crime is the issuance of the ballots by officials in the first place.The AG needs to investigate the procedeure of issuing the ballots and close the loopholes in the system, not go after those who are trying to clean it up.

      This is pretty cool. All complain about the the possibility of voter fraud yet no steps can be taken to curtail the possibility of it. When a state passes a law to stregthen the voting laws the DOJ files suit against the state before the ink is even dry on the new law. Heaven forbid that the voter be required to show ID, yet proper ID is requred to accomplish a miriade of other tasks. Double standards and hypocrisy run amuck.

      Acorn didn’t commit voter fraud. They committed voter REGISTRATION fraud. A very different and far less socially impacting offense. You can put Superman and Mickey Mouse on as many registration forms as you want, that doesn‘t mean they’re going to be able to show up to vote.

      Voter fraud is a virtually nonexistent problem in our country. We can’t even get half the people who legally can vote off their asses to do so. I challenge you to show me any credible research suggesting a serious VOTING FRAUD (not registration fraud) issue.

      They are technically right … they did “borrow” some one’s ID … however it is sad that an uneducated underpaid guy like me could walk into the polls and expose voter fraud. think about it these guys busted them with what I think is a cell phone cam!!! We pay our government MILLIONS to police this and keep us free through our votes and they got out done by a cell phone cam!!!!! I think they are pi$$ed that these bone heads lifted their skirt up and exposed their games of voter fraud. I pray that these guys are thanked by the public not prosecuted.

      I watched the revealing filming to expose the potential for double voting in the 2012 Presidential election. In the Alinsky book, Rules for Radicals, he, Alinsky, with a type of connection to Obama and H. Clinton, talks about the rationalization one would have with double voting without a condemnationof that rationalization. Now they are going to challenge the investigative reporting of sloppy voting methods in an era of technology that should easily eliminate those possibilities?

      The U.S. 1st Circuit Court of Appeals struck down this law last year. They said the first amendment protects the People’s right to record their government servants in public venues as they perform their duties

      Why would anyone make it a crime to accurately record an event, no matter who it was?

      The answer, of course, is that politicians and the authorities commit so many crimes constantly they don’t want to be caught in the act.

      Of course, being recorded while doing something illegal is why the police are beating people and taking away their cameras. They know recorded evidence is absolute proof they have committed crimes and they’ll try to oppress the evidence any way they can.

      There‘s no chance this state’s law against recording corrupt politicians and police will be rescinded, because the people who make and enforce the laws are people who write and pass them too.

      Nice try, but YOUR “argumentum” is “absurdum”. Where are your facts?

      1) How do you know that ACORN removed false registrations, and if that’s true, why didn’t they remove the thousands of “Jimmy John’s”, “Mickey Mouses”, etc.?
      2) Where’s your proof that none of them voted?
      3) More importantly, why did ACORN staff testify that they were instructed to look the other way and even encourage the paid workers to falsify registrations?

      Who is paying you to come on these sites to post misleading arguments in an attempt to cover up the truth? Do you really think it’s working? The sad part is that in order to lie you have to know the truth.

      Racist Eric Holder, using the ‘voters section’ of the ‘civil rights’ division of the DOJ, will complete their mission of seeing B.Hussein Obama getting re-elected.
      What you just saw in this video pales in comparison to what you will see happen in the areas heavily populated by Blacks and Hispanics.

      The ‘only’, and I mean ‘only’ hope for Obama getting re-elected is that Americans have waken from the sleep they were in prior to the ‘08 election. Obama must be defeated in a landslide. Anything like a one or two million vote difference in the favor of the Repub candidate will not be good enough.

    @bernbart O’Keefe is on probation for being able to show the illegitimacy of these organizations and the voter laws that are being scofflawed by the outlaw regime.       Here in Oklahoma the schools are going to merit pay! Sounds great but before my wife retired her principal gave out the state test to train the kids for the No Kid Left Behind test. My wife refused them along with a few other teachers that had ethitcs and my wifes class always had higher scores without cheating. This will just be the norm if a teacher wants the extra bucks. I bet the AG in Indiana could do a investigation on something like this and impress the folks better than hiding their faults in the voting system.

    so its against the law to use a fake name to obtain a ballot, but the morons cant figure out that there is NO way to enforce the law without having a valid ID. It shows that the politicians have no problem with the ‘fraud’ but the problem is with the fraud exposed and being used against them. The only way they were causght is because someone happened to recodnise a name. but how many fake ballots were gotten before that or after? in otherwords enforcement was entirely by accident. Ans since they never used it to cast any official vote, the emarrasment is soley on the AG and his cronies who are failures

    I guess Okeefe is going to be investigated for exposing a perfectly good racket that has served that state well. No wonder the Democratic party likes it so much they do it where ever they can get away with it like in Wisconsin and in Illinois. In California they like it to but with much less success my father who passed away in 1975 has apparently found a way to vote several times in California elections , my mother still has the letters from the Los Angeles AG office inquiring about his voting and being dead at the same time. My mother refered that office to the local Democratic party’s office since they have his name on their voter rolls. I guess he was helping out as a letter stuffer also, the person who eventually admitted to the fraud was someone answering to the name Jose Martinez but later they found out that he had a different name and beacuse he had so many names including my fathers he felt it was his duty to vote under each name. The laws have changed since then but it shows you that it‘s still isn’t very good and with a large hispanic population in LA well you can guess that theres a lot creative voting going on there.

    The NH Attorney General SHOULD BE PAYING O’KEEFE and his crew for showing them the holes in their system, and doing it in the moral way by he did by returning each ballot! For NH to discover what O’Keefe gave them for free would cost NH tons of money.

    This is no different than what corporations pay for routinely.

    This just shows how NH government doesn’t really care if there is fraud or not. Sad State of Affairs!

    O’Keefe is a superhero! Talk about taking one for the team. Great work! Democrats are completely insane. They want laws that require photo ID to purchase household cleaners, but they think it’s wrong to have to show photo ID to vote.

    I want to see MUCH harsher penalties for voter fraud. After Harry Reid’s union buddies rigged the voting machines in Nevada in 2010, I realized just how bad the problem is. I think that we should institute the death penalty for intentional voter fraud. Too many great people gave their lives for this country. People trying to destroy America should pay with their lives, too. Anyone caught submitting a forged or fraudlent ballot should be put on death row.

    O’Keefe is already on Probation for his other misdeeds, and should have been prosecuted for his fraudulent ACCORN pimp videos, which caused innocent people to lose their jobs. Both the CA & NH attorney generals viewed the unedited versions of the ACCRON pimp videos and said they were highly edited and presented a false picture of ACCORN and weer fraudulent, but they never prosecuted this moron. The videos lied. Besides The incidence of voter fraud in has never been problem except a few case with republicans.

    A bigger problem is voter turnout.

      Sounds to me like both sides did. So why is the Attorney Generals office picking sides. They should be focused on the obvious corruption within the election process. Not just the ones that exposed it. Which one is the real crime? Lets get our priorities straight.
      Wait until Nov. 2012 and see if we don’t see this kind of thing on a much grander scale while Eric Holder and the rest of the Obama administration refuse to do anything about it. But what should we expect from a party that has to use voter fraud to win elections?

Our government can pass the Patriot Act, NDAA 2012, and numerous other laws that makes most anything they want to do legal, as well as break the law by defrauding taxpayers and not paying their own taxes accurately or on time… But when a group exposes corruption, exposes bias, exposes the compromise of ethics, and the potentials for hazards they are decried as criminals?

      Watch the video. They were very careful with their words. No ID theft. Never lied. Never claimed to be the dead voter. No ballots were actually accepted, even when the poll workers practically begged them to take it.

      I agree. I look at my nearly 4 year old and wonder what our country will look like when he is nearly 40 like me. I hope it’s better than I am able to imagine. It seems that we have lost common sense and that the progressives on both sides of the political spectrum are ruining the country faster than the average American can comprehend. I know that my husband and I have had huge arguments as what is happening in our country. He will tell me you were right when things happen like/similar to what I told him would, yet he continues to argue and think that we’ll be okay in the end. I guess, I have my German grandfather’s voice and words in the back of my head and the similarities to what he described frighten the hell out of me. Maybe I am nuts, but I love my country and fear that we are headed towards a Civil War and a World War possibly simultaneously. I pray not, but it is what I think could really happen.
